Of the 19 responses that were, received per the , advertisements ,- an interview was held with seven of the top applicants . ' Public Works Director Colbert is ' recommending Mr. Bradley,. Swenson- to be approved for the position. Mr. Swenson is a graduate engineer, with .potential for future registration as a land surveyor. His interest lies in municipal government because of its variety of engineering and survey skills xequired. He is a graduate of the 'Dunwood Vocational Technical Institute at -the University. of Minnesota. His past work history entails employment with W. J. Lewis Corporation as -. a -project engineer, and engineer surveyor with C.E. Dogren and Associates Consulting Engineering Firm and has performed: energy ,and,, analysis engineering for 'the Honeywell Company. Therefore, it - is the recommendation -of Public Works Director Colbert that! The City consider approving the hiring of Mr. Brad Swenson to fill the position of Engineering Aide III at the- 1980 approved .rate -for that position. The public hearing was also ordered at this meeting, due to the fact, that a waiver of public hearing petition that was received from the developer. Paweisky PreliminaryReport on Harlan M.Olson p David E.Olson Sewer, Water and Storm Sewer for James Refrigeration Project No. 300 Eagan, Minnesota January 29, 1980 SCOPE: This project covers the construction of sanitary sewer, water and storm sewer laterals serving the proposed James Refrigeration commercial development in Eagan, Minnesota. FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance with the Master Plans for Sanitary Sewer, Water and Storm Sewer for the City of Eagan. For bidding purposes it can best be combined with another project in order to form a larger project. DISCUSSION: The proposed James Refrigeration commercial development consists of approximately 4.5 acres located at the northeast corner of the intersection of Pilot Knob Road and Wildwood Lane. The proposed development is a part of the Hilltop Addition. Phase One will consist of a small business near the north edge of the commercial lot. Sanitary sewer and water service to Phase One would be provided through laterals connecting to laterals in place in Berry Ridge Road. Connections to the existing system will be made to stubs projected beyond the surface of the road to eliminate the need for road repairs. Storm sewer drainage for Phase One will consist of a catch basin located in the parking lot of the small business. This catch basin will drain through a small storm sewer lateral to the ditch of Pilot Knob Road from where it will drain to the pond shown on the Master Plan for Storm Sewer as JP-36. Page 1. It is proposed to install the storm sewer for the balance of the commercial development at this time in order to avoid erosion problems. This storm sewer lateral will drain easterly into the pond shown on the Master Plan for Storm Sewer as Pond LP63 which outlets to Carlson Lake. Sanitary sewer, water and storm sewer laterals will be constructed on ease- ments within the Hilltop Estates plat. These easements must be obtained prior to any construction taking place. Tax Exempt Mortgage Program/Selection of, Lendors -- At the last regular City Council meeting held on February" 5,- 1980, consi- deration was given to the selection of lending institutions for implementation of the tax exempt mortgage program. The 'City was notified at the meeting that Minnesota Federal , a local savings and loan institution was not. going to participate in the program. Special Legal Counsel for the tax exempt mortgage I program, Mr. Jim Holmes , advised the City Council `through a letter that' designa tion of two (2) lending institutions within the City without due consideration given to other " lending -institutions - in the Metropoli- tanarea that might be doing business in the City of ' Eagan could be in violation of theanti-trust laws. The Finance Committee reviewed this matter and it was the decision of ; the City Council that any decision regarding the selection of lendors be continued until the February 19, 1980 meeting. The City Administrator and Fiscal Consultants Municipals, Inc. ," were authorized and; directed to send a letter of; inquiry to .all financial institutions in the Metropolitan area to determine whether there are additional finan- cial institions that have an interest in serving as a lending insti- tution for the program. The Finance Committee is planning to meet on Tuesday, February 19, 1980, to review the list of lending insti- tutions that have expressed interest. It is hopeful that a recom- mendation can be' made to the City Council for consideration. The Finance Committee has recommended Mid-America National Bank and Minnehaha National Bank which is a party of the First ' Bank' System. Those two financial institutions arelocated in the City of Eagan and have originated mortgage; loans serving Eagan residents. Lincoln Senior Financial Consultant Re: Eagan, Minnesota Single Family Mortgage Revenue Bond Program The City of Eagan, Minnesota (the "City") has been authorized pursuant to Minnesota Statutes, Chapter 462C, to develop and administer programs of making or purchasing mortgage loans to finance the acquisition of single-family housing -- located -anywhere within its boundaries. To finance such a program, the City intends to issue, and has retained Miller & Schroeder Municipals, Inc. to underwrite an issue of, its residential mortgage revenue bonds in the aggregate principal amount of $20,460,000. The City had, prior to April 25, 1979, taken specific action to issue obligations of a similar nature, and, therefore, may proceed to issue tax- exempt obligations in accordance with .the transitional rules provided under H.R. 3712 currently pending before Congress. The City anticipates issuing its bonds on or about March 15, 1980. Under the City's program, approximately $16,936,750 would be made available for the acquisition of mortgage loans. The mortgage loans to be acquired under the program would include FHA, VA and conventional mortgage loans, each with a term not exceeding 30 years (to the extent that a conventional loan has a loan-to- value ratio exceeding 80%, private mortgage insurance is required; ten percent of conventional loans may have loan-to-value ratios of 95%, the balance must be loans IS with loan-to-value ratios of at least 90%). While the final interest rate on the mortgage loans cannot be determined until the City's tax-exempt revenue bonds have been sold,- it is presently anticipated that the rate will be, approximately 9 3/4%. The program is to be made available to persons acquiring new or existing single-family houses located within the City, including single-family townhouses, single-family units under condominium ownership and mobile home units (if attached to permanent foundations and if such mobile home units are FHA insured for the full value thereof; no more than 10% of the loan proceeds may be used to finance the. acquisition of mobile home units). The loans may be made only to persons or families whose 'income does not exceed certain limitations, all of which is set forth in more detail in the enclosed summary. Loans sold under the program shall be originated on a best efforts, first-come, first-served basis by a group of lending institutions to be selected by the City (the "Originators"). The City intends to execute a contract with Banco Mortgage Company, Inc. to serve as Program Administrator forthe purpose of monitoring the origination of the mortgage loans by each of the Originators and for the purpose of servicing the mortgage loans. Prior to making a mortgage loan, an Originator must submit to the Program Administrator all credit information pertaining to the purchaser, the purchaser's loan _application form, an appraiser's report on the residence to be financed, a computation of the purchaser's income and a verification of the purchaser's employment. The Program Administrator shall review all such documents. and notify a trustee (to whom the City has assigned its interest in the program and who will be responsible for paying principal and interest on bonds and for investing bond proceeds) whether the trustee may purchase such mortgage loan. After the, Originator makes the mortgage loan, and after the mortgage loan has been purchased by the trustee, all documents comprising the customary mortgage l file for each mortgage loan shall be delivered to the Program Administrator. The Program Administrator shall review each mortgage file to determine if it is complete and if it conforms to the provisions under which the Originators*are to originate mortgage loans. If the Program Administrator discovers any defects in such documents, it shall notify the particular Originators and the trustee for the bonds of the defect, after which time the Originators shall, within 90 days, either cure the defect or purchase back the entire loan from the trustee of the bonds. The Program Administrator shall, on behalf of the City, service and administer all of the mortgage loans sold into the program by the Originators for the balance of the term of each mortgage loan. As compensation for servicing the mortgage loans, the Program Administrator shall be entitled to retain from each mortgage loan payment the amount of its service fee attributable thereto. The sole compensation to Originators shall be the Loan Origination Fees described in the attached summary. Should your institution be interested in participating as an Originator in the City of Eagan's program as outlined above, we ask that you furnish us with the following information: 1. Evidence that your institution is an "approved lender" by the Federal Housing Administration, the Veterans Administration, the Federal National Mortgage Association or the Federal Home Loan Mortgage Corporation; 2. Information for each of the last three years as to the number and principal amount of :mortgage loans for owner-occupied housing your institution has originated within the City of Eagan; 3. Statement of your institution's willingness to participate if the program were done on a "forward commitment" basis (you would be contractually obligated to originate a specific dollar amount of mortgages), rather than on a "first-come, first-served" basis.. You should understand that a forward commitment program would likely involve the deposit of a commitment fee of approximately one percent of the amount of the commitment, which would be refunded only as mortgages are closed and delivered; 4. I-35E Status Update -- The Minnesota `Supreme Court ruled during the month of January to uphold the hearing examiner' s . findings that a permit not be .granted to the Minnesota Department of Trans- portation by DNR to construct ; a bridge , across Blackhawk Lake . for the routing of `I-35E. Therefore, unless an appeal is made to the United States Supreme Court, or the Minnesota Supreme tourt has been petiioned _for ,a rehearing, the route for I-35E will be around the east side of Blackhawk Lake. To date, the City has not been notified of any formal action to appeal the recent decision of the Supreme Court; therefore, it is assumed that the .'Minnesota Department of Transportation and the City of Eagan will address one of the modifications to the A-2 alignment for purposes of de- signing the I-35E alignment around Blackhawk . Lake. The Mayor and City Administrator. plan to attend the I-35E update session to be held at the McKee Building at 2 :00 on Tuesday, February 19. Mr. DuBois has observed the operation for that period time, having purchased his, residence prior to Mr. Harp becoming his neighbor. . Mr. DuBois has stated that ,as the business .has grown so have the noise problems and the amo nt of truck traffic and other matters that are associated with a no mal business opera- tion. Mr. DuBois and residents within thatneighborhood are bringing, the petition, a copy is found on pages _10 through for your reference, before the City Council requesting that A business be relocated to a commercial property, allowing; the appearance and- noise levels of the neighborhood to return 'to a normal residential position. On the surface, this matter seems to be very, similar to the Wids:trom case where the City received a petition from the surrounding neighbors requesting that their business be relocated and in that particularexample the Widstroms were asked to comply by, means of applying for' a conditional use permit which was later denied by the .City Council . The Widstroms appealed this matter to the District -Court and the District Court upheld the City Council, issuing a Court Order that the business be terminated at its present location which causes the .Widstroms torelocatetheir business to a. proper zoning classification or discontinue their business ' altogether. Mr. . DuBois was informed that the City Council would consider the petition and possibly offer some advice Ias to how to proceed withthe ,problem, however; not to expect any decision at the meeting, realizing there are some steps that they as property owners or the City must follow once a complaint is initiated. In the past the Lexington Addition was platted into 18 lots in which Mr. Roeglin could of constructed apartment buildings. At the present time Mr. Roeglin is proposing to replat a portion of the Lexington Addition for a quadriminium development, keeping the new plat in continuety with the or- iginal plat which was proposed. 2. The proposed quadriminium project would be consistant with the proposed land use within the comprehensive plan. The plan indicates an R III land use which is a mixed residential from 6-12 units per acre. The proposed neigh- borhood would contain the land east of the proposed alignment of Interstate 35 East; South of the - Bulk. Mail Center West of Lexington Avenue and North of Yankee Doodle Road. 3. The proposed plat would follow basically the same .street design of the or- iginal plat. So if additional development does not occur the City will have a dedicated street within this development. The staff has suggested that the main street witin the project have an 80 foot right-of-way according to the trip generations which have been calculated for this neighborhood. The developer has agreed to dedicate and construct this collector street through the pro- ject, but has requested that he be allowed to only have a 30 foot setback 3S RICHARD GLIN JANUARY 14, 19$0 PAGE TWO instead of the normally required 40 foot setback. A variance would not be required for this 30 foot set back because the collector street is not .designated on the thourough fare plan. The proposed road will be public street. The developer is also providing a Tot-Lot to take .care of the needs of the pre-schoolers within the proposed development. 5. The Park Committee has not formally reviewed this plat, but they have ` reviewed the park plan protion of the comprehensive plan. The plan indicates a 10-15 acre park located South of this proposed development. Therefore staff is recommending that 'a cash donation satisfy the park requirement. If approved the plat should be subject to the following conditions: 1. The proposed development shall have a Homeowners Association- and the bylaws of the Homeowners Association shall be submitted and reviewed by staff prior to final plat approval. 2. A tot-lot should be provided by the developer to provide for the needs of the pre-school children. 3. A sidewalk shall be provided on one side of the proposed collector street. 4. The proposed plat shall be reviewed by the Dakota County Plat Commission and subject to the plan commissions comments. 5. Colbert - Director of Public Works DATE: January 17, 1980 ` RE: Preliminary Plat - LEXINGTON SECOND ADDITION (RICHARD ROEGLIN) The Engineering Division of the Public Works Department has the following comments to offer in regards to the review of the above referenced prelimi- nary plat: UTILITIES: Sanitary sewer and water main of sufficient size, capacity and depth to service this proposed addition, is available within Lexington Avenue, immediately adjacent to the East property line of this proposed plat, STREETS: Access to this proposed plat will be handled by the existing approved Lexington Avenue immediately adjacent to the East boundary of this plat. Internal streets serving this plat will provide for an 80 foot right-of-way for the east west minor collector street and a 60 foot right- of-way for the internal loop street on the north side. The street names as submitted on the revised plan dated December 31, 1979, will have to be revised to be consistent with the City street naming policy. Sidewalk is intended to be constructed along the south side of the east west collector street. This installation should be the responsibility of this developer. GRADING AND DRAINAGE:- A grading and drainage plan has been submitted which shows the majority of the drainage from this proposed addition will be dir- ected into an internal storm sewer-system which will empty into a small on-site pond located immediately south of this proposed addition. An out- let from this pond will have to be constructed to the existing storm sewer in Lexington Avenue, which will carry the water north into our master storm sewer plan. There is no anticipated adverse on our storm sewer because of this development. The grading plan will have to be revised to provide for a minimum normal water elevation of 883.5 with a high water elevation of 8885.5 for this small on-site pond, immediately to the south. We will re- quire that the minimum floor elevation of any structure will be set at 887.5 to provide for the necessary freeboard, for any potential flooding. EASMENTS AND RIGHTS-OF-WAY: Sufficient right-of-way has already been dedicated for Lexington Avenue, which has been improved to its final design section. An 80 foot right-of-way must be dedicated for the minor collector east west street, with all other public streets requiring a 60 foot right-of- way. Colbert - Director of Public Works DATE: January 17, 1980 RE: Preliminary Plat - CEDARVIEW ADDITION (WILLIAM BRANDT) The Engineering Division of the Public Works Department has the following comments to offer, in the review of the above referenced preliminary plat: UTILITIES: As was indicated in a previous report dated August 23, 1979, sanitary sewer and water main of sufficient size, capacity and depth are available, immediately adjacent to the East line of this proposed plat. STREETS: As was mentioned in previous reports, driveway access permit R-11 be required for this proposed connection onto Cedar Avenue,from the Dakota County Highway Department. This must be obtained before final plat application is received. EASEMENTS AND RIGHTS-OF-WAY: Sufficient easements and right-of-way have been dedicated for Cedar Avenue under the old Durnings Addition plat. Sufficient right-of-way has been dedicated for the new Cedar Avenue Freeway to the west of this proposed plat also. GRADING AND DRAINAGE: A grading and drainage plan,has been submitted and review of this indicates that additional revisions will have to be performed. Drainage is proposed to be handled by an internal storm sewer catch basin located in the center of the parking lot. Should this catch basin not function properly, the entire parking lot would flood, providing inaccessibility to any building for emergency vehicles. The future parking area is shown to have surface drainage directly to the west, this future drainage should be handled by an internal storm sewer system constructed with this phase conveying site drainage, through the existing storm sewer located in Cedar Avenue. This revised grading and drainage plan must be submitted and approved before final plat application is received. SITE PLAN: Site plan submitted with this proposed plat is acceptable to the Engineering Division as it pertains to emergency vehicle access and traffic flow patterns. RUNKLE, CITY PLANNER Application Submitted: The first',application submitted, is a request to amend the planned development to include an additional 18 apartment units, and eliminate the-detached garage units. The second application submitted, is to amend the preliminary plat, to add one additional lot. This lot would be lot 2, block 1, Duckwood Trails. The third application submitted, is for detailed site plan approval for the first phase of the Duckwood Trail Planned Development. Comments: 1. In January of 1979, the Eagan Planning Commission and City Council approved the Duckwood Trails Planned Development. The total area of the proposed site consists of approximately 33•3 acres and would contain 292 dwelling units, which is a mixture of apartment units, condominium.units, and townhouses. The first phase of the Duckwood Trails Planned Development, is the construction of the apartment complex which is located in the Southeast corner of the proposed pro- ject. The apartment project originally consisted of 162 dwelling units. This proposal also consisted of outside detached garages for the apartment complex. When the developer reviewed the detailed development plans for the apartment complex, he decided to eliminate the detached outside garage, and provide 162 underground parking spaces. According to the zoning ordinance there is special density credit given to apartment complex►:s, which provide for underground parking. The- density credits for this project, would convert to approximately 17.4 additional dwelling units to the project. Instead of adding these 17.x. units to the existing apartment complex, the developer is requestin to construct a three story, 18 unit apartment complex, next to the original 196'unit apart- ment complex. In order to add the 18 additional units, the deve er would . 61 �� BAR-ETT CONSTRUCITON COANY , JANUARY 16, 1980 PAGE TWO have to appear before the Advisory Planning Commission and City Council for the planned development amendment. Besides amending the planned development agreement, the developer is requesting to add the one additional building, which would also require amending the pre- liminary plat to include one additional lot, this lot is lot 2, block 1 of the revised preliminary plat. - Site-Plan Review: 1. The proposed apartment complex would be between three to four stories above ground, depending which elevation you would look at. 2. The proposed parking stalls have a dimension of 10 by 19. The parking stall requirement is 10 by 20. 3. Ordinance 52, requires at lease 12 parking spaces and garage space, per multiple dwelling unit. The proposed site-plan indicates one under ground garage space per unit, and one outside parking space per unit. According to the ordinance the proposed development is 90 parking spaces short of the parking requirement. In the past the City has required that apartment complex's only provide two parking spaces per unit, with the plan indicating where the addi- tional 2 space per unit could be constructed if the additional spaces is needed. The only exception to this is the Silver Bell Condominium project, which the City Council required them to install the two 2 spaces per unit. The proposed plan meets all set back requirements, according to ordinance 52, except the 20 foot green area between parking lot and the proposed street for the 18 unit apartment complex. If approved the plat should be subject to all of the conditions in the report from John Voss, dated February 21, 1979. Engineering Recommendations: 1. Duckwood Trail connecting Lexington Avenue to Duckwood Drive should be installed in its entirety as a part of the first phase development. 2. Standard drainage and utility easements should be dedicated adjacent to all property lines. 3. An access permit should be obtained from Dakota County Highway Department prior to application for final plat. 4. The developer escrow an amount sufficient to cover the installation of An g foot bituminous bikeway trail along the west right-of-way along Lexington Avenue. 5. Sufficient easements shall be dedicated to provide for the internal utility system and drainage pond as determined by City Staff prior to final plat application. 6 � MEMO TO: Advisory Planning Commission c/o Dale Runkle - City Planner FROM: Thomas A. Colbert - Director of Public Works DATE: January 17, 1980 RE: Preliminary Plat DUCKWOOD TRAIL (BAR-ETT CONSTRUCTION CO. ) The Engineering Division of the Public Works Department has the following information to submit in regards to the above referenced plat: UTILITIES: Sanitary sewer and water main of sufficient size, capacity and depth are available and adjacent to the east and south property lines of this proposed plat. STREETS: Access to this proposed plat is made available by way of Duckwood Drive, which has been approved to its ultimate design section. Lexington Avenue (County Road 43) is presently improved, but not to its ultimate design section, it is available to handle this proposed develop= ment. An internal street, Duckwood Trail, is proposed to provide the internal access required for this density development. This is proposed to be dedicated as public right-of-way and installed to a 36 foot standard street construction. The developer is proposing to construct Duckwood Trail in two stages. The first stage consists of a 700 foot cul-de-sac with access directly onto Lexington Avenue. It is recommended that this stage construction of Duckwood Trail be eliminated and the entire street connecting Lexington Avenue with Duckwood Drive be constructed as a part of this first phase development of this plat. GRADING AND DRAINAGE: The drainage for this proposed plat is intended to be handled by a series of internal storm sewer systems, which will direct all drainage into an internal sedimentation pond in the southwest corner of this proposed plat. This pond will then be connected by way of a storm sewer into O'Leary Lake. This sedimentation pond will provide for filtering, cleansing, and temporary storage of the storm water surface run off generated by this development. This drainage is in compliance with the overall master storm sewer plan and no adverse impact is anticipated because of this development. All storm sewer construction will be the responsibility of this development and no trunk storm sewer construction is required at this time. EASEMENTS AND RIGHT-OF-WAYS: Sufficient right-of-way has been dedicated for Lexington Avenue and Duckwood Drive under previous plats. Proper easements will be required along all property lines and through common areas for utility purposes. This will be determined by Staff at a later date, upon completion of the final design. SITE PLAN: The proposed lay out of this site plan provides for proper emergency vehicle access and traffic circulation patterns. PLANNER'S COMMENTS 1 . Density Calculations: The net usable acreage of this site, .after deducations for public street rlrg t-of-way and ponding, is 24.06 acres. The development meets the density requirements on an overall basis as contained in Section 52.07, Subdivision 5 of. the City's Zoning Ordinance. The proposed condominium lot by itself, could not meet the density requirements, however, under a Planned Development,, density calculations generally are based upon the usable land area for the entire project and on an overall basis, the City's minimum required densities for Multiple R-4 zoning are met. 2. The area appears to be generally well-designed. The public street - Duckwood Curve - will provide, public access to all of the properties. The plan also respects the ex- isting lakes and ponding areas in the area and also orients the higher densities toward Lexington Avenue and Duckwood Drive which is designed as a residential collector street. This plan is being presented as a prelimin plan of the planned development As such, all of the required information has been submitted except a staging pla.n. Prior to February 21, 1979 final approval by the City, a Planned Development Agreement will have to be executed between the petitioner, property owner and the City. Also, prior to the issuance of any building permits, detailed plans of each individual site, including'grading, utility and landscape plans, will have to be reviewed by the Planning Commission and approved ty the City Council . These individual construction plans are expected to be submitted in stages as construction ensues over the next several years. . 3. Rezoning: If the rezoning is approved by the City, it should be only completed after a staging plan has been submitted and a Planned Development Agreement has been executed. -4. Preliminary Plat: If the preliminary plat is approved, it should be subject to the foofiTowing conditions: A. The minimum 30' wide trail easement shall be dedicated to the City along the north boundary of Block 1 . Water main is provided by that 24 inch trunk water main on the north side of Duckwood Drive and the .18 inch trunk water main on the west side of Lexington Avenue. The water main will be looped through this plat with connections to both Duckwood Drive and Lexington Avenue It will also be stubbed to the north property line in the northwest corner of this proposed plat for future connections upon development. DRAINAGE Drainage for the proposed plat is intended to be handled by a interior storm sewer. system with catch basins located at a mirurm 600 to 700 foot intervals. The majority of the remaining surface drainage is intended to be directed to existing low lying wet lands in the southwest corner of this proposed plat. Autorize final payment and accept Project #195A -- Public Works Director Colbert has received confirmation from the Consulting Engineering firm that Improvement #195A has been satisfactorily completed and is ready .for final, acceptance by the City. The final Plan check costs amounted to $573.50 under the original contract amount. Therefore, it is in 'order for the City Council to consider:: Approval of the final pay request for' Protect #195A in the amount of $9,639.18 to Fisher Construction Company and accept perpetual: maintenance of this road. These drainage easement's have been incorporated into the. platting of the Brittany Addition.'
