Plans and Specifications The provided plans and specifications or the plans available at the site were used for our inspections. AA/EOE Hy -Vee, Inc. Project B1509819 May 31, 2016 Page 2 Summary of Special Inspections and Material Observations and Tests Soil Evaluation and Testing We issued a Geotechnical Evaluation Report on June 25, 2015 (Braun Intertec Project B1501149) for the overall Central Park Commons Development. The borings within the Hy -Vee building pad had 2 Y2 to 14 feet of previously placed fill soils overlying suitable native soils. The Hy -Vee building pad required cuts of 5 to 15 feet to reach the proposed subgrade elevations. Where previously placed fill remained in place after reaching subgrade elevations, we recommended removing the fill and placing compacted backfill. During the mass grading for the project, we performed observations and compaction testing on the fill soils. Soils exposed at structure subgrade elevations and in excavations were visually evaluated, while those below subgrade elevations and excavation bottoms were evaluated using hand auger borings, dynamic cone penetrometers and/or static cone penetrometers. These tasks were performed to determine if the observed and tested soils were consistent with those encountered by the geotechnical borings performed for the project, and suitable for support of the design structural Toads. The hand auger borings were drilled with a 1 1/2 -inch -diameter hand auger. The borings were advanced in 2- to 4 -inch increments to depths of 2 to 4 feet below subgrade elevations or excavation bottoms (shallower penetrations typically occurred where larger gravel, cobbles and boulders were present). The auger was then withdrawn from the borehole to obtain cuttings. The soils encountered in the borings were classified in general accordance with ASTM D 2488, "Description and Identification of Soils (Visual/Manual Procedures)." Preliminary estimates of soil consistency and density were also evaluated based on resistance to penetration of the hand auger, and the turning resistance. The dynamic cone penetrometer (DCP) tests were completed using a solid metal rod fitted with a 1 3/8 -inch diameter conical point. The number of blows required to drive the point each 6 -inch increment was recorded and then used to correlate the soils' relative density, consistency or compaction with that determined or estimated from the geotechnical borings, and also used as a basis to estimate the suitability of the soils to support the design loads. This test procedure was generally used when granular soils were exposed at subgrade elevations or in excavation bottoms. Concrete Reinforcement We initially reviewed the reinforcement and dowel requirements on the project structural drawings and shop drawings, if available. Information reviewed included bar size, bar length, bar spacing, bar location, splice lengths and dowel placement. This information was then used to determine if the inplace reinforcement was placed in accordance with the requirements of the project plans and specifications. We also noted if the inplace reinforcement was free of rust, scale and soil. Concrete Placement Observations Concrete placement observations were performed to monitor the procedures being used by the contractor and to determine if they were consistent with typical industry standards. Project B1509819 May 31, 2016 Page 3 Fresh Concrete Testing Routine tests to determine the plastic concrete's slump, temperature and air content were done during each pour. In addition, concrete cylinders were cast at rates specified in the project specifications to evaluate the concrete's compressive strength. Concrete Compressive Strength Testing The cast concrete cylinders were temporarily stored at the site and then returned to our laboratory for moist curing and testing. The results of the concrete compressive strength testing were forwarded to the interested parties under a separate cover as they became available. Visual Examination of the Field -Made Welds Visual examination of the field welds was conducted in accordance with American Welding Society (AWS) D1.1-2010, Figure 5.4 and Table 6.1 requirements and the requirements of the project plans and specifications. Tension -Control Bolted Connection Observations Tension -control bolted connection observations were conducted to determine if the bolt holes were filled, if the correct bolts were used, if the nuts were fully engaged and if the splined end of the tension - control bolts had separated from the body of the bolt. Removal of the splined end is a direct indicator the bolt has been torqued to the minimum snap -off load. At connections where the splined ends were AA/EOE Hy -Vee, Inc. In addition, each connection was observed for fit -up and to determine if the various plies were in contact with one another. Metal Deck Weld and Fastener Observations Metal deck weld observations were conducted in general accordance with AWS D1.3-2008, Section 6.0 requirements and the requirements of the project plans and specifications. Items reviewed included the quality, size and spacing of the welds. In addition, the location and the completeness of the side -lap fastener installation were observed and evaluated. Metal Deck Mechanical Fasteners Observations of the metal deck mechanical fasteners were completed to document the screw fasteners were installed as required in the construction documents and in accordance with the requirements of the manufacturer. Items noted were the placement and the depth of penetration. Shear Studs In areas where shear studs were placed over the supporting structural steel members, the size, spacing and soundness of the stud welds were documented. Soundness was determined by impacting each stud with an 8 -pound maul. Sound studs "ring" if they are fully attached to the steel member. Finally, selected sound studs were bent in accordance with the project requirements to further evaluate their soundness. Column Anchor Bolt Observations The column anchor bolts were observed to determine if they were in place, and if the nuts were installed, fully engaged and snug tight. The base plates were observed to determine if they were in full contact with the adjoining surface. If required by the construction documents, we also observed if the plate washers were installed. It is our goal that this review will help you in complying with the applicable codes and we are, therefore, requesting that the following items be addressed. The submitted plans have been hung in our plan review room, and a memo has been sent to all of the applicable City of Eagan departments. Each department will review the plans for compliance, and the memos will be returned to me. This review letter is specific to Building Code compliance. Please provide the following required submittal documents/information so that we may complete our review: 1. We normally require (2) full sets of Civil and Landscaping sheets. In this case however, since we already have subdivision plans, we will only require them if there are any changes to the finalized plans. This requirement is acknowledged. All site drawings related to the Hy -Vee contract are included in the original plan set. All other site development is under the contract of the subdivision developer's permit. 2. The total cost of construction. The construction valuation is $9,998,400 3. The Emergency Response Site Plan needs to be submitted in accordance with the specifications listed in our website. A SAC determination from the Met Council. The SAC determination has been applied for from the Met Council and their response to Hy -Vee Construction on this valuation is due back this week. When this valuation and approval is obtained, the proof of finalization will be provided to the City by Hy -Vee Construction. Address the following building Code plan review comments: 1. Breakdown the percentages of all of the accessory occupancies within the M occupancy (A2, A3, B, and S occupancies). It appears that the aggregate area of these accessory occupancies exceeds 10% of the total area. The area increases do not apply to the accessory occupancies. 2 • As discussed at our preliminary meeting on June 8, the G0.0 code plan breaks down areas of the building by business, assembly, storage occupancies as a basis for calculating the occupant load for the building, based upon the classifications of Table 1004.1.2 in the 2015 Minnesota Building Code. However, this division of occupant load areas is not the same as a division of accessory occupancies. The entire building is classified as a Type 'M' occupancy, with the exception of the accessory use A-2 occupancies of the Market Grille restaurant and the Casual dining area (highlighted on the attached G0.0 Code plan). The total area of the accessory type A-2 occupancies is 4,835 SF (3,620 at the Market Grille and 1,215 sf at the Casual Dining). With a total building area of 98,200 SF, the accessory occupancies are only 4.9%, which is below the 10% allowable area to be considered accessory occupancy. 2. The means of egress through the outdoor seating area adjacent to the Market Grille, shall be a continuous and unobstructed path of travel to the public way. The patio detail on sheet C1.2 shows tables within the required means of egress. Per the attached revised patio plan on C1.2, the seating has been modified to provide the required unobstructed path of travel. 3. Posting of the design occupant load in all assembly occupancies is required, and shall meet the requirements of Section 1004.3 of the 2015 Minnesota Building Code (MBC). This requirement is acknowledged and the appropriate signage will be provided prior to final building inspection. 4. Per your door hardware schedule (Section 08 7100 A), there are several hardware groups that state "Door requires thumb turn deadbolt and emergency egress capabilities." Per Section 1008.1.9.3, item #2 of the 2015 MBC and Section 309.4 of the Minnesota Accessibility Code (MAC), thumb turn deadbolts are not permitted. This requirement is acknowledged. The exterior door hardware groups in question are automatic sliding door systems with keyed cylinder locks that do not require thumb turn deadbolts. This terminology has been deleted from the hardware specifications. 5. Manual operated flushbolts or surface bolts are not permitted, except under certain conditions. Reference Section 1008.1.9.4 of the 2015 MBC, and verify that the hardware groups using flushbolts meet one of the exceptions. The only door hardware sets in the specification that include flush bolts are hardware sets 13A and 13B, which are designed for double doors leading into mechanical rooms, which is acceptable under exception 2 of section 1008.1.9.4. All of the following referenced Code sections are from the 2015 Minnesota Accessibility Code (MAC): 6. The fitting rooms adjacent to the Wine and Spirits store shall meet the requirements of Sections 803 and 903 (provide elevation and plan view details). The fitting rooms in the apparel department have been updated to incorporate the accessibility requirements for turn -around and bench seating listed in section 803 and 903. See the attached revised A3.10 for reference. 7. Direct us to or provide an elevation/cut detail for the Market Grille salad bar. We have made some minor plan revisions to the Hy -Vee Market Grille seating layout and in this revision the salad bar in question has been removed. See the attached A3.9 for this revised seating layout, 8. The common use sink/counter within the employee lounge shall be accessible, complying with Section 606. Per the requirement of Section 606.2, exception 1, the clear space required for parallel approach with the height meeting the 34" requirement is provided. See the attached revised A3.8A for reference. 9. The Clinic's concierge counter shall comply with Section 904. Per the attached revised A3.7A, the Hy -Vee Healthy You Concierge desk has been modified to provide the required accessible service counter, which is 36" wide with a working surface at 36" AFF. Per the attached re -revised A3.7A, the dimensions of the accessible portion of the counter are added to the elevation. 4 10. The restroom paper towel dispensers shall not overlap the water closet clear floor spaces (vertical clearance extends to 80" AFF). Reference Sections 604.3.3. and 307.4. This requirement is acknowledged. All paper towel dispensers will be relocated to provide adequate clearances around the water closets. Hy -Vee uses two styles of paper towel dispensers. In multi-user restrooms, we use larger roll -style units (see attached KCC model), but these units are placed in a manner that do not conflict with accessibility clearances. For single -user restrooms at front of store and in the office areas that require a smaller model due to clearance issues, we can use smaller folded -towel style dispensers (See attached Slimfold model) that meet the requirements of 4" maximum projection, and thus are not in conflict with accessibility clearances regardless of where they are placed. 3 11. Diaper changing tables shall not be located within the accessible toilet compartments. Reference Section 603.5. This requirement is acknowledged. Per the attached revised A3.8, the affected baby changing stations in the Market Grille Men's restroom has been omitted. 4 12. Ambulatory accessible toilet compartments shall comply with Section 604.10. Section 604.10.3 deals with door swings and clearances. Per the attached revised A3.8, the door swings in the three ambulatory stalls (Market Grille women's, and primary store Men's and Women's) have been modified to meet the requirements of 604.10.3, under which the partition doors must swing outward and provide 42" of clearance. In follow-up, I have eliminated the changing station in the women's Market Grille restroom to avoid conflict with the required 42" clearance in front of the ambulatory stall. See the attached revised A3.8. 13. Where coat hooks are provided, an accessible height coat hook shall be provided to accommodate a forward or side reach range complying with Section 308. Reference Sections 604.8 and 805.5. This requirement is acknowledged. 14. Toe clearances shall be provided for all accessible toilet compartments. The requirements are referenced in Section 604.9.5.1. Per the exceptions under section 604.9.5.1, toilet stalls that are deeper than 62" and wider than 66" do not require toe clearances under the partitions. The accessible stalls in the primary front -of -store restrooms that utilize full height built partitions have been adjusted to provide the required minimum clearance dimensions. See the attached revised A3.8 for reference. For clarity of the sizes of the restrooms stalls that have full height built partition walls, attached for your reference is the current A1.0, which provides dimensions of each stall area. These highlighted dimensions show compliance with the required stall sizes to eliminate the requirement for toe clearance. All other multi-user restrooms with stalls utilize standard toilet partitions that provide the required toe clearance under the partition. 15. Trash containers shall not overlap the toilet room clear floor spaces. This requirement is acknowledged and trash receptacles will be placed as needed to avoid overlap with accessibility clearances. 16. Plumbing, HVAC, electrical, and fire suppression plans are required to be submitted with their respective permit applications, if those applications have not been submitted prior to issuance of this building permit. Overview and concerns • Ensure that rough aggregates are not broadcast underneath foodservice equipment. • Provide the same flooring in all areas of food service/production and all walk in coolers and walk in freezers. Required floor finish must be a Tennant cementitious urethane and applied in a 3 part system, it must be capable of being troweled up the wall to create an integral minimum 4 inch covebase of the same thickness. Apply flooring thickness to 1/4inch in all areas. • All exhaust hoods are manufactured by Captive Aire, a certified NSF fabricator, and located as required by code. A Type I hood over appliances producing grease and smoke, and Type II hood over appliances producing heat and steam. This equipment will be used by store employees for making fresh juices in the approved produce prep area, with adequate handwashing, labeling and selling them from a refrigerated merchandiser on the sales floor. • Fresh made juice that is not pasteurized is considered a potentially hazardous food and must be stored under mechanical refrigeration. Refrigerated corner units meeting NSF #7 were added to the Custom Cut Produce kiosk for holding these juices. Provide floor drains under these units for draining ice used for decor purposes. • Two corner Cold wells by Hill Phoenix (model CWC -3R) meeting NSF #7 for the storage of potentially hazardous foods will be provided for storing unpasteurized fresh juices. STARBUCK'S KIOSK • If a blender rinser will be installed in the dumpsink, you are required to comply with the backflow requirements established by the MN Department of Labor and Industry -Plumbing Section listed below. Starbucks have installed blender rinsers in the one compartment work (dump) sink. If the plans include the use of a blender rinser in the single compartment sink: Review and follow the statements from the MN Department of Labor and Industry -Plumbing Section in regards to this installation: 1. This type of installation requires a pressure vacuum breaker (ASSE 1020) to be installed at least 12 inches above the spill line and in a location that does not allow back pressure. 2. A reduced pressure zone backflow preventer (ASSE1013) would also comply. 3. The hose and fitting should also be a code compliant material or NSF rated for potable water. 4. Additionally the dump sink where it is installed must have a direct connect to the sanitary sewer. Indirect connections would not acceptable. It is strongly recommended that the plumber discuss the rinser installation with the plumbing plan reviewer ensuring that the installation is properly completed. (4626.0705)(4-302.12) The internal temperature of potentially hazardous food must be maintained at 41 °F or below, or 140°F or above, except during preparation. *(4626.0395) (3-501.16) All freezer units shall hold food frozen. (4626.0370)(3- 501.11) Food on display must be protected from potential contamination from coughs, sneezes and improper handling by installing properly constructed food shields, the use of packaged food items or other effective means of protection. Provide an area for storage of employee's personal belongings that is separate from food, clean equipment, and single service supplies. (4626.1560) Provide an approved area for storage of chemicals, which is separate from food, food equipment, and single service articles. (4626.1600) Room Finishes The floors, floor coverings, walls, wall coverings, and ceiling surfaces shall be designed, constructed, and installed so they are: a) smooth, durable and easily cleanable where food operations are conducted; b) nonabsorbent, for food preparation areas, walk-in refrigerators, ware washing areas, toilet rooms, janitorial areas, laundry areas, interior garbage, refuse storage rooms, and areas subject to flushing or spray -cleaning methods, or other areas subject to moisture. (4626.1325) Polymer flooring systems: If polymer flooring such as an epoxy or urethane systems are installed they must be 1/8 inch minimum in thickness in snack bars and sandwich preparation areas and 3/16 inch minimum in thickness in areas where ovens, fryers and other heavy kitchen operations take place and contains a ground aggregate to refusal. The finish coat must render the floor surface smooth to the extent that it can be cleaned with available cleaning equipment. A test area should be provided so that our inspector can verify the flooring thickness. Concrete, sealed or unsealed, is prohibited: a) where food product packages, containers, or cases in those areas are opened. b) Under equipment in food preparation and service areas including under service cases. (4626.1335 D.) Unsealed concrete is permitted: For use where outside garbage and refuse containers are placed, including compactors stored on a smooth and nonabsorbent surface. (4626.1230) Vinyl flooring is prohibited: In a walk-in cooler or freezer. (4626.1335 C.) Vinyl flooring is not allowed in kitchens, deli areas, behind fast food or service counter areas unless the manufacturer recommends it for this use. It is allowed in storage rooms and retail areas including under food and beverage counters. Proof of recommended use will be required in the form of sales material or a letter from the manufacturer specifically showing the recommended use before approval of this flooring will be granted. Floor and wall junctures: Shall be coved and closed to no larger than one millimeter (1/32 inch) when cleaning methods other than water flushing are used for cleaning floors. At the floor wall juncture where the fiberglass panel meets the floor an acceptable base coving such as stainless, quarry or other pre -approved materials must be installed. (4626.1345A.) Where water flushing is used coving shall be sealed. (4626.1345B.) Glued rubber coving may not be acceptable on fiberglass panels, as it may not bond to the fiberglass material. Floor surfaces: In the food preparation, food storage, and utensil washing areas be constructed of smooth, durable, nonabsorbent, easily cleanable materials, which resist the wear, and abuse to which they are subjected. Walls and ceilings: In the food preparation, utensil washing and toilet room areas, shall be smooth, non- absorbent, and easily cleanable. (4626.1335A) Ceilings: Perforated or fissured drop lay -in ceiling panels are prohibited in food preparation, food service, and utensil washing or toilet room areas. (4626.1360B.) Ventilation Ventilation System: a) Provide an NSF approved ventilation hood over cooking equipment which will capture and contain moisture, vapors, smoke, fumes, odors, heat and grease laden vapors. (Minnesota Rule, part 4626.0505 and 4626.1475) i. Type I hood required: Where cooking appliances produce grease or smoke as a result of the cooking process. (Minnesota Building Code Chapter 1346.0507) ii. Type II hood required: Above all appliances that produce products of combustion and do not produce grease or smoke as a result of the cooking process. (Minnesota Building Code Chapter 1346.0507) b) Verify that Type I commercial hood ventilation systems on the premises comply with Chapter 1346 of Minnesota Building Code which includes 2015 International Mechanical Code (IMC), and Minnesota Amendments. Minnesota Rule, part 4626.1475. c) All open sides of a canopy hood shall overhang equipment by at least six (6) inches. The front of a Type II wall -mounted canopy hood shall overhang equipment by at least twelve (12) inches.(Minnesota Building Code Chapter 1346.0507) d) A Type I hood shall be provided for an electric cooking appliance if it produces more than 5mg/cubic meter of grease vapor when tested at an exhaust flow rate of 500 cfm.(Minnesota Building Code 1346.0507) e) Provide an air balance test by a qualified heating and ventilation professional. Air balance tests shall indicate the establishment' s air handling units operate as designed and in compliance with applicable mechanical codes. A food preparation area should be under slight negative pressure (less than 0.02 inches -water gauge).
