THIS INGRESS, EGRESS AND DRIVEWAY EASEMENT made and entered into this day of
e r , 2015, by and between John Couch and Sharon K. Couch, husband
and wife, hereinafter referred to as "Landowner, and THE CITY OF EAGAN, a municipal corporation,
organized under the laws of the State of Minnesota, hereinafter referred to as the "City".
WITNESSETH:
That the Landowner, in consideration of One Dollar($1.00)and other good and valuable
consideration,the receipt and sufficiency of which is hereby acknowledged,does hereby grant and convey
unto the City,its successors and assigns, permanent easements for ingress,egress,and driveway purposes,
over,across and under the following described premises,situated within Dakota County, Minnesota,to-wit:
The Easterly 10 feet of Lot Three(3), Block Four(4),Timbershores Fourth
` Addition, according to the recorded plat thereof on file in Dakota County,
Minnesota
See also Fig.A attached hereto and incorporated herein.
This permanent easement for ingress,egress and driveway purposes includes the right of the City,its
contractors, agents and servants, to use this easement for the purpose of ingress, egress and driveway
access to and from the Hurley Lake lift station (Lift Station No. 14) and the alum sediment basin. No
obstructions such as trees, shrubs, fences, buildings, gardens, etc., will be permitted to occupy this
easement. The grant of the foregoing permanent easement for ingress, egress and driveway purposes
includes the right of the City, its contractors, agents and servants, to inspect, repair and maintain the
bituminous access drive within the easement area.
The Landowner,for itself, its successors and assigns, does covenant with the City, its successors and
assigns,that it is the owner of the premises aforesaid and has good right to grant and convey the easement
herein to the City.
IN WITNESS WHEREOF, the Landowner has caused this easement to be executed as of the day and
year first above written.

Timbershore Fourth Addition, Dakota County, Minnesota,
and described as follows: /
The Northeast 10.00 feet of said Lot 3, Block 4, Timbershore
Fourth Addition, as measured at a right angle to the Northeast
line of said Lot 3. The Southwesterly line of said easement is
extended to the Northwesterly and South lines of said Lot 3.
