Therefore, the additional 2' of lattice atop a 6' solid fence is not allowed. As proposed, I am unable to approve your Zoning Permit for the 8'fence. I would not advise a Variance request, as I believe it is unlikely to be approved. You may consider installing tall plant materials to provide additional screening and buffering above the allowable 6'fence height. If you are intent on the 8'fence height, a fence over 6' ht. must meet structure setbacks from property lines, in this case a minimum of 5'from side and rear lot lines(the same as would apply to a shed,or garage or other structure/building). Also,any fence over 6' ht. requires a Building Permit and is subject to Building Code requirements, so you would need to apply for a Building Permit rather than the Zoning Permit. Please let me know how you wish to proceed, and if you will be revising your proposal and go with the allowable 6' fence. I would like to see if it is a possibility to add a lattice frame on top of a standard 6ft fence? If you see the attached side view drawing, you will see why I want to do it. If I put up a 6ft fence, It would not be very effective for privacy. Both my neighbor and I would agree to it, I've already talked to him about it. Would it be nessesary to apply for Eagan's $400 variance, or is there alternative route I could take? My drawing indicates 8ft to top,but I likely will not go that high.
