This application was recently turned down, and we are requesting a reconsideration at this time. Mr. Raza applied for a minor subdivision under Eagan City Code Sec. 13.11. Under that section, a division of property needs to meet four criteria: A. The application shall involve the division of one platted lot into not more than two lots, both of which meet the minimum dimensional requirements of the Zoning Code. B. The proposed lots shall have access to an improved street(s) and shall connect to municipal sewer and water facilities. C. The subdivision shall meet all dedication and other requirements of the City Code. D. A lot shall not previously have been the subject of this minor subdivision ordinance. His proposal meets all four. A. The applicant is dividing one lot into two. The minimum dimensional requirements for R-1 lots in the 1999 Zoning Code and the July 29, 2000 amendment all are met. Lot area: Under the ordinance, the lot area must be at least 12,000 square feet. Lot 1 will have 16,455 square feet, Lot 2 will have 12,534 square feet, both in excess of the requirement. Lot width: The ordinance requires a lot width (measured at the front yard setback) of at least 85 feet. Lot 1 has a lot width of 86.96 feet; Lot 2 will have a lot width of approximately 120 feet. Front setback: The ordinance requires a front yard setback along the public street of 30 feet. Lot 1 and Lot 2 meet this. Side setback: The ordinance requires a side yard setback of 10 feet. Lot 1 and Lot 2 meet this; in fact Lot 2's side yards will be in excess of 15 feet. Garage setb.: The ordinance requires a garage side yard setback of 5 feet. Lot 1 has a garage side yard setback of 9.90 feet; Lot 2 will have a garage side yard setback in excess of 15 feet. Rear setback: The ordinance requires a rear yard setback of 15 feet. Lot 1 will have a rear yard setback in excess of 90 feet; Lot 2 will have a rear yard setback in excess of 30 feet. Height: Finally, the ordinance sets a maximum height of 2%2 stories. The house on Lot 1 meets this; the proposed house on Lot 2 will meet this. B. The proposed lots have access to improved streets. Lot 1 will continue to access Hyland Court, and Lot 2 will access Stoney Point Road. Both streets are improved. Municipal sewer and water facilities are existing in Lot 1, and are stubbed into Lot 2. C. The subdivision will meet all dedication and other requirements of the City Code. Under the staff report, the following requirements must be met: Park dedication cash payment of$1,272, cash trails dedication of$168, and cash water quality dedication of$1,046. Mr. Raza is prepared to make those payments immediately. D. The lot being divided has not previously been the subject of this minor subdivision ordinance. When a proposed subdivision meets all the ordinance requirements, the governing body must approve it. "[W]here a subdivision ordinance specifies standards to which a proposed plat must conform, it is arbitrary as a matter of law to deny approval of a plat which complies in all respects with the subdivision ordinance." National Capital Corp. v. Village of Inver Grove Hem, 301 Minn. 335, 222 N.W.2d 550 (1974) (per curiam). To refuse to follow your own ordinance is considered arbitrary and capricious. See also Good Value Homes v. City of Eagan, 410 N.W.2d 348 (Minn. App. 1987). As a former city attorney, I understand that city council members like to consider the public views and be concerned about impacts on an existing neighborhood. However, those concerns must be set aside in the application of the ordinance to a proposed subdivision. As stated in Odell v. City of Eagan, 348 N.W.2d 792 (Minn. App. 1984), "While we remain respectful of the discretion given to local governing bodies, we find that in this case the Eagan city council did not have a reasonable basis on which to deny the Odells'preliminary plat application when it met the requirements of the Eagan subdivision ordinance." The same holds true for Mr. Raza's application. A subdivision application which meets all the ordinance requirements must be approved.
