Hello Pam,
Attached is a revised drawing of Teresa and Jeremy Bly's project at 3330 Rolling Hills Drive in Eagan. Below are your
original questions with my answers in red. Please let us know if there is anything else we should clarify.Thank you!
I am reviewing your Zoning Permit application. Based on our conversation, I have crossed off the shed from the plan. I
have added Retaining Wall<4 feet to the checked items under Type of Work. Please provide some additional
information and clarify some measurements as follows. Additional notes are on the attached plan.
• The shed has been removed from the design plan
• There will be no walls above 4 feet tall in this project
• Verify the property line, and location of easements on the property. There is a 15'wide easement along the west
side of the lot,and a 10'easement along the south side.
• I have marked the property line measures and drew in where the easements are.
• It appears portions of the circle patio and portions of boulder retaining walls will encroach into easement
areas. Our Engineers will have to review those encroachments. There is a sanitary sewer pipe in that 15' easement
along the west side,and any encroachments there would be subject to removal if access to the pipe is needed.
• I have adjusted the design so that the retaining walls do not encroach into the 15 ft easement area.
• Please confirm the height of the boulder walls, in particular whether at all points the wall is<4 ft. height, as
measured from the bottom of the footing below grade. If any point along the retaining wall is>4 ft. ht.,then a Building
Permit is needed for the retaining wall rather than this Zoning Permit.
• There are no walls over 4 feet in height.
• The fire pit must be at least 10'from the property line. The patio circle is noted as 16',which is an 8' radius. Does
the edge of the fire pit in the center of the circle meet the 10'setback? Also, is the fire pit at least 25'from all
combustible materials, including any wood fences?
• With the adjustments to the design the fire pit is now further than 10 feet away from the property line.There
are no wood fence/buildings

Hi Cassie,
My responses to your questions are in red italics:
• We are not planning to build any walls over 4 feet in height.Will you still need the heights of the walls if
they are not over 4 feet?
/will check the box for "retaining walls<4 feet"on the Type of Work section of the Application form.
• If the boulder wall encroaches the easement on the south/rear property line will it cause future issues?
Our Engineers would have to review that. I do not see any storm sewer, sanitary sewer or water pipes there.
• Is it advised to stay completely clear of the 15 ft easement on the west side of the property line because of
the sewer pipe?
Yes, that is best. While we can allow at-grade improvements such as the patio and small retaining walls to
encroach into such an easement, they are subject to the terms of the easement, including removal if access
to the sewer pipe is needed.

the drawing and will adjust the fire pit but before I send it back over I have a few questions.

• For future reference, if you intend to build a shed, it must be located at least a 5' setback from property lines
and outside of easement areas. In this case,that means a 5'setback from the east side lot line and 10' setback
from the south/rear lot line. The shed as shown on this drawing does not satisfy those setbacks.
