These minutes, as presented or modified, are in order for adoption by the Commission. III. VISITORS TO BE HEARD The Eagan City Council and its Commissioners set aside up to 10 minutes at the beginning of public meetings to permit visitors to address items of interest that are not scheduled ort the regular agenda. Items that will take more than 10 minutes or that require specific action can be scheduled for a future agenda. IV. OLD BUSINESS A. Communications Update - It is the practice of the Airport Relations Commission to discuss their communication initiatives each month, which include articles in the Experience Eagan newsletter, stories aired on the city's local access cable channels, and inclusions in the ARC Notebook. An article appearing in the October 18, 2006 Sun Times newspaper regarg the Orfield Labs presentation regarding the phase I -phase H analysis study is enclosed on pages V through . Articles being considered for future city newsletters include: a recap of the phase I -phase II analysis study performed by Orfield, and a reminder for Eagan residents of ways they can get involved — the MAC complaint submittal process, contacting state and federal elected representatives, attending MAC NOC meetings to voice concerns during public hearings, etc. If any of the Commissioners have suggestions for additional communication initiatives in the city regarding airport issues, please submit those suggestions at this time. B. MAC Monthly Reports — Eagan/Mendota Heights Corridor Analysis/Technical Advisory Report/ Runway 17-35 Departure Analysis Report — Enclosed on pages ja_ throughlT is the September 2006 Eagan/1V4endota Heights Corridor Analysis Report. Enclosed on pages ff_ through is the September 2006 Technical Advisory Report. Enclosed on pages'53— through 5q- is the September 2006 Runway 17-35 Departure Analysis Report. The September reports are the most current reports available on the MAC Web site. It is the practice of the Commission to review the reports and discuss any significant deviations that may have occurred or any other noteworthy occurrences as reported in the analysis. V. NEW BUSINESS A. City Comprehensive Plan — Airports & Aviation Chapter — The City of Eagan is in the process of reviewing and updating its comprehensive plan. Enclosed on pages (A) through(& is the Airports and Aviation Chapter. Airport relations commissioners will review the goals and policies of the Airports and Aviation Chapter, and make recommendations for the city council to consider. VI. STAFF/COMMISSION UPDATE A. MAC Representation Legislation — The city Noise Oversight Committee met Oct. 18 to discuss and recommend a legislative initiative, identifying MAC representation for communities affected by the Minneapolis -St. Paul International Airport. Representatives from Eagan, Bloomington, Richfield, Mendota Heights, Minneapolis, and Apple Valley attended the meeting. The cities of Burnsville, Sunfish Lake, Mendota, St. Paul, and St. Louis Park were invited to the meeting as well. The committee agreed to language calling for the addition of four seats for the cities of Eagan, Bloomington, Richfield, and Mendota Heights. The plan does include alternatives to the proposed four seats. Option one: Two seats, one for the two communities north of the river — Bloomington and Richfield, and one for the two communities south of the river — Eagan and Mendota Heights. Option two: One seat for all affected communities. Under the alternative plans, the city NOC group would recommend representatives to the respective city councils for concurrence and approval. These seats are determined by the 65 DNL contour. The city councils for each community represented by the city NOC group are asked to approve the language and strategy. The Eagan City Council will consider the legislation at its November 9 meeting. The legislation and action item presented to the City Council is enclosed on page through. With the election over, the next step is to contact legislators to solidify their support for the drafted legis ation. The Burnsville City Council will review and discuss the legislation at a workshop in December. The expectation is that the Burnsville council will neither support nor take a position on the legislation. B. Home Sales & Property Value Studies — Per the request of the ARC, the Southern Twin Cities Association of Realtors (STCAR) was contacted to request information regarding home sales for the past couple months and each month from now until the spring survey. Due to staff turnover, STCAR was unable to process the request for home sales information for the previous few months in time for the Nov. 14 ARC meeting. However, STCAR stated it, would provide the requested information going forward - November/December through April/May. This information will help provide a baseline of understanding regarding the housing market leading up to the spring survey. On a side note: One resident who called the city to complain about airport noise did state that her family was electing to sell their home and move due to persistent airport noise. Marth Krohn, University of Minnesota Humphrey Institute, reported no luck finding a student to perform the requested property value study as a class project. However, Ms. Krohn would like to try again, opening the prof ect up as a volunteer or internship opportunity. This study would ultimately determine if airport noise has an impact on property values in Eagan. The study could be extended to other communities affected by the Minneapolis -St. Paul International Airport. Commissioners should direct staff as to wishes regarding the property value study. Staff recommendation is for the ARC to wait until the spring home sales survey is completed before proceeding with property value survey. The home sales survey will indicate how homes are selling and their related sales prices. C. MAC Noise Oversight Committee - The next MAC Noise Oversight Committee meeting is November 15 at MAC offices, 6040 28t' Avenue South, Minneapolis. Enclosed on pages through is a copy of the November 15 agenda; minutes from the September 27 meeting are ori pages through D. ARC December Workshop - ARC commissioners agreed to .schedule a December workshop to discuss the phase I -phase II noise analysis report prepared by Orfield Laboratories of Minneapolis, determine the need for future noise studies, and how any information generated by future studies will be used by the city to set policy, etc. Minutes from the October 10 Eagan City Council meeting, highlighting council directives, are enclosed on pages � throughER : (Note: Item III.) Per the request of commissioners, city staff is compiling information for the December workshop. This information includes low-frequency/full-frequency studies conducted by Orfield Laboratories for the cities of Richfield, Bloomington, and Minneapolis. This information will be provide to commissioners in time for the December workshop. E. Next Airport Relations Commission Meeting - Due to the special ARC workshop, there is.no regular ARC meeting scheduled for December. VII. ROUNDTABLE Per the request of the Commission, this agenda item has been added so that commissioners have the opportunity to ask questions or make requests for future agenda items. IX. " 4 n' - — Adn n Intern MINUTES OF THE EAGAN AIRPORT RELATIONS COMMISSION MEETING OCTOBER 10, 2006 A regular meeting of the Eagan Airport Relations Commission was held on Tuesday, October 10, 2006 at 7:00 p.m. Those present were Curtis Aljets, Steve Beseke, Jason Bonnett, Justin Countryman, Tammy Mencel, Jack Prentice, and Bret Walsh. Absent were Charles Thorkildson and Dean Haehnel. Also present was Jason Ziemer, Administrative Intern. AGENDA Upon motion by Aljets; seconded by Prentice, the agenda was approved as presented. All members voted in favor. APPROVAL OF MINUTES Beseke made a motion to approve the minutes of the August 8, 2006 and September 14, 2006 regular meeting of the Eagan Airport Relations Commission; Mencel seconded the motion. All members voted in favor. VISITORS TO BE HEARD There were no visitors to be heard. COMMUNICATIONS UPDATE Ziemer introduced the item stating it is the practice of the Airport Relations Commission to discuss any communication initiatives relative to airport noise each month including articles appearing in the Experience Eagan newsletter, stories aired on the City's local access cable channels and inclusions in the ARC Notebook. Ziemer stated, with the completion of the Phase II Noise Study Report, information will appear on the City's website, the new Experience Eagan newsletter and, possibly, a news release relative to the final analysis. MAC MONTHLY REPORTS — EAGAN/MENDOTA HEIGHTS CORRIDOR ANALYSIS/TECHNICAL ADVISORY REPORT/17-35 DEPARTURE ANALYSIS REPORT Ziemer introduced the item stating the enclosed August 2006 Eagan/Mendota Heights Corridor Analysis, August 2006 Technical Advisory Report and the August 2006 Runway 17 Departure Analysis Report are the most current reports available on the MAC website. It was noted 17.8 percent of complaints received by MAC were from Eagan residents. Ziemer noted that Eagan has averaged approximately the same percentages over the last 5 months, with Burnsville having the highest number due to the 190 degree departure heading and Apple Valley continues to have a high number of complaints due to arrival operations. It was further noted that corridor compliance was just under 95 percent. 4 Eagan Airport Relations Commission October 10, 2006 Page 2 of 4 PHASE I — PHASE II COMPARISON NOISE STUDY Ziemer introduced the item stating Orfield Labs was present earlier at a Special City Council meeting and discussed results from Phase I and Phase II of the noise studies that were done in Eagan. He stated five sites have increased in noise comparing the two studies; three sites (1, 6 & 7) were a direct result of aircraft noise; site 4 was an increase as a result of traffic, and site 5 was residential construction. He also stated certain areas decreased and noted that Runway 17/35 is not operating at full capacity. The Commission discussed the intent of Phase I and Phase II Noise Studies which were performed to verify MAC data and to obtain a baseline on noise for future reference. It was suggested to have European Standards available for the Commission at the November ARC monthly meeting. The Commissionfurther discussed the payoff and use of data from a Full -Frequency Monitoring Study. There was discussion regarding an actual single event -versus an average noise level. The Commission discussed the potential of changing legislation from measuring average noise levels to single event measurements. Ziemer stated the City Council asked for direction from the ARC Commission on how to proceed. The Commission agreed to hold a work session for this purpose. Mencel suggested talking with the cities of Bloomington, Richfield and Minneapolis regarding the usefulness of data received from the full - frequency studies. CITY COMPREHENSIVE PLAN — AIRPORTS & AVIATION CHAPTER Ziemer introduced the item stating the City is in the process of updating its Comprehensive Guide Plan. The Commission agreed to have this item put on the November agenda for recommendations to the City Council regarding the Airports & Aviation Chapter of the Comp Guide Plan. Prentice suggested adding the benefit of employment and economics to the City in the Introduction of the Guide Plan. MSP NOISE OVERSIGHT COMMITTEE 190/200 -Degree Heading Update Ziemer introduced the item stating the FAA began testing the 200 -degree heading on June 19, 2006. Ziemer noted that the FAA maintains a position that operations are in compliance with previous environmental documentation. He also stated another meeting between the City of Burnsville and the FAA is expected to take place sometime in November. Builders Guide Ziemer stated the Met Council has put out their new Builders Guide which includes new regulations pertaining to 60 DNL contours. He further stated the guide identified a 60 DNL or greater as being incompatible for single home development. New Flight Tract Data Collection & Reporting Ziemer stated the MAC has knowledge of new technology for flight track information which currently takes a minimum 5 -day delay to access data. He stated the new technology will have the capabilities on the web site of accessing data within 10 minutes. Ziemer further stated the cost to install the new system would run between $300,000 and $500,000 plus annual maintenance fees. Eagan Airport Relations Commission October 10, 2006 Page 3 of 4 2007 NOC Work Plans Ziemer stated a preliminary agenda identifying discussion topics for 2007 was presented at the NOC meeting. Ziemer explained one of the topics that the City of Eagan would like to see on the agenda for 2007 is the discussion of reopening the Part 150 Program pertaining to flight tracts for Runway 17/35. He stated MAC staff is encouraging ARC members to attend NOC meetings and public hearings. HOME SALES & HOME SALE PRICES SURVEY Ziemer introduced the item stating Commissioners requested information comparing homes sales and sale prices between Eagan and Inver Grove Heights and Mendota Heights. He stated Inver Grove Heights sales were down slightly while Mendota Heights, Mendota and Lilydale were up. Prentice made a motion to have the Southern Twin Cities Association of Realtors conduct a follow up survey of realtors to determine reasons why homes are being placed on the market. Beseke seconded the motion. All members voted in favor. Bonnett suggested including home sales comparison information in the ARC monthly packet for the next six months for Commission review. The Commission discussed having information broken into specific categories for comparison. PROPOSED MAC REPRESENTATION LEGISLATION Ziemer stated the city Noise Oversight Committee will be meeting on October 18, 2006 at the Bloomington City Hall to discuss and draft legislation for permanent city representation on. the Metropolitan Airports Commission. He stated Eagan's ARC proposal includes: city membership identified by the cities inside the 60 DNL noise contour, no reconfiguration of seat assignments, and city representation to be appointed by city councils. Ziemer noted that city councils will be asked to signoff on legislation in November prior to submittal. NOISE OVERSIGHT COMMITTEE AIRPORT NOISE PUBLIC INPUT MEETING Ziemer stated the next Noise Oversight Committee meeting will be on Thursday, October 19, 2006 at the MAC general offices. He noted the ARC and general public are invited to attend and receive updates, provide comments and voice concerns regarding airport noise issues. NEXT AIRPORT RELATIONS COMMISSION MEETING Ziemer stated the next ARC meeting will be held on Tuesday, November 14, 2006 at 7:00 p.m. in the Eagan City Council Chambers. Other times things aren't so black and white. That's what the Eagan City Council learned when it received an airport noise analysis at its Oct. 10 work session. "What this does is give you a snapshot and in one of those snapshots, somebody blinked," said Elliot Dick, an engineer with Orfield Laboratories. Orfield Laboratories is the company that did the second of two sets of community noise measurements designed to show airport noise before and after the fall 2005 opening of the Minneapolis -St. Paul International Airport's new north -south runway. The first analysis, done in June 2005, was completed by Wyle Laboratories with Orfield doing its measurements this past June. Since the raw data collected from that second period showed little change from the 2005 data, the city hired Orfleld to compare and analyze the two results from both studies. A total of 10 portable noise -monitoring stations were placed around the community as part of the studies. Two were deliberately placed under the path of the existing runway with the rest scattered around Eagan. The,biggest complication with the noise data is that the first study concentrated on average noise levels while the new study looked at single noise "events." Averages is what federal and state regulations use to measure airport noise, but European standards look at noise events and that's a more accurate way to measure the impact of noise on communities, said Steve Orfield, president of Orfield Laboratories. "We don't care what noise averages are," Orfield said. "People don't complain about noise averages, they complain about noise at any one point." There were also several large spikes in noise measurements that did not align with times MAC has flights going over the city. Such instances could have been generated from a neighbor mowing a lawn or a loud radio in the area, Dick said. Counciimember Peggy Carlson said she was concerned because the two studies taken together create the idea that noise levels have decreased in the city despite the opening of the new runway. "It looks like noise has gone down in Eagan in some areas, but we live here and we know it hasn't" Carlson said. "It's only 30 seconds at a time, but it's there." The issue is further complicated because overall traffic at the Minneapolis -St. Paul International Airport is down and the new runway is not yet in full use, Dick said. "This data alone is not the whole story," Dick said. Orfield said it is possible to look at the earlier data and extrapolate some noise events, but that it wouldn't be as accurate as the newer data. In other business at the meeting: The council received an update on preplanning efforts in the case of a pandemic Avian Influenza outbreak. A committee of city staff led by Police Chief Jim McDonald has been meeting since the council was first briefed on the issue in May. The committee is working on a plan that is scheduled for council consideration in December. The effort so far has led to several assumptions, including the idea that a pandemic would last six to eight weeks and consist of several waves over the course of a year and that up to 30 percent of the workforce could be out during such an outbreak. Because health care facilities in the city could be overwhelmed during such an event, it might be necessary to use city facilities as treatment areas, McDonald said. The group is working on establishing other benchmarks laying out how the city would operate, manage its workforce and keep the public informed, McDonald said. "The plan needs to have flexibility," he said. "When we were preparing for Y2K, we knew the workforce we had and we knew the date it would happen, but this is very amorphous." The City benefits by convenient access to airport services while at the same time areas of the City are negatively affected by aircraft noise. A significant change at MSP occurred in October 2005 when a new north -south runway (Runway 17/35) opened, resulting in many areas of Eagan previously unaffected by noise now being impacted by aircraft noise. The existing parallel runways continue to have noise effects upon the northern portion of the City. Part of the City's challenge is to maximize the benefits of its convenient location while minimizing the aircraft noise effects. The major benefit of the City's proximity to the airport is convenient access for its residents and businesses to the services offered by MSP. It is less than a 20 minute trip from most areas of Eagan to MSP. In 2004, MSP served 36.7 million passengers and accommodated over 541,000 landings and takeoffs. MSP ranks 9th in North America for the number of travelers serviced. The airport boasts the eighth busiest airfield in the world. MSP is expected to serve 55 million passengers annually by the year 2020, thus creating a need for further airport expansion, according to the Metropolitan Airports Commission (MAC). As a result of the numerous over flights, substantial areas of Eagan are within a designated noise exposure zone'. Aircraft noise is a nuisance to many people and the amount of noise in certain areas affects how the land can be used and how buildings need to be constructed to minimize negative impacts. For example, much of the northern half of Eagan falls within designated noise zones and new single family homes, churches, schools and other noise sensitive uses are discouraged from being built in this area. If these uses are built they must be constructed to provide greater than average noise reducing walls, windows and doors. GOALS AND POLICIES GOALS To minimize the establishment of noise sensitive uses in areas where noise impacts are greatest. 2. To the extent possible, mitigate noise impacts in areas where noise sensitive uses currently exist, or can be anticipated, in noise impact zones. Based on Metropolitan Council's 2007 MSP Noise Policy Zones 06/20/2006 3. To advocate airport -operating procedures that will minimize adverse impacts in Eagan's noise sensitive areas, especially those areas that were established outside of areas where operations and noise impacts were anticipated. 4. To implement an orderly transition from noise sensitive land uses to noise compatible ones where appropriate, in consideration of all development factors for the area. 5. To minimize the establishment of physical structures that will interfere with aircraft operations. POLICIES 1. The City will generally discourage new residential development in areas most affected by aircraft noise. This area is depicted by the current Metropolitan Council Noise Zones as illustrated in Figure 5.1. 2. The City will consider in -fill residential development within the area described above on a case by case basis. Where such in -fill development is permitted, it will only occur under appropriate requirements respecting aircraft noise including sound attenuating construction techniques and buyer notification of the noise environment. 3. The City of Eagan will enforce its Noise Attenuation Construction ordinance, at such time as it is adopted, which applies to all noise -sensitive areas within the Metropolitan Council Noise Zones. 4. Any additions, modifications or replacements of existing homes within the Noise Zones shall use noise abatement designs and construction techniques to achieve an inside noise attenuation level appropriate for its noise zone. 5. The City will encourage the maximization of noise mitigation programs for the benefits of its residents. 6. The City will designate the Metropolitan Council Noise Policy Contours on its zoning and comprehensive guide plan maps to inform current and prospective property owners of the presence of potential noise impacts and the existence of regulations and performance standards for those areas. The designation of the contours on the comprehensive guide plan and zoning maps shall constitute buyer notification of the noise environment by the City. 7. The City, will continue its cooperative efforts with the Metropolitan Airports Commission, the Pollution Control Agency and other governmental agencies to reduce adverse noise impacts generated by air traffic. 8. The city will advocate for historic and prospective aircraft operating procedures that respect the City's purposeful efforts to minimize noise sensitive uses in the Eagan -Mendota Heights Corridor. The City will resist efforts by other agencies to introduce or modify operating 2 U). 06/20/2006 procedures so as to increase adverse impacts in noise sensitive areas of Eagan outside of the Corridor. 9. The City will continue to encourage noise compatible commercial -industrial uses in the northern portion of the City where the noise compatible Corridor has been established. The City will consider redevelopment of noise -sensitive residential uses to noise compatible uses in the Corridor in situations where other planning factors support such action. 10. The City does not anticipate a strategy of major redevelopment of the residential areas of south and west Eagan that now experience additional over -flights from the north -south runway. This is due to the scale of residential development that has occurred in this area to date and the presence of substantial areas of commercial and industrial land uses in the northern portion of the City associated with historic air traffic patterns. The City will apply appropriate performance standards to expansion or modification of uses, in -fill development or redevelopment within the area. 11. The City will advocate for specific noise attenuation considerations for noise sensitive areas in southwest Eagan, because neither the City nor its property owners could have anticipated the over -flight impact from the new north -south runway. 12. The City will notify appropriate agencies of proposed construction or alterations that will exceed height limitations in airport areas as specified in Federal or State law. ECONOMIC BENEFITS According to the 2006 Metropolitan Airports Commission's Strategic Plan, the Minneapolis -St. Paul International Airport is both directly and indirectly responsible for over 150,000 jobs in the region, $10.7 billion in annual business revenues, $5.9 billion in personal income, and $626 million in State and local taxes. For the City of Eagan, the benefit of being located in close proximity to the airport has helped the City support a healthy and diverse business community, from corporate headquarters to distribution companies to hotels and restaurants. The airport is a tremendous marketing tool for bringing in new businesses and retaining those that have made Eagan their home. AIRPORT/AIRCRAFT IMACTS LAND USE Different types of land use have varying degrees of sensitivity to aircraft noise. For example, commercial -industrial uses are more compatible with aircraft noise than noise -sensitive residential, churches and schools. Noise sensitivity varies among residential uses. Single family homes have more exposed exterior walls and roof areas and rely more on the outdoor yard areas than most multi -family housing. As such, single family homes are generally more affected by aircraft noise than multi -family housing. (Oa 06/20/2006 The northern portions of Eagan are particularly affected by aircraft noise (See Figure 5.1 for a location of the proposed 2007 mitigated noise contours). To avoid additional conflicts the City has guided most of this area for commercial -industrial development and discouraged construction of new single family residential homes and most multi -family homes in noise exposure areas. In general, the Comprehensive Plan does not recommend construction of new single family homes within the. noise exposure areas, except on a case specific basis. Extraordinary sound proofing should occur if new single family dwellings are constructed in noise exposure areas. Construction of multi -family homes may occur within the noise zones in which such uses are considered provisional or conditional, but they must be constructed to provide adequate sound insulation to provide a quiet indoor environment and meet other standards outlined for such uses in this guide and the regional guidelines. Where this is deemed appropriate, it can be accomplished by meeting the Structure Performance Standards established by the Metropolitan Council's Aviation Chapter of the Metropolitan Development Guide, as well as by meeting standards set forth in the City's future noise attenuation ordinance. For residential and educational/medical land uses, interior sound levels may not exceed 45 dBA. An interior sound level of 50 dBA is required for cultural, recreational, entertainment, office, commercial, and retail service uses. Table 5.1 outlines the Metropolitan Council's land use compatibility guidelines for development within noise exposure areas. NOISE EXPOSURE AND NOISE MITIGATION There are existing residential uses within noise exposure zones. Aircraft noise exposure is measured and mapped by the Metropolitan Airports Commission (MAC). The noise exposure zones and accompanying mitigation programs are subject to approval by the Federal Aviation Administration. Noise exposure is measured on an annualized average weighting of day -night noise levels measured in decibels (Ldn). Around MSP, the significant noise exposure zones are mapped from Ldn 75 (highest) to Ldn 60 (lowest). Homes within the proposed 2007 Ldn 65 Mitigated Noise Contour are eligible for the residential sound insulation program offered by MAC. All currently eligible homes in Eagan have been contacted for participation in the program, and have either had the insulation modifications completed or declined to participate. All homes within the 60-64 Ldn DNL contours may be eligible for some mitigation should the FAA approve the 2007 proposed residential noise mitigation being recommended by the MAC. As of June 2006, the City of Eagan remains in active litigation with the Cities of Minneapolis and Richfield against the MAC regarding the proposed 2007 residential noise mitigation program for those homes that are located within the 60-64 Ldn Noise Contours. While the MAC has submitted the 2007 Part 150 Update, the FAA has not yet approved the document. The FAA has approved the 2007 unmitigated noise contours; however, the mitigated 2007 noise contours, which show the homes that would be eligible for mitigation, have not yet been approved. Depending on the outcome of the litigation, it is anticipated that the next Part 150 4 b3 06/20/2006 Update, and corresponding update to the noise exposure map will begin at the earliest in 2007 to reflect the proposed noise forecast for 2012. Distance of proposed use from existing or proposed runways, parallel taxiways, or engine run-up areas. 6 06/20/2006 AIRPORT SAFETY Safety zones are established within the MSP Airport Zoning District to ensure an unobstructed flight path for departing and arriving aircraft. The safety zones extend off the ends of each runway and impose height and use restrictions on properties and structures within them. Due to the distance between the runways and the municipal borders of Eagan the safety zones do not have a significant effect upon height of proposed structures in Eagan. The main concern is that structures within safety zones do not exceed 200 feet in height. The City of Eagan is required to notify MNDOT of any proposed structure in excess of 200 feet outside of individual airport zoning districts to control potential obstructions in the region's general airspace. A section needs to be added to note the JAZB Overlay Area. AIRPORT EXPANSION A significant expansion of MSP Airport took place in 2005, which changed flight patterns and noise exposure in Eagan. Runway 17/35, also known as the North-South Runway, became operational in October 2005, and is anticipated to add 25% capacity to MSP. The current runway configuration consists of two parallel runways (12-30 left and right), one cross wind runway (4-22), and one north -south runway (17-35). The two parallel runways are oriented in a southeast -northwest direction and landings and takeoffs from/to the southeast are generally over Eagan. The North-South Runway is located to the west of the parallel runways, with both landing and takeoffs from/to the south. The location of Runway 17-35 in proximity to the other runways all for independent and simultaneous use of the north -south and the parallel runways. The flight departure tracks from the North-South Runway spread noise over much of the southern half of the city, and the arrival operations off of Runway 17-35 concentrate significant noise over those homes in Eagan that are located just east of Cedar Avenue, as that is the location of the extended centerline for arrival operations. The City will continue to work with the Metropolitan Airports Commission (MAC) to minimize the area affected by noise and to establish additional noise mitigation measures. INTERGOVERNMENTAL RELATIONS Ea an Airl)ort Relations Commission The City of Eagan has an active Airport Relations Commission. The Commission is an appointed advisory body of the Eagan City Council. The purpose of the Commission is to advise and make recommendations to the City Council concerning aircraft noise and airport policy issues that impact or have the potential to impact Eagan. As citizen volunteers, Commission members provide valuable insight into public perceptions of these issues for the City Council, City staff and community at large. Currently the Eagan Airport Relations Commission is focusing on: 7 //_w (IAo 06/20/2006 1. Monitoring departure and arrival tracks of Runway 17-35 to minimize noise exposure to residential neighborhoods. 2. Seeking a 95% or better rate of compliance within the Eagan/Mendota Heights Corridor. 3. Efforts to improve the representation the City receives on the Metropolitan Airports Commission (MAC). 4. Understanding the impacts of ground -level, low frequency noise on the community. § 5. Communications efforts to inform residents about the activities of the City to reduce airport noise over the City of Eagan and provide avenues in which citizens can be heard regarding concerns over airport noise. 6. Monitoring the progress of the litigation efforts against the MAC with regard to the Part 150 Residential Noise Mitigation Program. Minneapolis -St. Paul International Airport Noise Oversight Committee The City of Eagan is one of six communities surrounding the airport that has a seat on the MSP Noise. Oversight Committee (NOC). The MAC established the NOC in August 2002. Its purpose is to bring industry and community representatives together as a balanced forum to dialogue about noise issues at the Minneapolis -St. Paul International Airport and to bring policy recommendations to the MAC. The committee meets on a bimonthly basis. The NOC replaced the group formerly known as the Metropolitan Aircraft Sound Abatement Council (MASAC), which was disbanded in 2000. Metropolitan Council The Metropolitan Council is the regional planning agency that has the legislative authority of approving the MAC's Capital Improvements Plan budget. The Metropolitan Council's role in the evaluation of noise is to promulgate guidelines for the compatible use and development of land in communities surrounding the airport and approve individual airport long-term comprehensive plans. Other A«encies A number of other State agencies work with the MAC in either a cooperative and/or regulatory capacity. The Minnesota Department of Transportation is involved in all construction projects that will impact the traveling public, including runway construction and roadway improvements. The Minnesota Pollution Control Agency works with MAC Environment Department on issues such as noise and groundwater runoff. The Minnesota Environmental Quality Board has the N 06/20/2006 final authority in approving Environmental Impact Statements and other environmental documents related to the MSP. 0 Agenda Memo Regular City Council Meeting November 9, 2006 LEGISLATIVE/INTERGOVERNMENTAL AFFAIRS UPDATE: A. APPROVE SUBMITTAL OF LEGISLATION TO IMPROVE REPRESENTATION OF THE NOISE OVERSIGHT COMMUNITIES ON THE METROPOLITAN AIRPORTS COMMISSION ACTION TO BE CONSIDERED: To approve the proposed legislation from the local Noise Oversight Committee regarding community representation on the Metropolitan Airports Commission. FACTS: • The local Noise Oversight Committee (NOC) representing the cities of Eagan, Bloomington, Richfield, Mendota Heights, Minneapolis, St. Paul, Apple Valley, Lakeville, Burnsville and others met Oct. 18 to draft legislation concerning community representation on the Metropolitan Airports Commission (MAC). • The committee agreed the legislation would add four new seats to the MAC board. A representative from Eagan, Bloomington, Richfield, and Mendota Heights would fill those seats. The determining factor for those seats is the 65 DNL noise contour which affects those four cities. In addition to noise concerns, key message arguments for the four new seats will focus on economic and other airport impacts. • If approved by the legislature, the mayor of each city or by a person appointed by each respective city councils would fill the four seats. • Minneapolis and St. Paul already have permanent representation on the board. The other 13 of 15 seats currently on the MAC board of commissioners are appointed by the governor. The proposal would add four. seats and not reconfigure the MAC. • The proposal includes options. Option #2 would add two seats — one for the two communities north of the river — Bloomington and Richfield, and one for the two communities south of the river — Eagan and Mendota Heights. Option #3 would add one seat for all communities in the affected areas. Under options #2 or #3 city councils would approve community representatives upon recommendation of the city NOC group. • Past attempts to add or change the MAC have failed at the state legislature; none have made it out of committee. The majority of those proposals were offered by individual communities. The legislation drafted by the city NOC group presents a unified front. • A number of state legislators have indicated their support for the legislation in some form; whether four seats or one. After the election, NOC representatives will contact their state legislators to solidify support of the proposal, and ask them to do the same with their colleagues in St. Paul. • After all city councils approve, the legislation will be drafted and jacketed in December, and ready for the 2007 legislative session. Leqve, Manager — Aviation Noise and Satellite Programs SUBJECT: 2007 NOC WORK PLAN DATE: November 1, 2006 At the September 27, 2006 Noise Oversight Committee (NOC) meeting the Committee initiated discussion regarding the 2007 NOC Work Plan. MAC staff presented possible items for consideration in the context of the 2007 NOC Work Plan. Committee members were instructed to forward, prior to the mailing for the November 15, 2006 NOC meeting, any work plan elements to MAC staff that they would like to include on the 2007 Work Plan. To date, MAC staff has received no input from Committee members regarding additional work plan items. The attached Draft 2007 NOC Work Plan includes the items reviewed at the September 27th NOC meeting. It is important to note that throughout the year it is probable that additional items will arise as the Committee conducts its normal business. For purposes of review, the Committee had one of its most productive years to date, accomplishing the following in 2006 (representing substantial completion of the 2006 NOC Work Plan): • Analysis of Runway 17/35 operations trends. • Review of comments and issues south of MSP following Runway 17/35 opening. • Continued evaluation and advocated increased use of Runway 17 2.5 nautical mile departure turn point procedure resulting in compliance increasing from a low in November 2005 of 85.1% compliance to a high of 99.2% compliance in September 2006. • Evaluated uses of the 190 degree departure heading off Runway 17 over residential areas in northeast Burnsville during southeast operational flows and requested FAA open up west bound departure headings to a 230 degree heading over the uninhabited Minnesota River Valley during southeast operational flows. Discussions are ongoing with FAA to address the issue. • Conducted a review of Part 150 Noise Compatibility Program noise mitigation measures from an implementation perspective. • Received updates on Part 150 mitigation implementation issues focusing on the mold issue. • Reviewed FAA grant funding eligibility concerns for the mitigation of a Multi -family building in Bloomington. The discussion resulted in FAA approval of Part 150 grant dollars to mitigate the building as part of MAC's Part 150 program in the 65+ DNL. • Updates on the MSP 2020 plan discussions. • Increased the number of at -large communities with a by-law modification to include the representation of the City of Apple Valley in the at -large cities group. • Reviewed abnormally high Boeing 757 arrival noise events as measured by ANOMS and through coordination with Northwest Airlines, determined that engine bleed valves on the aircraft were opening in such a manner that created a high noise level. Subsequently, using ANOMS, MAC staff worked with Northwest Airlines staff to determine the specific aircraft. Northwest Airlines worked cooperatively with the engine manufacturer and the bleed valve manufacturer to identify the root cause and to develop a corrective action plan; Northwest Airlines took corrective action with the engine manufacturer. These efforts were a success; in May 2005, twenty-three Boeing 757 arrival aircraft showed up in the 'Top Ten Loudest Aircraft Noise Events' section of the Technical Advisor's Report, many with levels in excess of 100 dB. That is compared to 2 events in May 2004 and 1 event in May 2003 (all of which were normal in noise level magnitude). In September 2006, only 4 Boeing 757 arrival aircraft showed up in the 'Top Ten Loudest Aircraft Noise Events' section of the Technical Advisor's Report (all of which were normal in noise level magnitude). • Assessment of nighttime operations and associated impacts. • Reviewed new flight track data acquisition technologies that are available to reduce data lag times for consideration in a future ANOMS upgrade. • Consideration of supplemental noise metrics resulting in the addition of time above data in the monthly NOC Technical Advisors Report. • Reviewed status of the FAA Center of Excellence/PARTNER initiatives. • Reviewed updates to the Metropolitan Council Land Use Compatibility Guidelines related to airport noise. • Reviewed the macnoise.com website and implemented site enhancements. • Continued review and consideration of input received from the quarterly Public Input Meetings. The intent is to ensure residents' concerns are considered as part of the ongoing effort by the MAC and the NOC to address noise issues around MSP. The following memorandum provides a summary of the comments received at the last public input meeting. The NOC may also review these topics as possible future action items if the members so desire. On October 19, 2006 MAC Aviation Noise and Satellite Program staff conducted the fourth quarter 2006 public input meeting — 14 people attended the meeting and 8 individuals made comments. MAC staff responded to questions at the meeting and is also providing written responses to each of the individuals who commented. Office's current system which requires a`5-7 day lag time. Leqve stated that the current ANOMS system collects flight track data via a tie to the FAA's ASR -9 radar. That data is received. via a Memorandum of Agreement with a FAA; that MOA stipulates security measures including a "cooling off' period before data -is released. Leqve :stated that the total time it takes to get the information, import the information, and analyze and format the information for.pubiic consumption results in a 5-7 day delay. Leqve noted there are .two systems available that are different from the current system: Passive Radar and Multilateration. Leqve indicated that Passive Radar technology is available through Megadata (the-PASSUR system) and Lochard (SkyTrak-P). The PASSUR system includes a network of hardware deployed at airports around the country. A sensor picks up the signal communicated from an aircraft to the ASR -9. radar; data is sold, then,. like a subscription service. Leqve noted that hardware for this system is already installed at MSP. Leqve stated that the Noise Office has reviewedPassive Radar in the past and found the information collected to be -good from an operational perspective, but analysis showed it to be not at the same level of data integrity in terms of geographic representation of flight tracks as the cwet t system provides. In addition, Leqve stated that there are limitations on where Passive FWarte;hnofogy can be physically located at an airport. He. also noted that, in discussions with other MAC staff, the possibility of utilizing Part 150 grant dollars to p*0ase a Passive Radar or Multilateration system for use at MSP has been raised. Bill Kilian, City of Richfield, noted that he recently had the opportunity to observe the system currently utilized by San Francisco International Airport and that community members are able to access flight track information within 10 minutes. Staff at SFO indicated to Kilian that anecdotal evidence indicates the number of noise complaints was reduced. because residents were able to access flight track information quickly. Kilian noted that, specifically, residents could determine whether or not flights were directly over their homes and determine the reasons for various flight phenomena. Kilian stated that it appeared that when residents were able to answer their own questions without the frustration of waiting for a response they were more tolerant of noise issues. Leqve noted that virtually all of the same information, with the exception of a few elements of functionality, provided by the type of system used at SFO is available on the MAC Noise Office web,s'ite with the difference being that the majority otthe MAC's system was developed in-house. In comparison, at the majority of airports, such functionality is the result of an expensive contract with a vendor. Leqve stated that one thing that can't be addressed in-house, however, is data accessibility timeframes. RECEIVE ORFIELD NOISE MONITORING ANALYSIS City Administrator Hedges introduced this item and provided background on the City's efforts to determine community noise impacts and changes related to the operation of the new north -south 17/35 Runway. City Administrator Hedges introduced Administrative Intern Ziemer who provided additional background regarding the purpose of the study, the results at the various monitoring sites, and introduced Elliot Dick of Orfreld Laboratories. Mr. Dick presented the raw data collected from the Phase 11 study and a detailed analysis of the comparison of the Phase I and Phase II studies. He sited numerous factors including a change in the number of total flights between the two phases, the mix of arrivals and departures, and location within Eagan that make. definitive conclusions difficult. In general, the use of noise averaging which is the official . methodology in place at this time and is used for compliance studies, results in very little difference in noise levels between the two Eagan studies. In response to City Council suggestions that that conclusion does not match community experiences, Mr. Dick and Steve Orfreld explained in more detail how the methodology used generates a measurement of noise averages over time while noise to citizens is an event. They also noted that a noise event may have an annoyance factor much higher than what would be expected from an average noise level and that the earlier Wyle Laboratories work was a compliance study. After considerable discussion about the effectiveness of the information that was gathered, its potential limitations in explaining noise events to the community, and whether or not more useful data could be extrapolated from the report, the City Council accepted the report. Further, the City Council directed the Airport Relations Commission to: 1) study the noise impacts on various sites in more detail; 2) to determine whether or not better compliance standards could be promoted through legislation; 3) to determine other ways to influence the collection of more useful data; and 4) to review the options available to Eagan to gather and/or extrapolate data to distribute information that would be meaningful to the community. IV. RECEIVE UPDATE ON PRELIMINARY PREPLANNING EFFORTS TO ENSURE CONTINUITY OF GOVERNMENT OPERATIONS — MANAGE THE PANDEMIC EVENT City Administrator Hedges introduced this item and presented background on the staff planning that is underway for a possible Avian Influenza Pandemic. Chief of Police McDonald provided an overview to the City Council including a brief history of Avian Flu, the assumptions as developed by the Minnesota Department of Public Safety being used as a basis for City planning efforts, and a synopsis of City actions to date. In response to a question from Mayor Geagan Chief McDonald reported that the plan being developed for the potential Avian Flu Pandemic would not replace the City's existing Emergency Preparedness Plan but would be a mini -plan to augment it. V. REVIEW PROPOSED BURNSVILLE / EAGAN. COMMUNITY TELEVISION (BELT) 2007 OPERATING BUDGET City Administrator Hedges presented the background information on the development of the Burnsville/Eagan Community Television 2007 Operating Budget and the requested action for the meeting. Director of Communications Garrison outlined specifics of the budget including the assumption that activities would continue as usual and the potential for Federal Government action that would potentially disrupt that assumption. He also pointed out the present need for capital spending to maintain a functional system and the progress on the one year lease for the facility as previously directed by the two cities. Director Garrison pointed out the fund balance projections and the future need for more revenue to include additional partnerships. Development of additional revenue sources remains a priority in the 2007 work plan. The City Council directed staff to place the proposed 2007 Burnsville/Eagan Community Television Budget on a future regular City Council meeting consent agenda for formal ratification. VI. RECEIVE AN UPDATE ON THE 2008 COMPREHENSIVE PIAN UPDATE City Administrator Hedges provided background on the status of the 2008 Comprehensive Plan Update and outlined a process for a review of the update as developed to date and presented in the packet. City Administrator Hedges noted that staff did not plan to make a formal presentation and would primarily respond to questions, although a more detailed presentation was contemplated for the surface water management element of the Plan.
