SUBJECT: AGENDA INFORMATION
After approval is given to the November 12, 1985, minutes of
a Special Joint Meeting of the Eagan APC and City Council, the
regular minutes of the November 19, 1985, regular City Council
meeting and the minutes of the November 21, 1985, Special City
Council meeting, action is in order to consider the agenda for
the December 3, 1985, City Council meeting.
.MRPA-r.AW- ARD:
Recently, Roger Martin, Chairman of the Advisory Parks & Recreation
Commission, and Carolyn Thurston, its vice -chair, were recipients
of a special MRPA Award. A representative of the MRPA will
be present at 6:30 this coming Tuesday to make a brief, but
formal, presentation of the Award to both Roger and Carolyn.
There is no action to be considered on this item.
Our Metropolitan Council Representative, Mary Martin, was unable
to attend the November 19, 1985, City Council meeting due to
a conflict in her scheduling. Mary is planning to attend Tuesday
night's meeting and will discuss issues that are pertaining
specifically to barge movement on the Minnesota River and metro-
politan impact relating to the proposed mega -mall to be located
in the city of Bloomington. Other questions relating to the
Metropolitan Council are certainly in order for discussion by
the City Council.

The City's Director of Parks & Recreation is extremely pleased
with the work that was performed by Central Landscaping, Inc.,
and is recommending that the City accept perpetual maintenance
and make the final payment to that contractor as specified.

CHANGE ORDER #1, CITY PROJECT 85-24
C. Change Order #1, City Project 85-24 in the Amount of $1,745 --The
Director of Parks & Recreation is recommending a change order
to provide payment to People's Electric Contractors for costs
incurred for additional materials and labor on improvement contract
85-24 for lighting of athletic fields at -Goat Hill and Ridge
Cliff Parks. This work includes added trenching and placement
of a 4 -inch conduit under an existing 8' bituminous trail, with
the addition of concrete pads and oversizing of an electrical
service panel for the baseball field at Goat Hill Park.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve Change Order
#1 to City Project 85-24 in the amount of $1,745 to People's
Electric Contractors.
COOPERATIVE PURCHASE AGREEMENT FOR CITY VEHICLES
D. Cooperative Purchasing Agreement for City Vehicles --There
were 5 automobiles approved in the 1986 Budget for use as City
pool cars by Departments located at the City Hall. The City
is able to purchase through the Hennepin County Cooperative
Purchasing Agreement Chevrolet Celebrities in the amount of $9,848
with vehicle rust proofing at $110 each, for a total price of
$9,958. This action is being requested of the City Council prior
to January 1 due to the fact that bids are only effective until
December 9 under the Hennepin County Cooperative Purchasing arrange-
ment.
Technically the City has not formally adopted the 1986 Budget,
however, purchase of these vehicles were authorized by direction
given to the City Administrator for final preparation and develop-
ment of the 1986 operating budget which will be considered at
the next regular City Council meeting.
ACTION TO BE CONSIDERED ON THIS ITEM: To consider an appropriation
for suppling five vehicles for the City of Eagan through the
Hennepin County Cooperative Purchasing Agreement to Viking Chevrolet
in the amount of $9,958 for Chevrolet Celebrities.

FEASIBILITY REPORT/PUBLIC HEARING/DEERWOOD DRIVE
E. Project 455, Present Feasibility Report/Order Public Hearing
(Deerwood Drive) -- In response to a petition received from
Independent School District #196, a feasibility report has been
prepared for the proposed upgrading of Deerwood Drive from Lexington
Avenue to I -35E in anticipation of the new proposed elementary
school site to be located along this segment. This feasibility
report has now been completed and is being presented to the
Council for their review and consideration of scheduling a public
hearing to be held January 21, 1986.
ACTION TO BE CONSIDERED ON THIS ITEM: To receive the feasibility
report for Project 455 (Deerwood Drive - Streets and Utilities)
and schedule the public hearing to be held January 21, 1986.
FINAL PAYMENT/ACCEPTANCE/1985 SEAL COATING
F. Contract 85-17, Final Payment/Acceptance (1985 Seal Coating)
-- The final inspections in compliance with the specifications
for the above -referenced contract have now been completed and
is in :order for formal acceptance and authorization of final
payment to the contractor for the seal coating program performed
in 1985. Due to the fact that an overpayment was discovered
to the same contractor for the City's seal coating performed
under Contract 84-6, this final payment reflects a deduct for
the previous overpayment of $3,211..77.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the second
and final payment for Contract 85-17 (1985 seal coating) in
the amount of $5,642.67 to Allied Blacktop and accept this improve-
ment for perpetual maintenance.

EASEMENT ACQUISITION/PAYMENT WELLS #8 & #9
G. Project 457, Easement Acquisition/Payment (Wells #8 & #9)
-- With- the proposed development of Wells #8 and #9 under Project
457, it is necessary to acquire the appropriate easements for
the water transmission lines as well as the site location for
the pumphouse and wells. In accordance with our Comprehensive
Water Supply and Distribution Plan, the appropriate location
for Wells #8 and #9 are within the proposed Royal Oaks 2nd Addition
as a part of our main well field development. Through the coopera-
tion of the developer of the proposed Royal Oaks 2nd Addition,
the City was able to negotiate the acquisition of all permanent
and temporary construction easements for this facility in the
amount of $4,000. Payment for the acquisition of 0.49 acres
of permanent easement and 0. 25 acres of temporary easement is in accordance
with the City's acquisition rates for easements and rights-of-way
which are above the typical requirements of subdivision development.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the payment
of $4,000 for the acquisition of easements for Project 457 (Wells
#8 and #9) and authorize the Mayor and City Clerk to execute
all related documents.
FINAL PAYMENT/ACCEPTANCE/1984 SEAL COATING
H. Contract 84-6, Final Payment/Acceptance (1984 Seal Coating)
-- In researching the appropriate files, it was discovered that
a final payment and .formal acceptance for the 1.984 seal coating
program has never been officially processed. It has also been
discovered that the contractor was inadvertently paid for the
final street sweeping operations which were performed by Public
Works Maintenance personnel. Due to the fact that this contract
provided for a specific cost associated with this operation,
an overpayment has been accurately defined in the amount of
$3,211.77. This overpayment has been deducted from the final
payment for Contract 85-17 due to the fact that the same contractor
held both contracts. Subsequently, it is necessary for formal
Council action to approve the final payment reflecting the deduct
and to formally accept the project for perpetual maintenance.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the second
and final payment for Contract 84-6 incorporating a deduct of
$3,211.77 to be applied to the final payment for Contract 85-17
and to accept the project for perpetual maintenance.

Z Final Plat Approval, Royal Oak Circle 2nd Addition (Asp Con-
struction Company, Inc.) --We have received an application for
final plat approval for the 2nd phase development of the Royal
Oak Circle multifamily development complex being constructed
of the Surrey Heights Addition and west of Federal Drive. All
conditions placed on the preliminary plat approval of December
18, 1984, have been complied with and all final plat application
materials have been submitted, reviewed by staff and found to

J Final Plat Approval, Lexington Square 2nd Addition (Meritor
Development) --We have received an application for final plat
approval for the second phase development of the Lexington Square
Addition located south of Wescott Road and east of Lexington
Avenue. All conditions placed on the preliminary plat approval
of March 22, 1984, have been complied with. In addition, all
final plat application materials have been submitted, reviewed
by staff and found to be in order for favorable Council action.

K. Vacate Public Right -of -Way (Blue Gentian Road), Receive Peti-
tion/Order Public Hearing --We received a petition to vacate that
portion of Blue Gentian Road lying west of T.H. 149 which was
relocated due to the construction of I-494.
ACTION TO BE CONSIDERED ON THIS ITEM: To receive the petition
requesting the vacation of public right-of-way (Blue Gentian
Road) and schedule the public hearing to be held January 7, 1986.
FINAL PAYMENT/ACCEPTANCE/GOLDEN MEADOW RD.
L. Contract 85-6, Final Payment/Acceptance (Golden Meadow Road
- Streets & Utilities) -- We have received a request for final
payment for the above -referenced contract from our consulting
engineering firm along with a certification of compliance with
City approved plans and specifications for the installation
of streets and utilities along Golden Meadow Road. All final
inspections have been performed by representatives of the Public
Works Department and the project has been determined to be ready
for final acceptance and perpetual maintenance.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the fourth
and final payment for Contract 85-6 (Golden Meadow Road) in
the amount of $14,084.73 to Ceca Utilities, Inc., and accept
for perpetual maintenance.

CONSIDERATION OF PROPOSED HOUSING POLICY REPORT
A. Public Hearing for Consideration of Proposed Housing Policy
Report of the Dakota County Housing & Redevelopment Authority
-- In order for the City Council to consider a specific revenue
bond program for a first-time home buyer, regulations have been
enacted by Congress that require consideration of a proposed
policy report of the Dakota County Housing and Redevelopment
Authority. According to federal statutes, a public hearing
must be held by the City of Eagan to consider a proposed policy
report of the Dakota County Housing and Redevelopment Authority
as the entity authorized the issue of qualified mortgage bonds
on behalf of the City and other cities in Dakota County. The
Notice of Public Hearing is to be published by the mayor of
the city, among others, and contain a statement of the policies
regarding housing, development and low income housing assistance
to be followed by the Authority's issuing qualified mortgage
bonds and mortgage credit certificates. Essentially, the proposed
policy report concludes that the HRA has complied during the
1 -year period preceding this report with the intent of Congress
that the HRA use its authority to issue qualified mortgage bonds
and mortgage credit certificates to the greatest extent feasible
to assist lower income families in affording home ownership
before assisting higher income families. A policy statement
report is a good -faith audit on the part of the City of the
County's HRA, which becomes the issuing authority.
It has been the City staff's observation that the HRA does make
every effort to provide mortgages to assist lower income families
and, therefore, is in compliance with requirements of the Internal
Revenue Code causing their policy report to be consistent.
ACTION TO BE CONSIDERED ON THIS ITEM: After opening the public
hearing and considering any public input, a motion is in order to
consider a resolution_ certifying that the Dakota County HRA is in
conformance with the intent of their policy report.

HOMEBUYER PROGRAM/$10,000,000 REVENUE BONDS
B. Public Hearing for Consideration of the Dakota County Housing
& Redevelopment Authority Issuance of $10,000,000 in Revenue
Bonds for a First -Time Homebuyer Program -- The City has been
given an opportunity through the Dakota County Housing & Redevelop-
ment Authority to again provide mortgages available to first-time
homebuyers that are lower than the market rate. This is made
possible by issuing tax exempt bonds according to a program
that has been established by the Dakota County Housing & Redevelop-
ment Authority. The restrictions that were placed in the first-time
homebuyer pro ram document, a copy is enclosed for your review
on pages through 3,49 1 are the same restrictions that
were place in the 1981 program. Please review pages 12-20
(page numbers of the document) for a specific reference to the
criteria of the program. These pages discuss the amount of
monies available to make mortgage loans for first-time homebuyers,
how the mortgage loans are structured, the formula for adjusted
gross income and several other criteria. Mr. Mark Ulfers and
a representative of Miller & Schroeder Municipals, Inc., will
be present to answer any questions regarding the program.

1985 SINGLE FAMILY MORTGAGE REVENUE BOND PROGRAM

SINGLE FAMILY MORTGAGE REVENUE BOND PROGRAM
FOR THE CITY OF EAGAN
Minnesota Statutes, Chapter 462C, as amended (the "Act"),
authorizes a city, or a housing and redevelopment authority
designated by and acting on behalf of a city to develop and
administer programs of making or purchasing mortgage loans to
finance the acquisition, by low and moderate income persons and
families, of single family housing located anywhere within its
boundaries. The City of Eagan (the "City") has by ordinance
authorized the Dakota County Housing and Redevelopment
Authority (the "Authority) to exercise on behalf of the City
all powers conferred on the City pursuant to Minnesota Statute,
sections 462C.01 through 462C.07, provided that the City
reserved the right to hold public hearings required by the Act
and to approve any housing plan or program prior to submission
to either the Metropolitan Council or the Minnesota Housing
Finance Agency.
In creating this single family housing finance program for
the City, the City Council has found and determined that the
preservation of the quality of life in the City is dependent
upon the maintenance and provision of adequate, decent, safe
and sanitary housing stock; that accomplishing the provision of
such housing stock is a public purpose and will benefit the
residents of the City; that a need exists within the City to
provide in a timely fashion additional affordable housing to

persons of low and moderate income residing and expected to
reside in the City; that a need exists for mortgage credit to
be made available for both existing housing and for the new
construction of additional single family housing; and that many
owners of single family housing units are unable to sell such
units and would-be purchasers of single family housing units
either cannot afford mortgage credit at the market rate of
interest or cannot obtain mortgage credit because the mortgage
market is severely restricted.
The Authority, in preparing this housing finance program
on behalf of the City, has considered the information contained
in the Housing Plan of the City, including particularly (i) the
availability and affordability of other government housing
programs; (ii) the availability and affordability of private
market financing for the acquisition of existing and newly
constructed single family housing units; (iii) an analysis of
population and employment trends and projections of population
and employment needs; (iv) recent housing trends and future
housing needs in the City; and (v) an analysis of how the
program will meet the needs of low and moderate income persons
and families residing and expected to reside in the City.
The Authority has further considered (i) the amount,
timing and manner of sale of bonds to finance the estimated
amounts of mortgage loans to be made under the program, to fund
the appropriate reserves and to pay the costs of issuance;
(ii) the number and qualifications of lenders eligible to
participate in the program; (iii) the method for monitoring the

implementation by participants to insure that the program will
be consistent with the Housing Plan; (iv) the administrative
capacity of the Authority and other methods of administering,
servicing and supervising the program; (v) the cost of the
program to the Authority, including future administrative
expenses; (vi) the restrictions on the purchase prices of
housing units to be financed under the program; (vii) the
limits on income of persons or families receiving financing
under the program; and (viii) certain other limitations.
Section 1. Definitions.
The following terms when used in this program shall have
the following meanings, respectively:
( 1) "Acquisition Fund" shall mean that fund to be created
under an indenture,of trust or similar agreement
between the Authority and a Trustee for holders of
the Bonds into which shall be credited certain
proceeds of the Bonds and other funds, if any, and
from which the Authority shall purchase Mortgage
Loans qualified for purchase under the Program.
( 2) "Act" shall mean Minnesota Statutes, Chapter 462C as
currently in effect and as the same may be from time
to time amended.
( 3) "Adjusted Gross Income" shall mean Gross Family
Income, less $750 for each Adult in the family, to a
maximum of two Adults, and less $500 for each other
Dependent in the family.
( 4) "Adult" shall mean anyone who has attained a legal
age of majority -under Minnesota law but who is hot a
Dependent.
( 5) "Affiliate" of any specified Person shall mean any
other Person directly or indirectly controlling or
controlled by or under direct or indirect common
control with such specified Person. For purposes of
this definition, control, when used with respect to
any specified Person, shall mean the power to direct
the management and policies of such Person, directly
or indirectly whether through the ownership of voting
securities, by contract or otherwise.
( 6) "Agency" shall mean the Minnesota Housing Finance
Agency, or any successor to its functions under the
Act.
( 7) "Authority" shall mean the Dakota County Housing and
Redevelopment Authority acting on behalf of the City.
( 8) "Bonds" shall mean the revenue bonds to be issued by
the Authority to finance the Program.
( 9) "City" shall mean the City of Eagan, State of
Minnesota.
(10) "City Council" shall mean the governing body of the
City.
(11) "Commencement Date" shall mean the later of (a) first
day on which the Authority has Bond proceeds avail-
able to purchase Mortgage Loans under the Program, or
(b) for New Housing Units to be purchased with
Oma/
Mortgage Loan proceeds, the date on which pre -sale
efforts to market New Housing Units has commenced.
(12) "Dependent" shall mean dependent, as defined in
Section 152 of the Internal Revenue Code of 1954, as
amended, and the regulations thereunder.
(13) "Developer" shall mean any Person engaged in the
construction for sale of Housing Units, and any
Affiliate of such Person.
(14) "FHA" shall mean the Federal Housing Administration,
an agency of the United States of America within the
United States Department of Housing and Urban
Development, or any successor to its functions.
(15) "FHLMC" shall mean the Federal Home Loan Mortgage
Corporation, or any successor to its functions.
(16) "FNMA" shall mean the Federal National Mortgage
Association, or any succcessor to its functions.
(17) "Gross Family Income" shall mean the current annual
income from all sources of the Mortgagor, his or her
spouse, and any guarantor or co-owner of a fee
interest in the Housing Unit to be financed with the
proceeds of a Mortgage Loan as determined in
accordance with the then current loan origination
requirements of FHLMC, FNMA, FHA or VA as to Mortgage
Loans originated under programs regulated by FHLMC,
FNMA, FHA or VA, or as to a conventional Mortgage
Loan by the Qualified Mortgage Guaranty Insurer
insuring such Mortgage Loan, as the case may be, as
verified by an Originator in accordance with such
requirements and its customary underwriting practices.
(18) "Housing Plan" shall mean the Housing Plan of the
City, as adopted by the City Council on ,
and any amendment thereof.
(19) "Housing Unit" shall mean residential real property
and facilities functionally related and subordinate
thereto securing a Mortgage Loan, which shall be a
private detached or attached one- two- three- or
four -unit family dwelling, or a one -family apartment
under condominium ownership (as defined in Minnesota
Statutes, Chapter 515A), not including a mobile home
or trailer even if attached to a permanent
foundation, including a New Housing Unit, owned and
occupied by an individual or family as a principal
residence (or, if the Housing Unit contains more than
one dwelling unit, one of such dwelling units is
owned and occupied by an individual or family as a
principal residence), containing complete living
facilities and located within the geographical
boundaries of the City.
(20) "Lending Institution" shall mean any bank, trust
company, savings bank, national banking association,
savings and loan association, building and loan
association, mortgage bank or other mortgage lender
or governmental agency which customarily makes or
services mortgage loans on owner -occupied residential

housing, or any holding company for any of the
foregoing, provided, however, such Lending
Institution is approved by FHA, VA, FNMA or FHLMC or
is approved by the Authority.
(21) "Mortgage Insurer" shall mean the FHA, the VA or any
Qualified Mortgage Guaranty Insurer.
(22) "Mortgage Loan" shall mean an interest bearing loan
to a Mortgagor for the purpose of purchasing a
Housing Unit, evidenced by a promissory note and
secured by a mortgage on such Housing Unit.
(23) "Mortgagor" shall mean an individual or individuals
who have received a Mortgage Loan.
(24) "New Housing Unit" shall mean a newly constructed
Housing Unit, to which the Mortgagor will be the
first owner occupant.
(25) "Origination Agreement" shall mean a written
agreement between an Originator and the Authority
under which the Originator agrees to originate and
sell to the Authority and the Authority agrees to
purchase Mortgage Loans pursuant to this Program.
(26) "Originator" shall mean a Lending Institution which
executes an Origination Agreement as an originator.
(27) "Originator Commitment" shall mean a written
commitment by an Originator to the Authority, in a
form acceptable to the Authority, by which the
Originator agrees, upon certain terms and conditions,
to enter into an Origination Agreement.
(28) "Person" shall mean any individual, corporation,
partnership, joint venture, association, joint-stock
company, trust, unincorporated organization or
government or any agency or political subdivision
thereof.
(29) "Pledged Savings Account" shall mean a savings
account established in connection with a Pledged
Savings Account Mortgage Loan, which savings account
and the earnings thereon may be used to make payments
on the Mortgage Loan any time during the initial
years of its amortization period and which is pledged
as security for the Pledged Savings Account Mortgage
Loan.
(30) "Pledged Savings Account Mortgage Loan" shall mean a
Mortgage Loan originated pursuant to any plan
approved by the Program Administrator, for which a
portion of the principal and interest payments during
the initial years of such Mortgage Loan are expected
to be paid from a Pledged Savings Account.
(31) "Program" shall mean this single family housing
finance program authorized by the City and to be
implemented by the Authority pursuant to the Act.
(32) "Program Administrator" shall mean any Lending
Insitutution which agrees in writing with the
Authority to monitor the origination and servicing of

Mortgage Loans sold to the Authority under the
Program or to service all such Mortgage Loans, and to
perform such other functions as are agreed upon by
such Program Administrator and the Authority.
(33) "Project" shall mean a development of New Housing
Units, including condominiums or townhouses
constructed by a Developer, and including
condominiums or townhouses constructed by a Developer
for individuals who may sell their existing Housing
Units to persons who will finance the purchase of
such existing Housing Units with Mortgage Loans made
available by the Program.
(34) "Qualified Mortgage Guaranty Insurer" shall mean any
mortgage guaranty insurance company approved by FNMA
or FHLMC, which is licensed to do business in the
State of Minnesota and (i) whose insurance policies
would not adversely affect the rating on the Bonds
with the rating agency which initially rated the
Bonds or (ii) is rated by such agency on the basis of
claims payment ability at the highest rating then
given insurers issuing mortgage guaranty insurance
policies, so long as such agency rates such insurers
on the basis of claims payment ability.
(35) "Target Area" shall mean a targeted area as defined
in Section 462C.02, Subdivision 9 of the Act, as such
Target Areas may exist on the Commencement Date, or
as may thereafter be established.
(36) "VA" shall mean the Veterans Administration, an
agency of the United States of America, or any
successor to its functions.

Section 2. Program for Acquisition of Mortgage Loans.
The City hereby establishes a Program for the Authority to
acquire Mortgage Loans by contracting with Originators to
Purchase Mortgage Loans from Originators at such purchase
prices and upon such other terms and conditions described
herein or as shall be determined by the Authority in
Origination Agreements to be entered into between the Authority
and Originators. In establishing and carrying out such Program
the Authority may exercise, within the corporate limits of the
City, any of the powers the Minnesota Housing Finance Agency
may exercise under the provisions of Minnesota Statutes,
Chapter 462A.
Insofar as the Authority has or will contract with
underwriters, financial advisors, legal counsel, a Program
Administrator and a trustee, all of whom will be reimbursed
from Bond proceeds and continuing Program revenues, it is not
expected that additional staff will be necessary to implement
the Program, nor is it expected that any additional staff costs
need be paid from the Authority's budget. The Program
Administrator will administer the performance of the
Originators with respect to the limitations set forth in this
Program, and will monitor the Originators' servicing of the
Mortgage Loans or will itself service the Mortgage Loans. The
Authority will select a trustee for the bondholders who will be
required to be experienced in trust management and has a large
corporate trust portfolio. The trustee will administer and
maintain the Bonds sold to finance the Program.

The Executive Director of the Authority will monitor all
negotiations between the various parties taking part in the
Program to insure that the Program documents are consistent
with the Housing Plan and the Program. Prior to the adoption
of the resolution authorizing the sale of Bonds to finance the
Program, the Executive Director shall report to the Board of
Commissioners of the Authority his findings as to the
consistency of the Program documents with the Housing Plan and
the policies of the City contained in this Program.
Section 3. Non -Bond Proceeds to be Contributed to the Procram
To assure the financial feasibility of the Program and to
assure that interest rates on the Mortgage Loans will be as
favorable as possible to purchasers of Housing Units, as well
as to assure the completion of Projects intended to be
benefited by the Program, the Authority may commit various
revenues and other resources to the Program.
Section 4. Standards and Reeuirements Relating to Mortgage
Loans Pursuant to the Program.
The following standards and requirements shall apply with
respect to Mortgage Loans acquired by the Authority pursuant to
the Program:
( 1) A Mortgage Loan may be made only to finance the
purchase of a Housing Unit existing at the time such
Mortgage Loan is made. Construction loans shall not
be made, but an Originator may enter into an
agreement with a Mortgagor to make a Mortgage Loan to
him or her upon the completion of the construction of
a New Housing Unit to be financed by such Mortgage
Loan, subject to the "first-come, first-served" and
nondiscrimination basis requirements of Section 4 (2)
hereof, and subject to the receipt of a certificate
of a City building inspector stating that the New
Housing Unit complies with the building code
requirements of the state building code, set forth
under Minnesota Statutes, Sec. 16.83 et seq., as they
are then in effect.
( 2) Each Originator shall accept and process applications
for Mortgage Loans for the purchase or construction
of Housing Units on a nondiscriminatory "first-come,
first-served" basis, subject to the other provisions
of the Program, including any set asides and
restrictions imposed by Section 5 hereof, and will
not arbitrarily reject an application for a Mortgage
Loan for a Housing Unit within a specified geographic
area because of the location and/or age of the
property, or, in the case of a proposed Mortgagor,
arbitrarily vary the terms of a loan or the
application procedures therefore because of race,
color, creed, religion, national origin, sex, marital
status, age or status with regard to public
assistance or disability.

( 3) The Mortgagor of each Housing Unit must be the fee
owner of such Housing Unit and must occupy such
Housing Unit or, if the Housing Unit contains more
than one dwelling unit, one of such dwelling units as
his or his principal place of residence.
( 4) At least ninety percent (90%) of the moneys available
to make Mortgage Loans shall be used to purchase
Mortgage Loans made to first-time
homebuyers,including Mortgagors who have not owned a
home during any part of the three (3) years prior to
the date of closing of th mortgage Loan. Up to ten
percent (10%) of the moneys available to make
Mortgage Loans may be used to purchase Mortgage Loans
made to persons or families who are not first-time
homebuyers including those who have owned a home
during some part of the three (3) years prior to the
date of closing of the Mortgage Loan, provided they
meet all other requirements of the Program.
( 5) Mobile homes and trailers are not Housing Units for
purpose of the Program, even if such mobile homes and
trailers are attached to permanent foundations.
( 6) Each Housing Unit must be located within the
corporate limits of the City.
( 7) Loans must be made only to finance homes that are
serviced by municipal water and sewer utilities.
( 8) The purchase price of a Housing Unit may not exceed
the lesser of (a) three times the limit on Adjusted
Vol
Gross Income of the Mortgagor set forth in Section 4
(12); (b) four times the Adjusted Gross Income of the
mortgagor if the Housing Unit is located within a
Target Area or (c) 110% of the average area purchase
price for residential housing in the Minneapolis -St.
Paul Standard Metropolitan Area computed as provided
under the Proposed Treasury Regulations or any final
regulations promulgated under Section 103A of the
Internal Revenue Code of 1954, as amended.
( 9) Each Mortgage Loan must, at a minimum, be insured or
guaranteed if the original principal amount of the
Mortgage Loan exceeds (or is expected at any time to
exceed) 75% of the lesser of the purchase price or
appraised value of the property subject to the
related Mortgage , with either (i) FHA Insurance,
(ii) a VA Guaranty or (iii) a Mortgage Guaranty
Insurance Policy.
(10) The Adjusted Gross Income of a Mortgagor at the time
of application for a Mortgage Loan shall not exceed
the greater of:
( i) 110 percent of the median family income as
estimated by the United States Department of
Housing and Urban Development for the
Minneapolis -St. Paul Standard Metropolitan
Area; or
( ii) 100 percent of the income limit established by
the Minnesota Housing Finance Agency for the
City.

Provided that, beginning six (6) months after
the Commencement Date, up to twenty -percent
(20%) of the amount of bond proceeds deposited
in the Acquisition Fund may be used to
purchase Mortgage Loans made to Mortgagors
with Adjusted Gross income in excess of the
amount set forth above who are purchasing
Housing Units located within a Target Area.
(11) For the first six (6) months after the Commencement
Date, 100% of the funds provided for the purchase of
Mortgage Loans may be made or committed only to
Mortgagors with Adjusted Gross Incomes at the time of
application of less than eighty percent (80%) of the
limit set forth in Section 4 (11).
(12) To the extent required by the Act or other applicable
laws or to preserve the exemption of interest on the
Bonds from federal or state income taxation, the
assumption of a Mortgage Loan from a Mortgagor by any
other person or persons shall be permitted only if
the requirements of Sections 4(4), 4(8), and 4(3) are
met with respect to the assumption.
(13) An Originator may be allowed to retain from a
Mortgagor or seller an origination fee not exceeding
one and one-half percent (1-1/2%) (or such greater or
lesser amount as shall be specified by the Authority
in the Origination Agreements) of the principal
amount of the Mortgage Loan. In addition, each

Mortgagor may be charged a program participation fee
of two percent (2%) of the original principal amount
of a Mortgage Loan, or such greater or lesser amount
as shall be specified by the Authority, all or a
portion which may be deferred and made payable with
(and in addition to) the last installment of
principal and interest due on such Mortgage Loan,
whether at the scheduled final maturity of such
Mortgage Loan or at its prepayment in full prior to
its final maturity. A Developer and/or Seller of a
Housing Unit may also be charged an additional
origination fee, which fee may be used to defray
Program costs.
(14) The City hereby requests a waiver by MHFA of the
restrictions of Section 462C.03, Subdivision 5 of the
Act. Failure by the MHFA to reject this program will
be deemed to constitute approval of such waiver.
(15) The difference between the interest rate on Mortgage
Loans and the interest rates on the Bonds issued to
acquire such Mortgage Loans shall represent only the
costs of insurance premiums, amortized expenses of
issuing the Bonds, the Authority's ongoing costs for
the administration of the Program, fees of
originating, servicing, and administering the
Mortgage Loans and trustee and paying agent fees,
computed so as to provide that the Bonds shall not be
deemed to be "arbitrage bonds" under the Proposed

Regulations or any final regulations promulgated
under Section 103A of the Internal Revenue Code of
1954, as amended.
(16) In the event that the Authority acquires any existing
residences in the City, with the intention of
demolishing such residences and making the cleared
sites available for the construction of New Housing
Units, the Authority will make available to qualified
residents of the residences so acquired any
relocation assistance and benefits required to be
provided pursuant to Minnesota Statutes, Section
117.52 et seq.
(17) Sellers of existing homes will be required to pay to
have their homes inspected by a licensed truth in
housing evaluator in accordance with the Dakota
County Authority's regulations, as they exist at the
time of sale.
Section 5. Set Asides and Restrictions Relatint, to the
Acquisition of Mortgaa e Loans.
Notwithstanding anything in Section 3 to the contrary, the
following restrictions shall apply with respect to Mortgage
Loans acquired by the Authority pursuant to the Program:
( 1) The Authority may permit commitments to be made by
Originators to (a) Developers to provide Mortgage
Loans on New Housing Units to be constructed by such
Developers, or (b) Developers who will provide

Mortgage Loans for homebuyers purchasing existing
Housing Units owned by the purchasers of Housing
Units in the Developer's Project. Developers and
Originators may be charged a commitment fee for such
set asides, which fee may be used to defray Program
costs. No more than seventy-five percent (75%) of
the moneys deposited in the Acquisition Fund may be
used to purchase Mortgage Loans for New Housing Units
built or sold by any one Developer.
( 2) The Authority will enter into an Origination
Agreement with each Originator proposing to originate
Mortgage Loans pursuant to the Program. Each
Origination Agreement shall specify the dollar amount
of the Originator Commitment, provided that no more
than seventy-five percent (75%) of the moneys
deposited in the Acquisition Fund may be used to
purchase Mortgage Loans from any one Originator,
unless other eligible Lending Institutions are not
interested in participating.
( 3) Any Financial institution, as defined in Minnesota
Statutes, Section 47.0151, doing business in the City
which is an FHA/VA approved or FNMA/FHLMC approved
lender shall be offered an opportunity to participate
in the Program as an Originator.
( 4) For the first 12 months or such greater or lesser
time as shall be specified by the Authority after the
Commencement Date, ten percent (10%) of the amounts

deposited in the Acquisition Fund may be reserved for
non -first-time homebuyers who purchase a Housing Unit
in a Project. If, after 12 months or such greater or
lesser time as shall be specified by the Authority,
any funds so set aside have not been used to purchase
Mortgage Loans, they may be used by non -first-time
homebuyers purchasing any Housing Units in the City.
( 5) For the first nine (9) months or such greater or
lesser time as shall be specified by the Authority
after the Commencement date, no more than twenty
percent (20%) of the amounts deposited in the
Acquisition Fund may be used to acquire Mortgage
Loans for Housing Units under townhouse ownership.
At the end of such nine-month period, moneys
remaining in the Acquisition Fund may be used to
acquire any qualified mortgage loan.
( 6) For the first nine (9) months or such greater or
lesser time as shall be specified by the Authority
after the commencement date, no more than twenty
percent (20%) of the amounts deposited in the
Acquisition Fund may be used to acquire Mortgage
Loans for Housing Units under condominium ownership.
At the end of such nine-month period, moneys
remaining in the Acquisition Fund may be used to
acquire any qualified mortgage loan.
Section 6. Evidence of Compliance.
The Authority may require from each Originator, at or
before the time an agreement to originate Mortgage Loans is
entered into by such Originator, evidence satisfactory to the
Authority of the ability and intention of such Originator to
make Mortgage Loans and sell them to the Authority under such
agreement, and, at the time the Authority acquires a Mortgage
Loan, evidence satisfactory to the Authority of compliance with
the standards and requirements for the making of Mortgage Loans
established by the Authority herein and in any agreement
entered .into between the Authority and the Originator; and in
connection therewith, the Authority or its representatives,
including the Program Administrator, may inspect the relevant
books and records of such Originator in order to confirm such
ability, intention and compliance.
Section 7. Issuance of Bonds
To finance the Program the Authority, on behalf of the
City intends by resolution to authorize, issue and sell by
December 31, 1986 its Single Family Mortgage Revenue Bonds in
an aggregate principal amount up to $10,000,000, of which
approximately $9,000,000 will be -available to purchase Mortgage
Loans. The balance of Bond proceeds will be used to pay
underwriting costs, to fund a reserve fund for the Bonds and to
pay Bond issuance costs. Principal of and interest on the
Bonds shall be payable solely from the proceeds of the Bonds
and the revenues of the Program. The Authority shall enter

into an indenture of trust with an institution authorized to
accept such trusts and which is experienced in trust management
and has a large corporate trust portfolio, upon such terms and
conditions as the Board of Commissioners of the Authority shall
determine, being advised thereon by bond counsel. In issuing
Bonds, the Authority may exercise, within the corporate limits
of the City, any and all of the powers the Minnesota Housing
Finance Agency is authorized to exercise under the provisions
of Minnesota Statutes, Chapter 462A, without limitation under
the provisions of Minnesota Statutes, Chapter 475.
Section 8. Severability.
The provisions of this Program are severable, and if any
of its provisions, sentences, clauses or paragraphs shall be
held unconstitutional, contrary to statute, exceeding the
authority of the City or the Authority or otherwise illegal or
inoperative by any court of competent jurisdiction, such defect -
shall not affect or impair any of the remaining provisions.

FINAL RESOLUTION/MULTIFAMILY HOUSING FOR
ROYAL OAK CIRCLE PROJECT
C. Public Hearing to Consider Final Resolution to the $12,580,000
Multifamily Housing Revenue Bond/Royal Oak Circle Project --Miller
& Schroeder Financial Inc., the City's program administrator
for multifamily housing revenue bonds, has received a request
from Richard Asp of Asp Construction Company, developer of the
Royal Oak Circle project, requesting final approval to a $12,580,000
multifamily housing revenue bond project. For a location identifi-
cation, a copy of the final plat is enclosed on page fAG for
your review. Normally, a final resolution does not require a
public hearing; however, the applicant is requesting an increase
in the housing revenue bond amount to be approved by the City.
The original inducement resolution was approved by the City Council
on February 5, 1985, in the amount of $11,440,000. This amount
was in compliance with the Council's policy of inducing not more
than 800 of the market value appraisal. According to Miller
& Schroeder Financial Inc., since the initial appraisal and induce-
ment, a review of the project by a potential mortgage/bond insurer,
the project can support a higher mortgage loan and therefore,
additional insurance will be provided. As a result, the developer
is requesting that the approved bond amount of $11,440,000 be
increased by 10% to $12,580,000 which is in legal compliance
with Minnesota statutes 462.C. Attached on page is a copy
of a legal opinion from Holmes and Graven regardi g the proposed
adjustment to the multifamily housing revenue bond amount.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve or deny the
final resolution for the issuance of multifamily housing revenue
bonds to the Royal Oak Circle project.

Multifamily Housing Revenue Bond
(Royal Oaks Circle Project)
I have been informed that the developer for the above referenced project is
requesting that the bond amount of $11,440,000 be increased by 10% to $12,580,000.
On February 5, 1985, the Eagan City Council gave preliminary approval to a bond issue
size of $11,440,000 based upon the market value appraisal. After a current review of
the Project by a potential mortgage/bond insurer, it was determined that the Project
can support a higher mortgage loan. Consequently, the insurer agreed to provide the
necessary additional insurance. This letter will outline the procedure to be followed to
increase the originally approved bond amount by 10%, up to $12,580,000.
The original preliminary resolution adopted by the City Council is still
acceptable. However, it will be necessary to publish notice of a new TEFRA hearing
and hold a new TEFRA hearing prior to adoption of the final resolution. The notice of
the TEFRA hearing must be published at least 15 days before the hearing in a
newspaper circulating generally in the City of Eagan. The public hearing may be
conducted on the same day that the City Council adopts the final bond resolution. The
final bond resolution shall reflect the increased bond amount.

PROJECT 454, ASBURY ROAD (STREETS & UTILITIES)
D. Project 454, Asbury Road (Streets and Utilities) --In response
to a petition received from the developers of the Blackhawk Glen
Addition and the Blue Cross/Blue Shield property, a feasibility
report was prepared and presented to the Councilfor their review
and consideration at the November 6 Council meeting with the
public hearing being scheduled for December 3. Enclosed on the
following pages without page number is a copy of the feasibility
report for the Council's information and review during this public
hearing. All notices have been published in the legal newspaper
and sent to all potentially affected property owners informing
them of this public hearing date. Our consulting engineer and
Public Works Director will be available to discuss the details
associated with this proposed public improvement.
ACTION TO BE CONSIDERED ON THIS ITEM. To close the public hearing
and approve/deny Project 454 (Asbury Road - Streets and Utilities)
and, if approved, authorize the preparation of detailed plans and
speicfications.

SCOPE: This project provides for the construction of lateral sanitary sewer,
trunk water main, trunk storm sewer, and Ashbury Road within Blackhawk Glen
First Addition and the Blue Cross property. As a result of this project, a
loop of the trunk water main and the trunk storm sewer system within area C
south of Yankee Doodle Road will be completed.
FEASIBILITY AND RECOMMENDATIONS: The project as outlined herein is in accor-
dance with the City's Water Supply and Distribution Plan. Revisions are pro-
posed to the Comprehensive Storm Sewer Plan. However, these revisions are
minor and will not affect the outflow rate or required storage capacity of
Pond CP -10 which is the downstream pond at Yankee Doodle Road and T.H. 13 for
this area.
Ashbury Road, as proposed, deviates from the Comprehensive Street Plan be-
cause it will be designed to local access standards and not be classified as a
neighborhood collector.
DISCUSSION:
Sanitary Sewer - An 8" diameter lateral sanitary sewer is proposed along Ash-
bury Road west of Birch Pond Road to serve future development and the proposed
City park site. The sanitary sewer will connect to the existing trunk sani-
tary sewer at the north end of Birch Pond Road. Sewer services are also pro-
posed for future lots within Outlots B, D, and E of Blackhawk Glen First Addi-
tion and the City park. No sewer services are proposed as part of this proj-
ect to serve the Blue Cross property.
Water Main - An 18" diameter trunk water main is proposed along Ashbury Road
from Birch Pond Road to Hampton Heights as shown on the attached drawing. The
trunk water -main will connect to the 18" trunk main at the south end of Hamp-
ton Heights- Addition that is to be constructed as a part of the Hampton

Heights/Coachman Road Trunk Water Main Project No. 451 and an existing 18"
trunk main in Birch Pond Road. This connection will complete a loop of the
trunk system and will provide an alternate water source during the lowering of
the existing trunk main in Yankee Doodle Road when it is reconstructed in
1986. A 12" diameter lateral water main is proposed along Ashbury Road from
Birch Pond Road to Blue Cross Road. The 12" line will provide capacity for
future commercial development within the Blue Cross PUD. One inch services
will be stubbed off of the 18" trunk main to serve future lots within Outlots
B, D, & E Blackhawk Glen First Addition. In addition, water services are pro-
posed to the City park and the future Well Site No. 10. No water services are
proposed as part of this project to serve the Blue Cross property.
Storm Sewer - With the development of Blackhawk Glen, the storm sewer outlet
for Pond CP -11 is required. The outlet for Pond CP -11 is north to Pond CP -6
within the Blue Cross property (Parcel 010-01, Section 17).
Since the construction of the water treatment plant and the trunk storm
sewer overflow from Pond CP -2 to CP -11, Pond CP -11 has been filling rapidly
and is now close to the design HWL of 809. Based on this and the proposed de-
velopments of Hampton Heights, Royal Oak, and Blackhawk Glen contributing in-
creased storm water runoffs, the storm sewer outlet for Pond CP -6 is recom-
mended at this time. The outlet for Pond CP -6 is north to an existing storm
sewer in Yankee Doodle Road at T.H. No. 13 as shown on the attached drawing.
The existing storm sewer ultimately discharges to Pond CP -10 at the NE corner
of Yankee Doodle Road and T.H. No. 13.
Due to the desires of developments adjacent to Ponds CP -11 & CP -6 to in-
crease pond depths and reduce total depth of variations between HWL and NWL,
and based on new information and development plans, revisions by varying de-
grees are proposed for all ponds upstream of CP -10. The proposed new pond
data are given in Appendix A.

Based on these revisions restricted outlets will be required for Ponds
CP -1, CP -11, and CP -6. For Pond CP -1 revisions to the existing outlet struc-
ture will be required to reduce the outflow rate to 2.1 cfs. This revision
involves adding additional manhole sections to the existing outlet structure
and controlling outflow by use of an orifice. It is proposed to control the
outflow rate for Pond CP -11 by the same type of control structure used in Pond
CP -1. The outflow rate for Pond CP -6 can be best controlled by pipe size and
grade.
Lateral storm sewer is proposed in Ashbury Road. This sewer will dis-
charge into the trunk storm sewer between Pond CP -11 and Pond CP -6. In order
to handle present and future lateral storm sewer flows and due to grade limi-
tations, the trunk storm sewer is proposed to increase in size from 15" at
Birch Pond Road to 36" at the inlet to Pond CP -6.
Drainage of Ashbury Road from a high point east of Birch Pond Road to the
east end of the project is proposed to flow into Pond CP -11. Drainage of the
westerly 150' of Ashbury Road will flow west into the existing storm sewer
system along Blue Cross Road.
STREETS: Street construction as proposed will include a 32' wide street con-
structed to a 9 ton design thickness between Blue Cross Road and Birch Pond
Road and 7 ton east of the intersection. The proposed construction of Ashbury
Road will be from the west end of the present Blackhawk Glen project (approxi-
mately 1,400' east of Birch Pond Road) to Blue Cross Road. The connecting
street between the proposed Hampton Heights development and Ashbury Road is
also proposed under this project.
Birch Pond Road will be curved to the northeast creating an approximate
"T" intersection to discourage through traffic within the Blackhawk Hills de -

velopment. The point of intersection with Blue Cross Road has been estab-
lished at the south entrance to the Blue Cross parking lot.
EASEMENTS: The proposed construction will require acquisition of easements
from Parcel 010-01, NE 1/4, Section 17; Parcel 010-30, NW 1/4, Section 16; Lot
1, Block 1, Blue Cross Addition; and Outlot D, Blackhawk Glen First Addition.
These easements will be for the trunk storm sewer lines, one lateral storm
sewer, Ashbury Road, and Pond CP -6. The estimated amount of permanent ease-
ment required from each parcel is listed below:

SANITARY SEWER: It is proposed to assess the total cost of the lateral sani-
tary sewer on a front foot basis along Ashbury Road to Parcel 010-30 and the
portion of 010-01 that is not City Park property. Trunk area sanitary sewer
was previously assessed under Projects 15A, 29, & 371.
WATER - MAIN: It is proposed to assess an equivalent lateral benefit charge
against all properties abutting Ashbury Road, except City Park property, in
accordance with their proposed zoning. The 1985 rates are as follows:
Single Family & Multi -Family ...................$11.875/f.f.
Costs associated with the water main oversizing will be the responsibility
of the trunk fund. Trunk area water main was previously assessed under Proj-
ect 15A, 29 & 371.
SERVICES: It is proposed to assess the cost of services equally to the bene-
fited properties with the exception of the 111" water service. This service is
for a future City well site and will be paid for from the City's Water Utility
Enterprise fund.
STORM SEWER: It is proposed to assess the total cost of lateral storm sewer
to all benefited properties, except City Park property, on an area basis with
the exception of the 12" line that flows from Ashbury Road into Pond CP -11.
The cost of this line is proposed to be assessed equally to Parcel 010-30 and
Outlot D, Blackhawk Glen. Costs for the trunk storm sewer will be covered by
past trunk area assessments levied under Project 371 and by assessing previ-
ously non -assessed areas. The non -assessed areas, as shown on Figure 5, are
all within the Blue Cross PUD. Since exact sizes of each defined use within
the PUD are unknown, all areas within the PUD are -proposed to be treated as
single family. When platting and development of these areas occurs, the dif-
ference in assessment between single family and platted use should be levied.

STREET: It is proposed to assess the total cost of Ashbury Road on a front

TRUNK RATES: The trunk storm sewer oversize rate in effect at the time of
this report for single family is $0.048/sq.ft. The lateral benefit from trunk

UTILITY AND STREET IMPROVEMENTS
Project No. 454

INTRODUCTION
This is an addendum to the feasibility report for Blackhawk Glen (Ashbury
Road) dated October 15, 1985. The purpose of this addendum is to revise the
preliminary assessment roll as presented in the original report.
DISCUSSION
The computation of the preliminary assessment roll for street improvements did
not reflect the difference in the street design section between the portions
of Ashbury Road east and west of Birchpond Drive. Since the east portion will
be designed to a 7 ton strength versus the 9 ton strength on the west portion,
different assessment rates have been computed.
ASSESSMENTS
Based on the above discussion, the new estimated assessment rates are as
follows:
Segment West of Birchpond Road $48.52/F.F.
Segment East of Birchpond Road $36.66/F.F.
Appendix C, Section E: Streets and the Summary Preliminary Assessment Roll
have been revised to reflect this change and are attached.

E. Project 443, O'Neil Pond (Trunk Storm Sewer Outlet) -As a
part of- the development of the Town Centre 70 & 100 Additions
south of Yankee Doodle Road, trunk storm sewer ponding areas,
lift stations and related force main outlets have to be constructed
within the general vacinity of Yankee Doodle Road and Lexington
Avenue. Subsequently, in response to a petition submitted by
the developers of the Town Centre Additions, a feasibility report
has been prepared and presented to the Council on November 6
with the public hearing being scheduled for December 3. Enclosed
(unnumbered) on the following pages is a copy of the feasibility report
for the Council's information and review during this public hearing.
All property owners proposed to be effected by this proposed
improvement have been notified of this public hearing and all
notices published in the legal newspaper.
ACTION TO BE CONSIDERED ON THIS ITEM: To close the public hearing
and approve/deny Project 443 (O'Neil Pond Trunk Storm Sewer Outlet)
and, if approved, authorize the preparation of detailed plans
and specifications.

SCOPE: This project provides for the construction of trunk storm sewer to
provide outlets for storm water ponds within and adjacent to Robert O'Niell's
property. Robert O'Niell's property includes approximately 120 acres located
north of Yankee Doodle Road between Lexington Avenue and I -35E in Parcels
010-76 and 77, Section 10. The outlets for these ponds are required at this
time due to the increase runoff generated from the Town Centre 70 and 100
Additions, Tomark Additions, Lexington Place Additions, Forrest Ridge,
Duckwood Estates, and Duckwood Trails. The outlets for Ponds DP -4, 5, and 10,
will discharge to LeMay Lake which in turn discharges to the Minnesota River
through existing storm sewer systems.
FEASIBILITY AND RECOMMENDATIONS: The project is feasible from an engineering
standpoint and is in accordance with the Master Comprehensive Storm Sewer Plan
for the City of Eagan. The project as outlined herein can be carried out as
one contract.
DISCUSSION: This project provides for the construction of storm sewer outlets
from Pond DP -10' to Pond DP -5 and from Pond DP -5 to Pond DP -4. The outlet for
Pond DP -4 to Pond DP -26, which is included entirely within I -35E right-of-way,
was constructed as part of I -35E. However, the pipe between Pond DP -26 and
Pond DP -4 was plugged because the land which includes Pond DP -4 was not ac-
quired by Mn/DOT for ponding purposes at that time. Therefore, as part of the
development of the Town Centre 70 and 100 Additions, it was required that the
land necessary for Pond DP -4 and DP -5 be acquired. Both these ponds are lo-
cated on Robert. O'Niell's property and are presently being acquired through
the condemnation process. Pond DP -10 which is included in the Tomark Addition
was dedicated as part of the Tomark 1st Addition.

To minimize the land acquisition for Pond DP -4 and Pond DP -5, the sizing
of these ponds assumes only agricultural runoff from O'Niell's property. De-
sign considerations for Pond DP -4 and DP -5 are listed below:

Therefore, at the time when O'Niell's property develops additional storage
will be required either through raising the HWL or by increasing the surface
area of each pond. However, prior to raising the HWL in the future the impact
of the higher elevation should be reviewed as it relates to upstream ponds and
structures. The additional storage required for Pond DP -4 and Pond DP -5 once
O'Niell's property develops is 11.6 and 12.0 acre-feet respectively. The out-
flow rate from each pond will remain the same in the future due to the addi-
tional storage being provided. Construction proposed herein includes defining
Ponds DP -4 and DP -5 based on the interim design which will require the con-
struction of dikes or berms. It is proposed that the excess material excavat-
ed from Pond DP -4 be utilized to build the dikes in Pond DP -4 and a major por-
tion of the dikes in Pond DP -5. Due to the existing terrain and the amount of
trees adjacent to Pond DP -5 only a minor amount of excavation is proposed.
To provide the outlet from Pond DP -10 to Pond DP -5 a 15" diameter gravity
storm sewer is proposed along and across Yankee Doodle Road and Lexington Ave-
nue as shown on the attached drawing. The 15" storm sewer will connect to an
existing 33" RCP beneath Lexington Avenue which presently discharges to Pond

DP -5. Due to the location of the easterly berm within Pond DP -5 it is necess-
ary to extend the 33" RCP to the westerly edge of the berm. Final design con-
siderations for Pond DP -10 are as follows:

The storm sewer outlet from Pond DP -5 to Pond DP -4 includes a submersible
lift station located at the southwest corner of Pond DP -5. The submersible
lift station will pump through a 14" force main constructed along Yankee
Doodle Road connecting to an existing 48" storm sewer at Denmark Avenue. The
48" storm sewer constructed as part of Project No. 429, Town Centre 70 and 100
discharges into Pond DP -4.
The outlet for Pond DP -4 to Pond DP -26 will require the removal of the
plug within the existing outlet pipe.
EASEMENTS & PERMITS: The only easements required for this project are those
for Pond DP -4 and Pond DP -5 which are presently being acquired through condem-
nation. Construction permits will be required from Mn/DOT and Dakota County
for work within their respective right-of-ways.
COST ESTIMATES: Detailed costs estimates are presented in Appendix A located
at the back of this report. The total estimated project cost is $388,430
which includes contingencies and all related overhead. Overhead costs are es-
timated at 30% and include legal, engineering, administration, and bond inte-
rest -but does not include any costs associated with the acquisition of requir-
ed permits or easements.

ASSESSMENTS_ Assessments are proposed to be levied against the benefited pro-
perty. All construction included herein is considered trunk with the excep-
tion of the grading associated with defining each pond. Those areas which
have not been previously assessed for trunk area storm sewer and benefit from
this project are proposed to be assessed their trunk area assessment as part
of this project.
TRUNK RATES: Trunk assessment rates in effect at the time of this report are
as follows:

F. Project 450, Williams& LaRue 1st & 2nd Additions (Sanitary
Sewer) -- Through a succession of public hearings initiated
in November of 1984, a petitioned request for the installation
of sanitary sewer to service the Williams & LaRue Addition under
Project 422 was subsequently denied at the April 16, 1985, Council
meeting. Subsequent to that action, several of the affected
lots have proposed to subdivide into smaller lots requiring
sanitary sewer service for final approval. Subsequently, a
new feasibility report had been requested and authorized under
Project 450 to service the Williams & LaRue 1st and proposed
2nd Additions. A copy of the referenced feasibility report
is attached without page numbers for the Council's information
and review during this public hearing. All notices have been
published in the legal newspaper and sent to all potentially
affected property owners informing them of the public hearing
to be held on December 3. Our consulting engineer and Public
Works Director will discuss the details associated with this
project accordingly.
ACTION TO BE CONSIDERED ON THIS ITEM: To close the public hearing
and approve/deny Project 450 (Williams & LaRue 1st & 2nd Addition
- sanitary sewer) and, if approved, authorize the preparation
of detailed plans and specifications.

SCOPE: This project provides for the construction of sanitary sewer, water
main, and storm sewer to serve Williams and LaRue 1st and the proposed 2nd Ad-
dition and the adjacent property. The area being served by the proposed util-
ities is located.in the northeast quadrant of Lexington Avenue and Wescott
Road. -Williams and LaRue 2nd Addition is a proposed replat of Lots 3 and 4 of
Williams and LaRue Addition.
Williams and LaRue 2nd Addition will be served by Wescott Road which is
presently a 20' wide gravel road. Wescott Road is designated as a Municipal
State Aid street in the City of Eagan and is proposed to be upgraded in the
very near future. At that time Williams and LaRue 2nd Addition will be res-
ponsible for upgrading their portion of Wescott Road based on a residential
equivalency.
FEASIBILITY AND RECOMMENDATION: This project is feasible from an engineering
standpoint and is in accordance with Master Utility Plan for the City of
Eagan. The project as outlined herein can be carried out as one contract.
DISCUSSION:
SanitaEy Sewer - Sanitary sewer to serve the Williams and LaRue Additions and
the adjacent area is proposed to be constructed westerly along the south line
of Parcel 044-53 as shown on the attached drawing. The proposed 8" diameter
sanitary sewer will connect to an existing sanitary sewer located at the most
southerly and westerly edge of Lexington Place South. The sewer will then
continue south adjacent to the westerly edge of Pond JP -44 to serve Williams
and LaRue Addition. It is also proposed to continue the sewer northerly to
serve Parcel 043-53. Also included is a service wye and 10 feet of 4" dia-
meter sewer service to each existing or proposed parcel or lot.

Water Main - Water main to serve Lots, 1, 4, & r of Williams and LaRue 2nd Ad-
dition, is proposed to be constructed along the north edge of Wescott Road.
The proposed 12" diameter water main is considered a trunk main as part of the
trunk water main system for the City of Eagan. The trunk main will connect to
the existing 18" trunk main in Lexington Avenue.
Services - As previously indicated, sanitary sewer services are included in
the sanitary sewer portion. Water services to serve Lots 1, 4, & 5 of Wil-
liams and LaRue 2nd Addition include a 1" diameter service. It is proposed
that a 6 inch diameter service be constructed to Parcel 016-25 located on the
south side of Wescott Road directly across from Williams and LaRue 2nd Addi-
tion.
Storm Sewer - Storm sewer proposed herein includes constructing the outlet
pipe for Pond JP -44 as designated in the Comprehensive Storm Sewer Plan. Pond
JP -44 is included in the Williams and LaRue Additions and a portion of Parcel
030-53 located immediately to the east. The outlet for this pond will connect,
to an existing 15" RCP storm sewer located in the Lexington Square Addition as
shown on the attached drawing. The proposed storm sewer is designed not only
to convey the outflow from Pond JP -44 but also 3.0 acres of direct runoff from
the future low point of Wescott Road. Design calculations for Pond JP -44 are
as follows:

The total estimated project cost is $109,260 which includes contingencies
and all related overhead. Overhead costs are estimated at 30% and include
legal, engineering, administration, and bond interest but do not include any
costs associated with permit or easement acquisitions.

ASSESSMENTS: Assessments are proposed to be levied against the benefited pro-
perties. A preliminary assessment roll based on estimated construction costs,
is included in Appendix B located at the back of this report. All lateral as-
sessments will be revised based on actual final costs incurred. An alternate
preliminary assessment roll is included in Appendix B listing pending assess-
ments should the Williams and LaRue 2nd Addition be final platted.
SANITARY SEWER: It is proposed to assess the total cost of sanitary sewer to
the abutting property it serves. It is proposed that Segment I, the
east -west portion included within Parcel 044-53 be assessed entirely to that
parcel based -on a lineal foot basis while Segment II, the north -south portion
included within Parcel 044-53 be assessed entirely to Parcel 043-53 also based
on a lineal foot basis. The front footage, which is the method used to deter-
mine the assessment rate, is equal to two times the lineal footage. Segment
III, the portion of sewer within Lots 1 through 4 of Williams and LaRue Addi-
tion, will be assessed based on a lineal footage rate determined by dividing
the costs of Segment III by the total length of Lots 1 through 4. Segment IV,
the east -west sanitary sewer serving the proposed Lots 3, 4 and 5 of Williams
and LaRue 2nd Addition, will be assessed equally to each lot combined with the
cost to serve lots 1 and 2 of Williams and LaRue 2nd Addition included in Seg-
ment III.
WATER MAIN: It is proposed to assess the lateral benefit from trunk water
main rate for the 12" water main in Wescott Road. The short side of Lot 4 of
Williams and LaRue was assessed under Project 404 for lateral benefit from
trunk water main, therefore a 75' corner lot credit was given to the long
side. It is also proposed to assess Parcel 016-25 the lateral benefit rate
for that portion of water main constructed along its frontage less a 75' cor-
ner lot credit. The 1985 rate is $11.88 per front foot for residential pro-
perty.

SERVICES: Water services are proposed to be assessed equally to the abutting
lots they serve, based on the diameter size.
STORM SEWER: All storm sewer proposed herein is trunk. Therefore, it is pro-
posed to assess those parcels which have not been previously assessed and ben-
efit from this project their trunk area storm sewer assessment. Trunk area
storm sewer rates in effect at the time of this report are as follows:

POND LP55 & 55A (STORM SEWER OUTLET)
G. Project 448R, Pond LP55 & 55A (Storm Sewer Outlet) -- On
July 16, 1985, a public hearing was held for Project 448 to
discuss the proposed storm sewer outlet for Pond LP55 & 55A.
As a result of the comments received, the Council continued
the public hearing to an unspecified later date to allow staff
to revise the report accordingly to address the concerns raised
and to review the proposed pond elevations with the Department
of Natural Resources. This work has now been completed and
the revised feasibility report (Project 448"R") has now been
completed and has been reviewed with the various affected property
owners through a series of neighborhood meetings. A copy of
the revised feasibility report is attached without page numbers*
for the Council's information and review during the public hearing.
All notices have been republished in the legal newspaper and
sent to all potentially affected property owners informing them
of the public hearing to be held on December 3. The consulting
engineer and Public Works Director will be available to discuss
the various options contained within this report at that hearing.
ACTION TO BE CONSIDERED ON THIS ITEM: To close the public hearing
and approve/deny Project 448"R" (Pond LP 55 & 55A - Storm Sewer
Outlet) and, if approved, authorize the preparation of detailed
plans and specifications for the appropriate option(s).
*Note: The feasibility report for this project will be included
as a part of the Additional Item packet on Monday.

A. Group W/Update--Jim Commers, local manager for Group W, has
requested time to appear before the City Council and provide
a brief status report on the progress of cable installation and
rate of subscribership within the City of Eagan. General questions
that the City Council might have regarding cable television are
certainly appropriate. Any specific complaints you have regarding
construction, restoration or other issues relating to a property
owner can always be channeled through this office or directly
to Ralph Campbell.

PUBLIC WORKS BUILDING EXPANSION
B. Authorization to Proceed With Public Works Facilities Expansion -
The architectural firm of Jack Boarman and Associates was hired
during the, early summer of 1985 to prepare a needs analysis for
consideration of an expansion to the existing Public Works building.
An employee committee was formed and has met on numerous occasions
to review all building needs with the architect. The Public
Works Committee has met on two occasions to review concepts that
were prepared by the architect taking into consideration present
and future needs for administrative space, specific shop work
areas and vehicular storage. At a special City Council workshop
session held on November 21, 1985, three (3) concepts were presented
by the architect for review and consideration. It was determined
that Scheme C, at an estimated budget of $1,525,000 is the most
practical solution for meeting the present and short term needs
for a Public Works facility. It was also determined that dollars
would be generated from a 1985 and 1986 General Government and
Public Utilities Fund allocation, General Fund revenue sharing
and a loan from the Consolidated Improvement Debt Fund which
is to be paid back over a five (5) year period of time.
There have been no formal improvements made to the Public works
garage for administration, workshop areas or vehicular storage
since the early 1970's when the City had approximately 90 miles
of street, one-half the sewer, water and storm sewer infrastructure
and a population of approximately 14,000. With the exception
of a small, metal pole barn that was erected in 1977, there have
been no other improvements made to the Public Works garage and
the system has approximately doubled while the population is
at approximately 33,000.
The City Administrator and Director of Finance were authorized
to prepare a budget which will be made available with the Admini-
strative Packet on Monday, December 2.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve or deny a budget
of $1,525,000 for the purpose of expanding the existing Public
Works garage facility to meet both present and future needs of
the Public Works & Parks Maintenance Departments.

A. Annual Review of Planned Unit Developments --At a special
joint meeting of the City Council and Advisory Planning Commission,
held on November 12, 1985, action was taken by the Advisory Planning
Commission to approve annual renewal of fourteen (14) active,
planned developments. The PUD that were approved are as follows:

was reviewed, however, does expire and will be reviewed as a
separate agenda item.
There is some question regarding procedure for the extension
of planned development agreements and, therefore, public policy
must be determined by the City Council after review of the City
Attorney's office opinion on extension of planned development
agreements referenced on page_ in the attached letter.
Since the City Council participated in both the public hearing
and review of each planned unit development at the special workshop
session, there is no need to reopen discussion unless there are
members of the public interested in any of the PUD's.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve or deny the
annual review of the Planned Unit Developments as considered
and recommended by the Advisory Planning Commission.

At the recent joint meeting of the Eagan City Council and Advisory Planning
Commission, the question arose as to whether it is necessary to hold a public
hearing in regard to an extension of a planned development and agreement and
whether such hearing would also have to be held before the Advisory Planning
Commission.
The City Code does not contain provisions for the extension of a planned
development agreement. 411.20 Subd. 8.E. does provide for annual review and
termination by the Council at its sole discretion at which time the Council
may cause the zoning to revert to the underlying designation.
Within the Code, the creation of a PD is a zoning authority requiring the
regular public hearings relative to rezoning. The only relevant State Statute
(4462.3595) states that a PD may be treated as a conditional use.
In conclusion, neither state law nor City Code require a public heraing to
extend a PD. However, if the PD is to be terminated or allowed to expire and
the zoning changed from PD to some underlying designation, public hearings
should be held as in any other rezoning.
Note that it would appear that the City has great leeway in amending its own
Code. Also, the costs (who pays) of notice for public hearing are a
consideration.

EXTENSION OF EAGAN 40 PLANNED DEVELOPMENT
B. Request For Extension of Eagan 40 Planned Development -- The
Eagan -40 Limited Partnership Planned Development was granted for
a ten (10) year period of time. Since the PD does expire in
January'1986, the developer is requesting two (2) three-year
extensions. This item and Mr. Dolan's request was reviewed at
the Special Workshop Session with the Planning Commission held on
November 12, 1985.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve or deny two (2)
three-year extensions, and approve or deny the Planned
Development review as considered in the joint session.

DAKOTA COUNTY PLAT I/CORRECTION/BOUNDARY DESCRIPTION
C. Dakota County Plat I, Correction to Recorded Boundary Descrip-
tion (Dakota County Surveyor) -- We have received correspondence
from the Dakota County Surveyor indicating their discovery of
certain errors, omissions or defects in the description of the
previously approved final plat for Dakota County Plat I Addition.
In accordance with state statutes, any corrections to a recorded
final plat must receive concurrence from the jurisdictional
municipality. These proposed revisions have been reviewed by
the Engineering Division and it has been determined that there
is no adverse impact to the City of Eagan by this correction.
Therefore, staff is recommending favorable concurrence with
this correction.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the Certificate
of Correction to the plat of Dakota County Plat I and authorize

PRELIMINARY PLAT/TOWN CENTRE 70 2ND ADDITION
D. Preliminary Plat/Town Centre 70 2nd Addition -- A public
hearing was held by the City Council at the November 19, 1985,
City Council meeting to consider a preliminary plat revision of
Town Centre 70 2nd Addition. It was determined at that public
hearing that the City Council does not normally hold a public
hearing for preliminary plats, and, therefore the hearing was
continued for consideration and review by the Advisory Planning
Commission at their November 26, 1985, meeting. The Planning
Commission did proceed with the public hearing to consider a
preliminary revision for Town Centre 70 and is recommending
approval of the new plat to the City Council. For additional
information on this item, refer to -the Planning and Engineering
Department report, copies enclosed in pages OPO' through

The public hearing for the Town Center 70 project containing
the Rainbow- Foods and strip commercial -center will take place
at the City Council meeting on Wednesday, November 6, 1985.
The subject area will require a replatting to create two separate
lots and the vacation of existing easements along Outlot D.
This replatting will be subject to the City Engineering require-
ments/review. The issue of parking stall size should be addressed
as the submitted drawings show 9' X 19' interiorstalls with
the 24' drives required by the City.
GRADING/DRAINAGE: The applicant is proposing no changes in the
grading of the Second Addition from the grading performed by
the applicant on the First Addition.
UTILITIES: The installation of sanitary sewer,. watermain and
services under City Contract 85-8 will be adequate to serve
this proposed development with public utilities. -This project
is very near completion.
STREETS: City Contract 85-8 also provides for the installation
of Town Centre Drive and a 48' wide 9 ton loading capacity City
street, City Contract 85-9 provides for the installation of
Denmark Avenue, a 52' wide 9 ton loading capacity City collec-tor.

The City anticipates both streets will be open to traffic by
mid November, weather permitting.
RIGHT-OF=WAY/EASEMENTS: Right-of-way dedication for Town Centre
70 Drive & Denmark Avenue occurred under the previously platted
Town Centre 70 Addition. Because the Town Centre 70 Addition
plat already exists, the City will require this developer to
petition to vacate existing lot line utility and drainage easements.
The vacation of the existing utility and draind'ge easements must
occur prior to.or concurrent with final plat approval.. --
The city will require a 20' wide utility easement over the watermain
fire loop yet to be constructed. The dedication of all other
easements shall be in accordance with -City Code.

It is our understanding that Naegle Sign Company has proposed that it be
allowed to erect an advertising sign on a parcel of property recently acquired
by the Lost Spur just north of the Lost Spur and south of 494. It is
understanding that this sign would exceed the maximum size under the sign
ordinance and would be located more that 300 feet away from the business pylon
sign located at the Lost Spur.
The sign described would be an advertising pylon sign as defined in Ordinance
Section 4.20, Subd. 1C. It would appear that the sign presently at the Lost
Spur would be considered a pylon business sign within the same definition.
To the best of our information, the proposed sign would be located within a PD
area with an RB designation pursuant to the 12/1/84 zoning map. Thus, the
advertising sign would comply with Ordinance Section 4.20, Subd. 2A.
Apparently the sign would exceed 250 square feet which may be allowed under
Ordinance Section 4.20, Subd.4C, when an advertising sign is located adjacent
to a limited access highway and the Council makes a determination that such
exception would be appropriate.
The more serious issue appears to be the location of proposed advertising sign
relative to the buisness sign already existing on the Lost Spur property.
Section 4.20, Subd.4A of the City Code provides that, "No advertising sign
shall be located on a platted lot which contains a Business Sign or within 300
feet of any Business Sign measured on the same side of the street". To the
best of our information, which should be verified by staff, it would appear
that the sign would not be located on the same platted lot as the Lost Spur
sign. In addition, it may be that the sign is more than 300 feet from the

existing business sign. Even if the sign is something less than 30 feet from
the Lost Spur sign, it our opinion that the Planning Commission and City
Council would have some discretion since the two signs are not necessarily on
the "same side of the street". Other portions of the Code suggest that if
signs are not located on the same side of the street, the distance between
them may be decreased.

G. Contract 85-5, Request for Extended Hours of Operation (Cedar
Industrial Park Trunk Storm Sewer) -- The staff will be receiving
a written request from the contractor (A.R.!. Contracting, Inc.)
requesting a variance to City Code 4.30, Subdivision 5, which
restricts the hours of operations from 7:00 A.M. to 7:00 P.M.
Due to the early onset of severe winter weather conditions,
they are requesting a variance to allow them to work 24 hours
a day. Their written letter of request defining the actual
days and duration of this request will be Forwarded to. the Council
as a part of the Administrative Packet. Due to the fact that
this work is confined to an industrial area, it is not anticipated
there would be any adverse impact associated with the construction
noise or lights from these extended hours of operations with

APPLICATION: An application has been submitted for Preliminary
Plat approval of 2 buildings on 2 lots east of state highway
49 and south of Becker Road.
ZONING & LAND USE: The entire site is ±43.2 acres and zoned
Light Industrial. The applicant is platting 2 lots, lot 15
± 2.2 acres and lot 16 ±2.3 acres and leaving the remaining
± 38.7 acres as an outlot. The topography generally flows to
a rather large low area near the center of the entire development.
A proposed pond is shown on the site plan in this area and will
act as a detention area for all of the proposed lots within the
development. An existing slough near .the souteast portion of
the site will be used as a building site in the future.
Adjacent land uses in Eagan are industrial as well except for
an agricultural strip fronting on Hwy 49. West Publishing and
part of the Gopher -Eagan P.D. are also to the west. Inver Grove
Heights (Delaware Avenue) forms the eastern property line.
SITE PLANNING: Lots 15 & 16 will share .a single common access
on to Hwy 49. Staff has asked the- applicant to widen this drive
to 36' to allow for easier turning by large trucks. Both buildings
meet all setback requirements. At this time, the parking stalls
are shown to be 9' x 201, 41 per building.
Both buildings will have the same floor plan with the 4,320 S.F.
office area in front of the 18,432 S.F..warhouse area. The office
area will have a brick exterior, dark glass with annodized aluminum
framing. The rest of the warehouse area will be block wall and
below the 30' height restriction of City Code. The loading bays
will be approximately 5,000 S.F. and the curbed bituminous surface
appears to be of ample size for easy vehicular movement.
Yorkton Development typically desires to lease to 'high tech'
industries. One of the proposed tenants for these buildings
is a printing company. These 2 platted lots will be subject
to the Parks Dedication fee of .04 at the time of building permit
issuance.

GRADING/DRAINAGE: The grading over this proposed development
proposes to maintain the existing drainage patterns in general.
The developer proposes on filling a slough area presently located
over proposed lots 12 & 13 and expanding a low area over proposed
lot 9 to incorporate the storage volume lost in filling the slough.
This is in conformance with the City's Comprehensive Storm Sewer
Plan as illustrated in figure 1. The pond this development proposes
on relocating is pond GP -7 on the Comprehensive Storm Sewer Plan.
This pond has a normal water elevation of 864 with a 100 year
storm elevation of 872. The cora,:m_sponding volume this pond requires
amounts to 63.9 acre feet. This development will ultimately
be responsible for the necessary :regrading to provide the required
storage volumes. Staff does not expect -he need for this ponding
area until further development of this site occurrs.
The preliminary grading plan appears feasible with the exception
of lots 15 & 16, the two lots proposed with this development.
The proposed grading and the proposed common lot line of lots
15 & 16 will not allow for a common access from Hwy 149. The
preliminary grading plan proposes a 5' drop accross lot 16 to
lot 15 in this area. The developer must revise his final grading
plan to facilitate a common access if allowed by Mn Dot for final
plat consideration. The grading plan for the final plat must
also be on a drawing to scale so that Staff may determine the
amount of storage volume proposed in the new pond.
SANITARY SEWER: The City has a 12" trunk sanitary sewer main
running northerly through this property about 400' west of Delaware
Tr (C.R. 63). This line is deep enough and of sufficient capacity
to provide service to this development. This line discharges
into a MWCC controlled and operated lift station at Becker Rd.
Staff reviewed the capacity of this lift station with MWCC for
the U.P.S. development located immediately to the north of this
proposed development. The consensus of that meeting is that
MWCC will not require any upgrading of this lift station in the
immediate future. MWCC is considering upgrading this lift station
within the next 5 years.
Because the 12" sanitary sewer line is in place, the developer
will have only to construct services off of it to both lot 15
and lot 16.
WATERMAIN: The City has an existing 16" trunk watermain along
the east side of Hwy 149. The City also -has an 8" watermain
along the west side of Delaware Tr. This line ends where it
provides service to the trailer park in Inver Grove Heights.
As a part of the U.P.S. development, the City upgraded C.R. 63A
(Becker Road) and also constructed an 8" watermain within it
from Hwy 149 to Delaware Tr. All of these lines are of sufficient
size and capacity to provide service to this proposed development.

However, Staff recommends that the 8" watermain within Delaware
Tr be extended to loop into the newly constructed watermain within
Becker Rd when the developer develops the lots adjacent to Delaware
Tr.
To provide service to lots 15 & 16, the developer will be able
to tap services off the existing 16" watermain within the Hwy
149 right-of-way.
STREETS: State Hwy 149 borders this proposed development along
the westerly boundary with C.R. 63A (Becker Rd) and C.R. 63
(Delaware Tr) bordering this development on its north and east
respectively. The County is in the process of turning Becker
Rd back to the City. Otherwise, Delaware Tr is under the jurisdic-
tion of Dakota County, T.H. 149 is under the jurisdiction of
Mn Dot and Becker Rd will be under the jurisdiction of the City.
The City recently completed upgrading Becker Rd to 9 ton standards
resulting from the U.P.S. development and expected increased
traffic because of it. If Mn Dot allows access to these proposed
lots, this development should provide for a right turn lane in
addition to any other conditions it may require. Because -Delaware
Tr is a County road and also is located within Inver Grove Heights,
upgrading this road to City of Eagan standards from Hwy 149 to
Becker Rd may be difficult. The City cannot hold a developer
responsible for upgrading his half of the roadway because it
is currently a rural roadway section and upgrading to an urban
section will require lowering of the grade line. Also, coordination
with Inver Grove Heights may present a problem. For these reasons,
Staff recommends the developer prepay street upgrading assessments
for Delaware Tr when the time comes for development of the property
along Delaware Tr.
RIGHT-OF-WAY EASEMENTS: This development shall dedicate the
entire right-of-way for Becker Rd over the westerly 562' and
the southerly half 40' right-of-way for Becker Rd over the
remainder. Also, the developer shall dedicate a 40' half right-
of-way for Delaware Tr.
This development shall dedicate a 20' permanent easement for
future trunk storm sewer west of the existing sanitary sewer
easement. Also this development shall dedicate a 10' utility
easement along the rear lot line of lot 15 for the future storm
sewer. To make construction of this storm sewer line easier
in the future, this development shall dedicate a 30' temporary
easement westerly of the previously mentioned storm sewer easement.
This easement shall expire upon completion of this particular
section of trunk storm sewer. This development shall also be
responsible for dedicating the required ponding easement for

63.9 acre feet of storage along with necessary easements to con-
struct the future outlet to pond GP -7. Finally, this development
shall be responsible for dedicating all other easements as the
City Code requires.
ASSESSMENTS: The City's record indicate this area being assessed
for trunk area water and trunk area sanitary sewer at the appro- -
priate rates. This leaves trunk area storm sewer and lateral
benefit from trunk sanitary sewer and trunk watermain assessments
as the responsibility of this proposed development.
The following table lists the assessments Staff proposes this
development is responsible for.
The City will determine the final amounts based on the assessment
rate at the time of the final plat approval and final plat areas
and dimensions. This development shall be responsible for all

FINAL RESOLUTIONS/YORKTON I & YORKTON II/IR FINANCING
I.. Final Resolutions for Yorkton I & Yorkton II Industrial
Revenue Bonds -- Final resolutions have been received and will
be reviewed by the City staff and City Attorney's office for
consideration of industrial revenue financing for both the Yorkton I
and Yorkton I -I -projects. The City has not received a letter
from bond counsel satisfying the City staff's concerns that
bonds could become taxable due to the. procedure variance
that was required for this application, due to the October 31
deadline. It is the City Administrator's recommendation that
final resolutions not be approved for Yorkton I and Yorkton
II unless a letter is produced from bond counsel and found to
be satisfactory by the City Attorney regarding this issue. A
letter has been requested on several occasions from the developer
and assuming an opinion is given to the City, it will be distributed
as part of the Administrative packet. Since all the final resolu-
tions and bond documents have not been sent to the City, the
City Attorney and City Administrator will reserve their right
for comment until preparation of the Administrative packet and
at the meeting on Tuesday.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve or deny the
final resolutions for Yorkton I and Yorkton II ($600,000 for
each bond transaction) industrial revenue bonds.

APPLICATION: An application has been submitted for Preliminary
Plat (Replat) approval in the Eagandale Industrial Park 3rd Addi-
tion. This plat combines the 4 existing lots into 3 new lots
north of Corporate Center Drive and west of Trapp Road.
SITE PLANNING: The Sperry office building approved by the City
Council in June 1985 is under full construction. This property
just south of I-494 and surrounded by L-1 (Light Industrial)
use is approximately 22.7 acres. The desired replatting will
allow all of the parking for this building to be on the same
Lot 1 parcel. A cul-de-sac, Trapp Court, will provide a secondary
access to this lot. It will also have the capability to service
replatted Lots 2 & 3. Lot sizes will be: Lot 1 ±10.4 ac, Lot
2 f4.4 acres, Lot 3 ±7.4 acres. Staff has requested that the
applicant submit a detailed plan demonstrating the parking layout
to ensure site compliance in terms of sizes and numbers. The
utilities are in and all setbacks meet Code requirements.
GRADING/DRAINAGE: The building contractor is performing the
site grading over this property under Sperry's building permit.
The grading plan is feasible and appears to be within City Code.
The grading plan proposes boulder retaining walls at various
locations along the southwesterly boundary of this site due to
the existing valley located along the southwesterly boundary
of this development. As long as the height of these rock retaining
walls does not exceed 5', Staff does not have any problems with
them.
This development is located within major drainage district H
as shown on Figure 1. Because the location of this site is near
the down stream end of this major drainage district the existing
trunk storm sewers should be able to handle the runoff from this
site.
WATERMAIN: The City has an existing 12" watermain along the
south side of Corporate Center Dr and an 8" watermain within
Trapp Rd to provide service to this proposed development.
EAGANDALE OFFICE PARK 3RD

This development proposes to loop an 8" watermain from Trapp
Rd through this development and connect to Corporate Center Dr.
The developer proposes to install this public line privately.
This is feasible as long as the developer constructs this watermain
in accordance with City standards.
SANITARY SEWER: The existing sanitary sewer that can provide
service to this development is the Eagan North Interceptor.
This -line runs down the southwest property line of this development.
The MWCC owns and operates this existing 21" trunk sanitary sewer
line.
This development is proposing to tie its sanitary sewer service
into this trunk line. To do this will require a permit from
the MWCC. Any necessary fees or bonds required with the permit
will be the responsibility of this development. This development
cannot connect to the sewer line until the City is in receipt
of a copy of the permit from the MWCC.
STREETS: Corporate Center Dr and Trapp Rd are existing city
streets bordering this proposed development. Corporate Center
Dr and Trapp Rd are both 44' wide 9 ton urban streets. This
development will not require any upgrading of these city streets.
This development is proposing the cul-de-sac off of Trapp Rd
to provide access to the easterly point of the Sperry property
and better access to lots 2 & 3. Staff recommends constructing
this cul-de-sac in accordance with City standards for a tear
drop design with center island. The developer will have to make
minor adjustments to the right-of-way dedication to suit the
tear drop cul-de-sac. Staff is recommending this different type
of cul-de-sac because it will help channelize the traffic. If
left open, there would be a 90' paved area with no channelization
providing many conflicts for vehicles attempting to reach Trapp
Rd. This design forces traffic in a one-way movement around
the cul-de-sac and will be much safer.
RIGHT-OF-WAY/EASEMENTS: The City has adequate right-of-way for
Corporate Center Dr and Trapp Rd. The proposed 60' right-of-way
for Trapp Ct will be adequate provided the developer dedicates
a 20' drainage and utility easement adjacent to the public right-of-
way. - This is in line with previous right-of-way dedications
in this area.
The City will require this developer dedicate a 20' easement
over the proposed water line from Trapp Rd through this property
to Corporate Center Dr. The developer shall dedicate all other
necessary easements in accordance with City Code.
ASSESSMENTS: A review of the trunk area related assessments
for utilities indicate that the City has levied all trunk area
related assessments for this proposed development.

is recommending the transfer of funds for the Municipal Center
expansion •project. It is Gene's determination that all budgeted
expenditures relative to the project have been made. Any additional
expenditures would be processed through a general fund appropri-
ation. (See the attachment on page_.)
Also, a transfer of the 1983 Equipment Certificate showing a
cash balance of $11,119.44 and the 1984 Equipment Certificate

Please -find attached more specific information relative to the
approval for the transfer of funds requested in my memo of November
21, 1985. The following information is included:
1. A project summary for the municipal center expansion
project showing a budget versus actual comparison.
The specific request is to transfer the balance of
$5,506.23 back to the Federal Revenue Sharing Fund since
it financed the estimated shortage of $190,000. I believe
that all budgeted expenditures relative to the project
have been made. Any additional expenditures will be
processed through a general fund appropriation.
2. A 1983 Equipment Certificate (Fund #35) Summary showing
a cash balance of $11,119.44.
3. A 1984 Equipment Certificate (Fund #36) Summary showing
a cash balance of $152.10. The specific request is
to transfer the total in 2 and 3 ($11,271.54) to the
debt service fund for the 1983 Equipment Certificates
to reduce subsequent debt service levies.
In addition to the dollar amounts noted above, authorization
to transfer should include any 1985 interest earnings which will
be determined at year's end.

SPECIAL CITY COUNCIL/PLANNING COMMISSION PUD REVIEW MEETING
Mayor Blomquist has been asked to attend and testify at an FAA
hearing in Washington, D.C. on December 10 which conflicts with
the date the Planning Commission and City Council were planning
to review the Comp Guide as it relates to commercial and industrial
and also the Blackhawk Park PUD. It was suggested by Mayor
Blomquist and concurred by the Advisory Planning Commission that
this meeting be rescheduled from December 10 until December 12.
If another date is more desirable, there should be discussion
on December 3 with a different day selected.
AIRCRAFT NOISE STUDY
Enclosed on page 10-7,, is a copy of an article from the Minneapolis
Labor Review regarding the FAA aircraft noise study. Councilmember
Wachter has asked that this article be shared with the rest of
the Council. The FAA hearing mentioned in the article is the
hearing that Mayor Blomquist has been invited to attend.

I write this letter out of concern as both a homeowner and as
a board member on the Coachman Highlands Townhome
Associat.ion. As you are well aware, Eagan has many
localized traffic problems. With luck, most of these high
traffic areas (such as Pilot Knob Road) will be mitigated due
to the completion of I 35 E. Are you aware, though, of the
severe traffic problems on Yankee Doodle Road, especially
during rush hours? I wonder if it will take a serious,
perhaps fatal, accident to occur before action is taken by
the City of Eagan to reduce the congestion and speed vehicles
on that road.
As the Board of Director understand from previous City
bulletins, Yankee Doodle Road is scheduled for a major
upgrade this coming Spring from a two lane road to a four
lane road. We also understand that there is no plans for
intersection control lights at Yankee Doodle and Coachman
Road. If I am correct in this, I would like to emphasis the
fact that land adjacent to Coachman Road is being heavily
developed. By next summer there will be a enormous increase
in intersection traffic on Coachman and Yankee Doodle.
Please consider a semaphore installation for that
intersection.
In the meantime, please seriously consider ways to reduce the
congestion and speed of traffic on Yankee Doodle. Is it
really necessary that Yankee Doodle be posted at a 50 mile
per hour speed limit. Since traffic can only go between Hwy
13 and Pilot Knob Road (1 mile) why is it that important to
have such a high speed limit? Is it too much to ask that
this speed limit be reduce to 35 miles per hour to reflect
the residential character of this area? We think not.
Finally, Coachman road itself is not posted and never
patrolled for excess speeds. It is quite common to see cars
traveling down Coachman at speeds in excess of 50 miles per
hour. This is definitely a residential area; please let's
not wait until a child is killed before action is taken to
regard this road as truly residential.

Brief description of assisted housing programs:
1. Section 8 Existing: Eligible low and moderate income households pay 30% of
their monthly adjusted gross income (less an established allowance for uti-
lities) for rent in market rate rental units. The Dakota County HRA (or
South St. Paul HRA) pays the rest. The rental units must pass federal
inspection standards and the rent plus an allowance for utilities paid by
the renter, must not exceed established Fair Market Rent limits.
2. Moderate Rehab: The Section 8 Moderate Rehabilitation program offers owners
of ,rental property assistance for making building repairs which will bring
their properties into compliance with Housing Quality Standards. The owner,
in turn, agrees to rent to households eligible for Section 8 Rent
Assistance. The rental of these units is coordinated through the Dakota
County HRA and the rent payments for the tenants is the same as Section 8
Existing. Besides the existing units in place, this program is no longer
available.
3. Section 8 New Construction: The developers of these units receive a subsidy
for construction of these units. The owners in turn, are required to rent
these units to eligible low and moderate income households. The rental
payments for tenants are the same as Section 8 Existing. These rental deve-
lopments are owned by private developers. Besides the existing units in
place, this program is no longer available except for Section 202 projects
for senior citizens.
4. Low Rent Housinq: The Dakota County HRA (or South St. Paul HRA) owns and
manages the housing units offered through the Low Rent Housing Program.
These housing units are rented to eligible low and moderate income house-
holds who pay 30% of their monthly adjusted gross income (less an
established allowance for utilities) for rent.
5. 235 Home Ownership: This program offered assistance to eligible low and
moderate households for purchasing a home. The program is no longer
available.
6. 236 Rental: The developers of these units receive a subsidy for construc-
tion of these units. The owners, in turn, are required to rent these units
to eligible low and moderate income households. The rental payments for
tenants are the same as Section 8 Existing. Besides the existing units in
place, this program is no longer available.

Brief description of Community Development Programs:
1. Weatherization: Through a joint effort of the Dakota County HRA and
Economic Assistance, low-income homeowners and rental units occupied by low-
income tenants are being weatherized to reduce the consumption of precious
fuels, promote energy conservation, and reduce the burden of high heating
costs on low-income county residents who can least afford rapidly rising
utility bills..
2. MHFA Home Improvement Loans: The Dakota County HRA administers this State
program as a Title I lender. Loans are made to eligible homeowners
(adjusted gross income less than $24,000 annually) for code compliance items
and certain general improvements. An interest rate of 3% to 11.5% is
charged depending on the applicant's income.
3. MHFA Home Rehab Loan: These loans are made to eligible low-income
homeowners adjusted gross income under $7,000 annually) for rehabilitation
items that directly affect the health, safety, energy conservation and
accessibility of the home. The interest rate is 3% and deferred loans are
available to households with adjusted gross incomes under $6,000 annually.
This program is administered by the Community Development staff of the
Dakota County HRA.
4. MHFA Home Energy Loan: These loans are made to eligible homeowners for
energy items. The interest rate is 8% for homeowners with adjusted gross
incomes of less than $24,000 annually and an interest rate 9% for those with
adjusted gross incomes of more than $24,000 annually. This program is admi-
nistered by the Community Development staff of the Dakota County HRA.
5. Rental Rehab: Rental Rehabilitation loans are available to owners of rental
units. There are no income or asset limitations. The loan amount cannot
exceed $15,000 per one dwelling unit and for structures with more than one
unit the loan limit is $7,500 per unit with a maximum of $37,500. The
interest rate on the loan is 11%. This program is administered by the
Community Development staff of the Dakota County HRA.
6. CDBG Rehab Loan: Various housing rehabilitation programs have been done
using Community Development Block Grant funds. They have assisted low and
moderate income homeowners in making repairs to their homes with low
interest loans and grants (grants are no longer available). This program
is administered by the Community Development staff of the Dakota County HRA.
7. MHFA Solar Bank: Deferred loans are given to eligible low and moderate
income homeowners for energy items. The eligible homeowners are referred
from Northern States Power Company and Minnegasco. This program is admi-
nistered by the Community Development staff of the Dakota County HRA.
8. 312 Loans: These loans are given to eligible owners of residential struc-
tures at an interest rate of 3%. The loan funds must be used to bring the
property into compliance with local codes, rehabilitation standards and some
types of general improvements. Commercial and mixed use (commercial and
residential) properties may apply for loans with an interest rate of 9%.
This program is administered by the Community Development staff of the
Dakota County HRA in HUD approved target areas.

Thank you for the time we had at your Mayors and Administrators meeting this
morning to discuss the critical issue of the future location of county
facilities. I am impressed with your strength of feeling that we must make our
best effort to act now at this crucial time in our County's history.
Because the time factor is critical, I am following up immediately with
information to support your efforts in discussing the issues and gathering the
support of your city leaders.
We discussed the following action at the meeting this morning:
A. I am enclosing the relevant legal statutes from our County Attorney,
dated August 29, 1985.
B. I am also enclosing a map giving the geographical centers, building
locations and population centers.
C. Each city offered to adopt a resolution in support of centralizing
facilities and calling on their County legislative delegation to take
action to provide the County with a more reasonable method of making
decisions in locating facilities and providing the most effective
services at the most efficient cost.
D. Cities offered to contact legislators to impress upon them the
importance of the issue and the fact that they must act now before we
lock ourselves into what could be a $35 million mistake in the long
run.

I. County Seat
A. Minn. Stat. Ch. 372 provides the following procedure
for relocating the county seat:
1. A change in location of the county seat must be
initiated by a petition signed by a number of
legal voters equal to not less than 60 percent
of those voting at the last preceding general
election presented to the county auditor. Minn.
Stat. §372.01
2. County Board must determine validity of
signatures on petition. Minn. Stat. §377.03
3. If petition is valid, auditor must set date for
special election not less than 20 days nor more
than 30 days after receiving certification of
validity of the petition from the county board,
Minn. Stat. §372.04, and must publish two -weeks
notice of the election. Minn. Stat. 372.05
4. A 55% majority vote in the special election is
required in order to change the location of the
county seat. Minn. Stat. §372.08
5. If the referendum passes, county seat must be
changed within 60 to 90 days of election. Minn.
Stat. §372.08
6. Elections to change the county seat may not be
held for a period of five years after the last
preceeding election for that purpose. -Minn.,

II. Court Facilities
Board of Commissioners
The following statutes concern location of court
facilities in Dakota County:
1. Minn. Stat. §373.05: "Each county shall provide
at the county seat and keep in good repair, a
suitable courthouse, supplied with fireproof
vault's and other necessary. buildings."
2. Minn. Stat. §375.18 Subd. 3: "Each county is
empowered to erect, furnish, and maintain a
suitable courthouse. No indebtedness shall be
created for a courthouse in excess of 1 2/3.
mills on each dollar of assessed valuation
without the approval of a majority of the voters
of the county voting on the question of issuing
the obligation at an election."
3. Minn. Stat. §2.722, Subd. 1, 1: Provides for
maintenance of - a permanent District Court
chambers in Hastings.
4. Minn. Stat. §480.22: _The Minnesota Supreme
Court designates locations of chambers for
judges of all courts. This is the only method
of changing the permanent designations found in
Minn. Stat. §2.722.
5. Minn. Stat. §375.14: This Statute provides in
part that: "The County Board shall provide
offices at the county seat for . . . judge of
probate court, clerk of the district court . . .
"
6. Minn. Stat. §487.21 Subd. 1: "The [County]
court by rule designates the locations within
the county court district at which regular
sessions of the court shall be held provided,
however, that regular sessions of the court
shall be held in at least the county seat of
each county within the county court district."
County Jail
The following statutes concern location of jail facilities
in Dakota County:
1. Minn. Stat. §373.05:
"Each county shall provide at the county seat
_and keep in good repair . . . a suitable and
sufficient jail and other necessary buildings.

2. Minn. Stat. §641.01:
"The county board of each county is authorized
to construct, purchase, or lease, regulate, and
maintain, at the expense of the county, a jail
for the safe keeping of prisoners, and also,
adjoining and connected to it, a residence for
the use of the sheriff."
3. Leasing
Minn. Stat. §641.24 allows the county board to
enter into a lease agreement with a city, or
county housing and redevelopment authority
whereby the city or HRA would construct a jail
in accordance with the County's plans, as
approved by the commissioner of correction, and
the county would lease back the jail site and
improvements. There is no requirement in this
statute that the leased jail be located in the
county seat. However, Minn. Stat. §373.05 would
require a jail at the county seat in addition to
such a leased facility.
4. County Regional Jails
a. Minn. Stat. §641.261 et seq. sets forth the
,requirements of funding sources and
authority to join with other counties in
establishing regional jails.
IV. Other County Offices
The following statutes concern location of offices for
other county officials:
1. Minn. Stat. §382.04:
"Every county auditor, treasurer, county
recorder, clerk of district court, sheriff,
judge of probate court and court commissioner
shall keep their offices at the county seat. In
any county where general terms of district court
are established and 'held at a place other than
the county seat, the court commissioner may have
his/her office at such other place."

Recently, Commissioner Steve Loeding attended a Mayor/Manager Break-
fast in West St. Paul and discussed the future location of County-
wide facilities. Apparently, Dakota County is considering several
public facilities that could total up to $35 million and obviously,
the location of these public facilities is of great importance to
the County's constituency.
The City of Eagan is experiencing rapid growth which appears to be
typical of northern Dakota County. In order to consider centraliza-
tion of County facilities to the constituency, both geographical
and population centers should be strongly considered when future
public facilities are funded and constructed within our County.
In official action that was taken by the Eagan City Council, at a
special meeting that was held on Tuesday, November 12, 1985, a
resolution was enacted that strongly encourages the Dakota County
Board of Commissioners to acquire land and construct future County
facilities in locations that consider 1) a central geographic
location, taking into consideration interstate and County highway
accessibility, and 2) the present and future population center. A
copy of that resolution is enclosed for your review.

has been very helpful and on behalf of the Eagan City Council, we
are very appreciative of our County commissioners taking the time
to share their long-range, public -facility planning objectives with
our communities.

CENTRALIZATION OF COUNTY FACILITIES
WHEREAS, the Dakota County Board of Commissioners is
proposing a major capital improvements program to fund the construc-
tion and location of certain public buildings within Dakota County;
and,
WHEREAS, the Dakota County Board of Commissioners has
determined these public facilities are needed for the purpose of
serving residents throughout Dakota County; and,

Sabo announces
aircraft noise study
and quieter ILS system
Congressman Martin Olav Sabo (D -MN) today an-
nounced that the Federal Aviation Administration
(FAA) will begin studying ways to accelerate the mod-
ernization of airline fleets in order to reduce airport
noise. The agency will also give the Minneapolis -St. Paul
Airport new landing equipment that will allow planes to
fly at higher altitudes over South Minneapolis and
Richfield.
Earlier this year, Sabo, who is the ranking majority
member of the House panel that funds the FAA, inserted
language in legislation directing the FAA to conduct a
six-month study of possible incentives to .get airlines to
modernize their fleets with quieter planes. The FAA will
hold a public hearing in Washington to begin the study on
December 10. Sabo said he intends to appear at the
hearing, along with Twin Cities officials.
Representatives of the House and Senate yesterday
began to reconcile differing versions of the transporta-
tion spending bills passed earlier by the two bodies. Al-
though the conferees have not completed action on the
measure, they agreed to a provision Sabo offered that
directs the FAA to install a precision Instrument Land-
ing System (ILS) for a runway at the Twin Cities airport.
Current landing procedures require aircraft to descend
to low altitudes over residential neighborhoods in South
Minneapolis and Richfield. The million -dollar ILS will
allow planes to fly at. higher altitudes, thus reducing
noise. It will also reduce the length of time that airport
operations are at their peak and enhance overall airport
safety.
