HomeMy WebLinkAbout04/09/1974 - Special Assessment Committee1�'NUTES OF THE ASSESSMENT COM 41TTEE REETUG Eagan, Minnesota April 9, 1974 The Assessment Committee meeting was held on April 9, 1974 at 6:30 p.m. at the City Hall, Eagan, Minnesota. Those present were: IZnight, Harrison, Marble, Sxith, Rahn, Bolke, Goers, Rosene and Hauge. The committee first reviewed Project #128-A relating to surfacing and grading improvements on Silver Bell Road North of Highway #13. Certain owners objected to the assessment covering the Silver Bell improvements abutting Highway #13 and ilrithin the Highway #13 right-of-way. It was noted that there were 3,305 front feet and 240 feet right-of-way with 285 feet adjacent to the right -of -Way. Jean Parranto appeared on behalf of Quickie Transport. Upon motion by Harrison, seconded Smith, all members voting yes, it was RESOLVED t1m t the matter be set over to the next meeting of the assessment committee to review pant similar actions in light of this project. The committee then reviewed the proposed revision to assessments for the 1973 Commanche Road street improvement covering the NSP, LaWmark Development Corp.; and MSB property. It was noted that the MSB had proposed a revised assessment procedure and the City Eugineer submitted a letter dated April 8, 1974 with proposals for revisions on Commanche Road on a front foot basis in the event that Tract A and Tract C of the Registered Land Survey acquire access to Commarr-he Road directly. It would reduce the assessment from $36,.20 per front foot to #13.84 per front foot. Upon motion by Harrison, seconded Marble, all members voting yea, it was RESOLVED that the proposal for revislon be approved and that the Engineer and Attorney attempt to enter into agreements with NSP, Landmark Development Corp. and the MSB incorporating this proposal. The City E:;gineer submitted a proposed increase for trunk area and lateral benefit charges of 1974 consisting of 57. increases over 1973 rates. Upon motion by Harrison, seconded Smith, all members voting yes, it was RESOLVED to recommend that the 5% increase of 1974 be ac,�epted and that the rates be re-evaluated in 6 months, namely Oc'Lober 1, 1974. The committee then reviewed the request of Mrs.. Husentruit to reduce by 10' the assessment for lateral purposes for the reason that the Hig1n7ay #31 right -of- way appeared to be 43'East of the Section line rather than 331. Upon motion by Smith, seconded Rahn, all members voting in favor, it was RESOLVED that such reduction be granted to each of the six owners in the i ±,ediate area under that assessment roll in the event that such owners agree to waive their claim or grant an easement fnr the additional 101. In the event that the owners agree to waive their claim to the 10' or to grant an easement to the 10' Co the county for Highway #31, then the entire project should be reassessed. The City Attorney then submitted a proposal to reassess the Metram property consisting of Townview 1st Addition and for Silver Bell and Blackhawk Road improve- ments from 1971 to provide that the respread be made over approximately 101 platted lots excluding common area. In the event that this is done, it would be condi- tional upon the developer agreeing to hold Eagan harmless from any claim of any owner of the lots in the subdivision due to the reassessment including any costs and damages resulting from assessment appeals. After discussion and upon motion by Harrison, seconded Marble it was RESOLVED to recommend that this proposal be implemented by the City Council and that a public assessment herring be called. Those voting in favor were Harrison, Marble and Rahn -- against were Smith and Knight. The meeting next scheduled will be on Wednesday, April 17th at 6:00 p.m.. Upon motion, the meeting adjoured.
