ADJOURNMENT E:� city of eagan TO: HONORABLE MAYOR & CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: NOVEMBER 1, 1996 SUBJECT: SPECIAL CITY COUNCIL MEETINGITHURSDAY, NOVEMBER 7, 1996 MEMO) A Special City Council meeting is scheduled for November 7 to: 1) canvass ballots for the municipal portion of the November 5 general election, 2) consider direction regarding criteria and issuance of on -sale liquor licenses and 3) review and consider the public enterprise budgets. CANVASS OF BALLOTS According to State Statute, the City Council must meet as a canvassing board and declare the results of a municipal election as they appear on the face of the election returns within two days after a general election. As a matter of interest, the Council has no authority to recount or inspect, either while sitting as a canvassing board or otherwise (except in the case of recounts). If there is an obvious mistake on the face of the returns, the Council may send the record back to the judges for correction, but neither the Council nor the judges have authority to recount or recheck the ballots. ACTION TO BE CONSIDERED: To certify the results of the municipal office for the City Council portion of the November 5 general election. Based on the current population and special legislation, the City is presently authorized to issue up to 26 on -sale intoxicating liquor licenses. Director of Finance/City Clerk VanOverbeke has raised some policy concerns that need clarification by the City Council relative to how those licenses should be distributed, i.e. hotels, restaurant and other restaurants, and further whether the criteria for determining the distribution of on -sale liquor licenses should be modified. Enclosed on pages 3 through A is a copy of a memo prepared by the Director of Finance/City Clerk regarding this issue. The City Administrator has contacted Al Baker and other on -sale liquor license holders so they are aware of the work session. ACTION TO BE CONSIDERED: To provide direction to staff; a formal action item regarding on -sale liquor license policies will appear in a future regular City Council agenda. , Z14411191*k &I During the months of August/September, the City Council reviewed and gave approval to a preliminary budget for the general fund operations. The public enterprise fund budgets consist of the civic arena, storm water utility, water, sanitary sewer and streetlights which are being presented for Council consideration. For a copy of the public enterprise fund budgets, refer to pages _Cj through AS—'. C.I.P./PART III (excluding Parks) 1997-2001 Also enclosed on pages iia through c1c_ is a copy of the five (5) year C.I.P. Part III that considers storm water, water and sanitary sewer utilities, local street improvements, signal lights and street lights. There are some remaining questions regarding the general fund that will be addressed in a memo and distributed as informational for the November 21 special City Council meeting. The remaining portions of the five year CIP, including Parts I, II and III, will also be presented at that meeting. ACTION TO BE CONSIDERED: To provide staff with direction regarding the public enterprise fund budgets.
