Zip. I understand that you can't do anything about this. You need to base your approval on a calculation of percentage of permeable vs. impervious area. Here's what I would ask your help with—is there someone we could talk to about what materials or building methods would be considered permeable? Either yourself or someone else at the city,or maybe the county? (Again,we have attended one of the county Blue-thumb classes so we are somewhat familiar with how this all plays into improved water quality...) My understanding is that decking above gravel with permeable fabric underneath would be considered permeable. Is there anything else on your list? In searching the web I find several articles on "Permeable Pavers",which appear to be small pavers on top of a bed of gravel that is permeable. I am looking for a list of options that you would say is ok (doesn't add to the impervious area.) Are you aware of anything like this? I see references to permeable pavers on the county water control web site, but I don't know if they are considered valid for your purposes. I need to draw up our as-is plan to see where we stand. Several things have changed, on both the photo and overall plan. We have simplified the retaining wall to just be a wall. So there are no pavers going up the back hill anymore—both sets are gone. We do need to add the front walk area. I would like to resubmit the zoning permit with just decking. We would like to get it done before the snow flies... If we convert the "patio" area to be unattached decking (with permeable stuff underneath)will that work? I appreciate your help in navigating these issues. We have removed pavers we had used to create a kennel... and the stepping stones on the back hill are gone. We have the retaining wall in back. And the front sidewalk which adds 86 sq ft. Creating a deck where you had proposed a patio can accomplish the same functionality without contributing to the impervious coverage. Unfortunately, any impervious that exceeds 25% requires a Conditional Use Permit(CUP), which can be costly and time- consuming. Through the CUP process, we can evaluate offsetting measures such as permeable paver systems, rain gardens, and in some cases underground cisterns, to capture the excess runoff and ensure they get implemented. Unfortunately, at the present time, we do not have the ability to allow substitute materials or such offsetting measures such as administratively. Please review the existing conditions of your property to confirm that what is represented on the survey is accurate, and clarify the proposal for the revised Zoning Permit. Once you have that information, please resubmit it directly to me. In the meantime, please let me know if you have any further questions. Thank you, Pam 1 /41C/C(9° As we discussed over the phone, I am unable to approve the Zoning Permit as submitted because the proposal exceeds 25%impervious coverage. The denied zoning permit is attached for your reference. This property is in the Shoreland Overlay District of Fitz Lake. As such,the impervious or hard surface area cannot exceed 25%of the lot. According to the survey we have on file (see attached), at the time of initial construction the impervious coverage ratio was 25%. It appears that some additional impervious coverage has since been added with stepping stones and sidewalks(see aerial image of property below), and the 25% ratio may already be exceeded. Therefore, no additional hard surface areas can be added to the property. In addition,the plan you submitted shows an extensive amount of work with two patios and a deck, retaining walls, stepping stones and landscaping. When we talked,you mentioned only the deck and patio off the back corner of the house are proposed at this time. It may be possible to construct the deck, if the area below the deck remains permeable (allows storm water to soak in). You may submit a new Zoning Permit application, if the proposed work does not increase the impervious coverage beyond 25%. If you do so, please confirm the information regarding the existing conditions of the property and current amount of impervious coverage. Please also clarify the proposal for a revised Zoning Permit application,and which items on the overall plan are proposed,and how the proposal does not further increase the hard surface area on the lot. Please note that if the proposed detached deck is more than 30"above grade, OR on frost footings, a Building Permit is required instead of a Zoning Permit.
