SUBJECT: SPECIAL CITY COUNCIL MEETING/MONDAY, JUNE 49 1990
At the May 24 special City Council workshop, special City Council meetings were
scheduled for June 4 and June 26. The purpose of the June 4 City Council meeting
is two -fold: 1) to review three (3) R-4 Study proposals and 2) to review the firefighters'
pension relief proposal as presented. This meeting will adjourn at approximately 7:00
p.m. and any members of the City Council that wish to join the City Administrator and
Director of Parks and Recreation for the first Ice Arena Committee meeting are
welcome.
Enclosed on pages 4-Z through Sfor your review is a copy of a memo from the
Director of Community Development that provides background information on three (3)
parcels the City Council will review of Monday. The City is anticipating a presentation
by landowners on both Areas M and V.
Also enclosed without page number is a copy of the firefighters pension relief proposal
that was submitted for consideration. The City Administrator has reviewed the proposal
with representatives of the Pension Committee and will present some additional
information at the workshop on Monday.

RE: UPDATE ON THE R-4 LAND STUDY
As discussed earlier, there have been three parcels the City is in
the process of working with in regard to site plans and/or
applications which will be submitted in a very short time. These
three parcels are: Area C located in the southwest quadrant of
Pilot Knob and Lone Oak Roads; Area M which is part of the Eagan
Hills West Planned Development. The City Attorney was to review
the status of this development; and Area B, the Crystal Ponds site
south of Highway 55 and west of Highway 149.
The applications for all three parcels are against the staff
recommendations for the change in land use and/or zoning. Prior
to starting the application, it was suggested that one more meeting
be held with the City Council and staff to try and negotiate a
reasonable compromise between what the landowner and/or developer
is requesting and what the City is proposing in the R-4 study.
Area C --this parcel did go through the June Planning Commission
public hearing for rezoning. The applicants have proposed a site
plan consisting of two buildings on the north of the R-4 density
and another set of buildings to the south. They are proposing to
develop in accordance with the existing zoning at this time. Staff
has suggested that the entire density be lowered to an R-3; the
applicants are against this recommendation. There was also some
history with the property and park dedication. New information has
been submitted and the City Attorney will be reviewing if there is
any vesting with the information submitted. It was originally
thought that the applicants would work a compromise with the City;
however they are requesting to pursue the existing zoning and will
not be present at the June 4 Special Workshop of the City Council.

Area M --the Eagan Hills West Planned Development: At an earlier
meeting, the City Council pulled this area from the study area to
be considered in the R-4 zoning proposal. The City Attorney has
reviewed this development to see if this is a binding agreement and
if, in fact the agreement is legally binding on the City at this
time. The preliminary indication that the staff has received from
the City Attorney's office is that the Planned Development
Agreement is in effect; there have not been any breaches to this
agreement and the agreement is binding on the City, as well as the
developer. It would be the suggestion of the City that Area M not
be considered in the rezoning process.
Area V --the Crystal Ponds development consisting of approximately
13.5 acres. The original zoning could allow approximately 160
dwelling units. The Preliminary Plat which was approved over a
year ago consisted of 132 multiple units and 15 buildings scattered
throughout the site. The Crystal Ponds Preliminary Plat expired
during the course of this study and the City then looked at this
13.5 acres as not having any current applications on the property.
Mr. Gary Sanders, owner of the property, has been in contact with
the City on a number of occasions indicating that he has a willing
buyer and would like to develop the property at the R-4 density.
He would consider the reduction from 160 units to 132 units as the
compromise being proposed. This development plan would consist of
two three-story buildings with underground garages that would
reduce the impervious surface and lot coverage from the original
plan. However, the massing in the size of the buildings was then
the concern of the City staff. As you can see by the
correspondence received from their legal counsel, they are
interested in pursuing the multiple zoning and would like a chance
to discuss this with the City Council once more to see if a
compromise can be made on the number of units for this property;
or does the City proceed in the course of action in accordance with
the recommendations in the R-4 study? Representatives of Mr.
Sanders will be present June 4th to discuss the merits of their
proposal.
As an update to the R-4 study, at the May meeting the Advisory
Planning Commission reviewed three of the 16 parcels for rezoning.
The three parcels were recommended to be rezoned in accordance with
the study recommendations. These items will be on the June 19 City
Council meeting for review.
Area V --the Sanders property was removed from the public hearing
portion in order that communications could be held on June 4th
prior to any discussion or action on this parcel.
