ADJOURNMENT W_ MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: APRIL 23, 1990 SUBJECT: SPECIAL CITY COUNCIL MEETING/APRIL 26 A special City Council meeting is scheduled for 5:30 p.m. at the Eagan Municipal Center Building. A light dinner will be served to each member of the City Council at 5:00 p.m. in the office of the City Administrator. I. ROLL CALIJADOPTION OF AGENDA H. OFF -SALE AND ON -SALE LIQUOR LICENSE POLICY AND FEES During December, 1989, there was an informal moratorium placed on the issuance of on - sale and off -sale liquor licenses, with the exception of liquor licenses that were under review and consideration by the City prior to the December, 1989 date. At a special City Council meeting held on January 30, the City Council reviewed the pending on-sale/off- sale liquor license policies, allowed presentations by the public and directed staff to research possible revisions to the existing liquor licensing regulations for City Council consideration. Staff, including the Director of Finance, Administrative Assistant to the Finance Director, City Attorney and Chief of Police have completed their study and, enclosed on pages through is a copy of their findings, recommendations, and open questions for which direction is requested. ACTION TO BE CONSIDERED ON THIS ITEM: 1) to approve or deny modifications to the existing on -sale and off -sale liquor license regulations or 2) complete the review of the proposed policy changes and direct this item to a regular City Council agenda for final ratification. M. FIRE DEPARTMENT PRESENTATION Periodically, the Fire Department has asked for time at a Special Workshop session to update the City Council on their operations. Since a formal presentation has not occurred before the City Council since the construction of Fire Stations 4 and 5, Chief Southorn will begin the presentation with a brief history of the department. Other members of the Fire Administration will be included in the presentation. District Chief, Dave DiIoia will review a profile of the department for the 1990's including a projection for personnel and equipment. Bill Lindblade is planning to present the profile of a firefighter and Chief Southorn will wrap up the 30 - 40 minute presentation with a review of department goals and future plans for fire operations. There is no action required on this item. IV. BLACKHAWK PARK DEVELOPMENT PLANS The Director of Parks and Recreation will present plans and a time schedule for the development of Blackhawk Park which includes the shelter building to be funded by the Eagan Lions Club. This development plan is consistent with the park systems plan that was adopted in the early 1980's and was presented as a final phase of development in the park referendum that was approved in 1984. This park was proposed in two development phases including 1) acquisition and 2) development of the facilities. Negotiations with Leo Murphy regarding the access road and land swap to maximize development opportunities for the park will be updated by the Director of Parks and Recreation. There is no formal action, however, a staff direction to proceed with the development project is recommended. V. OTHER BUSINESS There is no other business scheduled at this time. VI. ADJOURNMENT The meeting is scheduled to adjourn at 8:30 p.m. ;p", City Administrator 4 OFF -SALE LIQUOR - STAFF REVIEW Based upon Council discussion, the assumption is made that the City does want to exercise control over the number of off -sale liquor licenses. In the interest of health, safety and welfare, there should not be a proliferation of off -sale liquor licenses. Staff reviewed control through zoning and concluded restriction to certain zones would encourage, not relieve clustering of licenses. If the City were to eliminate NB as a permitted zone for off -sale liquor there would likely be rezoning requests. And, what happens to an existing license in an NB zone if the owner wishes to sell? Is the potential buyer told he cannot operate in an NB zone? Staff discussion, therefore, focused on a number limit as the most appropriate means of control. For example, the City could allow (1) one license per 2000 households or per each 5000 population. Walt Perlt of Liquor Control feels that the market supports one license per 5000 population and beyond that the market becomes saturated. At this point, only marginal operators want to have off -sale licenses. (Based on the current household/population count, the number of available licenses would be 8, which is the number of licenses now active in Eagan.) If only one license could be issued per year, the City would have a second means of control. There could be periods where the household/population count is ahead of the number of approved licenses but eventually the issued would meet the maximum. Allowing one per year would address the situation created when more than one license is available due to no applications in a particular year or when a license is not activated within a prescribed time frame thus rescinding approval. The Council should discuss what action should be taken when an existing license is turned back to the City. Would the potential buyer have to wait a year or more for consideration? The process to obtain a license could include the following: * The Met Council would provide the official household or population count as of April. The data is available to the cities on August 1. * Applications would be received through August 31. (If the household/population count did not meet the required number, the applications would be returned.) * The Police Department would have 90 days to review the application(s) September 1 through November 30. * The City Council would consider the application(s) at its first December meeting. * One new license would be approved effective January 1. 3 * If the license is not activated by August 31 of that next year, approval would be rescinded and the application process would be rolled over into the next cycle. It is recommended that residence of an applicant to be one of many criteria used in issuance of a license. A set of criteria such as financial structure, overall operation, proposed location, traffic situation, previous experience and ownership restrictions should be taken into account as part of the review process. Staff recommends that the present language not allowing an off -sale license within 300' of any public school or church be retained. The code should also retain.... Each applicant shall display to the City's satisfaction that it has at least an option on a specific site for the location of the off -sale store. The Council reserves the right to determine specific compliance with this subdivision. FOR CONSIDERATION: 1. If desire to control through maximum number, is household count or population count preferred? 2. If further control through "one per year", what do you do when an existing license is returned to the City? 3. Should there be additional standards for approval if there is one applicant for one license than when there are many applicants for one license? OFF SALE LIQUOR LICENSES 1980 Two active licenses: Cedarvale (now Big Top Wine & Spirit) Kennys Liquor, Yankee Doodle Road Two inactive licenses:J.E. Parranto - no specific site McCrae & Associates - Safari Mall 1980- City Code stated that four (4) off -sale liquor 1983 licenses could be issued and must be geographically spaced so that two are in western section of city; one in the northeast; and one in the south central. 1984 City Council notified J. E. Parranto and McCrae & Associates to activate their licenses in 1984 or the licenses would be made available to other applicants. 1984 McCrae & Associates received Council approval to move their location to Hilltop Shopping Center and opened Eagan Liquors at 4182 Pilot Knob Road. 1985 J.E. Parranto did not activate his license and on July 16, 1985, David Perrier was approved for the fourth license to be located at Cedar Cliff Shopping Center. 1985 City Code was amended to read: Four (4) off -sale licenses may be issued and must be geographically spaced so that one license shall be located in the north area (excluding Silver Bell Center); one shall be located in the southeast area and two shall be located in the southwest (including Silver Bell Center). 1985 McCrae & Associates sold Eagan Liquors. Spirits of Eagan dba MGM Warehouse, was approved for the off -sale license at 4182 Pilot Knob Road in action by the City Council at its October 15, 1985 meeting. 1986 On May 6, 1986 the City Council amended the ordinance to allow for five (5) off sale licenses. The fifth site was designated for the Town Centre area. 1986 At its July 15 and August 19, 1986 meetings, the City Council amended the off -sale liquor ordinance. 1986 City Code was amended to read: No more that one(1) off -sale license may be issued for each 2,000 households in the City as determined by the Metropolitan Council as of April 1 of each year. The sixth off -sale license shall not be approved prior to July 1, 1987. one additional off -sale license may be approved each year thereafter. However, no license shall be approved prior to the first of August of each year commencing in 1988. Applications will not be accepted unless a license is available as determined by the household count. Each applicant shall display to the City's satisfaction that it has at least an option on a specific site for the location of the,off-sale store. The Council reserves the right to determine specific compliance with this subdivision. 1986 On July 15, 1986, the City Council approved an off -sale license on Town Centre Drive for Curtis Johnson. A few weeks later Mr. Johnson withdrew his application. The license was eventually approved for Sid Applebaum dba Big Top Wine & Spirits , 1282 Town Centre Drive. 1989 The City Council approved an off -sale license for Liquor Shoppe, Inc. located near the intersection of Lexington and Diffley Road. 1989 In December, two applications were received for off - sale licenses: Cheers Wine & Spirits and Richard Barone - both located near Cliff & Nicols Road. Subsequent discussion of the applications generated the decision to reassess Code requirements and licensing procedures. 1990 A special Council work session was held January 30, to discuss liquor licensing policy. The Council decided to consider the off -sale applications apart from policy. 1990 The City Council approved off sale applications for Cheers Wine a Spirits, 1996 Rahn Cliff Court and for Richard Barone, 2119 Cliff Road on February 20, 1990. The code language could be amended to read: The eighteen (18) allowable on -sale licenses for cities with population up to 45,000, shall be distributed as follows: A. (Four) 4 for hotels B. (Fourteen) 14 for restaurants with greater than $350,000 valuation Those restaurants holding on -sale liquor licenses prior to this amendment will be exempt from the valuation amount. All new licenses must meet valuation requirements. The Council needs to determine what action should be taken when an existing license becomes available but the facility does not meet valuation requirements. Would a potential buyer be required to upgrade the restaurant before the application could be considered? Staff reviewed a possible increase in seating capacity. Currently, Eagan has a minimum of 30 which is the state standard for cities over 10,000. Current seating capacity for Eagan restaurants is shown on the attached map. A greater seating capacity tends to increase the valuation and decrease the possibility of a night club facility. Without enforcement of a food percentage requirement, however, seating capacity may just produce larger facilities whose sales are mostly liquor. Staff discussed the City's stringent food (60%) - liquor (40%) requirement and generally agreed it is currently not being enforced. Eagan has never challenged the food/liquor ratio and would need a detailed review of sales records to test compliance. FOR CONSIDERATION: 1. Define the categories for on -sale licenses as - Hotel and restaurants with greater than $350,000 valuation. 2. Establish a procedure to deal with those licenses that become available when a restaurant is sold. 3. Increase the minimum seating capacity to 50. The names and ownership changed but the sites remained the same. 1980- Cit _Code language remained unchanged during these 1986 years... No more than twelve (12) licenses may be issued with a thirteenth available for a hotel/motel. All licenses shall be for commercial or industrial use districts under a conditional use permit. 1986 Requests for on -sale licenses became more frequent and the Council amended the ordinance to allow 18 licenses (to conform to state guidelines) and to reserve the remaining unallocated licenses for specific uses. 1986 City Code was amended to read: No more than eighteen (18) on -sale licenses may be issued. All on -sale licenses shall be for premises situated in a commercial or industrial use district under a conditional use permit. The nine (9) licenses available March 5, 1986 shall be distributed to qualified applicants as follows: A. Four (4) licenses for hotels/motels B. Three (3) licenses for restaurants with at least $350,000 building valuation (exclusion of leasehold improvements, equipment or common areas); and, C. Two (2) for other restaurants. 1989 There are currently 13 active on -sale licenses. The remaining licenses are reserved for hotel/motel (3); restaurants with more than $350,000 valuation (1); and other restaurant (1). 1989 In December, Xaviers, Inc. applied for an on -sale license for their restaurant at 1260 Town Centre Dr. The application was continued in order to review the ordinance. 1990 A special City Council work session was held January 30, to discuss liquor licensing policy. The Council decided to consider the on -sale application apart from policy. 1990 The City Council denied the on -sale liquor application of Xaviers, Inc. at its March 20 meeting. /(i ON SALE LIQUOR By state statute,the City of Eagan is allowed 18 on -sale liquor licenses until the population reaches 45,000. For each 2500 increase thereafter, another license may be issued. The City could conduct a referendum calling for an unlimited number of on - sale licenses, if interested. Currently, there are 13 active licenses in Eagan and their locations are shown on the attached map. A survey of 8 metro area cities having similar growth and/or pop- ulation reviewed possible variables considered in on -sale liquor licensing requirements. A summary is shown on the attached chart. Valuation: Burnsville sets a $1,000,000 valuation which includes everything but the land and it only applies to hotel/motel licenses. Eagan has the $350,000 valuation which only applies to the building. None of the other survey communities considers valuation. Seating,Square footage: Apple Valley uses the state definition of restaurant but has no specific numbers in the liquor ordinance. Maple Grove does not specify either. Eagan and Brooklyn Park have a minimum seating of 30, Burnsville has 50, Eden Prairie and Minnetonka have 100 and Coon Rapids has 150. No survey city specifies square footage requirements. Reserved Licenses: Eagan is the only City which reserves licenses for certain facilities. Most cities say it hasn't been a problem because there are plenty of licenses available. Minnetonka held a referendum and now has an unlimited number of on -sale licenses available. Food/Liquor Ratio: Five of the survey cities do not have a food/liquor ratio. Eden Prairie and Minnetonka have a 50-50 ratio. Eagan has a 60/40 ratio. Eagan has never challenged the food/liquor ratio and would need an auditor's review to test compliance.
