SUBJECT: SPECIAL CITY COUNCIL MEETING/TUESDAY, JANUARY 13, 1987
The special City Council meeting scheduled for Tuesday, January
13, will commence at 6:30 p.m. Mr. Michael Foertsch, who is
currently under consideration for hiring as the Assistant City
Engineer, is scheduled for an introduction and meeting with the
City Council at 6:30 p.m. Enclosed is a copy of Mr. Foertsch's
resume and information about the interview and selection process
that was initiated to date by the City.
At 7:00 p.m., the interviews for all commission and committee
appointments are scheduled. Please note that new applicants and
incumbents were contacted for interviews. The attached schedule
indicates those persons who are requesting an interview, those who
are unable to interview, and candidates whom the City has not
contacted as of today but will have some indication by the end of
the weekend as to whether they can interview. Those persons who
have not been contacted and wiElh to be interviewed will be added
in the time slots at the end of the attached interview schedule.
The City Attorney and City Administrator have had a meeting that
was called by John Shardlow and Gerald Duffy, representing Robert
O'Neil, this morning and feel after visiting with Mayor Blomquist
and City Councilmember Egan that the information shared does
necessitate an executive session to discuss the O'Neil lawsuit vs
the City of Eagan immediately following the commission/committee
interviews Tuesday evening. Attached is a memo from City Attorney
Hauge indicating the need for such a meeting.
Also attached is a copy of a letter from Steve Rothmeier asking
that the City Council and Planning Commission attend a luncheon
and tour of the new Northwest Airlines world headquarters building
on Thursday, January 22. If each member of the City Council can
attend, please let me know Tuesday evening and I will make the
confirmation.

SUBJECT: ASSISTANT CITY ENGINEER
For your information, when the City of Eagan received the
resignation of the then Assistant City Engineer Rich Hefti, the
hiring procedure for a replacement was begun. Advertisements for
the vacant position were placed in the Sunday Minneapolis Star
and Tribune and St. Paul Pioneer Press for three straight Sunday
editions. The position was also advertised in all the This Week
Newspaper editions and all the Sun Newspaper Corporation papers
(including, of course, the Eagan Chronicle). These papers cover
all municipalities south of the river, and in the case of the Sun
Papers, the Cities of Richfield and Bloomington. The
advertisement was also placed in the state engineering journal
and a posting notice was sent with a cover letter to all members
of the state civil engineering association (whose membership
includes city engineers in most municipalities as well as
engineers working for private consulting firms). The job opening
was also posted at all City building locations.
Approximately 36 applications were received for the position.
These applications were closely screened by Administrative
Assistant Duffy and Director of Public Works Colbert. Criteria
for selection for an interview included the possession of a civil
engineering degree, present registration as or the ability to
become registered in the State of Minnesota as a Professional
Engineer, and municipal civil engineering experience including
experience with street, sewer and watermain projects, project
administration and contract administration.
Seven applications met these qualifications. These seven
_ applicants were contacted and invited to come for an interview at
the Eagan Municipal Center. One applicant declined because she
had already accepted another position. Another cancelled his
interview for the same reason. Therefore, five applicants were
interviewed by Director of 'Public Works Colbert and
Administrative Assistant Duffy. A copy of the questions asked
each applicant is included for your information at the end of the
memo.
From the five applicants, two applicants were selected for a
final interview with City Administrator Hedges and Director of
Public Works Colbert. Each applicant was then asked to send in
additional specific references and examples of his work. It was
the consensus of both City Administrator Hedges and Director of
Public Works Colbert (as well as of Administrative Assistant
Duffy from the first interview session) that Michael Foertsch was
the strongest and best suited applicant -for the position.

Mr. Foertsch is presently the Assistant City Engineer for the
City of Brainerd. A copy of Mr. Foertsch's application and resume
is attached on the following pages. Also attached are copies of
correspondence from Mr. Foertsch and reference letters for Mr.
Foertsch. As mentioned before, a copy of the questions used for
interview purposes is also included. As a point of information,
Director of Public Works Colbert also personally spoke with the
City Engineer from Brainerd concerning Mr. Foertsch and received
a very positive recommendation.
The Council is scheduled to meet Mr. Foertsch at 6:30 p.m. on
Tuesday, January 13, at the Eagan Municipal Center. If any
member of the Council requires further information before that
time, please contact me.

I have lived in Eagan most of my twenty five years. I intend to live
in Eagan for many years to come. I have watched Eagan grow as I have grown.

Aside from my personal interest In the benefits that the city's parks
and recreation system.provides my family, I feel I have an educational
and professional background that would be an asset to the commission.
After receiving a B.S. degree in Recreation Resource Management
from the University of Minnesota, I spent five years with the Minnesota
Department of Natural Resources working on river recreation and
management programs. I returned to the University to earn an M.S.
degree in forestry, during which I completed research an the Minnesota
Valley National Wildlife Refuge. I later spent two years with the DNR
Division of Forestry helping to prepare the first statewide forest
resource management plan. I have a good understanding of land use
planning, zoning, recreation planning and natural resource management as
a result of this educational and professional experience.
I feel I would bring to the Commission a perspective from a
significant and growing segment of the city's population - the younger
family that has recently moved to Eagan (We have been here for almost
one year).
Having grown up in Bloomington during its period of rapid growth
from the mid -fifties to the early seventies, I feel I have a good idea

community such as Eagan. -

appointment to the Eagan Economic Development Commission. The City
Council has had .extremely busy agendas with meetings lasting as long
as 8 hours in the past two months. Unfortunately, it was not
possible to receive direction on filling the vacancy until the last
City Council meeting.
Since the City Council will be reappointing its commissions and
committees in January and soliciting persons who are considering an
appointment during the month of December, it was decided that the
two (2) vacancies on the Eagan Economic Development Commission
created by Mr. Bob Shields and Richard Stevenson would be included
in that process. Your letter will be retained and you will be
contacted in early January for consideration of an appointment at
that time.

Commission. We Purchased our present home in Eagan in October 1965.
Our family has enjoyed Eagan for the past 21+ years.
My employment history is outlined as follows:
1965-1973 Bloomington Public Schools. Teacher, Administrator.
1973-1984 Country Kitchen International. Restaurant development.
1984-1985 The Franchisemasters. Sales, consultant.
1985- Ecodyne Corporation. New dealer development.
During my years with Country Kitchen I developed over 100 restaurants.
I identified and evaluated sites, prepared site plans; negotiated
real estate purchases and/or leases, and obtained building and sign
permits. I worked with over 100 planning commissions and councils.
I am thoroughly familiar with the function and responsibility of
an advisory planning commission. The December issue of the Eagan
News has made me aware of openings on the Commission. I desire to
utilize my experience by serving Eagan as a member of the Advisory
Planning Commission.

Dear Sir/Madam:.
I am writing in response to the article in the December
1986 issue of the Eagan News: I am interested in the open=
ings on the City Advisory Planning Commission. I am asking
for consideration of fullfill•ing one of these positions.
My wife and I moved to this area from Duluth, Minnesota
in 1984 to pursue both of our vocations; Diesel Mechanic and
Travel Consultant. We found that this.area suited both of our
occupations; a community that is growing steadily, establish-
ing major corporate operations. We then purchased a home in
Eagan in 1985 and since then, we have become concerned with
what has been happening with our growing Community. We have
been impressed with waht the city council has done with the
city, public library, schools, parks, highways and zoning.
As we plan to start a family at this time, I would like
to see this Community continue to grow strong with business,
schools, and recreation. I would like to be part of this
growth and help guide it in the right direction. I would ap-
preciate a position on the City Advisory Planning Commision.

It's my understanding that in the afternoon of Thursday, January 8, 1987, you
received a call from John Shardlow, the planner for Mr. and Mrs. Robert
O'Neil's property on Yankee Doodle Road, asking for a meeting as quickly as
possible to discuss some new events regarding the O'Neil land. You had
discussed with him on two other occasions including as late as last Monday,
the potential for some change in the viewpoint of the O'Neils and yet had
gotten a rebuff last Monday to the effect that the O'Neils would not be
willing to offer a more conciliatory approach.
John Shardlow and Jerry Duffy met with you and me at 10:30 a.m. on January 9,
1987 at your office. Chris Dietzen was asked to be present and thought he
could be there, but then called at the last minute and said that he was tied
up in Court in Hennepin County and would not be able to be present.
We had what appeared to be an enlightening, yet affirmative meeting, at which
time we let Duffy and Shardlow do most of the talking. The following is the
essence of the conversation:
1. There is a developer that is quite interested in the property, but no
Purchase Agreement has been signed.
2. Duffy and Shardlow, at the present time, are the principal players in
working with the City in attempting to put together a development package
either by O'Neil directly or potentially through a developer.
3. They asked that we again discuss with the City Council in executive
session a general approach to the O'Neil issues and we are suggesting that
the session be held after the January 13 special meeting following the
Committee and Commission interviews.

4. If the Council concurs with the very general development proposal, we
would then respond to Duffy and Shardlow and they would proceed to package
a plan that would be worked in concurrence with the City Planner and City
Consulting Planner.
5. A temporary stay of the proceedings would be reached until a more definite
understanding could be reached concerning the civil action, the
condemnation action and the steps involved in the development application
process.
There are a number of other issues that were discussed and can be reviewed
with the Council, one of which deals with the freeway zoning discussion that
took place earlier.

how do you perceive the City's trail system? Also, do you feel
the City has a balance of passive and active park land? If not,
what are some changes you would recommend. I assume you are
familiar with the City's recent bond referendum; do you agree
or have some suggestions regarding park land development that
was outlined as a part of that referendum?
Cable Commission Candidates
1. Are you familiar with public access and, if so, how do you
perceive the needs for our public access studio and program-
ming? Also, do you have any comments regarding the joint com-
mission arrangement between the Cities of Burnsville and Eagan
regarding the administration of cable television for these two
communities? You may or may not be familiar with the pro-
gramming that is being offered by Group W. If so, do you have
any comments regarding the services that are offered?

1. What do you see as _the most important issues facing the
Metropolitan Area pertaining to Aircraft Noise? What do
