DRUG PARAPHERNALIA ORDINANCE
Residents from the City of Eagan grouped
together this summer in an effort to close
"Mak'n Magic", a shop selling primarily
drug related paraphernalia in the community.
The City Council responded by passing an
ordinance entitled "An Ordinance Prohibiting
the Sale, Transfer and Possession of Drug -
Related Devices". Before the ordinance
was published, the owner of Mak'n Magic
filed a restraining order in Federal
District Court on July 20 that was granted,
therefore, disallowing the enforcement of
the ordinance. A Federal District Court
Hearing was then scheduled to consider a
preliminary injunction on August 10, 1979.
The ordinance was upheld by U.S. District
Judge Donald Alsop on August 30, 1979.
Judge Alsop then stayed his decision the
following day, giving the owner of Mak'n
Magic 14 days to appeal the decision. The
outcome of a final decision by the Federal
District Court is uncertain at this time.
The campaign to close Mak'n Magic was
initiated by concerned citizens and
exemplifies a commitment by these residents
and the community at large to recognize the
drug problem and make efforts to reduce its
SHORTAGE OF SCHOOL BUS DRIVERS
Independent School District 196 has a shortage
of transportation drivers. Morning runs are
short 13 drivers and afternoon runs are short

CITY ELECTION
The City election will be held on Tuesday,
November 6, 1979 between the hours of 7:00
a.m, and 8:00 p.m. in all eleven precincts
for mayor (two year term) and two council -
members (four year terms). Filings for
these positions will be open from September
25th through October 9th as the term of
office for Mayor Murphy and Councilmembers
Smith and Wachter will expire on December
31, 1979.
We would like to encourage all new resi-
dents and residents who have moved since
the last election to register at City Hall,
3795 Pilot Knob Road, on Monday through
Friday from 8:00 a.m. to 4:30 p.m. The last
day to register before the City election
will be October 16, 1979. Registration will
open again on election day, however, eligi-
ble voters will have to provide a.proof of
residence to register at that time. A
proof of residence is either a valid
driver's license with current address, a
non -qualification certificate (this is for
non -drivers and can be obtained at the
Motor Vehicle Department), or a sworn affi-
davit by a registered voter who resides in
the same precinct.
Eligible voters are urged to register early
to make election day lines shorter.

ELECTION JUDGES
Eligible voters in the City of Eagan who are
interested in serving as Election Judges for
the City Election on November 6, 1979 should
call City Hall at 454-8100.
HOUSE NUMBERING REQUIREMENTS
The City of Eagan has excellent Police, Fire
and Rescue Departments, but many times they
have had to waste valuable time responding
to an emergency because they could not iden-
tify the exact address. Eagan Ordinance No.
58 requires the homeowner to put in place,
on the street side of their house, house
numbers at least three (3) inches in height
in a contrasting color. The more visible
the numbers are, the more quickly emergency
people can aid you.
FIRE STATION #3 AND
ADDITION TO FIRE STATION #1
Construction has started on the addition to
Station #1 and excavation started for Station
#4. A 140 working day completion is expected.
The new 1500 GPM Fire Truck Pumper and the
Rescue Truck are now ordered. Most of the
equipment is ordered and will be delivered
before completion of the construction.
The Eagan Fire Department is looking for
firefighters who are available for fire calls
during the day.
The Eagan City Newsletter is distributed
three times a year as a public service by
the Eagan City Council. The Newsletter
is sponsored by the Public Relations
Committee and prepared through the office
of the City Administrator.
We are still experimenting with the for-
mat and type of news items. To make the
Newsletter better suited to the needs of
the community, citizen feedback is en-

and various relays.

evening throughout the fall.

CPR TRAINING
Two sessions of an 8 hour course in
Cardiopulminary Resuscitation are
being offered by the Eagan Park De-.
partment. This class, taught by the
Dakota County Emergency Care Educators,
will cover basic 1 and 2 person
rescue, blocked air and infant re-
suscitation. A test will be given
for certification in basic rescue.
Maximum class size is 2S; the fee
is $7.S0 to be paid to the Eagan Park
Department.

RENAMING OLD CEDAR AVENUE
The Minnesota Department of Transportation
(Mn/DOT) recently asked the City Council
to change the name of Cedar Avenue so
that there will not be two "Cedar Avenues"
when the new Cedar Avenue Freeway opens.
The City Council solicited ideas for a
name for old Cedar Avenue from residents,
and at the July 2, 1979 Council meeting
the Council selected "Nicols Road" as the
name for old Cedar Avenue. Nicols Road
was selected because of the historical
significance attached to its name in
Eagan. Nicols Railroad Station which was
at the intersection of the railroad tracks
and Cedar Avenue served as a primary means
of transportation for crops and residents
in Eagan's early years. A general store
across the street from Nicols Station was
owned and operated by James Scott. Thus,
the station and the store became Eagan's
first shopping center!
All residents who have a Cedar Avenue
address will have an address change to
Nicols Road, however, all house numbers
will remain the same. This change will
take effect sometime during the spring
of 1980 which is prior to the scheduled
opening of the new Cedar Avenue Freeway
in the fall of 1980. All affected resi-
dents will be notified by letter of the
date of the change well in advance so
that they can make the necessary changes
for mailing purposes.
HIGH LINE ALL PURPOSE TRAIL
One and three quarters mile of asphalt trail
is currently under construction from Pilot
Knob Road to Woodgate Lane. This trail will
serve as a combination bicycle -pedestrian trail
and is the first segment of an overland recre-
ational trail which is planned to cross
Eagan from east to west midway between Co.
Rd. #30 and Cliff Road along the route of
the Northern States Power electric trans-
mission lines. In addition to the main
trail, a walkway through the native prairie
area in Thomas Lake Park and a connection
leading to Thomas Lake Elementary School
are also being built. Construction, which
will include center striping and signs,
should be completed this fall.

f the funds for construction of this
emonstration trail.
ROAD INFO UPDATE
The Cedar Avenue Freeway, scheduled for
opening in the fall of 1980, is a six (6)
lane freeway crossing the river into the City
of Bloomington with access points at County
Road #30, Cliff Road, T.H. #13 and I -35E in
the City of Eagan. The I -35E interchange
is now under construction south of Cliff
Road and west of Nicols Road. I -35E will be
constructed from I -35W in Burnsville through
Apple Valley to the Cedar Avenue Freeway
interchange in Eagan.
The City had been informed by Mn/DOT that
I-494 will be constructed from the City of
Bloomington to Minnesota Trunk Highway #55.
The Mn/DOT plan provides Eagan access to I-
494 at Pilot Knob Road and T.H. 55 and esti-
mates that construction will be completed in
the fall of 1982. A public hearing regard-
ing I-494 will be held on September 27 at
Pilot Knob Elementary School.
There has been much discussion regarding the
status of the I -35E route through Eagan,
specifically the A -1/A-2 alignment in the
Blackhawk Lake area. The City of Eagan had
planned to route the interstate across Black -
hawk Lake, but in December of 1978 the State
Department of Natural Resources denied a re-
quest to bridge the lake because federal
guidelines discourage routing highways over
wetlands if there is a reasonable alternative
There have also been concerns regarding the
A-2 alignment around Blackhawk Lake due to
its proximity to Fish Lake. The relocation
of existing utilities, the rezoning of prop-
erty, the location of collector roads and
how this alignment would affectfuture trans-
portation throughout the community are also
concerns. Therefore, Mn/DOT has prepared
four options, all of which go around the east
side of Blackhawk Lake but offer various
levels of impact to transportation, wetland,
lakes and the years of planning and zoning.
It is expected that Mn/DOT will approve a
specific alignment this fall.
Two existing bicycle trails will connect wit
the overland trail; one on the west side of
Pilot Knob Road which leads south from Co.
Rd. #30 and one on the north side of Wilder-
ness Run Road. These trails are the begin-
nings of a system which the Eagan Advisory
Park Committee hopes will be continued to
provide for safe and convenient biking and
walking connections to schools, parks,
libraries, shopping centers and other points
of interest.
ORDINANCES
The Eagan Police Department would like to
remind the residents of -Eagan of the follow-
ing city ordinances that might apply to
them this fall and winter:
1. Shooting and Weapons Ordinance (reads
in part) No shooting or carrying of uncased
firearms shall be permitted in the City of
Eagan unless the person is the owner or
lessee, or accompanied by the owner or
lessee, on a minimum of five acres of agri-
culturally zoned land, nor shall the dis-
charge of the firearm occur within 500 feet
of any buildings on an adjoining owner's
property or occupied residence. The use of
a single projectile type weapon (including
bow and arrow) is strictly prohibited.
2. Snow Removal (reads in part) No person
shall park or leave standing any vehicle on
any public street or roadway in the City of
Eagan after a snowfall of one (1) inch or
more in depth until after the snow has
been removed or plowed to the curb line, or
until thirty-six (36) hours after the
cessation of such snowfall, whichever
shall occur first. Any car in violation
of this ordinance will be tagged and towed
away at the owner's expense.
3. Snowmobile regulations (reads in part)
It shall be unlawful to operate a snowmobile
on the public streets of the City of Eagan
except to and from his or a passenger's
residence by the most direct route and at
a speed no greater than five miles per
hour.

DAKOTA COUNTY LIBRARY
The Dakota County Board of Commissioners
approved an agreement with the City of
Eagan to construct a library with library
administration offices on City property
located east of the new Police Department
facility on Wescott Road and Pilot Knob
Road.
As the project progresses, more information
will be available in the Dakota County
Tribune and the next Eagan Newsletter
which will be printed later this year.
DRUG AWARENESS PROGRAMS
Drug awareness programs will be conducted by
the Eagan Police Department upon request
from private citizens or groups. If you are
interested in such a program, please call
the Police Department at 454-3900.

ducted later this fall for young people,
