streetlighting rate of.$18.00 per acre for 1.31 aores equals $23.58
per quarter.
The City is currently being billed by Dakota Electric for the
streetlight enerqy cost for this listed subdivision located along
Duckwood Drive.

Dear Mr. McKee:
I have reviewed for code compliance the plans submitted for the
above-referenced project. The comments listed below refer to
documents which make up the Minnesota State Building Codes and
applicable codes and ordinances of the City of Eagan. Certain code
deficiencies may not have been included in this report, but this
shall not be construed as an approval of such code deficiencies nor
relieve the responsible parties from complying with said codes.
1. Provide at least one handicap parking space in accordance with
MSBC 1340.0300 Subpart 5. The space must be identified by a
sign visible from inside the vehicle parked in the space as
required by Minn. S.s. 169.346.
2. Provide handicap access to the main entrance of the store
(MSBC 1340.0300 Subpart 3).
3. Toilet rooms in both structures must conform to the handicap
accessibility provisions of MSBC 1340.0300 Subpart 6,
1340.0400, 1340.0500, and 1340.0600.
4. Submit two sets of signed and certified structural plans and
specifications for the car wash (Minnesota Rules Chapter
1800).
5. See UBC Section 514 as amended by MSBC 1305.1750 for the roof
access and stairs in the store.
6. Provide a floor-level landing on both sides o£ all doors which
Complies with the provisions of UBC Sections 3304(h) and (i).

with the provisions of UBC 504(b) fire resistance of walls.

This correspondence ie to confirm receipt of the plana and of our aubsequent meeting
covering the Duckwood 66, to be located at 3575 Pilot Knob Road, Eagan, Minneeota.
The plaxis and epecifications appear to be in general conformity with the etandarde of the
Minneaota Retail Food Store Rules and with this department; however, the following
itema, additiona and/or clarifications are neceseary:
All food service eguipment must meet the applicable Standarda of Construction oF
the National Samtation Foundation (NSF).
Employee hand washing sinks must be conveniently located in all food preparation
and uteneil waehing areae. Provide an employee handwaeh eink.
Ensure that all expoeed wood areas of the custom fabricated faet food island
counter are covered with a pressure laminated plastic material and ie in
conformance with NSF Standard No. 36 (Laminated Plastice for Surfacing Food
Service Equipment).
4. Adequate pDDSOVBd NSF or equivalent ehelving covering the food service operation
must be provided to eneure that food producte, utensile or eingle service articles are
etored at leaet ais inches off the floor.
5. The walls and ceiling in the food preparation, utensil waehing and toilet room
areas must be amooth, non-absorhent, and eaeily cleanable.
6. Tke floara in the food preparation, feod eterage; utensil washing and toilet rooms
must be of a smooth durable material with a coved base at the walUfloor junctures.
7. Provide and routinely use a chemical test kit to determine the etrength of the
eanitizing agent in the final rinse water of the three compartment eink.
8. Lights over exposed food storage, food preparation, food dieplay facilitiea, and
uteneil cleaning and etorage areas must be ehielded or shatter-reeietant.
9. The food storage shelving uaed in the walk-in refrigerators must be NSF approved
stainlesa steel, factory pre-coated epoxy or Metroseal(g) or other approved material
designed for this type of environment. Chrome or zinc-plated shelving without an
approved factory applied hard-baked protective coating is not approved for thie
purpose.

10. Toilet rooms must be provided with aelf-closinp doora, adequate ventilation, hand
cleanser, single-use towels or hand drying devices, tissue paper and waste paper
receptacles. Toilet roome used by women ahall have at least one covered waste
receptacle.
11. All junctures between the wall surface and the edges of attached equipment must
be sealed with an approved caulk/sealing compound (e.g. three compartment sink,
hand sinka, etc.).
12. In accordance with the Minnesota Clean Indoor Air Act, thie establiahment shall be
posted ae NO SMOKING ALLOWED. Signe ahall be place at public entrances.
13. If conduit pipes are provided for beverage lines they muat extend at least three to
four inches above the finished floor elevation at hoth ends and the annular opening
between the beverage lines and the conduit pipe sealed with a hard material and
provided with a cleanable finish.

Dear Mr. Merchak:
In your letter to Carl McKee dated 12/8/89, you referred to UBC Section 514
as amended by MSBC 1305.1750 concerning roof access. This code section re-
quires that "unless specifically exempted by the building official due to
space limitation, roof height above grade or other special consideration...",
a stairway with an angle of 60 degrees or less shall be provided for
access to the roof. Phillips requests that it be permitted to construct a
variation of a dock ladder for access to the roof, as shown by the enclosed
shop drawings from Madison, Inc. and pictures of this device at our Burnsville
station.
There are two alternatives by which Phllips could construct a roof access
device which would be in strict compliance with the above cited code section;
neither are feasi67e. First, Phillips could construct stairs inside the office
portion of the store. However, this portion consists only of a small office
and the cashier's area. Phillips has built hundreds of these service stations
and these areas are designed in such a manner that a11 available space is
utilized by office furniture, computer equipment, safes, equipment controls
and monitoring systems, cash register, etc. There simply is no surplus space
to permit the construction of a stairway as defined by the code.
Our stations are open 24 hours a day. For much of this 24 hour period it is
necessary for security reasons that our cashier be situated behind a locked
door and bullet-proof glass. Locating the roof access stariway in this re-
stricted area would create a security risk by presenting the possibility that
an imposter, or even a legitimate service technician with ulterior motives,
could gain access. This would also impair Phillips' strict policy of per-
mitting only authorized Phillips employees in this area.
The other alternative would be to construct a permanent stairway on the outside
of the building. However, there are prohlems with this as well. First, un-
authorized individuals can gain access to the roof. Phillips has constructed
several such roof access stairways in Chicago and Indianapolis and has ex-
perienced problems with unauthorized individuals getting on the roof. Several
of these incidents have resulted in vandalism. Preventing unauthorized access

would entail building a chain link cage around the stairway, resulting in an
unsightly contraption which would be undesirable to both Phillips and the City
of Eagan.
The height from grade to the top of the roof ineasures only 8'5"; the parapet
wall is an additional 2'8". Only a few individuals access the roof each year.
Finally, Phillips has experienced no problems or complaints with the dock
ladder variation it proposes to use.
Based on the foregoing, Phillips respectfully requests that it be exempted
from UBC Section 514 as amended by MSBC 1305. 1750, and be permitted to
construct the roof access as shown by the enclosed drawings and pictures.

APPLICATION SiTMMARY: An application has been submitted requesting a Variaace
to the required 20' parking setback located on I.ot i, Block 1, George W. Giles Addition.
COMIIIENTS: During the process of laying out the site for wnstruction, a miscalculation
of 7.0' occuned. As a result of this miscalculation, the underground tanks, pump islands
and buildings were placed 7.0' south of the position indicated on the plan. By the time
the mistake was found, the tanks, pump islands and building footings were in place.
The applicant is requesting a modification of the original plan in order to maintain proper
traffic flow into and out of the site by reducing the size of the boulevard along Duckwood
Drive by 7.0'.
T'he applicant ceased all construction on the site when the 7.0' error was noted. Their
new plan would decrease the boulevard by 7.0' without decreasing the landscaping or
berming. In fact, they have submitted a revised landscaping plan in which they have
added additional plantings for screening.
If approved, this Variance shall be submitted to all applicable Code requirements.

Notice of Release
The Minnesota Pollution Control Agency (MPCA) has been informed that a release of petroleum has occurred from
storage tank facilities which you own and/or operate. We apprecia[e your timely notification so this site can be handled
in an efficien[ manner.
Legal Obligations
Federal and state laws require that persons legally responsible for storage tank releases notify the MPCA of the release,
investigate the release and, if necessary, clean up the release. A person is considered legally responsible for a tank
release if the person owned or operated the tank either during or afrer the release, unless specifically exempted under the
law. If you believe that you are not legally responsible for this storage tank release, please contact the project manager
listed below.
If you are not legally responsible for the release, but hold legal or equitable title to the property where the release
occurred, you may volunteer to take corrective action. Responsible persons and volunteers who take corrective action
may be eligible for reimbursement for a major portion of the costs of corrective action. The legislature has established
the Petroleum Tank Release Cleanup Account to reimburse responsible persons and volunteers. The account is
administered by the Petro Board which is part of the Minnesota Department of Commerce. Final decisions regarding the
amount of reimbursement are made by the Petro Board. All questions about eligibility and reimbursement should be
directed to the Petrofund staff at (651) 297-1119 or (651) 297-4203 or I(800) 638-0418.
Request to Take Corrective Action
The MPCA staff requests that you take steps to investigate and, if necessary, clean up the release in accordance with the
enclosed MPCA fact sheets. The site investigation must fully define the extent and magnitude of the soil and/or ground
water contamination caused by the release. A report (Excavation Report and/or Remedial Investigation/Corrective
Action Design (RUCAD)) which details the results of the investigation or concludes that excavation was sufficient to
clean up the release must be submitted to this office within 10 months of the date of this letter. Please refer to MPCA
fact sheets for information pertaining to the amount of work needed at the petroleum release site(s).

Sites with free product (free-floating petroleum), drinking water supply impacts, surface water impacts, indoor vapor
impacts, £ire or explosion hazards, or ground water impacts which pose a significant threat to public health or the
environment, aze considered high priority for staff review. If one or more of these situations apply to your site, an
RUCAD report must be submitted within 90 days. In addition, if you laiow or discover that there is free-product from a
well, excavation, or borehole, you must notify the MPCA within 24 hours and IMMEDIATELY begin interim free
productrecovery.
If you have not already done so, the MPCA recommends that you hire a qualified consulting firm registered with the
Petrofund staff that has experience in conducting petroleum release site investigations and in proposing and
implementing appropriate corcective actions. A list ofregis[ered contractors and consultants is available from the
Petrofund staff. The MPCA reserves the right to reject proposed corrective actions if the requirements of the site
investigation have not been fulfilled. Please note that, under Minn. R. 2890 (2003), you must solicit a minimum of two
competitive proposals on a form prescribed by the Petro Board to ensure that the consulting costs are reasonable.
Questions about bidding requirements should be directed to Petrofund staff.
Required Response
MPCA staff requests a response to this letter within 30 days. Please tell us whether you intend to proceed with the
requested work. If you do not respond within this rime frame, the MPCA staff wil] assume that you do not intend to
comply, in which case the MPCA Commissioner may order you to take corrective action. Failure to cooperate with the
MPCA in a timely manner may result in reduced reimbursement from the Petro Board. See Minn. R. 2890 (2003). The
enclosed fact sheets will provide you with the information necessary to complete a successful investigation and cleanup

The Minnesota Pollution Control Agency (MPCA) staff has reviewed the report, dated
July 7, 2004, for the above-referenced site.
The report provides documentation on petroleum contatnination detected during the performance of soil
borings conducted neaz the site tanks and pump islands. Based on the levels of contamination reported,
MPCA staff will not require an additional invesrigation or corrective action at this time for the petroleum
contamination described above. MPCA staff reserves the right to reopen this file and require addirional
work if in the future more work is determined by MPCA staff to be necessary. If you, or other parties
later come upon any evidence of contamination other than what was previously reported, you aze required
by Minnesota law to notify the MPCA immediately.
The contents of this letter only refer to information reported Co MPCA staff for the activities described
above. This lette7 does not address other types of contamination that may he present at the subject
property. This letter does not release any party from liability for the petroleum contaminarion under
Minn. Stat. § 115C. (2002), or any other applicable state ar federal law.
