Ownership -
Scope - This examination is limited to the design of this particular project only insofar
as the provisions of the Minnesota Plumbing Code,. as amended, anply, and does not tover
the water supply or sewerage aystem to which this plumbing syatem is_connected. the examina-
tion of plans is based upon the supposition that the data on vhich the design is based are
carrect, and that necessary legal authority has been obtained [o conetruct the project.
The responsibility for the design of atructural features and the efficiency af equipment
must be taken by the project designer. Approval is contingent upon satisfactory disposition
of any requirements included vith this report.
Inepections - Special care should be taken to insure that the material and inatallation
oE the plumbing system are in accordance with the provisions of the Minnesota Plumbing Code.
It ia neceseary that the State Health Department make roughing-in and final inapectione
of the plumhing system to de[ermine whether it complies with the Code. Provieiona should
be made for applying an air test at the time of the roughing-in inspection as outlined in
Minn. Rules p. 4715.2820 of the Code. In order to facilitate this work, there is attached
a self-addresaed cerd which should be returned, indicating the name of the plumbing contractor
so [hat arrangements can be made for the State Health Department to be notified hy him as to
the time that the installation will be ready for test and inspec[ions.
No acceptance of the plumbing inatallation can be given until inspec[ion and test of the
roughing-in work (Minn. Rules p. 4715.2820, subp. 2), finished plumbing (Minn. Rules
p. 4715.2820, subp. 3), and inspection of the completed installation by a representative
of the State Health Depar[ment indicates compliance with the provisions of the Code.
Bequirements - (pVEg)
Authorization Eor construction in accordance with the approved plans may be withdracm if
conetruction is not undertaken within a period of two years. The Eact that plans have been
approved does not necessarily mean that recommendations or- requirements for change will not
be made at some later time when changed conditions, additional information or advanced

Requirements:
1. A statement that the plumbing system shall comply with the Minnesota_
Plumbing Code should be included in the specifications (see Minn. Rules
p. 4715.0320 and p. 4715.0330).
2. Verify that the.disinfection is in accordance with the Minnesota
Plumbing Code.
3. Use of 50-50 solder or flux containing lead is now prohibited try State
law on potable water distribution systems. Solder containing less than
.2 percent lead must be used (Section 326.371).
4. Verify that the plastic waste and vent piping is less that 35 feet
in horizontal length,
5• Verify that all vents through the roof are at least 2 inches in diameter.
6. Verify that the inflammable waste traps have air-tight covers.
The inlet water seal must be at least 3 inches and the outlet water
seal must be at least 18 inches.
7. Verify that the infla~able waste traps are constructed in accordance
with the Minnesota Plumbing Code.
8. Verify that the drain for the car wash is installed to permit complete
drainage. A sand trap may be Ynstalled in the waste line prior to
the inflammable waste trap.
9• Provisions for supp]ying 180-degree Fahrenheit water to the three-
compartment sink should be shown on the plans, or provide for chemical
sanitizing.
10. Verify that all threaded hose connections are equipped with vacuum breakers.
11. Verify that the sink in Room 209 is trapped and vented in conformance
with the Minnesota Plumbing Code.
12. Verify that the water closet is the tank type.

Approval of the project deacribed in this letter doea not relieve the

A. Thc City's policy is to assess property at its existing use or zoning
whichever is higher.
B. The City assessed Project #275 in 1980 at the agricultura1/single

C. The existing use is being determined under the terms oE the Planned
' Unic Development Agreemen[ 82-3. ie The zoning and the.use are being

1'he Wa[er Availabili[y Charge is imposed on both residential and
commercial property. On residential property, it is collecced ac
che time a building permit is issued. On commercial property it

UTILITY IMPROVEMENTS
EAGAN CONTRACT 85-T
PROJECT DESCRIPTION
This project is a privately constructed municipal improvement. The project
consisted of the installation of a 2 inch copper water service jacked under
Slater's Road to service the Amoco station at the intersection of Slater's
Road and Cliff Road. It was constructed under a Development Agreement between
the City of Eagan and Winlcler Development and construction documenta that were
prepared by the developer and Probe Engineering and revieved and approved by
the Citq.
RECOMMENDATION FOR PROJECT ACCEPTANCE
To provide the City with a greater degree of assurance that the constructed
project conforme to the requiremente of the construction contract documents,
industry standards and City standards for municipal improvements; it is City
policy that all projects be inapected by a City representative. This project
was inspected in accordance with that policy. The inspectiona and tests per-
formed verify that the work is complete and substantially complies vith the
appropriate requirements and standards. It is, therefore, appropriate that
the City accept this project for perpetual maintenance as stipulated in the
Development Agreement.

Dear Mr. Wobschall:
This letter is a follow up to the telephone conference call
among myself, Greg Soule, and you of September 26, 1988. This is
in regard to Lot 1, Block 1 of Oak Cliff Third Addition and the
adjacent 1.76 acres of outlot A.
It is my understanding that the City of Eagan will issue a
waiver of plat to allow the recording of that certain Warranty
Deed dated October 30, 1987 from Cliff Road Partnership to Robert
R. Schlangen for the 1.7 acres of outlot A lying north of a line
which is parallel with and distant 254.5 feet southerly of, as
measured at a right angle to, the north line of said outlot A,
said parallel line being extended easterly to the easterly line
of said outlot A. A copy of that Deed is enclosed.
Mr. Schlangen will be delivering this letter along with the
original Deed to receive the endorsement for the waiver of plat.
It is also my understanding that the City of Eagan will
allow the replatting of Lot 1, Block 1, Oak Cliff Third Addition
which will include the addition of the north 50 feet of said
254.5 feet to the existing service station parcel.

As part of the settlement of the outstanding issues, Mr.
Schlanqen shall pay the special assessment in the amount of
$3,237.75 which represents that portion of the deferred assess-
ment of the 50 feet of the part of outlot A that he is acquiring.
The check is accompanying this letter. Finally, in consideration
for all of the above and the service station being exempt for any
portion of the deferred assessment, it is my understanding that
the balance of the 204.5 feet of outlot A that is being acquired
by Mr. Schlangen will be subject to the deferred assessment to be
paid when the property is either developed by Mr. Schlangen or
sold:

Submitted herewith for your approval are necessary plans for installation of
4-101000 gallon underground Tjpe P-3 tanks for Storage o£ Regvlar Gasoline,
Premitan Gaslline and Unleaded Gasoline (two tanks manifolded for Unleaded).
These tanks to be installed at Schlangen's AMOCO Service CPnter., Co. Rd #32
and Slaters Roadv Eagan, Minn. R+ao additional 500 gallon underground tanks
will be installed £or storage of waste oil and motor oil.
'Ihis job will be completed by Pump & Meter Sernice., Inc. of Hopkinsp Minn.
10,000 gallon tanks will be installed with 31 tnu'y and be covered with 6"
concrete pad Rith 6-6-10 wire mesh as requi.red by State Code. Smaller tanks
will be installed stith 31 bury in the non-parking area and be in the landscaping
area. Vent lines for larger tanks will terminate 161 above grade and be in
the landscaping area at the Horth edge of the prope=ty and be nrotected try
a concrete burb. We will also install 4 opservation wella as indicated on t§e
plot plan (Item 15 & 15A)

Bitianasbic #50 whe*e galvanized is nicked or thread§d. Piping will be 13ro-
tected by installing anodes as indicated on the plot plan. Tanks will have

on all submersible pumps and impact valves will be installed under each`:dis- -
penser,
Soil testa as taken on September 3., 1985 are attaEhed.
In our oninion the installation of thesa tanks in the manner as stat ed above
wlll orovide adequate and effective corrosion protection for these tanks and
piping at this loc3tion.

The Eagan City Council has adopted an ordinance pertaining to outdoor storage and
display. As a result, outdoor storage/display is not a permitted use. This ordinance
requires a Conditional Use Permit for all outdoor storage/display. In an effort to allow
eacisting businesses ume to comply with this requirement, the City Council allowed until
March 2, 1993 before enforcement would begin.
For your convenience, I have enclosed a copy of the new ordinance which defines outdoor
storage/display and lists minimum requirements to be met. Conditional Use Permit
appiications are available at City Hall should you wish to apply fox this permit Until then,
please remove all outdoor items within 10 days from the date of this letter as they are in
violation of the City Code.
Please inform me of your intent and provide a schedule of compliance as soon as possible.

As your referenced correspondence verlfied, the City of Eagan entered imo an agreement wRh Mr.
Schlangen on September 30, 1988, whereby the northerly 50' of Outlot A, Oak Cliff 3rd Addition, was
assessed for lateral benefk from trunk watermafn, water availability charge (WAC) and the upgrede of Slaters
Road. This was a settlement agreed to by the Ctry whereby Lot t, Block 1, Oak Cliff 3rd Addition, wouid
be exempt hom any portion of similar deferred assessments. Thfs was aCknowledged in your letter of

Dear Jim:
As we discussed, I am trying to determine the status of the special assessments regarding
Bob Schlangen's property, exclusive of the service station. In reviewing the file, it was more
than a couple years ago.
Enclosed is a copy of our letter dated September 29, 1988 to the City of Eagan agreeing
to the settlement, a copy of Greg Soule's Affidavit of March 1989, and a copy of my letter to
you dated April 25, 1990.
We have had several discussions, and it is my understanding that the Ciry was reviewing
the various ordinances regarding the special assessments, and was considering forgiving the rype
of special assessments for which we have raised our concern and assessing against future
development.
We have always objected to that portion of the special assessment that appeared
subsequent to Bob's purchase of the propeny. It could have been assessed when the Cliff Road
addition was platted. There was a special assessment search before Bob bought the property,
and there was nothing of record. It could have been assessed when Bob platted the service
station. It could have been assessed when the building pernut was granted.
The issue was raised for the first time when Bob tried to record title after purchasing an
additional fifty feet. We believe that the letter of September 29, 1988 represents a settlement
negouated with the City. Tom Colbert informed Greg Soule and myself that Jerry Wobschall
would complete the settlement for the Ciry as he (Tom) would be out of town. Clearly, Jerry

was an employee (or at least an agent) of the City. This amounts to an accord and satisfaction
of the disputed assessment under which Bob agreed to settle with $3,000 paid in 1988 and the
balance to be paid when the property was subsequendy developed (which has not yet occurred).
If there had been no agreement, the special assessment could have been assessed when there was
the waiver of the plat.
I am sure your memory is as sketchy as mine after all of these years. Any efforts to
bring this to a conclusion would be greatly appreciated.

Dear Mr. Wobschall:
This letter is a follow up to the telephone conference call
among myself, Greg Soule, and you of Septemher 26, 1988. This is
in regard to Lot 1, Block 1 of Oak C1iff Third Addition and the
adjacent 1.76 acres of outlot A.

It is my understanding that the City of Eaqan will issue a
waiver of plat to allow the recording of that certain Warranty
Deed dated October 30, 1987 from Cliff Road Partnership to Robert
R. Schlangen for the 1.7 acres of outlot A I.ying north of a line
which is parallel with and distant 254.5 feet southerly of, as
measured at a right angle to, the north line of said outlot A,
said parallel line being extended easterly to the easterly line
of said outlot A. A copy of that Deed is enclosed.
Mr. Schlangen will be delivering this letter along with the
original Deed to receive the endorsement for the waiver of plat.
It is also my understanding that the City of Eaqan will
allow the replatting of Lot 1, Block 1, Oak Cliff Third Addition
which will include the addition of the north 50 feet of said
254.5 feet to the existing service station parcel.

As part of the settlement of the outstanding issues, Mr.
Schlangen shall pay the special assessment in the amount of
$3,237.75 which represents that portion of the deferred assess-
ment of the 50 feet of the part of outlot A that he is acquiring.

for all of the above and the sezvice-station-be'inq eX~t for any)

1. He is an attorney with the law firm o£ Best & Flanagan, 3500
IDS Center, Minneapolis, Minnesota and represents the Cliff Road
Partnership, which sold approximately 1.76 acres of Outlot A, oak
Cliff Third Addition to Robert Schlangen.
2. He had cectain telephone conversations with Tom Colbert, the
City Enqineer for the City of Eagan, pursuant to which conversations
Mr. Colbert indicated that the deferred special assessments for the
1.76 acres of Outlot A heing purchased by Mr. Schlangen could be
paid as follows: Lhat portion attributable to approximately 50
frontage feet along Slaters Road at such time as such portion oE the
1.76 acres was added to the existing service station patcel then
owned by Mr. Schlangen, with the remaining deferred special
assessments pertaining to the remaining 200 Erontage feet along
Slaters Road to be payable at such time as a building permit was
obtained for that property or the property was otherwise
"developed".
3. The above-described arrangements for payment of the deferred
special assessments on the 1.76 acres of Outlot A were discussed in
the context of the City issuing a waiver of plat to allow the
recording of a warranty deed from Cliff Road Partnership to Robert
Schlangen Eor that portion of Outlot A. Further conversations
concerning that waiver of plat were conducted with Mr. Jerry
wobschall, at the direction of Mr. Colbert who was goinq on
vacation. Neither Mr. Wobschall nor Mr. Colbert ever indicated that
Mr. Wobschall was an independent contractor or otherwise was unable
to represent and bind the City of Eagan.
4. On or about September 26, 1988, he had a conversation with Mr.
Wobschall and Saul Bernick, at which time the above-described
arrangement for payment of the deferred special assessments was
agreed upon, as well as the fact that any deferred special
assessments for the service station parcel would not be payable as a
condition for obtaining the waiver of plat or the recombination of
the 50 frontage foot portion of ;or 6 cres wit he service
station parcel as a single lot.

our discussions follows the Cauncil's response to the
platting of the additional pieces.
We have been very patient with the hopes that the matter
could be resolved.
A11 we want is an abatement of what was probably an improper
assessment on the service station. We have paid the assbssment
on the first expansion piece, and have agreed to pay any assess-
ment on the second expansion piece at the time of development.
All that is reguired by Bob is the approval of the plat for the
new piece.
