Memo TO: File, 1309 Deerwood Drive FROM: Pam Dudziak, Planner DATE: September 12, 2018 SUBJECT: Zoning Permit—shed Proposal The owner submitted a Zoning Permit application to construct an 8' x 12' shed on this property. The property is 2.06 acres in area, 200' wide by 450' deep, and is zoned R-1. The lot is wooded and the house is set back approximately 90 feet from the front lot line. City Code Section Section 11.40, Subd. 5, Accessory buildings, structures and uses. Part C.1. states "No accessory use or building shall be allowed within a required front yard setback. With the exception of an attached garage, no accessory building or structure may be placed within the front yard." The required front va-d setback for this lot is 30 feet. The front yard is that area of the lot between the front building line of the principal structure and the front lot line, which on this lot is —90 feet deep. Summary of Interpretation The shed is proposed to be located 30 feet from the west side lot line and 50 feet from the front lot line. Thus, the proposed shed location exceeds the "required front yard setback" of 30 feet, however, because the house is set back —90 feet, the shed is within the "front yard." After consultation with City Planner Mike Ridley, the Zoning Permit was approved for the following reasons: • The ordinance was written for typical R-1 lots where the principal structure is placed at the minimum 30' front setback line so the "required front yard setback" and "front yard" generally occupy the same space • The —90 foot setback of the house on this 2-acre lot results in a great disparity between the "required front yard setback" and the "front yard" • The proposed shed is 96 s.f. and does not require a Building Permit • The proposed shed exceeds the 30' minimum structure setback, and is located below street grade and with topography and vegetation minimizing its visibility. • Other zoning performance standards for sheds are satisfied meo To: City ofE•gan From: Bryan a d Amber Frandrup CC: Date: August .8,2018 Re: Zoning .ermit application for 8x12 pre-fab storage shed at 1309 Deerwood Drive,Eagan Comments: Hello, My na e is Bryan Frandrup. After spending 13 years in Rosemount,my wife and I just moved here on July 27t to 1309 Deerwood Drive in Eagan. I have worked in Eagan for 7 years and have been an active ember of the Eagan community through the Eagan Rotary Club. We think it is a great place to raise a f:mily,which is why we decided to move here with our 2-year old daughter. We are equesting permission to install a pre-constructed 8x12 steel storage shed. The shed will be comple rely dark brown to match the color of the house and is of a very high grade steel as evidenced • by its$.,900 cost. I have included a photo of what the shed's design will look like from the manufa turer,who is by the way,a wonderful Eagan manufacturing business-Transamerican Struktu oc! While o r lot is a large 2 acres,it is a unique property whereby locations available to place the shed are quit- limited. Due to major elevation changes and a heavily wooded backyard,there is literally no location the shed could be placed behind the house. Fortunately,the spot we identified is secluded and not visible from the street primarily because it is about 20 feet below street level but also shielded by heav brush and trees. The sheds dark color will also enable it to be quite hidden from the street view. I have i cluded photos for illustration,however photos can still be difficult to gather proper perspec ive. As a result,I've also uploaded a video of the property to YouTube which you should be able to iew by clicking on this link. I would also welcome the opportunity to have anyone from the city out o our home to see the site as I think it would help demonstrate why this is an acceptable locatio and truthfully the only location the shed could be placed due to the aforementioned barriers.
