RE: AGENDA ITEMS FOR THE OCTOBER 28, 1980 ADVISORY PLANNING COMMISSION MEETING
At the September Advisory Planning. Commission Meeting, the Commission requested a
study be done regarding the variances in the City. Staff has researched all the
variances from February, 1975 `which was the point that Ordinance #52 was adopted.
Since February of 1975 the City of Eagan has granted 34 variances of which four
have some relationship to residential lot coverage. Of these four variances, it
appears that not one affects an R-1, Single Family Residential Lot of 12,000 square
feet. The variances that had been granted deal with acreage and when the lots are
re -subdivided they will meet the 20`1 lot coverage. Therefore, it appears that the
City has not deviated from the ordinance provision of the 20% lot coverage require-
ment.
Enclosed is a report listing all the variances from February of 1975 for your re-
view. If you have any questions regarding the variance report or any other items,

APPLICATION SUBMITTED
An application has been submitted for preliminary plat approval, Mari Acres,
2nd Addition, which consists of approximately 30 acres and contains eight lots
and one outlot. The second application submitted is a request for detailed site
plan approval for the first phase of the Community Shopping Center District.
BACKGROUND
As you may recall back in 1979 and the first part of 1980, Hillcrest Development
Corporation submitted an application for preliminary plat, Mari Acres, which con-
sisted of one lot which was to be sold to McDonald's Corporation, and the remain-
der of the property was platted into outlots. The City of Eagan was dedicated an
outlot which consisted of a ponding area for Cedar Avenue. The Advisory Planning
Commission recommended denial of the preliminary plat on the basis that there was
not an overall site plan for the commerical area and that the first phase of de-
velopment did not contain a minimum of 20,000 square feet for the first phase con-
struction.
The Eagan City Council approved the preliminary plat with the understanding that
an overall development plan will be submitted and the first phase of development
would consist of 20,000 square feet.
At the present time, Hillcrest Development Corporation has received a grading per-
mit and is preparing the site for development. Hillcrest Development Corporation
has also submitted an overall plan for the entire community shopping center district
and is also proposing that the fust phase of construction would consist of a two-
story office building which would contain 20,600, which is in excess of the 20,000
square foot minimum requirement. The overall site plan has been submitted for your
review.
Along with the overall site plan, Hillcrest Development Corporation is also proposing
to plat additional area within the Mari Acres and receive detailed site plan approval
for the first phase of construction.

SITE PLAN REVIEW
1. The preliminary plat consists of approximately 30 acres and will contain
eight lots and one outlot. The preliminary plat is based on the overall
development of the 30 acres.Staff is requesting that the preliminary plat
be allowed to be approved for three years, and when each phase of the
shopp' e e ,a ep at be recorded with the undevelopeA
portion being platted as outlots. Therefore, the preliminary plat would
stand for three years.
2. At the present time the City staff did not have any problems with the pre-
liminary plat.
3. The overall site plan has been submitted as requested by the City staff.
The site plan indicates:
a. 3 fast-food establishments, of which McDonald's is one,
b. 2 office buildings,
c. 2 satellite buildings,
d. 1, 110,000 square foot shopping center,
e. one financial center
The buildings which have been proposed cover approximately 12% of the site,
which is under the maximum requirements of Ordinance N52. The overall site
plan has been included for your review and comment.
FIRST PHASE BUILDING
1. Hillcrest Development Corporation is proposing a two-story office building
which would contain 20,600 square feet to be constructed as the first phase
of the Community Shopping Center District.
2. The proposed building will cover 11% of the lot.
3. According to Ordinance N52, 104 parking spaces will be required for the site.
The developer has proposed 114 spaces. The original plan was proposing Erin
Lane as a private street. At the staff meeting, it was brought forth that it
should be a public street, therefore, the developer would have to either re-
design the parking area to provide for a 20 -foot green area along the pro-
posed public street, or a variance would have to be granted to encroach on
the side lot line.
4. The proposed building meets all setback requirements and other ordinance re-
quirements.
5. Proposedlandscaping plan meets City staff approval. If approved, the plat
and site plan should be subject to the following conditions:
a. the preliminary plat shall be approved fornthree years with each
phase of the final plat being recorded as constructed and the re-
mainder of the final plat, which has not been constructed' shall Q

RE: PRELIMINARY PLAT APPROVAL - MARI ACRES 2ND ADDITION
Previously, this 30 -acre parcel of land was platted under Mari Acres 1st Addition,
which provided for the establishment of Lot 1, Block 1 with the remainder being
platted as 3 outlots. The previous report indicated that utilities and streets
were being provided for by the in-place Nicola Avenue and the existing sewer and
water located near the intersection of Nicola and Cliff Road. All necessary ease-
ments and rights-of-way were dedicated with the original platting of Mari Acres.
The 2nd Addition further subdivides the previous outlots into specifically designa-
ted lots and blocks with proposed public right-of-way dedication for Erin Drive to
provide the circular traffic movement on the internal plat. The 2nd Addition also
provides for the development of the first phase of construction for this overall
plat (20,600 square foot office building).. Therefore, the comments on this report
will deal with this first phase office complex development in addition to any
comments relating to the 2nd Addition.
UTILITIES
Sanitary sewer of sufficient size and depth to handle the overall development of
Mari Acres 2nd Addition is readily available in the northwest corner of the inter-
section of Cliff Road and Nicola Road. This sanitary sewer will be extended from
this intersection to the northwest corner of this overall plat in a time sequence
consistent with the phase development. Water main of sufficient size is readily
available along the westside of Nicols Road to provide service to this overall plat.
Internal laterals will have to be constructed.in a time sequence consistent with
the phase development. Overall trunk storm sewer has been provided for during past
utility projects (18b) and by the dedication and construction of the internal pond
under the ownership of the City of Eagan (Outlot C _ Mari Acres). Internal storm
sewer catch basins and laterals will have to be constructed as each respective
phase is developed. This internal storm sewer will flow into the,internal pond pre-
viously dedicated to the City.
STREETS
Access to the 'overall plat is provided by the present in-place Nicola Road. The
2nd Addition plat provides for 3 lots to be created in the southerly portion of this
plat which was formerly referred to as Outlot'-A of Mari Acres. In order to meet the
City's requirement that each lot have a minimum of 60 -foot frontage on a publicly -
dedicated right-of-way, they are proposing to dedicate a southerly extension of Erin
Drive referred to as Erin Lane to provide this access. This will be a fully dedicated
60 -foot right-of-way for public maintenance and jurisdiction. As such, the appropriate
setbacks from public right-of-way will have to be met for the proposed first phase
office building complex on Lot 3 of the 2nd Addition. In addition, a 36 -foot wide
9 ton street will have to be constructed along. Erin Drive from Nicola Road to the
westerly edge of this plat in addition to the construction of a 32 -foot street for
Erin Lane to the south as a part of this first phase development.

APPLICATION SUBMITTED
The first application submitted is a request to rezone approximately 33 acres from
agricultural to R-1 (Residential Single District) and R -2 -(Residential Double Dis-
trict). The second application submitted is a request for preliminary plat approval
for Overhill Farm Addition, which consists of approximately 33 acres and will con-
tain 42 single family lots and 14 duplex lots, 28 units.
COPM4ENTS
The applicant is proposing to subdivide the property because sewer and water and
streets have been provided to his property. The proposed development will consist
of 56 lots. The applicant is proposing to plat duplex lots where his property abuts
Cliff Road and Dodd Road. The remainder of the plat would be single family lots.
Lots 1-7, Block 1 and Lots 1-7, Block 4, would be duplex lots.
The proposed plat appears to,be well designed. All lots meet the minimum lot require-
ments.
The plat continuity has also been provided. The applicant has extended Twiggy Street
from the South Oaks Plat and is also proposing to dedicate park land in conjunction
with the South Oaks Park.
75 -foot half right-of-way shall be required on Cliff Road.
According to the park and ponding formula, 70% of the 10% park dedication has to be
land prior to receiving credit for any of the water. The proposed plat only has
65% of the park as land. Therefore,.only 1.75 acres of park land will receive credit.
The remainder, or 1.55 acres, shall be made as a cash contribution according to the
current park rate at the time final plat is approved. If approved, the plat should
be subject to the following conditions:

APPLICATION SUBMITTED
An application has been submitted requesting Lots 1-12, Ridgecliffe 4th Addition,
be rezoned from R-1, Residential Single District to R-2, Residential Double District
to conform to the revised preliminary plat.
COMMENTS
In April, U. S. Homes Corporation submitted a preliminary plat, Ridgecliffe Addition,
which consisted of 159 single family homes, 216 quadraminium units, and 10 duplex
units. In August, 1980, U. S. Homes submitted another application to revise the
Ridgecliffe 4th and 5th Additions. The original plat for the 4th and 5th Addition
consisted of 136. The revised preliminary plat for Ridgecliffe 4th and 5th consisted
of 120 quadraminium units and 12 duplex units for .an overall net reduction of 11
dwelling units. The revised preliminary plat was approved by the Eagan City Council
on September 16, 1980; with certain conditions. The one condition that is pertinent
to this application is that the Council requested that the zoning be changed to con-
form to the revised plat. Therefore, Orrin Thompson at this time is making applica-
tion to rezone Lots 1-12, Ridgecliffe 4th Addition from R-1 (Residential Single Dis-
trict) to R-2 (Residential Double District). This will then complete the condition
to make the zoning conform to the revised preliminary plat.

duplex lots for single ownership. The lots are 1-5, Block 4, Meadowlands 1st
Addition.
COMMENTS
Again the staff would like to state that for the past year the City staff has
been researching a way to plat duplex, or twin home lots, so that each indivi-
dual lot would not have to be approved by the City once the foundation has been
completed. At the present time, there are only two ways to subdivide property.
The first is the platting process; the second is the waiver of plat. Both re-
quire public hearing and consume a great deal of time. In order to avoid the
applicant having to submit 5 applications for 5 lot splits, the Staff is suggesting
that the Advisory Plaaning Commission and City Council review all 5 at one time,
and staff would issue the waiver of plat for each individual building as permits
are requested. In the past, the City has already done this procedure. This was
granted when Tilsen requested to subdivide the duplex lots on County Road 30, and
also when Zachman Homes applied for 14 lot splits. If this is agreeable with the
Advisory Planning Commission and City Council, we will treat the application for
Son's Construction Co. in the same manner.
The proposed duplex lots are the five lots at the very south end of the Meadowlands
1st Addition.
The applicant has provided a survey as to how he will subdivide lot 2. The re-
mainder of the surveys will come with the individual building permits. If ap-
proved, the waiver of plat shall be subject to the following conditions.
1. Individual services shall be provided to each unit of the duplex.
2. Each lot shall conform to all other ordinance requirements regarding set-
backs and lot coverage.

It is the staff's understanding that Boyer Truck & Equipment purchased Lot 8,
Block 1, Sibley Terminal Industrial Park, which was formerly the location of Brad -
Eagan Goodyear Tire Company, then New Star Car Wash. The building has been in
existence for sometime prior to the purchase by Boyer Truck & Equipment Co.
The applicant is requesting to repair and recondition new and used trucks for
industrial needs. According to Ordinance 52.07, Subdivision 15, this facility
could fit into a'permitted use or a conditional use within the I-1, Limited Indus-
trial District. Since the applicant is proposing outside storage, staff is re-
questing that a conditional use permit be acquired prior to the storage of any
trucks.
The existing building has had outside storage in the past, and the location is
suitable for the proposed type of use.
The applicant has submitted some background information for your review in consider-
ation for the conditional use permit. If approved, the conditional use should be
subject to the following conditions:
1. The outside storage area shall have an asphalt surface and concrete curbing
around the perimeters of the storage area. /
2. (3-1 slope shall be provided on the northSide of the storage

History and Background
Boyer Truck & Equipment, Inc., was incorporated June 18,
1980. The company was established to engage in the final manu—
facturing of trucks for ready—mix cement and construction trades,
the sales of such completed trucks and the used trucks traded in
thereon, and the attendent truck service and body repair and
paint work. It was the intention of the company to locate in the
south Twin Cities metropolitan are in order to serve the Dakota,
Carver and Washington county areas.
C) Boyer Truck & Equipment, Inc., is owned by Philip S. Maas.
Mr. Maas is also the owner and president of BoyerFord Trucks,
Inc. Boyer Ford Trucks was incorporated under Minnesota laws
as McDonald Motor Company on February 15, 1934. The company
went through two name changes in the following years becoming
Bill Boyer Ford, Inc. on October 1, 1964. On August 20, 1979
the name Bill Boyer Ford, Inc., was changed to Boyer Ford
Trucks, Inc., reflecting the company's change from an automo—
bile agency to a truck—only dealership. Boyer Ford Trucks is
located at 2811 Northeast Broadway, Minneapolis'. The company
occupies a 33,000 square foot sales and service facility on a
-6.25 acre site.
Boyer Truck & Equipment has been granted a license by the
State of Minnesota as a truck further manufacturer. This license
has been granted on a temporary basis pending inspection by the
Minnesota Department of Public Safety.

Presently, Boyer Truck & Equipment has eight employees.
Employment is projected to reach 25 people during 1981 with an
estimated annual payroll of approximately $550,000.
Location and Site
Boyer Truck & Equipment is locating at 3291 Terminal
Drive, Eagan. The legal description of this property is Lot 8,
Block 1, Sibley Terminal Industrial Park. This is a 4.6 acre
site with a 18,500 square foot office, service and warehouse
facility.
The following improvements are being made to the property:
Grading and blacktopping of site to the northeast of building and
existing blacktcpto property line, observing setback require—
ments. Install new entrance to Terminal Drive and widen
existing frcnt driveway from 18 feet to 24 feet. Regrade area
100 feet to the north of existing blacktop and install 6 inches
of gravel base. Install approximately 588 feet of concrete curb
and gutter to meet or exceed city recommendation. In addi—
tion, beautification landscaping is planned for Spring 1981.
The grading has been done to provide drainage from the
newly surfaced area to Terminal Drive. Please see drawing

Parkin
The anticipated parking requirements for this operation .
are as follow: 30 automobiles, 12 completed new .trucks, 18
used trucks, plus a maximum of 12 trucks waiting for service
work. The space require for this parking is approximately

COMMENTS
In reviewing Ordinance #52.07, Subdivsion 9, permitted uses in a Neighborhood Busi=
ness District are as follows:
"Stores and shops selling the personal services or goods over the counter. These
include: dairy stores or quick -stop, bakeries, barber shops, beauty parlors,
Christmas tree sales�Yarists, gifts, hardware, hobby shops, laundry and dry-cleaning,
laundromat, phonograph records, photography studios, shoes, sporting goods, variety
stores, off -sale liquor stores, restaurants with sit-down facilities only, lodges,
sports and health clubp, indoor theater, offices, quick -pr nt, e c."
The question comes in interpreting the permitted uses of the phrase -"sit-down restau-
rants only". Therefore, the staff is requesting that the City consider the proposed
izza restaurant be granted a conditional use permit in accordance with Ordinance 52.09,
Subdivision 4C, which states, "The City Council may grant a conditional use permit -as
the use permit was applied for or in modified form, if it determines that the proposed
location of the conditional use is in. accordance with the objectives of the Comprehen-
sive Plan and the purposes of the district in which the site is located, and that it
would not be materially injurious pr properties or_improvements in the vicinity."

The first application submitted is a request to rezone.approximately 33 acres from
agricultural to R-1 (Residential Single District) and R-2 (Residential Double Dis-
trict). The second application submitted is a request for preliminary plat approval
for Cverhill Farm Addition, which consists of approximately 33 acres and will con-
tain 42 single family lots and 14 duplex lots, 28 units.
COMIENTS
The applicant is proposing to subdivide the property because sewer and water and
streets have been provided to his property. The proposed development will consist
of 56 lcts. The applicant is proposing to plat duplex lots where his property abuts
Cliff Road and Dodd.Road. The remainder of the plat would be single family lots.
Lots 1-7, Block 1 and Lots 1-7, Block 4, would be duplex lots.
The proposed plat appears to be well designed. All lots meet the minimum lot require-
ments.
The plat continuity has also been provided. The applicant has extended Twiggy Street
from the South Oaks Plat and is also proposing to dedicate park land in conjunction
with the South Oaks Park.
75 -foot half right-of-way shall be required on Cliff Road.
According to the park and ponding formula, 70% of the 10% park dedication has to be
land prior to receiving credit for any of the water. The proposed plat only has
65% of the park as land. Therefore, only 1.75 acres of park land will receive credit.
The remainder, or 1.55 acres, shall be made as a cash contribution according to the
current park rate at the time final plat is approved. If approved, the plat should
be subject to the following conditions:'
1. Plat shall be subject to Dakota County Plat Commission's review and comments
because the plat abuts Cliff Road.
2. 75 -foot half right-of-way shall be dedicated for Cliff Road.

RE: PRELIMINARY PLAT - OVERHILL FAMi ADDITION
The Public Works Department has the following comments to offer in regards to con-
sideration of the above -proposed preliminary plat:
UTILITIES
Sanitary sewer of sufficient size and capacity is available at the intersection of
the future extension of Wilderness Run Road with the recently upgraded Dodd Road.
This is approximately 500 feet north of the location of this proposed plat. It
will require the extension of this trunk sanitary sewer across an easement that
is presently being acquired from the property immediately to the north and adjacent
to the Overhill Farm Addition plat. This trunk sewer will then be constructed through
the northeast corner of this plat to provide future service for the South Oaks Addition,
which is located to the east and immediately adjacent to this proposed plat. Sub-
sequently, this.sanitary sewer extension will have to be provided for before this
plat can be finaled, as its installation is necessary to provide the sewer service
for this proposed plat.
Water main facilities of sufficient size is readily available along the frontage ad-
jacent to Dodd Road. Internal viater main lateral distribution will be handled as a
part of this plat's development, which will provide a future extension to the South
Oaks Addition.
STREETS
Access to this proposed plat will be provided by way of the recently upgraded Dodd
Road and providing for a connection to the South Oaks Addition.The internal resi-
dential street distribution meets with staff approval and does not have, any proposed
grades that exceed 8%.
GRADING AND DRAINAGE
The overall topography of this proposed plat is situated on a small hill which pro -
video for drainage in all four directions. The majority of the drainage will be
handled by internal storm sewer systems which will be directed into Hay Lake immedi-
ately to the north of this plat, which presently does have an outlet to control the
water elevation. Approximately one-third of the southerly portion of this proposed
plat will drain towards Dodd Road or towards the existing marshy, drainage ditch
parallel to and adjacent to the northside of Cliff Road. This drainage will empty
into the two ponds located within the South Oaks Addition, which ultimately drains
into the pond located on the southside of Dodd Road immediately south of the South
Oaks Addition (LP -28). This pond (LP48) presently does not have an outlet and is
of such an elevation that is creating ponding and flooding problems to,adjacent
properties. It is anticipated that.this pond will requi-re a storm sewer outlet which
will then drain to Hay Lake through the Overbill Farm plat. Because of the present
high water problems associated with the two ponds in South Oaks and Pond LP -28, it
is recommended that the final plat for Overhill Farm Addition not be approved until
storm sewer outlet for Pond LP -28 has been ordered in by Council action.

Some steep grades will be created in the nortli'east corner of this plat due to the
fill required in this vicinity. It is recormended that no slope greater than 2:1
be created outside of this public right -of -::ay. In addition, the existing previously
referenced drainage area adjacent to Cliff Road along the south portionsof this
proposed plat muss be propagated during all future lot developments. Due to the
fact that it presently transgresses across these proposed newly created lots, it
is recommended that it be redefined and reconstructed adjacent to Cliff Road to
eliminate any potential blockage, disturbance, etc. to the development of any in-
dividual sites along the southerly allowance of this plat, or adequate drainage
easements be granted to protect this drainage way.
EASL ENTS AND RIGHTS-CF-1."A.Y
Sufficient right-of=say has been dedi^ated for the recently constructed Dodd Road
adjacent to the .,jest edge of this plat. In the northwest corner of this proposed
plat, the alig^,rent of Dodd Road was realigned slightly to the west.. This has
created a triangular parcel of excess boulevard right-of-way in the extreme north-
east of this plat. It is recommended that this trianz-,alar-shaped parcel of excess
City boulevard right-cf-:^.ay be incorporated into the final plat of the Overhill
Farm Addition. Correspondingly, it is recommended that the old alignment of Dodd
Road in the northwest corner of this plat be vacated pr`_or to final plat approval.
Additional right-of-way will have to be dedicated to provide for a 75 -foot half
right-of-way adjacent to County Road 32 (Cliff Road).
In addition, a specific drainage easement will have to be dedicated adjacent to
Cliff Road along the southerly portion of this plat to provide for continuation
and preservation of the existing drainage swale. There will also have to be suffi-
cient utility easements dedicated to provide for the extension of proposed future
trunk sanitary sewer to the South Oaks Addition. Also, we will have to insure that
adequate drainage and utility easements are provided for the anticipated storm
sewer outlet from Pend LP -28 to Hay Lake (LP -31).
I will be available to answer additional questions regarding this proposed plat at
the Planning Commission Meeting of October 28, 1980.

An application has been submitted for preliminary plat approval, Mari Acres,
2nd Addition, which consists of approximately 30 acres and contains eight lots -
and one outlot. The second application submitted is a request for detailed site
plan apprcval for the first phase of the Community Shopping Center District.
BACKGROUND
As you may recall back in 1979 and the first part of 1980, Hillcrest Development
Corporation submitted an application for preliminary plat, Mari Acres, which con-
sisted of one lot which was to be sold to McDonald's Corporation, and the remain-
der of the property was platted into outlots. The City of Eagan was dedicated an
outlot which consisted of a ponding area for Cedar Avenue. The Advisor, Planning
Commission recommended denial of the preliminary plat on the basis that there was
not an overall site plan for the commerical area and that the first phase of de-
velopment did not contain a minimum of 20,000 square feet for the first phase con-
struction.
The Eagan City Council approved the preliminary plat with the understanding that
an overall development plan will be submitted and the first phase of development
would'consist of 20,000 square feet.
At the present time, Hillcrest Development Corporation has received a grading per-
mit and is preparing the site for development. Hillcrest Development Corporation
has also submitted an overall plan for the entire community shopping center district
and is also proposing that the first phase of construction would consist of a two-
story office building which would contain 20,600, which is in excess of the 20,000
square foot minimum requirement. The overall site plan has been submitted for your
review.
Along with the overall site plan, Hillcrest Development Corporation is also proposing
to plat additional area within the Mari Acres and receive detailed site plan approval
for the first phase of construction.

1. . The preliminary plat consists of approximately 30 acres and will contain
eight lots and one outlot. The preliminary plat is based on the overall
development of the 30 acres. Staff is requesting that the preliminary plat
be allowed to be approved for three years, and when each phase of the
shopping ,:enter is completed, that the plat be recorded with'the undeveloped
portion 'being platted as outlots. Therefore, the preliminary plat would
stand for three years.
2.' At the present time the City staff did not have any problems with the pre-
liminary plat.
3. The overall site plan has been submitted as requested by the City staff.
The site plan indicates:
a. 3 fast-food establishments, of which McDonald's is one,
b. 2 office buildings,
c. 2 satellite buildings,
d. 1, 110,000 square foot shopping center,
e. one financial center
The buildings which have been proposed cover approximately 12% of the site,
which is under the maximum requirements of Ordinance H52. The overall site
plan has been included for your review and comment. .
FIRST PHASE BUILDING
1. Hillcrest Development Corporation is proposing a two-story office building
which would contain 20,600 square feet to be constructed as the first phase
of the Community Shopping Center District.
2. The proposedbuilding will cover 11% of the lot.
3. According to Ordinance #52, 104 parking spaces will be required for the site.
The developer has proposed 114 spaces. The original plan was proposing Erin
Lane as a private street. At the staff meeting, it was brought forth that it
should be,a public street, therefore, the developer would have to either re-
design the parking area to provide for a 20 -foot green area along the pro-
posed public street, or a variance would have to be granted to encroach on
the side lot line.
4. The proposed building meets all setback requirements and other ordinance re-
quirements.
5. Proposed landscaping plan meets City staff approval. If approved, the plat
and site plan should be subject to the following conditions:
a. the preliminary plat shall be approved for three years with each
phase of the final plat being recorded as constructed and the re-
mainder of the final plat, which has not.been constructed shall
be recorded as outlots.

b. the 20,600 square foot office building shall be the first
phase of construction prior to the establishment of any
fast-food facilities.
c. an overall architectural design shall be approved by the
City of Eagan.
d. the $2,000 landscape bond shall be submitted and not re-
leased until one year after the landscaping has been com-
pleted.
e. the plat shall be subject to Md nnesota Department of Trans-
portation and the Dakota County Plat Commission review be-
cause the proposed plat abuts State and County roads.
f. either a 15 -foot variance be granted or the parking lot
layout must be revised to provide for the 20 -foot setback.
g. the proposed trail, which is shown on the overall plan
going around the drainage pond, shall be constructed with
the first phase of development within this area.
h. the circular drive through the access shall be redesigned
to provide for better traffic circulation.
i. the City shall approve each phase of development prior to
issuance of any building permit.
J. the parking lot shall be asphalt, and concrete curbing
shall be provided around the perimeter of the parking area.

RE: PRELIMINARY PLAT APPROVAL - MARI ACRES 2ND ADDITION
Preciously, this 30 -acre parcel of land was platted under Mari Acres 1st Addition,
which provided :or the establishment of Lot 1, Block 1 with the remainder being
platted as 3 outlots. The previous report indicated that utilities and streets
were being provided for by the in-place Nicols Avenue and the existing sewer and
water located near the intersection of Nicols and Cliff Road. All necessary ease-
ments and rights-of-.iay.were dedicated with the original platting of Mari Acres.
The 2nd Addition further subdivides the previous outlots into specifically designa-
ted lots and blocks with proposed public right-of-way dedication for Erin Drive to
provide the circular traffic movement on the internal plat. The 2nd Addition also
provides for the'developmert of the first phase of construction for this overall
plat (20,600 square foot office building). Therefore, the comments.on this,report
will deal :.iith this first phase office complex development in addition to any
comments relating to the 2nd Addition.
UTILITIES
Sanitary sewer of sufficient size and depth to handle the overall development of
Mari Acres 2nd Addition is readily available in the northwest corner of the inter-
section of Cliff Road and Nicols Road. This sanitary sewer will be extended from
this intersection to the northwest corner of this overall plat in a time sequence
consistent with the phase development. Water main of sufficient size is readily
available along the westside of Nicols Road to provide service to this overall plat.
Internal laterals :•fill have to be constructed in a time sequence consistent with
the phase development. Overall trunk storm sewer has been provided for during past
utility projects (196) and by the dedication and construction of the internal pond
under .the v.,mership of the City of Eagan (Outlot C - Mari Acres). Internal storm
sewer catch basins and laterals will have to be constructed as each respective
phase is developed. This internal storm sewer will flow into the internal pond pre-
viously dedicated to the City.
STREETS
Access to the overall plat is provided by the present in-place Nicols Road. The
2nd Addition plat provides for 3 lots to be created in the southerly portion of this
plat which was formerly referred to as Outlot A of Mari Acres. In order to meet the
City's requirement that each lot have a minimum of 60 -foot frontage on a publicly -
dedicated right-of-way, they are proposing to dedicate a southerly extension of Erin
Drive referred to as Erin Lane to provide this access. This will be a fully dedicated'
" 60 -foot right-of-way for public maintenance and jurisdiction. As such, the appropriate
setbacks from public right-of-way will have to be met for the proposed first phase
office. building complex on Lot 3 of the 2nd Addition. In addition, a 36 -foot wide
9 ton street will have to be constructed along Erin Drive from Nicols Road to the
westerly edge of this plat in addition to the construction of a 32 -foot street for
Erin Lane to the south as a part of this first phase development.

GRADING AND DRAINAGE
The grading plan submitted dated 10-20-80 is acceptable to the Engineering Depart-
ment. It provides for internal storm. sewer laterals and catch basins to handle
the drainage, which will then be directed into the internal city pond (Outlot C -
Mari Acres).
EASEMENTS AND RIGHTS -OF 3AY
Sufficient right-of-way is being dedicated for Erin Drive and Erin Lane as a part
of the proposed 2nd Addition. Other than the customary 10 -foot drainage and utili-
ty easements adjacent to the perimeter of the respective lots, no additional ease-
ments or rights-of-way are anticipated to be required with the 2nd Addition as it
relates to the first phase development.
OTHER COh4ENTS
Because the development of Mari Acres and its subsequent Additions, it has been
determined that an internal pedestrian pathway/sidewalk will be required to handle
the anticipated non -motorized traffic. This has been reviewed in conjunction math
the residential.development on the eastside of Nicols Road in addition to the ter-
minus of the City's overall all purpose Highline Trail adjacent to the northeast
corner of this proposed plat. Subsequently, it is recommended that an internal
8 -foot bituminous trail be constructed around the perimeter of the pond in addition
to a 5 -foot concrete side,. -;alk being constructed adjacent to the northerly entrance
of Erin Drive as it connects to Nicols Road (Cedar Avenue).

development at the Planning Commission Meeting of October 28, 1980.

COMMENTS
On September 10, 1980, the Eagan 40 Planned Development was reviewed at the Joint
Meeting between Planning Commission and City Council. The Advisory Planning Commission
accepted the review on the condition that the applicant make formal application to re-
vise the land use within 90 days from the annual review. The applicant at this time
is proposing to meet this requirement.
The original planned development shows planned uses as follows:

RE: WINTER RINKS CLASSIFICATION
At the September 1980 meeting of the Advisory Park Committee, staff presented
a draft proposal for the classification of outdoor skating rinks. (See attach-
ment) At the time of the presentation, staff indicated that it was bringing
this to the advisory committee's attention for review and input, and, that the
staff had intended to meet with representatives of the three local hockey
associations for their review.
On October 15, 1980 staff met with the various hockey association representatives
to review the material as presented to the Advisory Committee, as well as to
review other problems and issues related to the winter program. A memo dated
October 17, 1980 is attached for your review, which is a synopsis of the items.
discussed at that meeting.
The hockey associations were supportive of the staff's plans to classify the
rinks into three categories. In addition, they sighted a recommendation to
close outdoor skating rinks at 9:00 P.M. during the regular skating season;•
rather than the previous time of 9:30 P.M. The parks staff is in agreement
with this recommendation which is born out by lack of'use.during the 9:00 to
9:30 P.M. time period by skaters. Also,.a high degree of vandalism and
supervisory problems are encountered during this 11 hour period.
Action Requested: The Advisory Committee is requested to either approve or
disapprove the classification system for use during the 1980-81 skating
season, and for the system to be re-evaluated throughout the year for
possible changes during ensuing skating years. Action is also requested
to approve or disapprove the closing of facilities at 9:00 P.M. during
regular skating season hours.

RE: WINTER PROGRAM
The department staff has begun its planning for,the up-
coming winter program by reviewing past practices, procedures,
problems, etc. Issues being reviewed can be grouped into
major categories:
1) Maintenance
2) Staffing
3) Length of season/length of skating day
4) Special needs of the hockey associations
5) Budget
6) "Mischief" activities
All of these major issues are further influenced by the
uncertainty.of the weather and the limiting resources of staff,
equipment, time and budget.
In addressing the problems, the department is -considering
the possibility of implanting a "classification system" for
the outdoor skating rinks. This system would, "prioritize"
the rinks in one of three categories. Each category would
interface with the other, in serving the winter program .needs,
while co-ordinating the maintenance and staffing function.
Reasons for classification of rinks
1. Not all rinks have the same volume of usage. In fact,
there is a'dramatic difference in some cases.
2. Provide a quality _experience.that corresponds, to ._'s
the need.
3. Staff can function more efficiently and effectively
with predetermined guidelines.
4. Budgetary: plans can be more precise when guidelines
are clear, and allocation of resources can be fitted
.to the needs of the skaters.
5. Communications with public improved.
6. ?Need for "extended" skating season to accommodate
hockey play off.

Supervised/non-supervised skating rinks.
Volume of usage based on observations over the past
3 skating seasons.

Present: Kathy Dumas, Eagan Hockey Boosters; Jean Morris, Rosemount Area
Hockey Association, Tony Lancette, Eagan Hockey Boosters; Ken Vraa, Eagan
Parks and Recreation Director; Jim McGuffee, Parks Maintenance Foreman;
and Dorothy Peterson, Eagan Recreation Programmer.
The meeting was called by the Parks and Recreation Department to: Introduce
Mr. Vraa to the hockey associations, to provide information regarding the
capabilities and priorities of City maintenance workers in,a snow emergency,
to discuss the proposed classification of•rinks and to hear problems the
associations may be dealing with.
Maintenance Priorities: During.a snow fall of as little as � inch that
creates slippery intersections, all City crews first priority is sanding
streets.
After a 1 or 2 inch snow fall, Park maintenance crews can give ice rinks
normal attention; however, they may be called upon to plow fire stations
and the police department area and flooding of rinks would not be possible.
After a 3 inch or more snow fall, considered a snow emergency, park
maintenance crews must plow.fire stations, the police department area and
cul de sacs. Skating rinks may not be plowed at all.
The Park and Recreation Department Will,be supplied with a practice and
outdoor game schedule from the hockey associations, prior to December 1.
If there is a snow emergency when a game is scheduled, Dorothy Peterson
will call the ice co-ordinator to advise whether the rink ,can be cleared.
Coaches contact ice co-ordinators, ice co-ordinators contact Dorothy
Peterson regarding outdoor ice.
Rink Classification: Based on volume of usage and budgetary planning.
This is a flexible plan and may be revised next season based on this years
attendance, problems, etc. All rinks will open on December 20. Class C
rinks will close on February 8, 1981; Class B on February 15, 1981 and
Class A will remain open at reduced hours as long as possible or until
March 15, 1981. Class C rinks are: Highview, Cedar Pond and unsupervised
pleasure rinks. Class B rinks are: Carnelian, Woodhaven, Pilot Knob and
Lexington. Class A rinks are: Rahn and the Well Site.
In terms of.maintenance, following a snow fall, Class A rinks will be
cleared first, then B and so on. All ice surfaces at a site will be cleared.
On a normal winter day when brooming and flooding is being done, the rounds
of maintenance will be determined by the most fuel cost efficient route.
All rinks, pleasure and hockey, will be given equal treatment and care.
Other items of discussion:
1. Closing time for warming houses was recommended to be 9:00 P.M.
2. Wind chill factor of -300 for closing warming houses will remain
in effect. Park and Recreation Office will inform attendants and
ice co-ordinators at approximately 3:30 P.M. if the warming houses
are to be closed. .Warming house attendants will be informed to
close warming houses early if -30 *wind chill is reached while
they are on duty.
3. Parking problems were discussed. The lots at Carnelian, Rahn and
Woodhaven will be plowed. Parking on the boulevard at any location
is not allowed. Hockey associations to inform coaches that there is
"no parking" in these areas.
4. Shovels in the warming houses will be available on a sign out basis.
A system of locking them up will be devised for coaches.
S. A copy of the warming house attendants job description will be sent
to the hockey associations.' The association will keep the Recreation
Programmer informed of infractions of conduct by attendants.
6. A warming house attendant must be present at all times when a warm-
ing house is used to meet the City's liability requirements.
7. City will paint lines on hockey boards.
8. It was emphasized that communications shall be only -through the
designated staff/association representatives. Staff and association
representative may meet during the season,.but hopefully at season
end to review problems, etc.
9. Other areas of improvements were discussed.
The excellent input from the hockey association representatives is appreciated.
Park and Recreation staff looks forward to an excellent skating season.

SHADE TREE DISEASE CONTROL PROGRAM
The City of Eagan has initiated a Shade Tree Disease Control Program to
meet the requirements of Minnesota State Laws and Department of Agriculture
Rules and Regulations concerning Dutch elm and Oak wilt diseases. Eagan has
established control areas in those parts of the City where control of these
diseases is feasible. Eagan City Ordinance No. 53 authorizes the City Tree
Inspector to order removal of diseased, dead or dying trees, or oak and elm
wood with bark intact. Removal must be within 20 days of notification. The
prompt removal of dead and dying trees is all important in reducing the rate
of spread of these tree diseases.
If a diseased tree is left untreated, close surrounding trees may sub-
sequently become infected resulting in more tree mortalities each year. Oak
wilt and Dutch elm disease are both caused by a fungus. These diseases can
spread rapidly from tree to tree.
DUTCH ELM DISEASE - Dutch elm disease spreads underground
through common rootsystemsor root grafts
which occur when roots of different trees
cross and eventually grow together. Dutch
elm disease is also transmitted overland.
Dead and dying elm trees, as well as elm
wood with the bark intact, can serve as
breeding sites of elm bark beetles. These
beetles carry the fungus from diseased trees
to healthy trees and infect them.
OAK WILT DISEASE - Oak wilt disease is transmitted primarily
underground through root grafts as described
above. These root grafts only occur between
trees of the same species. For example; a
white oak can only root graft with another
white oak. Oak wilt can also spread overland.
The Oak wilt causing fungus can produce
fruiting bodies on red oak trees. Spores pro-
duced by these fruiting bodies are carried by
the wind and/or sap feeding insects and can in-
fect all types of oak trees. While there is
some overland spread of Oak wilt, infection
primarily occurs from'root grafts.
According to the Eagan City Ordinance No. 53, any elm tree which is dead,
nearly dead, or which has been determined to be -diseased must be removed. Also
to be removed is any living or standing oak tree, or part thereof, infected to
any degree with the Oak wilt fungus. Those trees to be removed are marked with
a red or orange "X". Stumps must be removed or debarked to ground level.
Although it is not required, it is suggested that property owners
attempt to disrupt any root grafts between diseased trees and healthy trees.
This root graft disruption may be accomplished with a mechanical trenching
machine or with a chemical soil fumigant. Trenching and soil fumigation
are services available from many landscaping firms and tree services.
The trees may be brought to the City's tree disposal site located on
Coachman Road. Bring only elm and oak trees as permitted by the Metropolitan
Pollution Control Regulations, which prohibit the burning of any wood greater
than 6 inches in diameter and 4 feet in length. Residents, as well as con-
tractors for Eagan residents, may use the site, free of charge. Burning takes
place between the hours of 7:30 AM and 3:30 PM. Diseased wood may be left at
the site after hours.
Elm trees may be cut and split into firewood only if the.bark is removed.
Red oak may be used as firewood only if it is covered with 4 millimeter plastic
during the period of April 15 to July 1, when spores are most likely to be
produced. Wood from white and bur oaks may be cut and split for firewood with-
out any special treatment what so ever since the fungus can not produce spores
on these species of oak.
With your help we can reduce the rate of spread of Dutch elm disease and
Oak wilt. It is important to remove dead and diseased trees.to limit the
spread of these diseases. In addition to combating Dutch elm and Oak wilt
disease, removal of dead an dying trees also protects your family and property
from injury or damage that might occur if this tree or any part of it were to
break off in a storm or high winds.

REASON: STATE SHADE TREE PROGRAM/CITY OF EAGAN REFORESTATION
The Minnesota Department of Agriculture administers the State Shade Tree
Control Program. On November 15 of each year municipalities wishing to
be included in the aid program is required to submit their shade tree
disease control and replanting programs for the following calendar year.
The Commissioner of Agriculture reviews these programs to determine if
the requirements of the law and rules have been met.
In the last legislature session the code was changed and required communities
to establish local, review commissions to review and recommend changes within
the municipality. As the Advisory Park Committee is aware, the City Council
took such action to appoint the Advisory Park Committee to act as the City's
advisory commission on tree's.
Inclosed you will find the proposed 1981 budget work sheet for the tree con-
servation department. The total budget envisions expenditure of $32,024 as
follows: approximately $20,000 for salaries and fringe benefits, supplies
totaling $2,380 and other services and charges amounting to $8,975. These
totals compared to a budget figure of approximately $16,000 for 1980. The
increase in budget is reflected in two areas: one contractual services:
$8,000 has been budgeted for 1981. This amount of money is being programmed
for reforestation of City parks and open spaces. City staff envisions an
aggressive tree reforestationprogramfor 1981 as well as a development and
refinement of improved nursery stock.
The other major area of budget increase is in that of personnel services.
Prior to 1981 the City Forester position has been a halftime position. The
1981 proposed budget indicates a salary level for a full time forester be-
ginning April 1, 1981 and continuing throughout the year.
ACTION REQUESTED: Advisory Park Committee is requested to review, and approve,
the 1981 tree conservation budget for the purposes of submission by November
15 to the Department of Agriculture for State Shade Tree Program reimbursement.
Also attached for committee review is the material sent to Eagan residents
when Dutch Elm or Oak Wilt diseases are suspected.
City staff will review existing control areas for Oak Wilt and Dutch Elm
disease as well as the budget material at the Advisory meeting.

REASON: 1981 ADVISORY COMMITTEE OBJECTIVES
The intent of this item being placed on the November 6 Advisory Park Committee
meeting is to alert the committee that it may wish to begin discussion on
objectives that it may wish to pursue during the calendar year 1981.
The Advisory Park Committee chairman, and the Director of Parks $ Recreation
have previously discussed objectives that the Advisory Committee may wish to
develop. As an example, the Advisory Committee may wish to begin a program
whereby the Advisory Committee tours the City's parks and recreational programs
on a spring and fall basis for the purpose of keeping in touch with current
park problems and programs. And, develop a "Recreational Guide Plan" dealing
with recreational opportunities within the City.
No action is being requested from the Advisory Committee at this time. However,
the Advisory Committee may wish to begin discussion on it's ideas in an effort
to define what issues, problems and goals it would find as significant for the
Advisory Committee to concentrate on.

REASON: 1981 LAWCON GRANT APPLICATION
Although the next round of LAWCON grant applications is still several months
off, it would seem that now is the appropriate time for the Advisory Committee
and staff to begin looking at what its priorities are for possible funding in
the next round of grant applications.
By identifying possible projects at an early date, City staff can plan an
objective approach to developing plans in meeting the criteria of the grant.
This may include such things as an informational meeting with local residents,
as well as identifying areas which would help the grant achieve success. At
this point in time staff has briefly reviewed several grant possibilities,
these include the development of Carlson Lake Park, a development proposal for
Rahn Park, (should the land acquisition be successful) and_a grant application
for the development of Thomas Lake Park.,
The Advisory Committee may wish to identify other park areas for development
or possible land acquisition and bring it to the staff's attention for review
and evaluation. The intention of staff, over the next two months, will be to
review these suggestions to make a determination as to which park area will
have the greatest possibility of success and with greatest benefit to the
Eagan park system.
