06/22/1971 - City Council RegularLl MINUTES OF MEETING OF ASSESSMENT COMMITTEE TOWN OF EAGAN, DAKOTA COWNTY, MINNESOTA June 22, 1971 Those present were Polzin, Knight, Rosene and Hauge. Mr. Jean Parranto appeared on behalf of Eugene Slater requesting review of the assessment on a triangular parcel of property on Highway #13, and Silver Bell Road assessed for road purposes on Silver Bell Road. The Town Attorney indicated that according to his information the triangular parcel was condemned and owned in fee by the Minnesota Highway Department. It was suggested that the two billboards on the property be removed. After considerable discussion, upon motion duly made and seconded, it was recommended that the assessment for Silver Bell Road be determined according to the April 20, 1971 Assessment Committee minutes which would in effect providing for an approximate 75 feet assessment for Silver Bell Road pu+:poses. The Town Clerk was requested to write the Highway Department explaining the situation and recommending that the billboards be removed if this is Highway Department policy. Mr. Parranto then questioned the proposed assessment for sanitary sewer and water laterals in Blackhawk Road and the extension northerly of Kennebec Drive in Cedar Industrial Park. It was noted the laterals were installed in 1967 at the Town's suggestion in order to serve LaHass Corporation. The questiol was whether lots abutting should be assessed when the remainder of the park is platted or connected. An agreement dated January 30, 1967 between the Town of Eagan and Joseph A. Adelman was reviewed in relation to assessments in Cedar Industrial Park. It was recommended upon motion duly made and seconded that there be no interest charged for lateral improvements in the area that was not requested to be served by laterals by the developer. No decision was made as to whether the assessment be done at the time of the platting or at the time of connection. The Town Attorney then reviewed the acquisition of easements in the Elrene Road area, and noted that the action in condemnation had been commenced against the Emma Braun Estate and Egan Realty, Inc. The Committee then retewed with Don Christenson the proposed agreement between the Christensons and Eagan concerning the acquisition of a sanitary sewer trunk line of the Christenson property north of Fish Lake. After consider- able discussion, it was decided to meet on the Christenson property on June 23 at 5:30 P.M. At 5:30 P.M. on June 23 the Committee met with Don Christenson, including Herb Polzin, Don Knight, Keith Gordon and Paul Hauge. The Committee viewed the property and Mr. Gordon indicated that an attempt would be made to avoid the taking of any trees over 4 inches. After considerable discussion, upon motion by Polzin and seconded by Knight, it was recommended that the agreement as proposed between Eagan and the Christensons providing that in the event that any trees over 4 inches is removed or dies within two years from the completion of the construction of the sanitary sewer trunk line that the Christensons be compensated on the basis of 50% of the estimate provided in the Bachman letter of May 28, 1971 determined by the International Tree Evaluation Guide.
