Those present were Polzin, Knight, Rosene, Bolke and Hauge.
The Committee first discussed easements in the process of acquisition
covering Fish Lake sanitary sewer trunk. It was indicated that Mr. Gardeen had
requested payment for the one 13 inch oak tree to be removed at the rate of about
$600 and in addition requested payment for any other trees above 4 inches that
dip as a result of construction within two years following construction. No actioo
w:.s taken on the matter.
The Town Attorney was requested to write Mr. Henry Bruestle at such
time as an easement is acquired from Mrs. Ella Englert indicating that a trunk
line would be installed adjacent to his property and in the event that he chooses
not to grant a temporary easement that we will avoid his property but will pay
him reasonable damages for loss of flowers and will reinstall sod, his driveway,etc.
The Town Attorney was authorized to attempt to settle the Ella Englert
temporary utility easement for the sum of $400. After additional contacts with
Mrs. Englert and upon motion by Polzin, seconded Knight, it was recommended that
the sum of $525 be paid to Mrs. Englert for the temporary easement based on loss
of crops, use of her property for temporary road, loss of access to her property
temporarily, etc.
The Town Attorney indicated that after two days of jury trial in Dakota
County District Court the jury awarded Ralph Ostendorf $8775.00 for approximately
two acres of temporary and permanent highway easement on Cliff Road. After
discussion, upon motion by Knight and seconded by Polzin, it was recommended that
the Town Attorney pursue with Dakota County the possibility of contribution by the
County in the award of this parcel and the Max Norton property and further to
review the proposed assessment on Cliff Road.
The Committee then reviewed the Elrene Road street acquisiton matter
and it was noted that a hearing onthe condemnation cases is scheduled for July 16th
in Hastings.

After discussion upon motion by Knight, seco-c.ded Polzin, it was
recommended that the lateral benefits for sewer and water purposes of trunk linea
be assessed against motel property on the same basis as the assessments levied
against commercial and industrial property.
Upon motion the meeting adjourned and the next meeting was scheduled for
:uly 13th at 7:30 P. M.
