Other new business MINUTES OF ASSESSMENT COMMITTEE TOWN OF EAGAN$ DAKOTA COUNTY, MINNESOTA October 26, 1971 A meeting of the Assessment Committee, Town of Eagan, Dakota County, Minne- sota, was held on October 26, 1971, at 6:30 p.m. Those present were Klein, Polzin, Knight, Rosene, Bolke, Hauge, and Goers. The Committee first reviewed the Virginia McLean property North of Highway No. 55 consisting of approximately 2 acres. It was noted that the assessment nor sanitary sewer was based on 605 feet of easement on the East line of hhe property and 470 feet of assessment for water lateral purposes on the South side. It was recommended that there be no change in the assessment. The Committee then discussed the proposed water area assessments in Sections 13, 14 and 15. It was recommended that the water area assessment figures under Project No. 58 be used in this assessment. Upon motim by Klein seconded by Polzin it was recommended that the cut-off period of rates for lateral assess- ments from trunk lines be determined when the assessment rolls on the.trunk lines are certified to the County. The Committee did not review the proposed Agreement between Inver Grove ll;:ights and Eagan covering water and sewer services to Emerald Hills Mobile Home Park. The Committee then discussed in detail the acquisition of right of way on Cliff Road covering the Dakota County Improvements of 1968 and 1969. It was noted that several possibilities here present: 1), That the benefited property could be assessed along the right of way acquirdd; 2) That payment could be made to each of the property owners on an equal basis in proportion to the amount of the awards to the Ostendorfs and Norton property, in the sum of approximately $8700.00 and $3150.00 each. 3) That the Board could determi_re that the entire Town has benefited from the up -grading of Cliff Road and that the cost be acquired from'the Road and Bridge Fund or Gas Tax Fund paid by the C:,Lnty to the Town. Upon motion by Klein seconded by Knight aye Polzin it war 0 recommended that because of the complications of the assessment, and because it appeared that the entire Town had benefited substantially from the up -grading of the road that the Town Board acquire funds for the payment of the right of way from sources other than direct special benefit assessments. Upon motion duly made and seconded it was recommended that there be no penalty against a property owner, for example Cliff Road Properties along Highway No. 30 and Rahn Road, for the grant of a utility easement paralleling the road right of way in the determining density for development of the pro- perty. It was noted that the density in a development area has not been penalized for the grant of utility easements other than streets in the past. Upon motion duly made and seconded it was recommended that a fire hydrant be installed along the Christ Evangelical Lutheran Church property on Highway No. 30 as consideration for grant of the water trunk easement along the property. Upon motion by Polzin seconded by Knight it was recommended thtt the sum of $200.00 be paid for three acres of lost corn on the Cliff Road Properties lend East of Rahn Road currently farmed by Robert Toombs of Rosemcunt, Upon motion made and seconded i;t was recommended that a letter be sent tr George Huber that any settling of the black top on the Huber property near Highway No. 13 due to the installation of the utility line be paid by the Township or its contractor. Upon motion the meeting adjourned. It will cost you, at the present town evaluation of $4,710,000 as follows: $12,000 home - $ .80 per year 18,000 home - 1.44 per year 22,000 home - 1.86 per year As the town evaluation increases this cost will decrease. In refusing the request, Judge Robert Breuning said he could not approve the $250 cost bond while the com- mission was in contempt of court for not following his June 30 order. He told the commissio that when it revised its Burnsville incorporation to exclude Eagan township—as he ordered MMC to do—he would accept the bond and the formal notice of appeal. Joseph Robbie, MMC chairman, said earlier that the commission had decided to appeal to the state su- preme court "on its own." Breuning's order blocks the appeal until the commission complies with his ruling. His order resulted from a suit by Eagan township. The MMC's notice of ap- peal came after the commis sion was turned down by Gov. Rolvaag when it report- edly asked him to back its action Thursday. The office of Ally. Gen. Walter Mondale also is report- ed to have decided against an appeal. Mondale's staff ®®® was not represented at theme meeting with Rolvaag. 99�� Gov. Rolvaag said he met with the MMC Thursday to receive a progress report on the matter and as a result thinks "any decision to ap- peal the recent court ruling should be made by the com- mission on the basis of theitrb own judgment." 4� He added that "they are dedicated, honest citizens of our state and I am sure they can be relied upon to do what is proper." Rolvaag remove Joseph Robbie from the UMC. He charged that Robbie defied the will of the people when lh�- commission included a por- tion of Eagan in the Burns- ville incorporation. Klaus, in a heated letter to the governor, claimed that Robbie is further defying Eagan voters in appealing the district court order. Rolvaag, in reply to Klaus, said he has no powers of re- moving Robbie or any other member of the commission "merely because he has par- ticipated in the deliberations and decisions of the body charged with responsibilities" of so doing. Other new business MINUTES OF ASSESSMENT COMMITTEE TOWN OF EAGAN$ DAKOTA COUNTY, MINNESOTA October 26, 1971 A meeting of the Assessment Committee, Town of Eagan, Dakota County, Minne- sota, was held on October 26, 1971, at 6:30 p.m. Those present were Klein, Polzin, Knight, Rosene, Bolke, Hauge, and Goers. The Committee first reviewed the Virginia McLean property North of Highway No. 55 consisting of approximately 2 acres. It was noted that the assessment nor sanitary sewer was based on 605 feet of easement on the East line of hhe property and 470 feet of assessment for water lateral purposes on the South side. It was recommended that there be no change in the assessment. The Committee then discussed the proposed water area assessments in Sections 13, 14 and 15. It was recommended that the water area assessment figures under Project No. 58 be used in this assessment. Upon motim by Klein seconded by Polzin it was recommended that the cut-off period of rates for lateral assess- ments from trunk lines be determined when the assessment rolls on the.trunk lines are certified to the County. The Committee did not review the proposed Agreement between Inver Grove ll;:ights and Eagan covering water and sewer services to Emerald Hills Mobile Home Park. The Committee then discussed in detail the acquisition of right of way on Cliff Road covering the Dakota County Improvements of 1968 and 1969. It was noted that several possibilities here present: 1), That the benefited property could be assessed along the right of way acquirdd; 2) That payment could be made to each of the property owners on an equal basis in proportion to the amount of the awards to the Ostendorfs and Norton property, in the sum of approximately $8700.00 and $3150.00 each. 3) That the Board could determi_re that the entire Town has benefited from the up -grading of Cliff Road and that the cost be acquired from'the Road and Bridge Fund or Gas Tax Fund paid by the C:,Lnty to the Town. Upon motion by Klein seconded by Knight aye Polzin it war 0 recommended that because of the complications of the assessment, and because it appeared that the entire Town had benefited substantially from the up -grading of the road that the Town Board acquire funds for the payment of the right of way from sources other than direct special benefit assessments. Upon motion duly made and seconded it was recommended that there be no penalty against a property owner, for example Cliff Road Properties along Highway No. 30 and Rahn Road, for the grant of a utility easement paralleling the road right of way in the determining density for development of the pro- perty. It was noted that the density in a development area has not been penalized for the grant of utility easements other than streets in the past. Upon motion duly made and seconded it was recommended that a fire hydrant be installed along the Christ Evangelical Lutheran Church property on Highway No. 30 as consideration for grant of the water trunk easement along the property. Upon motion by Polzin seconded by Knight it was recommended thtt the sum of $200.00 be paid for three acres of lost corn on the Cliff Road Properties lend East of Rahn Road currently farmed by Robert Toombs of Rosemcunt, Upon motion made and seconded i;t was recommended that a letter be sent tr George Huber that any settling of the black top on the Huber property near Highway No. 13 due to the installation of the utility line be paid by the Township or its contractor. Facilities are designed to be expanded when necessary A franchise operateddcommunity water system now serves the same area. It has a 100,000 gallon elevated storage tank, a 20" x 12" deep well into the Jordan sandstone and a 600 gallon per minute fountain. It is capable of serving up to 600 homes without expan- sion of the existing supply or storage. A second community system is under construction and will be turned over to the township for municipal operation upon completion. PAUL, AHNN., FRIDAY, JULY 10, 1964 Final Mam ets - PMUE -LU Urav'i,� Robbie Ouster' Asked The Minnesota municipal commission (MMC) today was turned down by Dakota county district court at Hastings, in an attempt to file a notice of appeal in the ruling that the MMC amend its Burnsville incorporation order. In refusing the request, Judge Robert Breuning said he could not approve the $250 cost bond while the com- mission was in contempt of court for not following his June 30 order. He told the commissio that when it revised its Burnsville incorporation to exclude Eagan township—as he ordered MMC to do—he would accept the bond and the formal notice of appeal. Joseph Robbie, MMC chairman, said earlier that the commission had decided to appeal to the state su- preme court "on its own." Breuning's order blocks the appeal until the commission complies with his ruling. His order resulted from a suit by Eagan township. The MMC's notice of ap- peal came after the commis sion was turned down by Gov. Rolvaag when it report- edly asked him to back its action Thursday. The office of Ally. Gen. Walter Mondale also is report- ed to have decided against an appeal. Mondale's staff ®®® was not represented at theme meeting with Rolvaag. 99�� Gov. Rolvaag said he met with the MMC Thursday to receive a progress report on the matter and as a result thinks "any decision to ap- peal the recent court ruling should be made by the com- mission on the basis of theitrb own judgment." 4� He added that "they are dedicated, honest citizens of our state and I am sure they can be relied upon to do what is proper." The commission set off sparks in Eagan Tuesday when it failed to comply with , the court order deadline. At that time Robbie said the commission needed additional time to prepare an appeal., In further fireworks today, State Rep. Walter Klaus, Da- kota county, demanded that Gov. Rolvaag remove Joseph Robbie from the UMC. He charged that Robbie defied the will of the people when lh�- commission included a por- tion of Eagan in the Burns- ville incorporation. Klaus, in a heated letter to the governor, claimed that Robbie is further defying Eagan voters in appealing the district court order. Rolvaag, in reply to Klaus, said he has no powers of re- moving Robbie or any other member of the commission "merely because he has par- ticipated in the deliberations and decisions of the body charged with responsibilities" of so doing. "There is no cause for the removal of Mr. Robbie or any other member of this body," the governor said.
