The newly formed Assessment Committee of. the Village of Eagan met
at 4;30 P.M. at the Village Hall. Those present were James Smith, Art Rahn,
Joe Harrison and Donald Knight. Jon Marble was absent.
Upon motion by Rahn, seconded by Smith all members voting yea,
Donald Knight was appointed Chairman and Joe Harrison was appointed Vice -Chairman
of the Committee.
The first item on the agenda was to review the request of the
Council concerning a proposal relating to assessments for street improvements
of County roads. It was noted that it would be important that the assessment
and any payment for right-of-way should be kept separate and not off -set the
other. The Assessment Committee reviewed all possibilities and it noted that
important precedent problems for tuture improvements including condemnation
issues arose.
In the case of Lexington Avenue that was currently facing the
Council, the County Engineer had indicated that he would work with each owner

After considerable discussion, upon motion by Rahn, seconded
Harrison, all members voting yes, it was recommended to the Council that in the
event improvements on•a County road are proposed, that any single-family homes
only whether zoned residential or agricultural be assessed on the basis on one- /
half of the normal residential equivalent in effect at the time of the assessment;
with the balance deferred until such time as a change in zoning or use takes plaei�
Further that in the event that there is any change from the single-family or
agricultural zoned use of the property then at the time of the change of zoning
or use that the property be assessed at the rate for the new zoning category that

was assessed at the time of the street imnro-!ement: together with interest at the
going interest rate in effect at the time of dssessment; that such assessment
be determined on the basis of the unpaid portion of the assessment; further
RESOLVED that if payment is made for right-of-way to such residentially or
agriculturally zoned property along the County road and in the event that a
different use is made to the property and developed, then the owner at the time
of the change of use or development would repay to the Village for the right-of-
way cost to the Village on the basis of the cost at the time of the improvement./
The Committee then discussed tl proposed payments of the acquiai-
tion of easements along Lexington Avenue from single-family owners. Upon motion
by Knight, seconded by Harrison, all members voting yea, it was RESOLVED to
recommend to the Council that the rules above outlined be applied to the acquisi-
tion of easements and street assessments on Lexington Avenue and further, that
the average damage estimate for the two ap;:caisers hired by the Dakota County
Board for appraisal of Lexington Avenue improvement be offered to the owners for
the acquisition of easements.
The Committee next reviewed assessments for sanitary sewer and
water laterals in McCarthy Ridge Addition. Upon motion by Harrison, seconded by
Rahn, all members voting in favor, it was RESOLVED that it be recommended to ,
the Council that the 1972 cost of the installation of laterals in McCarthy Ridge
Addition be determined and that the cost be divided by the number of lots being
served under that project.
A letter from Mr. Pete Parranto concerning his request to remove
$3,320.00 of assessments on Lot 3, Block 3 Effress Addition and pass it on
certain other lots in the Addition was next reviewed. The Committee determined
that the understanding reached between American Cereal Chemists and the developers
of Effress Addition was a private agreement and the request to spread the assess-
ment on Lots 4 & 5, Block 3 from Lot 3, Block 3 did not appear feasible. Upon
