Mr. Richard Stryker and a representative of the Thorson Construction
Compauy appeared in connection with the appearance of DCR Comparq and Thorson
Construction Company regarding an apartment project on Beau d'P.ue Drive West'. of
Rahn Road, It was noted by Mr, Stryker that this was the same project which
rc::oived approval by the APC approximately a year ago but that the cr-.ars
cu:a:ing back to the APC at this time inasmuch as there had been some amendments
to tae original plans. It was noted by the developer that the building, unit
would be the came size, however, there would be an increase in the numuer of
the apartment units from 48 to 108 with a reduction in the size o; L:%i

R-1 to R-2 of the lot closest to Yar'.cee Doodle Road and to recommend the con-

Mr. Jame L. Sowle and his planner appeared in connection with Llys
application of James Sowle for rezoning of the Southeast corner. of Judy eared

to the final approval of the plans by the Village Engineer and Building Inspector,.
Mr, Jerry Lagro.appeared informally in connection with an earlier
request of the planning committee to submit a grading plan and topographical
map in connection with his proposed development near Highway #13 end Lone Oak
Road, Discussion was had between Mr. Lagro and the committee concerning
whether or not in view of the topegaphy of the area the desired number of lots
would be feasible. It was recommended that he make further study of this matter
and try to develop a grading plan to determine actual usage of the propose:: lctj,

The committee then reviewed the letter from Mr. Richard Dougherty of
the Metropolitan Sewer Board requesting reduction in assessments for Comanche
Read for street purposes levied in 1973. It was noted that the Sewer Board had
been notified several times since 1972 when a request was made by the Board for
street improvements and that there had been no objection to the proposed assess-
ment until after the levy of the assessments and the certification of the roll to
tics auditor. It appeared also that the Sewer Board was the main beneficiary of
t%e _xtension of Comanche Road, that it was done at its request, that the land
os tce East side of Comanche Road was extremely steep and had very little benefit-,
that this would offer the only access to the Metropolitan Sewer Poard P1art, that

6. Rose Hill Addition - Contract 484-12. It was recommended that the
Council approve the third and final payment to Widmer Brothers, Inc. in the
amount of $23,447.85 for Contract 484-12 for the installation of streets and
utilities to the Rose Hill Addition and to accept the project for perpetual
maintenance.
7. Nicola Road - MSAS Designation. A proposed Resolution was submitted
to the City Council and staff recommended it be approved providing for 1.5
miles from Cliff Road to Beau D'Rue Drive to be designated as Municipal State
Aid Street.
8. Westbury lst and 2nd Additions--- Pro ect 4396. The Public Works
Director recommended that although the contractor had severely unbalanced
bids, the assessment roll be accepted because of negotiations with the
developer and that the. final assessment hearing be scheduled for January 15,
1985 at 7:00 p.m. at the Eagan City Municipal Center.
9. Lexington Square Addition - Project 4401. The final assessment roll
for Project 4401 consisting of Lexington Square trunk sanitary storm sewer
improvements was presented to the Council and it was recommended that the
Council receive the roll and schedule a final assessment hearing for January
15, 1985 at 7:00 p.m, at the Eagan Municipal Center.
Upon motion by Smith, seconded Thomas, it was resolved that the foregoing
consent agenda items as presented, be approved and authorized to be imple-
mented. All members voted yes.
ADDITIONAL CONSENT AGENDA
1. Blackhawk Road - MWCC Excavation Permit. An application had been
received from the Metropolitan Waste Control Commission for excavation/fill
permit to dispose of excess material that has been accumulating in its ash
disposal basin near the Seneca Waste Water Treatment Plant. The staff recom-
mended approval, subject to compliance with City requirements.
2. Lexington Avenue - Trunk Water Main - Project 0395I. The final
assessment roll regarding Project 4395I covering trunk water main along
Lexington Avenue was presented to the Council and the staff recommended that
the roll be received and that the final assessment hearing be scheduled for
January 15, 1985 at the Eagan Municipal Center at 7:00 p.m.
3. Shoreland Zoning Ordinance Resolution. The City Attorney's office
presented a Resolution providing for the publication of a title and summary of
the Shoreland Zoning Ordinance in order to avoid printing the Ordinance in its
complete draft. It was recommended that the Resolution be adopted.
Wachter moved, Egan seconded the motion to approve the above consent
agenda items. All voted in favor.

Project No. 403 provided for the installation of water main, sanitary sewer,
storm sewer and street improvements under Contract No. 84-12. All construction
work has been completed and the final construction costs have been tabulated
in preparation for the final assessment hearing scheduled for February 5,
1985. The following information is being used in preparation of the Final
Assessment Roll.

It would be ben`ef cial if the City Council could take action on
the following items at their special meeting to be held on January
8, 1985:
1. CONTINUATION OF FINAL ASSESSMENT HEARINGS - SPECIAL ASSESSMENT
OBJECTIONS:
As result of the August 7th and September 18th final assessment
hearings, several property owners submitted objections to the
proposed final assessments for various projects. Consequently,
the City Council continued the final assessment hearing for those
objecting property owners until October 16, at which time the
final consideration was again continued until the January 8, 1985,
special City Council meeting to allow the staff to prepare the
appropriate appraisals and findings of facts to justify the amount
of the assessments. As discussed previously, the appraisals have
only recently been completed and were not available in the time
frame to proceed with the final hearing of the ten objections at
the January 8 special Council meeting.
At the January 2nd Council meeting, the City Council determined
that it would be best to have these special assessment hearings
held over a period of regular Council meetings which are being
recommended as follows:

Appraisals have been received for the four property owners on
Blackhawk Road. It is anticipated that copies of the appraisals
for the other six objections will be received by January 14.
Copies of the related appraisals will be forwarded to the Council
approximately one week prior to the rescheduled final assessment
hearing for that property. Any additional information received
from the property owner will be forwarded to the Council with
their regular Council packet for that appropriate meeting.
ACTION TO BE CONSIDERED ON THIS ITEM: To continue the final
assessment hearing for the above -referenced special assessment
objections from January 8, 1985, to the designated dates.
2. Project 405, Rahn Road Streets - New Public Hearing Requirement:
On January 7,in response to newspaper articles regarding the
Council's authorization of street improvements to Rahn Road,
the Public Works Department received several telephone calls
from property owners who indicated that they had not received
notice of the public hearing and had several concerns regarding
the project. Investigation of these complaints revealed that
38 of the 60 affected parcels to be assessed did not receive
their notice of the public hearing on January 2, 1985. The
mailing list prepared by the special assessment division inadvert-
ently omitted the Cedar Grove 2nd, 3rd, 4th and 5th Additions
which are the majority of the single-family properties taking
driveway access from Rahn Road. Due to this staff error, it
will be necessary to reschedule the public hearing to insure
that all property owners receive notice to protect the integrity
of the special assessment process.
Once a new public hearing date has been scheduled, the Public
Works Director will send a letter of explanation along with
the new notices to explain the situation.
ACTION TO BE CONSIDERED ON THIS ITEM: Schedule a new public
hearing for Project 405 (Rahn Road - Streets) for February 5,
1985.

\1j�1 Councilmembers indicated it was important to keep the rates up to date on an
annual basis and to justify all revisions. . Wachter moved, Egan seconded the
motion to approve the recommendations and order their implementation effective
January 1, 1985. All members voted yea.
CONSENT AGENDA
Upon motion by Wachter, seconded Thomas, it was resolved that the
following consent agenda items be submitted to the Council and be recommended
for approval:
1. Contractors' Licenses. A schedule of contractors licenses having
submitted applications for approval was brought to the Council and it was
recommended that the applications be approved.
2. Personnel Items. It was recommended that in light of the
resignation of Ken Conyers from the Police Department, that Kevin McGrath be
authorized to replace officer Conyers upon submission of a formal resignation
from Mr. Conyers.
It was further recommended that John Sachi be hired as Engineering Tech I
at the established rate of pay for that position that was provided under the
1985 Budget.
3. MnDOT Cost Participation Agreement. A Cost Participation Agreement
under Project 0186 consisting of Cedar Avenue storm sewer project, Agreement
No. 62501 providing for the payment of $58,002.74 from MnDOT to the City for
its share of construction and engineering costs associated with these trunk
storm sewer facilities was recommended to be approved.
4. Water Treatment Plant _ Chaaae Order No. 8. A change order
consisting of seven parts under Contract 083-1 regarding the water treatment
plant was submitted with a total additional amount of $6,917.00 was brought
before the Council and recommended that it be approved.
5. Rose Hill -.Project 0403 - Assessments. The final assessment roll

consisting of the streets and utility improvements in Rose Hill Addition under
Project 0403 was submitted and it was recommended that the assessment roll be
received and that a.public hearing be scheduled on the roll for February 5,
1985 at 7:00 p.m. at the Eagan City Municipal Center.
Upon motion by Wachter, seconded Thomas, it was resolved that the
foregoing consent agenda items as presented, be approved and authorized to be
implemented. All members voted in favor except Wachter who abstained
concerning the application of Ted Wachter Construction Company for
contractor's license.
1983 AUDIT REPORT
City Administrator Tom Hedges explained that the City has recently been
notified by the Municipal Finance Office for the United States and Canada,
that it has received a Certificate of Performance and Commendation concerning
its accounting practices and stated that it consists of special recognition to
the City for work done by its finance office.
CITY INTERN
Mr. Hedges then announced John Hohenstein, a student at Mankato State
University in the Masters Program has been selected as Intern for the City
beginning January 3, 1985 for a six month period. He further recommended the
Council authorize Ed Meister be retained through the month of April.
WEST SERVICE ROAD - VACATION HEARING
Public Works Director, Tom Colbert, announced that the vacation hearing
that had been held concerning the west service road along I -35E had
inadvertently included the wrong description and recommended the Council
reschedule a public hearing for February 5, 1985 at 7:00 p.m. at the Eagan
Municipal Center to consider vacation of the entire roadway. Egan moved,
Wachter seconded the motion to approve the recommendation and authorize its

NOTICE IS HEREBY GIVEN, that the City Council of the City of Eagan,
Dakota County, Minnesota, will meet at the Eagan Municipal Center located at

to the Minnesota Statutes, Section 429.081 by serving notice of appeal upon
the Mayor or City Clerk within, thirty (30) days after adoption of the
assessment and filing such notice with the District Court within ten (10) days
after service upon the Mayor or City Clerk. No such appeal as to the amount
of any assessment may be made unless a written objection signed by the
affected property owner is filed with the City Clerk prior to the assessment

Notice is further given that pursuant to Minnesota Statutes, Section
435.193 to 435.195, the City of Eagan has adopted City Code Section 2.75
relating to Senior Citizen hardship special assessment deferral.. This
ordinance provides that the Eagan City Council may defer the payment of a
special assessment against homestead property, which is owned and occupied by
a person 65 years of age or older or retired by virtue of disability when the
assessment would create a hardship upon the property owner. Applications for
deferral must be made not later than 90 days after the assessment is adopted.
Further information relating to these assessments and to application for
deferral of assessments may be obtained from the Special Assessment Division
of the Public Works Department and any questions should be directed to that
Division.

Road, Discussion was had between Mr. Lagro and the committee concerning
whether or not in view of the topegaphy of the area the desired number of lots
would be feasible. It was recommended that he make further study of this matter

The committee then reviewed the letter from Mr. Richard Dougherty of
the Metropolitan Sewer Board requesting reduction in assessments for Comanche
Read for street purposes levied in 1973. It was noted that the Sewer Board had
been notified several times since 1972 when a request was made by the Board for
street improvements and that there had been no objection to the proposed assess-
ment until after the levy of the assessments and the certification of the roll to
tics auditor. It appeared also that the Sewer Board was the main beneficiary of
t%e _xtension of Comanche Road, that it was done at its request, that the land

6. Rose Hill Addition - Contract 484-12. It was recommended that the
Council approve the third and final payment to Widmer Brothers, Inc. in the
amount of $23,447.85 for Contract 484-12 for the installation of streets and
utilities to the Rose Hill Addition and to accept the project for perpetual
maintenance.
7. Nicola Road - MSAS Designation. A proposed Resolution was submitted
to the City Council and staff recommended it be approved providing for 1.5
miles from Cliff Road to Beau D'Rue Drive to be designated as Municipal State
Aid Street.
8. Westbury lst and 2nd Additions--- Pro ect 4396. The Public Works
Director recommended that although the contractor had severely unbalanced
bids, the assessment roll be accepted because of negotiations with the
developer and that the. final assessment hearing be scheduled for January 15,
1985 at 7:00 p.m. at the Eagan City Municipal Center.
9. Lexington Square Addition - Project 4401. The final assessment roll
for Project 4401 consisting of Lexington Square trunk sanitary storm sewer
improvements was presented to the Council and it was recommended that the
Council receive the roll and schedule a final assessment hearing for January
15, 1985 at 7:00 p.m, at the Eagan Municipal Center.
Upon motion by Smith, seconded Thomas, it was resolved that the foregoing
consent agenda items as presented, be approved and authorized to be imple-
mented. All members voted yes.
ADDITIONAL CONSENT AGENDA
1. Blackhawk Road - MWCC Excavation Permit. An application had been
received from the Metropolitan Waste Control Commission for excavation/fill
permit to dispose of excess material that has been accumulating in its ash
disposal basin near the Seneca Waste Water Treatment Plant. The staff recom-
mended approval, subject to compliance with City requirements.
2. Lexington Avenue - Trunk Water Main - Project 0395I. The final
assessment roll regarding Project 4395I covering trunk water main along
Lexington Avenue was presented to the Council and the staff recommended that
the roll be received and that the final assessment hearing be scheduled for
January 15, 1985 at the Eagan Municipal Center at 7:00 p.m.
3. Shoreland Zoning Ordinance Resolution. The City Attorney's office
presented a Resolution providing for the publication of a title and summary of
the Shoreland Zoning Ordinance in order to avoid printing the Ordinance in its
complete draft. It was recommended that the Resolution be adopted.
Wachter moved, Egan seconded the motion to approve the above consent
agenda items. All voted in favor.

It would be ben`ef cial if the City Council could take action on
the following items at their special meeting to be held on January
8, 1985:
1. CONTINUATION OF FINAL ASSESSMENT HEARINGS - SPECIAL ASSESSMENT
OBJECTIONS:
As result of the August 7th and September 18th final assessment
hearings, several property owners submitted objections to the
proposed final assessments for various projects. Consequently,
the City Council continued the final assessment hearing for those
objecting property owners until October 16, at which time the
final consideration was again continued until the January 8, 1985,
special City Council meeting to allow the staff to prepare the
appropriate appraisals and findings of facts to justify the amount
of the assessments. As discussed previously, the appraisals have
only recently been completed and were not available in the time
frame to proceed with the final hearing of the ten objections at
the January 8 special Council meeting.
At the January 2nd Council meeting, the City Council determined
that it would be best to have these special assessment hearings
held over a period of regular Council meetings which are being
recommended as follows:

Appraisals have been received for the four property owners on
Blackhawk Road. It is anticipated that copies of the appraisals
for the other six objections will be received by January 14.
Copies of the related appraisals will be forwarded to the Council
approximately one week prior to the rescheduled final assessment
hearing for that property. Any additional information received
from the property owner will be forwarded to the Council with
their regular Council packet for that appropriate meeting.
ACTION TO BE CONSIDERED ON THIS ITEM: To continue the final
assessment hearing for the above -referenced special assessment
objections from January 8, 1985, to the designated dates.
2. Project 405, Rahn Road Streets - New Public Hearing Requirement:
On January 7,in response to newspaper articles regarding the
Council's authorization of street improvements to Rahn Road,
the Public Works Department received several telephone calls
from property owners who indicated that they had not received
notice of the public hearing and had several concerns regarding
the project. Investigation of these complaints revealed that
38 of the 60 affected parcels to be assessed did not receive
their notice of the public hearing on January 2, 1985. The
mailing list prepared by the special assessment division inadvert-
ently omitted the Cedar Grove 2nd, 3rd, 4th and 5th Additions
which are the majority of the single-family properties taking
driveway access from Rahn Road. Due to this staff error, it
will be necessary to reschedule the public hearing to insure
that all property owners receive notice to protect the integrity
of the special assessment process.
Once a new public hearing date has been scheduled, the Public
Works Director will send a letter of explanation along with
the new notices to explain the situation.
ACTION TO BE CONSIDERED ON THIS ITEM: Schedule a new public
hearing for Project 405 (Rahn Road - Streets) for February 5,
1985.

\1j�1 Councilmembers indicated it was important to keep the rates up to date on an
annual basis and to justify all revisions. . Wachter moved, Egan seconded the
motion to approve the recommendations and order their implementation effective
January 1, 1985. All members voted yea.
CONSENT AGENDA
Upon motion by Wachter, seconded Thomas, it was resolved that the
following consent agenda items be submitted to the Council and be recommended
for approval:
1. Contractors' Licenses. A schedule of contractors licenses having
submitted applications for approval was brought to the Council and it was
recommended that the applications be approved.
2. Personnel Items. It was recommended that in light of the
resignation of Ken Conyers from the Police Department, that Kevin McGrath be
authorized to replace officer Conyers upon submission of a formal resignation
from Mr. Conyers.
It was further recommended that John Sachi be hired as Engineering Tech I
at the established rate of pay for that position that was provided under the
1985 Budget.
3. MnDOT Cost Participation Agreement. A Cost Participation Agreement
under Project 0186 consisting of Cedar Avenue storm sewer project, Agreement
No. 62501 providing for the payment of $58,002.74 from MnDOT to the City for
its share of construction and engineering costs associated with these trunk
storm sewer facilities was recommended to be approved.
4. Water Treatment Plant _ Chaaae Order No. 8. A change order
consisting of seven parts under Contract 083-1 regarding the water treatment
plant was submitted with a total additional amount of $6,917.00 was brought
before the Council and recommended that it be approved.
5. Rose Hill -.Project 0403 - Assessments. The final assessment roll

consisting of the streets and utility improvements in Rose Hill Addition under
Project 0403 was submitted and it was recommended that the assessment roll be
received and that a.public hearing be scheduled on the roll for February 5,
1985 at 7:00 p.m. at the Eagan City Municipal Center.
Upon motion by Wachter, seconded Thomas, it was resolved that the
foregoing consent agenda items as presented, be approved and authorized to be
implemented. All members voted in favor except Wachter who abstained
concerning the application of Ted Wachter Construction Company for
contractor's license.
1983 AUDIT REPORT
City Administrator Tom Hedges explained that the City has recently been
notified by the Municipal Finance Office for the United States and Canada,
that it has received a Certificate of Performance and Commendation concerning
its accounting practices and stated that it consists of special recognition to
the City for work done by its finance office.
CITY INTERN
Mr. Hedges then announced John Hohenstein, a student at Mankato State
University in the Masters Program has been selected as Intern for the City
beginning January 3, 1985 for a six month period. He further recommended the
Council authorize Ed Meister be retained through the month of April.
WEST SERVICE ROAD - VACATION HEARING
Public Works Director, Tom Colbert, announced that the vacation hearing
that had been held concerning the west service road along I -35E had
inadvertently included the wrong description and recommended the Council
reschedule a public hearing for February 5, 1985 at 7:00 p.m. at the Eagan
Municipal Center to consider vacation of the entire roadway. Egan moved,
Wachter seconded the motion to approve the recommendation and authorize its

The SW 1/4 of the NW 1/4 of the NW 1/4 of Section 10, Township 27,
Range 23, Dakota County, Minnesota
The area proposed to be assessed is all property described above, all as
more fully and particularly described in the assessment roll on file with the
City Clerk in his office, which roll is open to public inspection. Written or
oral objections by any property owner will be considered at the public
hearing.
A property owner may appeal an assessment to the District Court pursuant
to the Minnesota Statutes, Section 429.081 by serving notice of appeal upon
the Mayor or City Clerk within, thirty (30) days after adoption of the
assessment and filing such notice with the District Court within ten (10) days
after service upon the Mayor or City Clerk. No such appeal as to the amount
of any assessment may be made unless a written objection signed by the
affected property owner is filed with the City Clerk prior to the assessment
hearing or presented to the presiding officer at the hearing.
Notice is further given that pursuant to Minnesota Statutes, Section
435.193 to 435.195, the City of Eagan has adopted City Code Section 2.75
relating to Senior Citizen hardship special assessment deferral.. This
ordinance provides that the Eagan City Council may defer the payment of a
special assessment against homestead property, which is owned and occupied by
a person 65 years of age or older or retired by virtue of disability when the
assessment would create a hardship upon the property owner. Applications for
deferral must be made not later than 90 days after the assessment is adopted.
Further information relating to these assessments and to application for
deferral of assessments may be obtained from the Special Assessment Division
of the Public Works Department and any questions should be directed to that
Division.
