MINUTES OF A REGULAR MEETING OF THE EAGAN ADVISORY PLANNING COMMISSION
EAGAN, MINNESOTA
FEBRUARY 27, 1978
A regular meeting of the Eagan Advisory Planning Commission was held on
February 27, 1978, at 7 p.m. at the City Hall. Those present were: Chairman
Harrison, Members Dembroski, Blomquist, Roszak, Hedtke and Hall. Also present
were: City Administrator Hedges, City Engineer Rosene, City Attorney Hauge,
City Planner Voss and Zoning Administrator Runkle.
MINUTES. Upon motion by Blomquist, seconded Dembroski, all members voting
in favor, it was RESOLVED the minutes of the regular January meeting be approved
as distributed.
AGENDA. Bea Blomquist requested that she be permitted to discuss the Metro
Council proposal for amendment to the Transportation and Development Guide at the
foot of the agenda. City Administrator Hedges also noted that the request for
waiver of plat and conditional use by Eagan Realty for truck repair shop had been
requested to be continued by the applicant as had the application for preliminary
plat for Oak Pond Hills 2nd Addition.
DREXEL HEIGHTS PRELIMINARY PLAT. Chairman Harrison convened the public
hearing concerning the application of Pilot Knob Properties for preliminary plat
approval of Drexel Heights Addition East of Pilot Knob and North of Wescott Road
extended. Ralph Wohlers appeared for the applicant. He noted there would be 24
lots in an area with utilities already installed. Henry Braun, a neighboring
property owner, appeared and requested that fencing or property line separation
be installed between his property and the park land and also.had questions about
storm sewer outlets into Fish Lake. All park land within Pilot r"nh F '•�•
Planned Development has been dedicated vita+ aur exception of the outlots and trails
in proposed Drexel Heights Addition. There was discussion concerning the possi-
bility of down zoning the underlying zoning from R-4 to R-1 and Mr. Wohlers indi-
cated that the applicant would Pubmit an application for dowa.zoning. Blomquist
moved and Roczak seconded a motion to recommend approval of the preliminary plat

subject to the submission by the owners of an application to revise the underlying
z6ning from R-4 to R-1. A11 members voted yes, except Hall who abstained.
PILOT KNOB HEIGHTS STH ADDITION PRELIMINARY PLAT. The public hearing con-
cerning the application of Pilot Knob Properties for approval of the preliminary
plat of Pilot Knob Heights 5th Addition was next reviewed. Mr. Wohlers explained
that the area had been zoned at the time of approval of the Planned Development
for commercial purposes and indicated that an application to rezone from Commer-
cial to R-1 will be heard at the next Planning Commission meeting. Roszak moved
and Blomquist seconded a motion to recommend that the preliminary plat be approved
conditioned upon the submission of an application by the owners to rezone the
underlying zoning from R-4 and the Planned Development from Commercial zoning
both to R-1. All members voted yes, except Hall who abstained on the motion.
WILLIAM RYDRYCH - ST. JOHN NEUMANN WAIVER OF PLAT HEARING. William J
Rydrych appeared on behalf of his application for waiver of subdivision regula-
tions for the 0.76 acre parcel zoned Public Facilities intended to be attached
to the property to be purchased by St. John Neumann Catholic Church, The Planning
Commission members discussed the need for platting at the time a building permit
is requested by the owners and there was also discussion concerning the need for
a 33 foot half right-of-way along Deerwood Drive adjacent to the church property.
Hedtke moved and Dembroski seconded a motion to recommend approval of the applica-
tion for waiver of plat - variance from the platting procedure, it being under-
stood that the 0.76 acre parcel would be attached to the land adjacent to it to
be purchased by the church. All members voted in favor.
WILLIAM RYDRYCH - ORDINANCE 1152 VARIANCE. The hearing regarding the appli-
cation of William Rydrych for variance under Ordinance 1152 for 0.4 acres below the
5 acre minim required in agriculturally zoned property was next considered. It
was noted that there was one residence on the property and no intention by Mr.
Rydrych to construct additional buildings at the present time. It was recommend-
ed by the Planner that in the event of future development on the 4.6 acre parcel,

Blomgiiist moved and Hall seconded a motion, with
all members voting in favor, to recommend approval of the variance as requested.
SURREY HEIGHTS 5TH ADDITION PRELIMINARY PLAT. The next hearing convened was
the application of D. H. Gustafson 6 Associates, Inc. for preliminary plat approval
of Surrey Heights 5th Addition South South of Yankee Doodle Road in Section 16.
Larry Frank appeared for the applicant and showed a layout of the complete fourth
phase of Surrey Heights. There would be 9 acres with 44 buildings within Surrey
Heights 4th through 7th Additions and the 5th Addition would include 16 units in
four -quads and eight garages. It was noted that footings had already been in-
stalled and the buildings are under construction in the 5th Addition. Planning
Commission members stated that the applicant had not followed the procedures for
platting and it was expected that the normal ordinance procedures will be followed
In the future. Hedtke moved and Hall seconded a motion to recommend approval of
the preliminary plat for the 5th Addition and all members voted yes.
SURREY HEIGHTS 6TH ADDITION PRELIMINARY PLAT. Upon motion by Hall, seconded
Roszak, all members voting in favor, it was RESOLVED that the Planning Commission
be on record recommending approval of the preliminary plat.for Surrey Heights 6th
Addition.
FEDERAL LAND COMPANY PRELIMINARY PLAT FOR BICENTENNIAL 3RD pnnrriON. The
public hearing concerning the application of Federal.I-^-a Company for preliminary
plat approval of Bicentennial 3rd Addition � the Yankee Square area South of
v.,.,i.« noodle Road was next cone^ -u• Martin Colon and Vernon Colon appeared for
the applicants. It was no, -a that three blocks would be included in the proposal
which would ,provide -or a separated service station with gasoline pumps adjacent
to Yankee Doruie and a service bay behind the existing building. It would also
include a drive-in bank facility and proposed restaurant with food and on -sale
liquor. Planning Commission members expressed a concern about the earlier approval
of the conditional use for a service station and questions arose as to whether the

service station approved by the Planning Commission and Council in 1976 provided
for connecting service bays to the service station. Ordinance #52 requires full
service gasoline stations and a question arose as to whether it may be necessary
to apply for a variance under the ordinance for separated service bays from gas
pumps. Blomquist moved and Eedtke seconded a motion to recommend approval of the
preliminary plat for Bicentennial 3rd Addition subject to determination by the
staff concerning the need for a variance because of a possible revision of plans
for the service station and further, subject to the following conditions recom-
mended by City Planner John Voss in his report of February 22, 1978:
a) No direct access shall be permitted from lots 1 and 2, Block 1 to
Yankee Doodle Road.
b) Access from lot 1, Block 1 to Washington Drive should only be permitted
at a location(s) approved by the City when a building permit is issued
in order to maintain a proper separation from Yankee Doodle Road.
c) Grading and utility plans shall be approved by the City Engineer prior
to approval of the final plat.
d) Detailed site and building plans shall be submitted to the Planning
Commission and Council for approval prior to the issuance of building
permits in accordance with Ordinance #52.09, Subdivision 6D and the
Planned Development Agreement.
e) Sidewalks shall be installed along the west side of Washington Drive in
accordance with the Planned Development Agreement.
f) Street lights shall be installed along Washington Drive in accordance
with a plan submitted by the petitioner approved by the City Council
prior to approval of the final plat.
g) Since the plat abuts Yankee Doodle Road (County Road No. 28), the pre-
liminary plat shall be reviewed by Dakota County prior to approval of
the final plat.
h) Preparation of an environmental worksheet is not recommended since the
development appears to be below the mandatory requirements.
CONDITIONAL USE PERMIT - BICENTENNIAL 3RD ADDITION. The hearing concerning
the application of Federal Land Company for conditional use permit for a restaurant
with on -sale liquor was next considered. The applicants indicated that the main
concern at the present time is to acquire a consensus of the Planning Commission
members as to a restaurant with on -sale liquor', on proposed Lot 1, Block 2, Bicen-

tennial 3rd Addition. Several resi.deits of the Surrey Height' area appeared and
were concerned about increased traffic on Washington Drive and Federal Drive.
Planning Commission members stated that there was an understanding at the time of
the submission of the Planned Development that a restaurant would be constructed
in the Yalatwo Square area. Hedtke moved and Hall seconded a motion to recommend
approval of the conditional use for the proposed restaurant to include on -sale
liquor, subject to the submission of detailed plane before a ti-&.talno p.,,,1c is

PILOT KNOB HEIGHTS PLANNED DEVELOPMENT REVIEW. At the request of the appli-
cant, Blomquist moved and Roszak seconded a motion to continue the application
for annual review of Pilot Knob Heights Planned Unit Development. All members
voted yes.
GOPHER-EAGAN PLANNED DEVELOPMENT. A letter from Mark Kutoff, an owner of
the Gopher -Eagan Planned Development was read indicating that no changes have been
made in the Planned Development proposal and requested approval for an additional
year. Planning Commission members agreed that ordinarily a letter from the owner
of a Planned Development for approval of the annual review for Planned Develop-
ments will be sufficient unless there has been a change or proposed change in the
development or if there are significant changes in the use of adjoining property.
Hall moved and Dembroski seconded a motion with all members voting yes, to recom-
mend approval of the annual review for Gopher -Eagan Planned Development.
DAKOTA COUNTY SPECIAL PERMIT FOR WOOD UTILIZATION SITE. Chuck Lowry, Dakota
County Park Director,.appeared on behalf of the request of the County of Dakota for
a special permit under Ordinance #52 for a wood utilization site in Holland Jensen
Park adjacent to Cliff Road, approximately 250 yards Southwest of Fred Schultz's
dog kennel. A report from Dale Runkle dated February 22, 1978, 35 -SP -1-78 was
reviewed in detail by the Planning Commission members. Mr. Lowry indicated the
Metro Inter-�County Council utilizes a'site at Pig's Eye in St. Paul and further,
that the PCA burning Permit for diseased trees ..i17. expire on April 1, 1978. He

stated there will be some noise from trucks, debarking and chain saws, but that the
temporary site will not be used in excess of two years. Cities and private owners
can bring diseased trees to the site. The county will fence the property and there
will be no burning at the site. Hall moved to recommend approval subject to the
conditions outlined on page 6 of Mr. Runkle's report. There was no second to the
motion. Hedtke then moved and Roszak seconded a motion to recommend approval of
a temporary special permit to expire within nine months after flual approval of
the permit unless an extension is granted and further, subject to the following
conditions:
1) That an attendant be posted at the site at all hours the site is open.
2) That the site have chains or gates at the ingress and egress to prevent
the dumping of unwanted refuse.
3) That the machines on the site be operated only during the hours indi-
cated by the applicant from 9 a.m. to 2 p.m. on weekdays.
All members voted in favor, except Hall who voted no.
SPECIAL APC MEETING. City Administrator Hedges stated that an application
of Dunn S Curry for planned unit development called Eagan Hills West in the area
formerly designated Mission Hills North and preliminary plat for approximately
150 single family lots withiw the proposed Eagan Hills West was not ready for
consideration on February 27th. other items to be considered at the meeting could
be a joint meeting with the Park Committee, particularly regarding park land dedi-
cation, the review of the Procedural Manual for developers' applications in the
City, and also the variance study undertaken by the City staff. After discussion,
the Chairman scheduled a special meeting of the Advisory Planning Commission for
March 14, 1978, between the hours of 7 p.m. and 9:30 p.m. to -Include consideration
of the Dunn 6 Curry Eagan Hills West application and as a joint meeting with the
Park Committee members.
METRO COUNCIL TRANSPORTATION DEVELOPMENT GUIDE POLICY PLAN. Member Blomquist
distributed copies of proposed amendments to the Transportation Development Guide
Policy Plan of the Metro Council, including reclassification of certain segments

of highway within the metropolitan area. In particular, she was concerned about
the designation of Cliff koad - County Road 1132 as an.intermediate arterial in
light of approximately 35 existing driveways and 9 cross streets on Cliff Road
within Eagan. Blomquist moved and Hedtke seconded a motion to recommend that
the City Council write the Metropolitan Council requesting a detailed definition
of the term "intermediate arterial" used in the Transportation Development Guide/
Policy Plan particularly in light of the many existing outlets directly onto
Cliff Road within Eagan. All members voted in favor, except Roazak who voted no.
ADJOURNMENT. Upon motion duly made and seconded, the meeting adjourned at

the City Council write the Metropolitan Council requesting a detailed definition
of the term "intermediate arterial" used in the Transportation Development Guide/
Policy Plan particularly in light of the many existing outlets directly onto
Cliff Road within Eagan. All members voted in favor, except Roazak who voted no.
