MINUTES OF A REGULAR MEETING OP THE EAGAN ADVISORY PLANNING COMMISSION
EAGAN, MINNESOTA
MARCH 28, 1978
A regular meeting of the Eagan Advisory Planning Commission was held on
March 28, 1978, at 7 p.m. at the City Hall. Those present were Chairman Harrison,
Members Blomquist, Roszak, Dembroski, Sperling and Hedtke. Member Hall was ex-
cused. Also present were City Administrator Hedges, City Engineer Rosene, City
Planner Voss, Zoning Administrator Runkle and City Attorney Hauge.
AGENDA. After the Pledge of Allegiance, the Commission members reviewed the
agenda and additional items added to the agenda included the following: a) Dis-
cussion of Sign Ordinance 1;16; b) Change of name of plats by developers; c) Sug-
gestions for including reasons for abstentions or denials; d) Solar Air Rights
Ordinance.
MINUTES. Blomquist moved and Roszak seconded a motion to approve the minutes
of the February 27, 1978 meeting as distributed.
ST. FRANCIS WOOD REZONING AND PRELIMINARY PLAT. Chairman Harrison convened
the public hearing concerning the application of Richard Land Associates - Richard
M. Geifer to rezone approximately 5.5 acres to R-3 and Outlot A of proposed St.
Francis Wood Addition to R-4 and in addition, preliminary plat approval for St.
Francis Wood, consisting of 80 acres. The parcel located West of Lexington and
South of Duckwood Drive in Section 15 had formerly been acted upon by the Planning
Commission on January 24, 1978 and the plat for the single family area then was
designated Eagan Wood. The applicant now requests that the entire 80 acre plat
be labeled St. Francis Wood with three outlots, two of which would be designated
R-3 and one outlot R-4 zoning. The applicant also requested that the Widgeon Way
through the plat be redesignated St. Francis Drive, but Planning Commission members
and staff recommended against a change from Widgeon Way. Also, the City requests
that all cul-de-sacs be labeled Court or Circle. APC members requested a policy
be set up by the City concerning street naming methods for naming cul-de-sacs,
etc. It was also suggested that the Addition be entitled St. Francis Wood 1st

Addition to avoid confusion with future subdivisions. There was discussion con-
cerning the changing of names of plats after original submission of an applica-
tion by an applicant and the confusion it creates in the City records. After
discussion, Roszak moved and Dembroski seconded the motion, with all members vot-
ing in favor, to recommend rezoning of Outlot A to R-4 and Outlots B and C to
R-3, with the balance of the property R-1, Single Family.
B) Roszak then moved to rescind the action of the Advisory Planning Commis-
sion of January 24, 1978, concerning preliminary plat approval and rezoning at
the request of the applicant and to recommend the City Council rescind its action
due to redesignation of the plat and the submission of new applications for platt-
ing and zoning. All members voted yes.
C) Roszak then made a motion with Hedtke seconding the motion, all members
voting yea, to recommend approval of the prel4minary plat of St. Francis Wood 1st
Addition subject to the following:
1. The through street (Widgeon Way) should be platted at this time to
either the South boundary of the property or to Lexington Avenue to insure a con-
tinuous street through the subdivision.
2. An environmental worksheet should be prepared and acted upon by the City
before final approval of this plat.
3. Park dedication requirements should be satisfied.
4. Special setback deviations should be permitted for this wooded area
by the building inspector in accordance with previous City policy.
5. Drainage easements at an elevation specified by the City Engineer should
be required for ponding areas.
6. No direct vehicular access from individual lots should be permitted to
Duckwood Avenue.
7. The preliminary plat should be reviewed by Dakota County since it abuts
a county road (Lexington Avenue).
8. The petitioner should be required to guarantee that all lots will meet
the minimum dimension requirements of the City, including width and area.
9. That cul-de-sacs be renamed as Court or Circle.
10. That the Clerk cross-reference the former name of Eaganwood to St.
Francis Wood 1st Addition.

DREUL HEIGHTS REZONING AND PILOT KNOB HEIGHTS 5TH ADDITION REZONING. The
next hearing that was convened by the Chairman concerned the application of Pilot
Knob Properties to rezone the Drexel Heights subdivision and Pilot Knob Heights
5th Addition in the Pilot Knob Heights Planned Development area near Fish Lake.
Ralph Wohlers appeared for the applicant and it was noted that the Planning Com-
mission recommended at an earlier meeting that the rezoning take place, including
Drexel Heights from R-4, Residential Multiple Planned Development to R-1, Resi-
dential Single PD and further, to rezone Pilot Knob Heights 5th Addition area
designated Commercial under the PD to R-1, Residential Single PD. There were no
objections to the application. Hedtke moved and Blomquist seconded a motion with
all members voting yea, to recommend approval of the rezoning of the two areas
above designated.
KNOB HEIGHTS PLANNED DEVELOPMENT ANNUAL REVIEW. Mr. Wohlers briefly
explained to the Commission members activity in the Pilot Knob Heights Planned
Development in the past year and by a drawing, indicated the parcels still owned
by the developers. Blomquist moved and Hedtke seconded a motion to recommend
approval of the Planned Development for an additional year. All members voted
yes.
DRAGON PALACE CONDITIONAL USE PERMIT. Chairman Harrison convened the public
hearing concerning the application of Frederick Ko for conditional use permit to
allow on -sale 3.2 beer in the Dragon Palace restaurant on Lot 1, Block 1,
Bicentennial Addition within the Yankee Square shopping center. It was noted that
other 3.2, wine and liquor licenses had been issued in the Yankee Square shopping
center and appeared to be compatible with surrounding uses. Mr. Ko was present
and indicated the restaurant has 80 seating capacity and at the present time is
requesting only a conditional use for 3.2 beer license.. Hedtke moved and Dembros-
ki seconded a motion to recommend approval of the application. All members voted
in favor of the motion.
NAEGLE ADVERTISING SIGN PERMITS. Chairman Harrison then convened the public

hearings regarding three petitions of Naegle Outdoor Advertising Company for con-
ditional use permits for three advertising signs located as follows: a) Blackhawk
Road and Highway 1113; b) 1,000 feet South of Yankee Doodle Road on Pilot Knob
Road; c) 1,000 feet East of Pilot Knob Road on Yankee Doodle Road. Mr. Henjum
appeared for the applicant and reviewed the locations. A number of neighboring
affected owners appeared objecting to the location of the signs near Yankee
Doodle and Pilot Knob Roads on the basis of a claimed detrimental effect to ad-
joining property, a potential nuisance of large signs in the area, objections
due to the fact that the advertising signs would be adjacent to the proposed
35B and for other various reasons. It was noted that sign "B" would be located
within the right-of-way of proposed 35E and the Naegle representative stated
that sign "B" would either be moved or a lease would be signed by Naegle that no
compensation would be requested for removal of the sign from MN/DOT at the time
of acquisition of the right-of-way property. It was further noted that certain
variances would be required, including sign "A" because the size exceeded the
allowable limit under Ordinance 1116 and sign "C" because the zoning did not per-
mit advertising signs. A report from the Zoning Administrator, Dale Runkle,
dated March 21, 1978, was.reviewed by the Planning Commission members and other
aspects of Ordinance 1116 and Ordinance 1152 were discussed by the APC members.
Hedtke moved to recommend denial of the application for conditional use permit
for sign "A" for a number of reasons specified by him, including incompatibility
with the principles of Ordinance 252 and the land use guide, that Ordinance 1116
does not specifically provide for erection of billboards in fact, the Ordinance
avoids mention of the provision for billboards, that the conditional use permit
is not suitable under Ordinance 1152 as requested, that the City Council has
discretionary powers to deny conditional use permits and other reasons. Sperling
seconded the motion. The members then suggested that a specific motion be pre=
pared by the City Attorney for submission and review to Planning Commission mem-

bers prior to the next meeting. Hedtke and Sperling then withdrew their motion
and second. Hedtke then moved and Blomquist seconded a motion, with all members
voting in favor, to direct the City Attorney to review the applications, together
with the City staff, to prepare motions appropriate for ieview and adoption by
the Planning Commission at its next meeting concerning the applications. Hedtke
then moved and Blomquist seconded the motion, with all members voting yes, to
continue the public hearings regarding the conditional use permit applications
of Naegle Outdoor Advertising Company for the three advertising signs described
above.
WEST PUBLISHING COMPANY REZONING AND PRELIMINARY PLAT - WEST PUBLISHING
2ND ADDITION. The public hearing regarding West Publishing Company's application
to rezone 15.04 acres from Agricultural to I-1, Limited Industrial, and for pre-
liminary plat approval of West Publishing Company 2nd Addition near the Northwest
corner of Highway 1149 and Wescott Road was next convened. Mr. Ed Ryberg of
Rauenhorst Corporation appeared for the applicants as did a representative of
West Publishing Company. It was noted the additional 15.04 acre parcel was re-
cently purchased to the North of the existing West Publishing property from the
Braun family, but that 3 acres of an original 18 acre parcel was being deeded to
one of the Braun family members owning land directly to the North of that prop-
erty on Highway 1149. There was concern by Planning Commission members that there
not be a separate 3 acre parcel that would result in separate ownership and re-
quest for building permit at some future time but that the 3 acres be attached
to the property to the North. Roszak moved to recommend rezoning and Hedtke
seconded a motion subject to a notice being forwarded by the City to the owner
of the Braun property to the North of the 15 acres that the 3 acre parcel should
be attached to the balance of the property lying Northerly of that land and owned
by the same property owner. All members voted in favor. Roszak then made a
motion with Hedtke seconding the motion to recommend approval of the preliminary

plat for the West Publishing Company 2nd Addition encompassing all of the lst
Addition and the additional 15 acres, subject, however, to the understanding that
a separate 3 acre tax parcel will not be created as the basis for a request for
a building permit and separate use from the land lying Northerly of the 3 acres.
All members voted yes.
RUSTIC HILLS ADDITION REZONING AND PRELIMINARY PLAT HEARING. Chairman
Harrison convened a hearing to rezone Lots 14 and 15 of proposed Rustic Hills
Addition from R-1, Residential to R-2, Residential for duplex purposes and for
preliminary plat approval of Rustic Hills Addition East of Highway #13, North
of Lone Oak Road. Mr. Derrick appeared on behalf of the applicant. The plat
will include 5.74 acres divided into 15 lots including 13 single family and 2
duplex lots. It was noted that the plat for Rustic Hills Addition and zoning
had been approved by the Planning Commission at an earlier date, but the proposal
now is to change two lots to double duplexes. A number of affected neighboring
residents appeared and objected to the density, but in particular the two family
lots along Highway 1113. It was noted that there are virtually no other residen-
tial uses in the area other than single family except for one duplex on Lone Oak
Road. The original plat had only single family uses and it was noted about V5
acres along the East of the area had been sold to the owner directly East because
of the access problem to that parcel. Mr. Jureseck, the purchaser of that V1
acres was present and stated that he would be willing to permit the 131 acres to
be added to his present property for tax purposes. In addition, there was a
suggestion of screening and berming the two lots along Highway 1113 and the
Engineer recommended that additional site grading plans be submitted for appro-
val by the City. Mr. Derrick agreed that the double bungalows would be used
for single family purposes and that the Planning Commission accepted the revision
in the application to allow for only single family homes in the entire subdivi-
sion. Hedtke moved to recommend approval of the preliminary plat for 15 single

family. lots, subject to the following:
a) Submission and approval of the detailed site grading plan by the City
Engineer;
b) Approval of the street connection from Rustic Hills Drive to Trunk
Highway 1113 frontage road by MN/DOT;
c) Satisfaction of park dedication requirements;
d) Approval of the variance for the cul-de-sac beyond the 500 maximum to
675 feet as measured from the frontage road;
e) That adequate screening be provided for the lots adjoining Highway 1113
including the submission and approval of landscape plans to be approved by the
Building Inspector at the time of approval of .building permits.
Roszak seconded the motion and all members voted in favor.
CAMERON DEVELOPMENT COMPANY PRELIMINARY PLAT AND REZONING. The public hear-
ings concerning applications of Cameron Development Company for rezoning from
R-4, Residential to Multiple R-2, PD Residential Double and preliminary plat
approval of Cameron Court Addition in Section 9 adjacent to Bunker Hill Apart-
ments North of Yankee Doodle Road was next convened. At the request of the
applicant and upon motion of Roszak, seconded Dembroski,.all members voting yes,
it was RESOLVED that thepublic hearings concerning the applications be con-
tinued until the next meeting of the Planning Commission on April 11, 1978, at
7 p.m.
PLAT NAME CHANGES. Member Blomquist expressed her views concerning adminis-
trative problems involved when developers change names of plats after original
submission and approval of preliminary plats by the Planning Commission and
Council. It was noted, however, there are cases where plat names must be
changed because of duplication of names, and the same problem with streets, but
administrative records become confusing when the name changes take place after
original submission of applications. Blomquist moved and Roszak seconded a
motion, with all members voting favorably, to include a provision in the proposed
Procedures Manual to encourage developers to select nsmes for their plats at the
initial stage of submission of applications and in addition, to include the

names of streets to avoid confusion by the City and affected individuals.
ABSTENSIONS AND NEGATIVE VOTES. Member Hedtke suggested that Commission
members give reasons in the event that they abstain from voting on certain issues
and in addition, in cases where members vote no on motions before the Commission.
It was also suggested that the minutes reflect additional details regarding
discussions and reasons for action by the Commission, whether action is taken
in favor or against applications being heard by the Commission.
SIGN ORDINANCE 416. Member Hedtke stated that it is important for the
Planning Commission and the Council to review Ordinance 416 because of the pro-
jected increase in applications for pylon signs, advertising signs, etc. in
light of heavy development of proposed freeways in the area. It was noted that
the last revision of Ordinance 416 was completed in March of 1976. There was
discussion concerning recommendation for a committee to restudy Ordinance 416
and the Chairman was requested to submit this recommendation to the City
Council for review and action.
SOLAR RIGHTS ORDINANCE. Chairman Harrison recommended to the Planning
Commission that the Commission and Council consider the adoption of an ordinance
granting property owners the right to retain sun rights for solar energy pur-
poses within the confines of the property owner's land. The Chairman directed
the staff to review and prepare an ordinance for submission to the Planning
Commission at a later time.

will include 5.74 acres divided into 15 lots including 13 single family and 2
duplex lots. It was noted that the plat for Rustic Hills Addition and zoning
had been approved by the Planning Commission at an earlier date, but the proposal
now is to change two lots to double duplexes. A number of affected neighboring
residents appeared and objected to the density, but in particular the two family
lots along Highway 1113. It was noted that there are virtually no other residen-
tial uses in the area other than single family except for one duplex on Lone Oak
Road. The original plat had only single family uses and it was noted about V5
acres along the East of the area had been sold to the owner directly East because
of the access problem to that parcel. Mr. Jureseck, the purchaser of that V1
acres was present and stated that he would be willing to permit the 131 acres to
be added to his present property for tax purposes. In addition, there was a
suggestion of screening and berming the two lots along Highway 1113 and the
Engineer recommended that additional site grading plans be submitted for appro-
val by the City. Mr. Derrick agreed that the double bungalows would be used
for single family purposes and that the Planning Commission accepted the revision
in the application to allow for only single family homes in the entire subdivi-
sion. Hedtke moved to recommend approval of the preliminary plat for 15 single

family. lots, subject to the following:
a) Submission and approval of the detailed site grading plan by the City
Engineer;
b) Approval of the street connection from Rustic Hills Drive to Trunk
Highway 1113 frontage road by MN/DOT;
c) Satisfaction of park dedication requirements;
d) Approval of the variance for the cul-de-sac beyond the 500 maximum to
675 feet as measured from the frontage road;
e) That adequate screening be provided for the lots adjoining Highway 1113
including the submission and approval of landscape plans to be approved by the
Building Inspector at the time of approval of .building permits.
Roszak seconded the motion and all members voted in favor.
CAMERON DEVELOPMENT COMPANY PRELIMINARY PLAT AND REZONING. The public hear-
ings concerning applications of Cameron Development Company for rezoning from
R-4, Residential to Multiple R-2, PD Residential Double and preliminary plat
approval of Cameron Court Addition in Section 9 adjacent to Bunker Hill Apart-
ments North of Yankee Doodle Road was next convened. At the request of the
applicant and upon motion of Roszak, seconded Dembroski,.all members voting yes,
it was RESOLVED that thepublic hearings concerning the applications be con-
tinued until the next meeting of the Planning Commission on April 11, 1978, at
7 p.m.
PLAT NAME CHANGES. Member Blomquist expressed her views concerning adminis-
trative problems involved when developers change names of plats after original
submission and approval of preliminary plats by the Planning Commission and
Council. It was noted, however, there are cases where plat names must be
changed because of duplication of names, and the same problem with streets, but
administrative records become confusing when the name changes take place after
original submission of applications. Blomquist moved and Roszak seconded a
motion, with all members voting favorably, to include a provision in the proposed
Procedures Manual to encourage developers to select nsmes for their plats at the
initial stage of submission of applications and in addition, to include the

names of streets to avoid confusion by the City and affected individuals.
ABSTENSIONS AND NEGATIVE VOTES. Member Hedtke suggested that Commission
members give reasons in the event that they abstain from voting on certain issues
and in addition, in cases where members vote no on motions before the Commission.
It was also suggested that the minutes reflect additional details regarding
discussions and reasons for action by the Commission, whether action is taken
in favor or against applications being heard by the Commission.
SIGN ORDINANCE 416. Member Hedtke stated that it is important for the
Planning Commission and the Council to review Ordinance 416 because of the pro-
jected increase in applications for pylon signs, advertising signs, etc. in
light of heavy development of proposed freeways in the area. It was noted that
the last revision of Ordinance 416 was completed in March of 1976. There was
discussion concerning recommendation for a committee to restudy Ordinance 416
and the Chairman was requested to submit this recommendation to the City
Council for review and action.
SOLAR RIGHTS ORDINANCE. Chairman Harrison recommended to the Planning
Commission that the Commission and Council consider the adoption of an ordinance
granting property owners the right to retain sun rights for solar energy pur-
poses within the confines of the property owner's land. The Chairman directed
the staff to review and prepare an ordinance for submission to the Planning
Commission at a later time.
