MINUTES OF A SPECIAL MEETING OF THE EAGAN ADVISORY PLANNING COMMISSION
EAGAN, MINNESOTA
MARCH 14, 1978
A special meeting of the Eagan Advisory Planning Commission was held on March
14, 1978, at 7:00 p.m. at the City Hall. Those present were: Chairman Harrison,
Members Sperling, Blomquist, Hall and Roszak. Also present were: City Administra-
tor Hedges, City Engineer Rosene, City Planner Voss, Park Director Schmidt, Zoning
Administrator Runkle and City Attorney Hauge.
The Chairman stated that certain neighboring residents to the proposed Dakota
County debarking center in Holland Jensen Park on Cliff Road were present and
wanted to make a short presentation. Mrs. Pam Lane of 890 Lakewood Hills Road
appeared and reported concerning contacts she had made with numerous state agencies
regarding potential noise problems, dutch elm disease spread, and potential traffic
hazards resulting from the proposed debarking center. She indicated that agencies
that have been contacted include the PCA, which recommended an EIS study, and the
EQB which recommended both an EAW and EIS on the project. She also contacted the
University of Minnesota Department of Agriculture regarding dutch elm disease
problems and the Department of Natural Resources. The concern of the neighboring
residents was duly noted by the Chairman who stated that the Planning Commission
had made its recommendation to the City Council and recommended that the neighbor-
ing residents appear at the City Council meeting when the issue will be considered.
EAGAN HILLS WEST PLANNED DEVELOPMENT. The Chairman then convened the public
hearing regarding the Planned Development for Eagan Hills West located in Sections
20 and 29 lying both North and South of County Road #30 and between Blackhawk Road
and Rahn Road. A large number of neighboring.residential property owners appeared
at the meeting. Mr. Rod Hardy and Mr. Astilenidos of Urban Scope representing the
developer appeared. It was noted that the proposal included 386 acres in the
area formerly known as Miaaton Hills North, with 220 acres residential, 50 acres
commercial, with road :IghG-of-way of approximately 38 acres and open space of

approximately 62 acres including 32 acres intended to be credited toward park con-
tribution. It was estimated the development will take 10 to 12 years for comple-
tion, with a first stage consisting of single family adjoining County Road #30 and
Rahn Road. It was noted that the original underlying zoning on the property was
primarily R-4 with the exception of R-1 where the single family is intended to be
developed. Mrs. Elizabeth Bassett appeared as did John Klein regarding the Eagles
Nest Home's proposal on Rahn Road North of Shale Lane and indicated that the con-
figuration of the property for Eagles Nest had changed slightly and asked for re-
confirmation of the use and the zoning. Certain neighboring.property owners to
the North of County Road 1130 questioned the high density area and requested that
a buffer from the single family backyard development to the North and East be pro-
vided. It was noted that vehicle access will be granted from Eagan Hills North of
County Road 1130 on the North side of County Road 1130. There is not intended to be
any revision in the underlying zoning. There was also concern about traffic on
Rahn Road prior to installation of 35E with the high density proposed and the de-
veloper indicated that the high density would not likely be constructed until 35E
is completed. Mr. Hardy stated that screening and setbacks will be taken into
account by the developer and would agree to a 50 foot setback adjoining the exist-
ing single family. Hall moved to recommend approval of the Planned Development
subject to (1) the conditions recommended by the Planner, (2) compliance with all
affected ordinances of the City including a PD Agreement, (3) that Area VI be
developed at a density of 4 to 6 units per acre due to its adjoining the Woodgate
area to the East, (4) an overall density of 3,278 dwelling units, (5) that the
high density areas be subjected to density requirements for arartments contained
in Zoning Ordinance 52.06, subd. 5B and future revisions thereto, (6) that the
approval be subject to an EAW approved by the City, (8) to the submission by the
developer and approval by the City of a plan at the time of platting of the high
density area providing for a suitable buffer bordering the single family develop-
ment pursuant to a plan submitted by the developer and approved by the City.
Blomauist seconded the motion. all members votine in favor.

EAGAN HILLS WEST 1ST ADDITION PRELIMINARY PLAT. The next public hearing con-
vened by the Chairman concerned the application of Dunn 6 Curry Real Estate Manage-
ment, Inc. for preliminary plat approval of Eagan Hills West lst Addition consist-
ing of single family at the Southeast corner of Rahn.Road and County Road 1130.
Mr. James Hill and Mr. Hardy appeared for the applicant. It was noted that the
North cul-de-sac exceeds the 500 foot cul-de-sac requirement by 150 feet. Mr.
Hill indicated that there would be additional dedication for road right-of-way
along County Road #30 and Rahn Road with berming in the green space consisting
of a minimum 4 foot berm along each street. There was further discussion concern-
ing confirmation of the Eagles Nest Home location and it was suggested by the
developer that with a revision in the location of Shale Lane, that Eagles Nest
could be located South of Shale Lane. Mrs. Bassett indicated that plans had been
completed for Eagles Nest Home, but that financing is not completed and that the
proponents of Eagles Nest prefer not to change its location. It was noted that a
sidewalk would be required along both Rahn and County Road 1130 pursuant to the
ordinance. It was noted further that certain lots are below the R-l.area require-
ment of 12,000 square feet and minimum width requirement of 85 feet with the aver-
age net lot size of 12,391 square feet. The proposed plat would yield 2.49 dwell-
ing units per acre. Only one lot North of Shale Lane will have direct access to
County Road 1130 and no lots will have direct access to Rahn Road. There was dis-
cussion concerning the possibility of a thru street from the cul-de-sac through
the Christ Lutheran Church parking lot on County Road #30, but it was recommended
by the City consultants that a thru street not be approved. In addition, the
petitioner proposed a minimum 25 foot side street setback for corner lots along
all streets including, Beaver Dam Road. It was noted that 80 foot right-of-way
street ordinarily requires a 40 foot setback, which is the case with Beaver Dam
Road. The Park Committee representatives indicated that Shale Lane was proposed
to be realigned to take into account the park land proposed East of Beaver Dam -
Road, which would create a larger outlot South of Shale Lane within which the

developer suggested double bungalows. Blomquist moved and Roszak seconded a motion
to recommend approval of the preliminary plat, subject to the following:
1. Completion of park dedication requirements to the City's satisfaction.
It is understood that the dedication for park purposes will consist of an area
outside the 1st Addition primarily located within the NSP power line right-of-way.
2. Submission of landscape plans for screening rear yards along County Road
1130 and installation of sidewalks along County Road 1130 and Rahn Road as required
by the City.
3. Submission of the plat to and approval by Dakota County.
4. The preparation and submission of an EA14 for approval by the City.
5. A satisfactory agreement with Eagles Nest Homes, Inc. concerning the
location of its development on Rahn Road.
6. Approval of the variance for the 650 foot cul-de-sac South of Rahn Road.
7. Compliance with all ordinances including the Planned Development require-
ments.
All voted in favor except Hall who abstained. Hall then moved to recommend that
the City grant a variance to provide for 25 foot sideyard setbacks for corner lots
along Beaver Dam Road and along Rahn Road in the 1st Addition, and further, to
recommend a variance to allow 30 foot front yard setbacks on Beaver Dam Road and
on Rahn Road because of the normal requirement of at least 40 foot setback.
Harrison seconded the motion. All members voted in favor.
There was further discussion concerning the realignment of Shale Lane and the
use of the property South of proposed Shale Lane for double bungalows to avoid the
requirement that the developer return to the Planning Commission for further
authorization. Hall moved and Sperling seconded a motion that in the event the
Park Committee recommends that Shale Lane be straightened, that in order to accom-
modate good land use planning, that the Planning Commission recommend that the
land within the 1st Addition South of proposed Shale Lane be authorized to be
used for double bungalows and to permit platting for that purpose. All voted in

favor except Blomquist who abstained indicating she felt neighboring owners had
not been fully notified concerning the double bungalow use.
EAGLES NEST HOMES, INC. After further discussion, Hall moved to reconfirm the
prior action of the Eagan City Council on August 3, 1976, granting approval to
Eagles Nest Homes, Inc. for the installation of a development for handicapped
persons consisting of four lots, numbered 107 to 110, Block 1, Eagan Hills West
1st Addition. Roszak seconded the motion. All voted in favor, except Blomquist
who abstained indicating the action had already been taken on the motion.
SPECIAL METING - APRIL 11, 1978. Chairman Harrison scheduled a special meet-
ing of the Advisory Planning Commission for 7 p.m. on April 11, 1978, at the City
Hall due to the excessively large agenda at the regular meeting on March 28th.
