The following memorandum is offered as background information
for the special City Council meeting to'be held on Tuesday,
December 12, 1978.
Old Business
A. Dakota County Library facility -- Mayor Murphy has been
contacted by Dakota County regarding the possibility of locat-
ing the County library headquarters in the City of Eagan. The
Dakota County Board of Commissioners and the Dakota County
Library Board would like to meet with the City Council and/
or City staff to discuss the possibility of utilizing a portion
of the 40 acre parcel of property owned by the City of Eagan
for the County library headquarters. Mayor Murphy has pre-
pared a memorandum to the City Council and a Resolution for
review and consideration. Copies of the resolution and the
'memorandum are enclosed on pages C� through y
The City Administrator has enclosed a copy of the letter and
City Council minutes relating to previous action by the City
Council regarding the possibility of locating a library facility
within the City of Eagan. A copy of the letter and City
Council minutes are enclosed on page S through

Public Hearings
A. Imp. Project 257, Storm sewer to Heine Lake to Blackhawk
Lake and Oak Chase Pond outlet -- A public hearing is scheduled
to consider the proposed improvement project 257 which includes
the construction of storm sewer trunk from Thomas Lake to
Blackhawk Lake. A legal notice was advertised in the Dakota
County Tribune for two weeks and all residents affected by th e
proposed improvement were sent legal notice. Director of
Public Works Colbert and Consulting Engineer Rosene conducted
a neighborhood informational meeting at the City Hall on
Thursday, December 7, 1978 to discuss the overall project as
described with those property owners in attendance. Approximately
45 people were present and for additional information regarding
the informational hearing please refer to a memorandum pre-
pared by Director of Public Works Colbert enclosed on pages

SUBJECT: PROPOSED LIBRARY
I am enclosing a resolution for your consideration at the
December 12, 1978 Council meeting. The County wanted something
in writing. The Administrator was going to research previous
Council action in reference to a library facility. The results
of my poll of Council Members on the County library were all
affirmative for pursuing the matter further. i believe that
the County Library Board intends to make this the County
Library Headquarters. The advantages I see of a library
headquarters over a branch library are:
1. All new books and periodicals will come to the headquarters
first and be available to Eagan residents. Branch libraries do
not stock all the books and periodicals; they have to be
ordered from the headquarters necessitating a second trip to
pick them up.
2. The Burnsville Library has excellent pre-school and lower
grades material.and learning facilities as well as reading
rooms for 'periodicals and a tape library. These are geared to
branch library.size and they would probably be larger and more
complete in the main library headquarters.
3. Eagan residents go'to the Burnsville library often stopping
and shopping at the neighborhood shopping center. That money
should be spent in Eagan and will be if Eagan has a library.
4. County Library headquarters will attract people from sur-
rounding communitiesand these people will spend money in
Eagan, thus, helping our businessmen.
5. The County proposes some modest county services in the
library'building such as a place to pay taxes, a place to
purchase hunting and driver's licenses etc. and probably a
computer outlet terminal, similar to our police dispatch
center, where real estate information can be obtained.

6.- The Burnsville Library does have community meeting rooms.
The County Library headquarter building would also and probably
would be larger. The City might be able to induce the Library.
._-Board to,have a large meeting room or auditorium and this .would
be ideal for overflow City Council meetings. A large meeting
.:room woiil'd-not be possible with a branch library.
7. Parking facilities could be shared by the library and the
Eagan facilities.
Philosophically speaking, I feel that as a member of a council
promoting the health, safety and well-being of the residents,
that part ofthat well-being consists of providing facilities
for the uplifting and improving of the intellect or mind. We
approve beer and liquor licenses.,.discoteques etc..that satisfy
the physical needs; we now have the opportunity to,promote
a facility that will help upgrade the quality of life in Eagan.
It has been said that man is only one generation away from
reverting back to primitive life. It is the responsibility
of each of the adult generation to promote the intellectual
development and aesthetic appreciation of each new generation.

believe exchanging a few acres of ground fora library is a.
good bargain..

CITY OF EAGAN

WHEREAS, the Dakota County Library'Board plans to build
a- new' library; and,
WHEREAS, Eagan is their first choice for the location; and,
WHEREAS, the Library Board does not have funds for a land
purchase; and
WHEREAS, the Library Board has gone before the Dakota
County Board of Commissioners requesting that the County staff
search for sites that would be made available to them at no
cost including the possibility of locating -it in the County
Holland Jensen Park property; and,
WHEREAS, the City.of Eagan has added an additional 20
acres to their City office park; and,
WHEREAS, all members of the Eagan City Council are interested
in pursuing with the County the possibility of donating some
of -this acreage for a County Library facility;
THEREFORE, in a motion by

the City Council of Eagan requeststhe County Board of Commissioners
and/or the Library Board to designate County personnel and/or
the Library Board CX -staff to meet with the 'Eagan City Council
and/or staff to pursue the possibility of,locating the library

Monday, March 13, 1978, I was directed to write a letter
expressing our enthusiasm toward the possibility of locating -
a library facility within the City of Eagan.

The City of Eagan owns twenty (20) acres of land in the center
of the community (at the intersection of County Road 31 and
Westcott Road). This property was purchased by the City to
accomodate various governmental facilities that will be
needed as the community continues to grow. The City Council
is receptive to locating a county library facility on City
property. However, before a decision can be made by the
City Council to consider giving land, many questions such as
size of the library facility and amount of land required
for such a facility would have to be examined. Also, the
City must decide whether twenty (20) acres is adequate for
additional facilities such as a library and if the land is
not adequate it is possible that additional land could be
acquired adjacent to the City owned property.

I enjoyed meeting you and discussing our mutual concern for improved
library services in the City of Eagan.
At the April 20, 1978 meeting of the Dakota County Library Board, the
proposal put forth by Eagan as outlined in your letter of March 14, 1978
and as further explored in our meeting of April 19, was discussed. The
gist of the discussion'was reservation on the part of the Library Board
to deviate from the plan to use the site at the County park in south
Eagan as a possible site for a new library building. There was some
concern registered as to whether or not there would be sufficient space
on the Eagan twenty acre site for a 50,000 square feet building with
expansion to another 50,000 should the need ever arise.
The Library Board was delighted with the interest and support of Eagan
for a permanent library facility in your community and we will be happy
to work with you toward our common goal for better library service for
Eagan and all of Dakota County.

1 MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL
EAGAN, MINNESOTA
March 13, 1978
.A special meeting of.the Eagan City Council was held on
March 13, 1978 at 5:00 p.m. at City Hall to review the bids on the
$1,800,000 General Obligation Refunding Improvement Bonds which had
been opened at 12:00 p.m. Those present were: Mayor Murphy, Council
Members Egan, Parranto, Smith and Wachter. Also present were City
Administrator Hedges, City Clerk Bolke and Phyllis Slattery,
Bill Gablisch and Rod Pakonon from Miller and Schroeder.
A tabulation of the four bids which were received is attached
hereto and made a part of the official record.
To satisfy the escrow it was necessary to sell an additional
$20,000 of bonds thereby making the total refunding issue $1,800,000.
Upon motion by Council'Member Smith, seconded by Council Member
Wachter, all members voting aye, it was RESOLVED that the sale of,
$1,800,000 General Obligation Refunding Improvement Bonds be
awarded to Banc Northwest for a total interest cost of $387,299.38
and a net interest rate of 4.66068.
Upon motion by Council Member Wachter, seconded by Council
Member Parranto, all members voting aye, it was RESOLVED that the
Resolution -establishing the terms of the'bond sale be approved.
...The City Administrator stated that Dakota County Commissioner
Kennedy has notified the City of Eagan that the Dakota County
Library Board i -a considering a new library facility in the Eagan area.
After a brief discussion.the City Administrator was directed to write
a letter to Commissioner Kennedy expressing enthusiasm toward the
location of a library facility in the City of Eagan. The twenty (20)

acres`of property in Section 22 that was purchased for future
expansion is to be considered.

April 27, 1978
A special meeting of the Eagan City Council was held on.April 27, 1978 at
x7-00,=p:m.-,at:.the-Eagan City Hall.All Council Members were present. Also present
was City Administrator Hedges.
LEAGUE CONVENTION. City Administrator fledges reported that the League,of
Minnesota Cities convention is to be held on June 7,8, and 9 at the Downtown
Minneapolis Radisson Rotel. It was generally agreed that one reservation be made
for a City Council Member to attend the convention in addition to members of the
City staff who are planning to attend various parts of the convention.
ORP. PROPERTY. The City Administrator recommended that the farm house which
Is presently occupied by Hollis Orr and 'owned by the City of Eagan be toured by the
Public Works -Committee to determine a rent for the house which will be evacuated
on June 30, 1978. The City Administrator stated that Mr. Orr is asking that the
City of Eagan purchase a.security light for $60. After a discussion by the City
Council it was determined that the security light is part of the .real estate and
therefore is owned by the City of Eagan. City Council Members Parranto and
Wachter agreed to investigate the farm house and other buildings on Monday, flay 1,
1978 so that a rate of rent and improvements that are necessary to the property
can be determined.
PUBLIC FACILITY'CAPITAL IMPROVEMENTS. The City Administrator reported that
the Volunteer=Fire Department is working on plans for Fire Station 03 which is
planned for the Wilderness Rua area. The City Administrator also reported that it
was learned in &.recent meeting with the Dakota County Library Board that a
50,000 square foot library facility could be constructed on City property if
adequate land is available. 'After discussion by City Council Members, it was
generally agreed that the City should pursue the feasibility.of purchasing

additional property adjacent to the 20 acres owned by the City southeast of the
intersection at Wescott Road and Pilot Knob Road. It was generally agreed by
members of the City Council tbat 20 acres would more than likely not be an adequate
amount of land to provide facilities for government services for the City of Eagan
and possibly Dakota County in future years. There was also a discussion as to
when the second story addition to the Police Department facility should be built
tq accomodate administrative offices and City Council chambers. Without detailed
study available,, it was generally discussed that the facility would be needed in
three to five years.
DAKOTA COUNTY CENTRAL DISPATCH CENTER. Chief of Police DesLauriere,reported
that a committee has.been investigating the feasibility of establishing a county
wide central dispatch center in Dakota County for the past several years. He
stated that a.federal grant was received by the Dakota County Law Enforcement
Association approximately a year and a half ago to study the cost and feasibility
of a central dispatch system for Dakota County. Chief of Police DesLauriers
reported that Ralph White and Associates were hired and the report was completed
in September, 1977. He stated that the City of Eagan.could encounter additional
costs of approximately $20,000 per year for the City's share of a central dispatch
center. He further indicated that the capability of the County computer is not'
known and it appears there could be duplication at the local level. Chief of
Police DesLauriers also stated that the City of Eagan would continue its 24 hour
operation to properly handle local service calls and also that the level of
dispatching that is now provided could not be provided through a central dispatch
system. Chief of Police DesLauriere.stated .that the County Board is asking that
governing bodies in Dakota County comment on the central dispatch system project by
Junel, 1978. After a discussion on the.matter it was generally agreed that the
City'Administrator would be directed to send a letter to the Dakota.County Board of

Improvement Project 257
Eagan, Minnesota

SCOPE: This project includes the construction of storm sewer trunks in
Section,21, 27 and 28 in Eagan, Minnesota.
FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance
with the Master Plan for Storm Sewer for the City of Eagan. It can best be
carried out as outlined herein and not as a part of any other project.
DISCUSSION: The Master Plan for Storm Water Drainage shows the outlet to
Thomas Lake to flow through a series of ponds to Blackhawk Lake. This outlet
was expected to be constructed during the development of the land through
which the outlet is located.
High water on Thomas Lake has caused flooding problems at existing homes
on'East Thomas Lake. Thomas Lake this year reached an all time high as far as
recorded levels are concerned. Flooding on Carlson Lake also occurred and the
construction of a lift station to control the level in this lake is under con-
struction. Pumping from Carlson Lake into Thomas Lake with the new lift station
cannot be carried out without a proper outlet to Thomas Lake as it would cause
flooding on Thomas Lake.
As part of the Thomas Lake Road project, the trunk storm sewer is being
constructed from a point just west of the west end of Thomas Lake to the pond
west of Heine First Addition at County Road 30. Overflow from Thomas Lake cannot

be accommodated in this trunk unless an -outlet to the Heine Addition pond is
provided or flooding will occur in Heine First Addition.
The proposed trunk storm sewer from Co. Rd. 30 to Blackhawk Lake follows
the route of the present sanitary sewer easement wherever possible. Where
deviation from the existing easement is required, the trunk storm sewer will
follow expected development patterns.
Some ponding easements will be required from property owners of ponds shown
to be required on the trunk Storm Sewer Master Plan.
In the future, a lift station outlet will be required at the west end of
Blackhawk Lake. The amount of water currently to be discharged from Thomas
Lake to Blackhawk Lake is not expected to raise Blackhawk Lake over a foot. The
long range planning anticipates raising the water level several feet at Black -
hawk Lake to improve it as a Lake. The lift station will be required in the
future when its need is demonstrated by reaching the projected high water level
of Blackhawk Lake.
Also included herein is the lift station outlet and force main required to
control the level of the two interconnected ponds in Oak Chase 1st Addition.
The force main has been installed from the south side of Wilderness Run Road
to the ponding area to the north and this pond has been provided with an over-
flow to Carlson Lake.
Flooding has occurred on the Oak Chase Ponds but it has not been possible
to relieve this high water condition due to the flooding condition on Carlson
Lake. With the outlets to.Thomas Lake and Carlson Lake completed, this lift
station outlet will be feasible.
It is anticipated that all costs of this project will be paid from the
Storm Sewer Trunk Fund with assessments levied against benefited property within

the drainage area. Because of the large size of the drainage area and because
additional trunk system improvements will be required in the drainage area in
the future, assessments will be levied against those properties most immedi-
ately benefited which are considered to be the existing developed areas and
those currently planned for development.
Assessments will be levied in accordance with the current storm sewer
assessment policy. This policy allows for a reduction in the rate on large lot
single family residential property for lots over 16,538 sq.ft. and up to 5 acres.
Credit is given on the assessment for the area of any ponding area for
which a pondingeasement is given to the City.
In those developments where trunk storm sewer was installed during develop-
ment,'it is assumed that the residents of the drainage area served by that
trunk storm sewer paid for it with the price of their lots. A credit is given
for these trunk storm sewer oversizing costs previously paid during development.
For those areas where the full Trunk Storm Sewer Oversize Costs were paid
during.development, no further Trunk Storm Sewer Oversize Assessment will be
levied by this project and is not anticipated to be required by future projects.

SCOPE: The project covers the construction of sanitary sewer trunks and laterals,
storm sewer trunks and laterals and streets serving the proposed Safari Estates
Development in Eagan, Minnesota. The proposed Safari Estates plat is located in
the southwest quarter of Section 32 in Eagan, Minnesota.
FEASIBILITY AND RECOMMENDATIONS: The project as proposed is feasible and is in ac-
cordance with the Master Comprehensive Plans for Sanitary Sewer, Water, Storm Sewer
and the Major Street Plan for the City of Eagan, Minnesota. For bidding and con-
struction purposes the project can best be carried out in two separate portions,
one for utilities and the other for the street improvements.
DISCUSSION: The proposed Safari Estates Development consists of 51 single family

residential lots located west of Galaxie Avenue in the Southwest quarter of Section
I
32 in Eagan. The platted property is very hilly and has a heavy wooded cover. The
I
plat also has many large estate type lots. These factors all tend to increase the
costs of improvements. The utilities have been routed to provide the most econo-
mical combination yet preserve as much of the natural cover on the plat as possible.
Sanitary sewer service to the proposed addition will be provided by extending
a trunk sanitary sewer from the intersection of Rahn Road and Cliff Road south

along the section line to the right of way of Interstate Highway 35E. The trunk

line will cross I -35E at right angles to the highway centerline and then continue

in a southerly direction around two storm water holding ponds terminating on the
section line westerly of the proposed development.
Sanitary sewer laterals will be located in the streets to serve all lots. The
lateral to serve Safari Circle will be routed along Safari Circle, Galaxie and across
an easement where it will connect with Safari Court South.
Trunk water mains will be extended from the Southeast corner of the Vienna
Woods Development. An 18 inch diameter trunk water main will be routed east from
Vienna Woods to Interstate Highway 35E, cross the highway at right angles and con-
tinue east and south following the trunk sewer alignment wherever possible ter -
minting at the Safari Estates Development.
A water storage site is proposed within the Safari Estates Development. A
24 inch trunk water main will be installed along the "By -Pass" Road from the storage
site to Galaxie Avenue.
Alternate water storage sites are also currently under investigation and may
alter the trunk water main costs, however the lateral
Development should remain as indicated in this report.

The Master Storm Sewer Plan for the City of Eagan indicates that the storm run-
off from the platted development will flow in a northerly direction. Trunk storm
sewer will be installed along Galaxie Avenue to carry 70 cfs from Apple Valley and
the runoff.from Safari Circle. The Storm Sewer will follow an easement connecting
Galaxie Avenue with Safari Court South. The storm sewer must carry an additional

36 cfs from the Dakota County Park. The storm sewer will follow Safari Court So.
to Safari Trail across the "By Pass" Road to a pond located on the Section Line
and northeast of the development. One other section of storm sewer consisting
of two catch basins and the connecting pipe will drain a low point on the "By
Pass" Road to a low marsh on the west side of the "By Pass" Road.
All the interior streets in Safari Estates will be constructed as normal
residential streets, 32 feet wide with a bituminous surface, with concrete curb and
gutter and having a 5 ton per axle carrying capability. The "By Pass" Road is
being graded by the Minnesota Department of Transportation in conjunction with the
construction of Cedar Avenue and Interstate Highway 35E.
COST ESTIMATES: The following coat estimates include construction costs plus 17
percent for engineering, legal, administrative and other costs appurtenant to the
project:

SCOPE: This project covers the construction of sanitary sewer, water and storm
sewer laterals and streets serving the Thomas Lake Addition in Eagan, Minnesota.
FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance
with the Master Plans for Sanitary Sewer, Water and Storm Sewer and the Major
Street Plan for the City of Eagan. For construction purposes it can best be
carried out in two projects; one for utilities and the other for street improve-
ments.
DISCUSSION: The proposed Thomas Lake Addition consists of 8 single family
residential lots located north of Cliff Road near Thomas Lake. The proposed
plat is located in Section 28 in Eagan, Minnesota.
The proposed plat will receive sanitary sewer service through a lateral
connecting to a trunk sewer located west of the proposed plat. Future develop-
ment to the east will also be served by this lateral.
Water service will be provided by connecting to the 24" diameter water trunk
in place in Cliff Road. A stub was constructed to the north side of Cliff Road
during the construction of the trunk for the purpose of serving the proposed
Thomas Lake Addition and other development in the area.
Storm sewer drainage for the proposed plat will consist of laterals,drain-
ing to a small siltation pond near Thomas Lake and to Thomas Lake directly.
All of the streets within the proposed Thomas Lake Addition will be con-
structed as normal residential streets with 32' wide bituminous surfaces, con-
crete curb and gutter and 5 ton carrying capabilities.
In order to serve the Thomas Lake Addition with utilities and streets it
is necessary to cross other properties with these services. It is expected
that properties to the west of the addition will share in the cost of these
services.

sidential and 15 double family residential lots located in section 31 in Eagan.
This project also includes service to several existing homes in the area, three of
which are in included in the plat.
Sanitary sewer service to the proposed addition will be provided through a
series of laterals draining to a 12" diameter trunk in place at the east end of
Nancy Circle. Future service to residential property along Cedar Avenue will also
be provided through these laterals.
Improvement project No. 191 as ordered by the City Council provides for the
construction of a 16" diameter water trunk from the intersection of Nancy Circle to
the intersection of Cedar Avenue and Kings Road. It is proposed to construct the 16"
trunk in conjunction with this project and extend it as an 18" trunk over the length

of Kings Road. Laterals connecting to this trunk will serve the proposed Vienna
Woods Addition as well as properties along Cedar Avenue.
Improvement project No. 186 as ordered by the City Council provides for the
construction of a trunk storm sewer from Pond AP;Bthrough the proposed addition and
northerly to Pond AP -9 . Laterals draining to this trunk will drain the western three-
fourths of Vienna Woods. The eastern edge of Vienna Woods will drain to a small
pond located in the eastern portion of the addition.
All of the streets within the proposed addition will be constructed as normal
residential streets, 32' wide with bituminous surfaces, concrete curb and gutter
and 5 ton carrying capabilities.
AREA TO BE INCLUDED: The west 1,900' of the south half of the northeast quarter of
section 31, town 27 north, range 23 west, Eagan, Minnesota.

Water service will be provided by extending the 24" trunk in place in Cliff
Road to Lexington Avenue. A 20" diameter water trunk will then be placed in Lex-
inton Avenue forming a loop to the water main proposed for Wilderness Run Road.
Water laterals connecting to this 20" trunk water main will serve the proposed
plat.
Storm sewer laterals serving Ches Mar East will drain to several small ponds
located near the north and east edges of the proposed addition. Outlets to these
ponds may be provided in the future if needed.'
All of the streets within the proposed Ches Mar East Addition will be construct-
ed to the City standards for normal residential streets. A normal residential street
in the City of Eagan has a 44' wide bituminous driving surface, surmountable con-
crete curb and gutter and a 5 ton carrying capability.

A. Final plat - Safari Estates -- Mr. Byron Watschke has
requested time on the agenda to discuss the final plat for
Safari Estates. The final plat was submitted to City Hall for
review by the staff, however, there are no Sh x 11 copies
available for the City Council. The City Attorney has the
various -figures available required for the Development agreement
which -will -be completed in a few days. Even though the final
plat and development agreement have not been completed as of
-today,'i felt it was necessary to address the Safari Estates
issue at the meeting on Tuesday for the following reasons:
1. Mr. Watschke has requested time on the agenda to
discuss a reservoir matter in detail and
2. The City staff would like to have the matter discussed
with the City Council so there is some direction provided
as a result of the meeting on Tuesday.
If you recall, the City Council approved site 1 on the Safari
Estates Addition plat for dedication of a water reservoir high
altitude system as it is required in future years. The Watschkes
has objected to dedicating this site for water reservoir. The
Watschkes are planning and have had plans to construct their
own personal residence on the same site. When the City Council
approved the preliminary plat with the understanding that the
Site 1 would be selected for the water reservoir high altitude
system, the staff was also directed to pursue other alternatives
to locating a.reservoir site. The Consulting City Engineer did
pursue two other sites in Safari Estates as well as a site on
the Sieg property. Those sites were all more expensive than
'Site 1 on Safari Estates. Recently, several meetings have been
held between the City staff including the City Administrator,
City Attorney, Consulting City Engineer, and Director of Public
works with the Watschkes to negotiate various alternatives to
locating the water reservoir site either in Safari Estates or
an area of land more or less adjacent to the Safari Estates
Addition as proposed. The staff has met with Chuck Lowery,
Dakota County Park Director, and it appears that it might be
possible for the City and County to secure a location within the
park to locate a water reservoir which would eliminate the
necessity of locating a water reservoir site in Safari Estates.
According to Consulting Engineer Rosene, at least one site in
the park would be the same cost as Site 1 in Safari Estates. it
.is essential that the City establish a site for a high altitude
water reservoir that would be constructed in future years at
this time. if the final plat of Safari Estates is to be
approved by the City Council at the meeting on Tuesday, or at
a future meeting, it is recommended that action be taken to
approve the reservoir site as site 1 of Safari Estates with the
understanding that the reservoir would be located on an alternative
site if an alternative site could be secured by the City staff
and developers. Mr. Watschke has addressed the whole reservoir
question i a letter of which a copy is enclosed on pages -/7

Dear Mr. Hedges:
I am writing this letter to you as well as the City Councel Members
with respect to the proposed water reservoir location in Safari Estates.
Our final Plat hearing is before the Council at the December 12th.
meeting and we would Like to address the Council on this matter at that
time.
The City Council in approving our Preliminary Plat for Safari Estates
on August 1, 1978 did so "with the (Council's) understanding that Site #1
would be acquired by the City for water reservoir site purposes". We
did not have an opportunity to discuss this issue at that time, the
alternate sites, the environmental and economic effects of site #1 on
Safari Estates and Eagan nor were we aware of Mr Rosene's letter to
the City Council relative to costs of various sites for the Reservoir.
Furthermore, -this matter had not cane up before the Planning Comnission
as part of Preliminary Plat Approval -so we maturally assumed the question
;and -decision would be brought up in the future as its need was some
years away.
After the Council action of August 1, 1978 we wrote Mr. Hedges outlining
our concern and objections to our site #1 location for the Reservoir,
my letter dated 'August 15, 1978. This letter waswrittenafter a
physical inspection of the Safari Estates sites and the Seig site was
made by Mr. Hedges, Mr. Rosen and the applicant on August 9, 1978 and after
we held a meeting in your 'office August 4 where we verbally outlined our
great concern -over this matter.
We. have held'several meetings with you and your staff since August in
an attempt to resolve this matter to both of our satisfaction. Fran these
meetings it appears that a water reservoir site in the Dakota County Park
land on the East may be available at no additional cost to the City over
site #1. Secondly, we have offered to give the Seig site to the City
upon acquiring their property abutting on the West. Thesealternates
should be discussed at the Council meeting on December 12 at which time
I understand refined costs for the various sites will be presented by Mr.
Rosen.
The major reason for our.,great concern over the location of the,water reservoir
in the Safari Estates site is our development plan._ Of the 27 lots in the
wooded, rolling hills towards the South, (3) lots are over 2 acres in size,
17 are over 1 acre and the other 7 are approximately 'h,acre to 1 acre. Our
Covenants for this area and for these lots will be very restrictive

and we expect the cost of homes in this area to be $200,000 and over. This
could make Safari Estates one of the finest Residential Developments in
the whole Metro Area, if not, Eagan for sure. A water tower 80 feet high
no matter how it is built would seriously detract from these develofinent
plans, in particular, the (4) lots on top of the hills, lots #18, 19, 20
and 21 which are all over.2 acres in size except lot 21 (1.1 A). We, as you
arewellaware, have completed plans for our own home on site #1, lot 18,
-having started preparation of the house plans early last year, 1977, before
we even heard of the water problem.
in conclusion, from an economic stand point it would seem more prudent for
the City of Eagan to select either one of the Alternate sites; 1. Dakota
County Park Iafid.- possible 3 sites or;2. The Sieg Site even tho the Sieg
Site may initially cost slightly more. Certainly the cities share of
Real Estate taxes and Assessments on 4 homes of $200,000 + value would
far exceed any additional costs of construction on the Sieg site and the
city would not be removing lot #18 from the tax rolls. We may be willing
to even monetarily assist•in relocating the water reservoir to an alternate
site under the circumstances should this become an important factor of
major consequence.
Another suggestion was for us to offer Site #2 (Lot 19) in place of Site
#1 (Lot 18). We would bemore in favor of Site 2 of course from a personal
stand point but the adverse effect of a water tower would still be there.
We will consider this as a possible solution,providing an alternate site
does not become available,and discuss the suggestion at the hearing if
requested.
Recently we investgated a water reservoir site in Apple Valley, Heritage
Hills, and of 6 lots on the Tower Cul de sac, only one lot has been built
upon:and that home has been for sale every time we have gone by. In Burnsville
a Reservoir off.Parkwood Drive in Butlers Addition sits on top of a hill
surrounded by a large Condominium Codex. Some residents we talked to
complain about noise during.freezing weather carting from the tank and at
times, the shade it creates by blocking the suns 'rays during cooler weather,
not to mention the appearance factor which no one found appealing. Sites
l and 2 are both heavily wooded thus causing Environmental problems as well
as those mentioned.
We look forward to an open discussion of this matter by all concerned
on December 12th. I am'sure we can came up with a reasonable solution
to all concerned.

Resources. Mr. Hyde has asked to meet with the City Council
in an executive session that will more than likely not exceed
one hour in length., I have enclosed for your reference a
copy of the final exceptions as presented by Mr. Hyde to the
Department of Natural Resources. Also enclosed is a copy of
a memorandum from Mr. A.W. Clapp III, who is special Assistant
Attorney General representing the DNR, a copy of a letter to
the Department of Natural Resources from Dunn and Curry Real
Estate Management, Inc., and a copy of a letter from Mr. Hyde
to Joe Alexander, all of which relate to the I -35E Blackhawk
Lake crossing matter.
I met with the Police Association bargaining unit on Wednesday,
December 6, 1978 and it appears that I will have a counter
proposal to the City Council's proposal #2 prior to the meeting
on Tuesday. If the public hearings are not too lengthy, I
would like to meet with the City Council briefly to discuss the
status of the Police negotiations so that I may continue nego-
tiations next week. I have also addressed all non-union and
management salaries for 1979 and have completed a spread sheet
for consideration by the City Council. I will distribute that
after the meeting on Tuesday.

The Report of the Hearing Examiner was received by
this.office November 13, 1978. I have accepted exceptions
received through November 28, 1978. I have reviewed the
hearing examiner's report, the hearing record and the
exceptions. The examiner's conclusion is the outcome of an
obviously careful review of the facts and application of
the statutes and case law to the facts. I agree with his
recommendation.and therefore accept it.
Because of the generally felt need to get on with
the building of I -35-E from Burnsville to Mendota Heights,
I am issuing this Order as promptly as possible. Findings of
Fact will be forthcoming in the near future.
The.application of the Minnesota Department of
Transportation for permission to route Interstate 35-E across
Blackhawk Lake in the City of Eagan, is denied.
A permit is granted for the freeway route which
passes around the east end of the lake as more precisely
described in the hearing record where it is identified as
the A-2 route. It is -a condition of the permit that'MnDOT
must obtain approval from DNR of the final plans and
specifications, which shall show that reasonable effort
has been made to minimize its impact on the lake and the
park.

Report of Hearing Examiner Myron S. Greenberg of
November 9, 1978.
Dear Sir:
We compelled to respond to what we consider substantial
erroneous interpretation of fact by Mr. Greenberg regarding
the subject as follows.
Planning: Testimony - E. Dunn - Pages 93-98 establishes.the
history of an eight year expensive, detailed planning process
which led to our present Planned Unit Development agreement
with the City of Eagan in 1977. This is a formal, mutually
binding contract.
Mr. Greenberg's conclusion: "The Dunn proposal is clearly
flexible" - Page 12 -DNR -78-922 MG is based on study and hearsay
which preceded by two years our final development agreement
with the City of Eagan and the selection of alignment A-1 by
Mn/Dot.
Mr. Greenberg's conclusion: "Mr. Dunn finds either route
acceptable" - Page 19 (T-100). My testimony as contained
on pages 100-101 documents our reasons why we currently feel
A-1 the superior route. Mr. Greenberg ignores my reasoning
and conclusion to the contrary.
Cost of delay: - Page 98 - Mr. Dunn - "Our costs of holding
this.land..... will range on the order of five to six hundred
thousand dollars a year just for interest costs. In addition
we have paid ..... $166,000 in real estate taxes in Dakota County
this year."
Page 9.9 - Mr. Dunn - "We think it urgent a solution be found
to finishing 35 East."
Mr. Greenberg's conclusion:
Page 18 - "Delay is not a problem for Dunn f, Curry because
they do, not intend to begin construction of the project for
more than five years" and
Page 28 - "The only direct quantifiable cost to any party con-
sists of $129,500 for relocation of a trunk sewer line and
waterline in Eagan."
Dunn and Curry did invest freely in discussing and evaluating
alternatives for A'-1 and A-2. When the decision was made by
Mn/Dot and A-1 was selected, we made financial commitments
related to projected completion date of this segment of 35E.
If started now, this appeared to be three to five years away.
A delay of two years impacts all of our property in Eagan -
not just 10%. Accordingly we would project any delay approach-
ing two years to cost us in excess of forty thousand dollars
per month delay.

Page 9 - Greenberg quoting - "Fashingbauer agrees that 'If the
whole thing is going to be invaded by the Huns, we are all
wasting our time as to whether A-1 or A -Tis completed."'
We feel the examiner evidences a prejudice by using this arbi-
trary, intemperate statement to help support his findings.
It's baffling that seven families who located here previously
with an intimate knowledge of the probable alignment of 35E
have acquired all of the rights while those who have held
property perhaps longer at greater expense, but have not built
a building have lost their rights.

We have attempted to focus only on those subjects which we
believe misconstrue the intent of our own testimony. However
there are many other conclusions contained in this report we
assume will be questioned by others.
In.conclusion we submit it is our firm conviction that the
legal, orderly process has been followed and that Mn/Dot
application should be granted promptly. Past gross delay
can hardly be a justification for continued delay.

As counsel for the City of Eagan, Minnesota, a party to the
above entitled proceedings and the municipality in which the
A-2 segment of I -35-E is located, I wish to note that several
objections and reservations to the action of the DNR Staff
and implications of the Response and proposed Order.
it would appear that the implication of the DNR Staff Response
and proposed Order is that all regulatory and statutory
proceedings necessary to initiate, consider, approve and
_.review.a new project locating I -35-E in the east end of the
Blackhawk Lake basin on a new and different alignment requiring
new designs, anew right-of-way designation and ultimately
new takings have already occurred. However, the statutory
scheme of federal and state highway development requires
that permits must be initiated by the Department of Transpor-
,tation and must be reviewed consistent with federal and
state environmental requirements and must be subject'to
possible challenge by residents and affected communities
under the federal and state environmental laws. The proceedings
before the Commissioner at this time contained no such
permit application for federal and state environmental
reviews.specifically following the statutory scheme. There
is no•sugges:tion in the bNR Staff'Response or proposed Order
as to any authority in federal or state laws, rules or regu-
lations which would allow the Commissioner' to issue a permit
for A-2 on the.strength of these proceedings. Moreover, the
Staff Response and proposed Order do not provide even the
barest specification of the work in 'public waters or other
action of a state agency, municipality or private party
which constitute the "permitted" activity supposedly to
result from the entry of this order.

As the DNR Staff is aware, the jurisdiction of any single
agency does not encompass all approvals, reviews and considera-
tions which are accorded other agencies, communities and
individuals under applicable laws and regulations. Therefore,
the implication of the Response and proposed Order is erroneous
in suggesting that the entry of such an Order can sweep away
the requisiteadministrative actions and community input. The
proponents of the A-1 corridor have outlined the potential
delays of selecting an A-2 corridor',while the opponents in-
cluding the DNR Staff have contended that such delays may he
eliminated or ignored. We must unfortunately conclude that the
Staff Response and proposed Order are submitted for the purpose
of advancing the Staff's adversary position that administrative
procedures required by law may be eliminated or ignored. In
doing so, we believe that the Staff has exceeded its role as
'a party to this proceeding.
'rime does not permit a detialed explication of the procedures
which are required in initiating, considering, approving and
reviewing amajor project such as the A-2 corridor. These
procedures have been the subject of extensive consideration
in the administrative proceedings and are a matter o.`. recor.d.
In behalf of the City of Eagan, the undersigned formally
lodges an objection to the DNR Staff Response and proposed
0 i:C,-r and states that contrary to the implcation thereof and
contrary to any action which the Commissioner might undertake
in adopting the Staff proposed Order there will necessarily
flow from the rejection'of.the A-1 alternative a significant
and substantial delay in the implementation and completion of
I -35-E of several years.

A. Dakota County Library facility -- Mayor Murphy has been
contacted by Dakota County regarding the possibility of locat-
ing the County library headquarters in the City of Eagan. The
Dakota County Board of Commissioners and the Dakota County
Library Board would like to meet with the City Council and/
or City staff to discuss the possibility of utilizing a portion
of the 40 acre parcel of property owned by the City of Eagan
for the County library headquarters. Mayor Murphy has pre-
pared a memorandum to the City Council and a Resolution for
review and consideration. Copies of the resolution and the
'memorandum are enclosed on pages C� through y
The City Administrator has enclosed a copy of the letter and
City Council minutes relating to previous action by the City
Council regarding the possibility of locating a library facility
within the City of Eagan. A copy of the letter and City
Council minutes are enclosed on page S through

Public Hearings
A. Imp. Project 257, Storm sewer to Heine Lake to Blackhawk
Lake and Oak Chase Pond outlet -- A public hearing is scheduled
to consider the proposed improvement project 257 which includes
the construction of storm sewer trunk from Thomas Lake to
Blackhawk Lake. A legal notice was advertised in the Dakota
County Tribune for two weeks and all residents affected by th e
proposed improvement were sent legal notice. Director of
Public Works Colbert and Consulting Engineer Rosene conducted
a neighborhood informational meeting at the City Hall on
Thursday, December 7, 1978 to discuss the overall project as
described with those property owners in attendance. Approximately
45 people were present and for additional information regarding
the informational hearing please refer to a memorandum pre-
pared by Director of Public Works Colbert enclosed on pages

I am enclosing a resolution for your consideration at the
December 12, 1978 Council meeting. The County wanted something
in writing. The Administrator was going to research previous
Council action in reference to a library facility. The results
of my poll of Council Members on the County library were all
affirmative for pursuing the matter further. i believe that
the County Library Board intends to make this the County
Library Headquarters. The advantages I see of a library
headquarters over a branch library are:
1. All new books and periodicals will come to the headquarters
first and be available to Eagan residents. Branch libraries do
not stock all the books and periodicals; they have to be
ordered from the headquarters necessitating a second trip to
pick them up.
2. The Burnsville Library has excellent pre-school and lower
grades material.and learning facilities as well as reading
rooms for 'periodicals and a tape library. These are geared to
branch library.size and they would probably be larger and more
complete in the main library headquarters.
3. Eagan residents go'to the Burnsville library often stopping
and shopping at the neighborhood shopping center. That money
should be spent in Eagan and will be if Eagan has a library.
4. County Library headquarters will attract people from sur-
rounding communitiesand these people will spend money in
Eagan, thus, helping our businessmen.
5. The County proposes some modest county services in the
library'building such as a place to pay taxes, a place to
purchase hunting and driver's licenses etc. and probably a
computer outlet terminal, similar to our police dispatch
center, where real estate information can be obtained.

The County Library headquarter building would also and probably
would be larger. The City might be able to induce the Library.

7. Parking facilities could be shared by the library and the
Eagan facilities.
Philosophically speaking, I feel that as a member of a council
promoting the health, safety and well-being of the residents,
that part ofthat well-being consists of providing facilities
for the uplifting and improving of the intellect or mind. We
approve beer and liquor licenses.,.discoteques etc..that satisfy
the physical needs; we now have the opportunity to,promote
a facility that will help upgrade the quality of life in Eagan.
It has been said that man is only one generation away from
reverting back to primitive life. It is the responsibility
of each of the adult generation to promote the intellectual
development and aesthetic appreciation of each new generation.

WHEREAS, the Dakota County Library'Board plans to build
a- new' library; and,
WHEREAS, Eagan is their first choice for the location; and,
WHEREAS, the Library Board does not have funds for a land
purchase; and

County Board of Commissioners requesting that the County staff
search for sites that would be made available to them at no
cost including the possibility of locating -it in the County

Westcott Road). This property was purchased by the City to
accomodate various governmental facilities that will be
needed as the community continues to grow. The City Council
is receptive to locating a county library facility on City
property. However, before a decision can be made by the
City Council to consider giving land, many questions such as
size of the library facility and amount of land required
for such a facility would have to be examined. Also, the
City must decide whether twenty (20) acres is adequate for
additional facilities such as a library and if the land is
not adequate it is possible that additional land could be
acquired adjacent to the City owned property.

I enjoyed meeting you and discussing our mutual concern for improved
library services in the City of Eagan.
At the April 20, 1978 meeting of the Dakota County Library Board, the
proposal put forth by Eagan as outlined in your letter of March 14, 1978
and as further explored in our meeting of April 19, was discussed. The
gist of the discussion'was reservation on the part of the Library Board
to deviate from the plan to use the site at the County park in south
Eagan as a possible site for a new library building. There was some
concern registered as to whether or not there would be sufficient space
on the Eagan twenty acre site for a 50,000 square feet building with
expansion to another 50,000 should the need ever arise.
The Library Board was delighted with the interest and support of Eagan
for a permanent library facility in your community and we will be happy
to work with you toward our common goal for better library service for
Eagan and all of Dakota County.

March 13, 1978
.A special meeting of.the Eagan City Council was held on
March 13, 1978 at 5:00 p.m. at City Hall to review the bids on the
$1,800,000 General Obligation Refunding Improvement Bonds which had
been opened at 12:00 p.m. Those present were: Mayor Murphy, Council
Members Egan, Parranto, Smith and Wachter. Also present were City
Administrator Hedges, City Clerk Bolke and Phyllis Slattery,
Bill Gablisch and Rod Pakonon from Miller and Schroeder.
A tabulation of the four bids which were received is attached
hereto and made a part of the official record.
To satisfy the escrow it was necessary to sell an additional
$20,000 of bonds thereby making the total refunding issue $1,800,000.
Upon motion by Council'Member Smith, seconded by Council Member
Wachter, all members voting aye, it was RESOLVED that the sale of,
$1,800,000 General Obligation Refunding Improvement Bonds be
awarded to Banc Northwest for a total interest cost of $387,299.38
and a net interest rate of 4.66068.
Upon motion by Council Member Wachter, seconded by Council
Member Parranto, all members voting aye, it was RESOLVED that the
Resolution -establishing the terms of the'bond sale be approved.
...The City Administrator stated that Dakota County Commissioner
Kennedy has notified the City of Eagan that the Dakota County
Library Board i -a considering a new library facility in the Eagan area.
After a brief discussion.the City Administrator was directed to write
a letter to Commissioner Kennedy expressing enthusiasm toward the
location of a library facility in the City of Eagan. The twenty (20)

A special meeting of the Eagan City Council was held on.April 27, 1978 at
x7-00,=p:m.-,at:.the-Eagan City Hall.All Council Members were present. Also present
was City Administrator Hedges.
LEAGUE CONVENTION. City Administrator fledges reported that the League,of
Minnesota Cities convention is to be held on June 7,8, and 9 at the Downtown
Minneapolis Radisson Rotel. It was generally agreed that one reservation be made
for a City Council Member to attend the convention in addition to members of the
City staff who are planning to attend various parts of the convention.
ORP. PROPERTY. The City Administrator recommended that the farm house which
Is presently occupied by Hollis Orr and 'owned by the City of Eagan be toured by the
Public Works -Committee to determine a rent for the house which will be evacuated
on June 30, 1978. The City Administrator stated that Mr. Orr is asking that the
City of Eagan purchase a.security light for $60. After a discussion by the City
Council it was determined that the security light is part of the .real estate and
therefore is owned by the City of Eagan. City Council Members Parranto and
Wachter agreed to investigate the farm house and other buildings on Monday, flay 1,
1978 so that a rate of rent and improvements that are necessary to the property
can be determined.
PUBLIC FACILITY'CAPITAL IMPROVEMENTS. The City Administrator reported that
the Volunteer=Fire Department is working on plans for Fire Station 03 which is
planned for the Wilderness Rua area. The City Administrator also reported that it
was learned in &.recent meeting with the Dakota County Library Board that a
50,000 square foot library facility could be constructed on City property if
adequate land is available. 'After discussion by City Council Members, it was
generally agreed that the City should pursue the feasibility.of purchasing

additional property adjacent to the 20 acres owned by the City southeast of the
intersection at Wescott Road and Pilot Knob Road. It was generally agreed by
members of the City Council tbat 20 acres would more than likely not be an adequate
amount of land to provide facilities for government services for the City of Eagan
and possibly Dakota County in future years. There was also a discussion as to
when the second story addition to the Police Department facility should be built
tq accomodate administrative offices and City Council chambers. Without detailed
study available,, it was generally discussed that the facility would be needed in
three to five years.
DAKOTA COUNTY CENTRAL DISPATCH CENTER. Chief of Police DesLauriere,reported
that a committee has.been investigating the feasibility of establishing a county
wide central dispatch center in Dakota County for the past several years. He
stated that a.federal grant was received by the Dakota County Law Enforcement
Association approximately a year and a half ago to study the cost and feasibility
of a central dispatch system for Dakota County. Chief of Police DesLauriers
reported that Ralph White and Associates were hired and the report was completed
in September, 1977. He stated that the City of Eagan.could encounter additional
costs of approximately $20,000 per year for the City's share of a central dispatch
center. He further indicated that the capability of the County computer is not'
known and it appears there could be duplication at the local level. Chief of
Police DesLauriers also stated that the City of Eagan would continue its 24 hour
operation to properly handle local service calls and also that the level of
dispatching that is now provided could not be provided through a central dispatch
system. Chief of Police DesLauriere.stated .that the County Board is asking that
governing bodies in Dakota County comment on the central dispatch system project by
Junel, 1978. After a discussion on the.matter it was generally agreed that the
City'Administrator would be directed to send a letter to the Dakota.County Board of

SCOPE: This project includes the construction of storm sewer trunks in
Section,21, 27 and 28 in Eagan, Minnesota.
FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance
with the Master Plan for Storm Sewer for the City of Eagan. It can best be
carried out as outlined herein and not as a part of any other project.
DISCUSSION: The Master Plan for Storm Water Drainage shows the outlet to
Thomas Lake to flow through a series of ponds to Blackhawk Lake. This outlet
was expected to be constructed during the development of the land through
which the outlet is located.
High water on Thomas Lake has caused flooding problems at existing homes
on'East Thomas Lake. Thomas Lake this year reached an all time high as far as
recorded levels are concerned. Flooding on Carlson Lake also occurred and the
construction of a lift station to control the level in this lake is under con-
struction. Pumping from Carlson Lake into Thomas Lake with the new lift station
cannot be carried out without a proper outlet to Thomas Lake as it would cause
flooding on Thomas Lake.
As part of the Thomas Lake Road project, the trunk storm sewer is being
constructed from a point just west of the west end of Thomas Lake to the pond
west of Heine First Addition at County Road 30. Overflow from Thomas Lake cannot

be accommodated in this trunk unless an -outlet to the Heine Addition pond is
provided or flooding will occur in Heine First Addition.
The proposed trunk storm sewer from Co. Rd. 30 to Blackhawk Lake follows
the route of the present sanitary sewer easement wherever possible. Where
deviation from the existing easement is required, the trunk storm sewer will
follow expected development patterns.
Some ponding easements will be required from property owners of ponds shown
to be required on the trunk Storm Sewer Master Plan.
In the future, a lift station outlet will be required at the west end of
Blackhawk Lake. The amount of water currently to be discharged from Thomas
Lake to Blackhawk Lake is not expected to raise Blackhawk Lake over a foot. The
long range planning anticipates raising the water level several feet at Black -
hawk Lake to improve it as a Lake. The lift station will be required in the
future when its need is demonstrated by reaching the projected high water level
of Blackhawk Lake.
Also included herein is the lift station outlet and force main required to
control the level of the two interconnected ponds in Oak Chase 1st Addition.
The force main has been installed from the south side of Wilderness Run Road
to the ponding area to the north and this pond has been provided with an over-
flow to Carlson Lake.
Flooding has occurred on the Oak Chase Ponds but it has not been possible
to relieve this high water condition due to the flooding condition on Carlson
Lake. With the outlets to.Thomas Lake and Carlson Lake completed, this lift
station outlet will be feasible.
It is anticipated that all costs of this project will be paid from the
Storm Sewer Trunk Fund with assessments levied against benefited property within

the drainage area. Because of the large size of the drainage area and because
additional trunk system improvements will be required in the drainage area in
the future, assessments will be levied against those properties most immedi-
ately benefited which are considered to be the existing developed areas and
those currently planned for development.
Assessments will be levied in accordance with the current storm sewer
assessment policy. This policy allows for a reduction in the rate on large lot
single family residential property for lots over 16,538 sq.ft. and up to 5 acres.
Credit is given on the assessment for the area of any ponding area for
which a pondingeasement is given to the City.
In those developments where trunk storm sewer was installed during develop-
ment,'it is assumed that the residents of the drainage area served by that
trunk storm sewer paid for it with the price of their lots. A credit is given
for these trunk storm sewer oversizing costs previously paid during development.
For those areas where the full Trunk Storm Sewer Oversize Costs were paid
during.development, no further Trunk Storm Sewer Oversize Assessment will be
levied by this project and is not anticipated to be required by future projects.

SCOPE: The project covers the construction of sanitary sewer trunks and laterals,
storm sewer trunks and laterals and streets serving the proposed Safari Estates
Development in Eagan, Minnesota. The proposed Safari Estates plat is located in
the southwest quarter of Section 32 in Eagan, Minnesota.
FEASIBILITY AND RECOMMENDATIONS: The project as proposed is feasible and is in ac-
cordance with the Master Comprehensive Plans for Sanitary Sewer, Water, Storm Sewer
and the Major Street Plan for the City of Eagan, Minnesota. For bidding and con-
struction purposes the project can best be carried out in two separate portions,
one for utilities and the other for the street improvements.
DISCUSSION: The proposed Safari Estates Development consists of 51 single family

residential lots located west of Galaxie Avenue in the Southwest quarter of Section
I
32 in Eagan. The platted property is very hilly and has a heavy wooded cover. The
I
plat also has many large estate type lots. These factors all tend to increase the
costs of improvements. The utilities have been routed to provide the most econo-
mical combination yet preserve as much of the natural cover on the plat as possible.
Sanitary sewer service to the proposed addition will be provided by extending
a trunk sanitary sewer from the intersection of Rahn Road and Cliff Road south

along the section line to the right of way of Interstate Highway 35E. The trunk
I
line will cross I -35E at right angles to the highway centerline and then continue
I

in a southerly direction around two storm water holding ponds terminating on the
section line westerly of the proposed development.
Sanitary sewer laterals will be located in the streets to serve all lots. The
lateral to serve Safari Circle will be routed along Safari Circle, Galaxie and across
an easement where it will connect with Safari Court South.
Trunk water mains will be extended from the Southeast corner of the Vienna
Woods Development. An 18 inch diameter trunk water main will be routed east from
Vienna Woods to Interstate Highway 35E, cross the highway at right angles and con-
tinue east and south following the trunk sewer alignment wherever possible ter -
minting at the Safari Estates Development.
A water storage site is proposed within the Safari Estates Development. A
24 inch trunk water main will be installed along the "By -Pass" Road from the storage
site to Galaxie Avenue.
Alternate water storage sites are also currently under investigation and may
alter the trunk water main costs, however the lateral
Development should remain as indicated in this report.

The Master Storm Sewer Plan for the City of Eagan indicates that the storm run-
off from the platted development will flow in a northerly direction. Trunk storm
sewer will be installed along Galaxie Avenue to carry 70 cfs from Apple Valley and
the runoff.from Safari Circle. The Storm Sewer will follow an easement connecting
Galaxie Avenue with Safari Court South. The storm sewer must carry an additional

to Safari Trail across the "By Pass" Road to a pond located on the Section Line
and northeast of the development. One other section of storm sewer consisting
of two catch basins and the connecting pipe will drain a low point on the "By
Pass" Road to a low marsh on the west side of the "By Pass" Road.
All the interior streets in Safari Estates will be constructed as normal
residential streets, 32 feet wide with a bituminous surface, with concrete curb and
gutter and having a 5 ton per axle carrying capability. The "By Pass" Road is
being graded by the Minnesota Department of Transportation in conjunction with the
construction of Cedar Avenue and Interstate Highway 35E.

SCOPE: This project covers the construction of sanitary sewer, water and storm
sewer laterals and streets serving the Thomas Lake Addition in Eagan, Minnesota.
FEASIBILITY AND RECOMMENDATIONS: The project is feasible and is in accordance
with the Master Plans for Sanitary Sewer, Water and Storm Sewer and the Major
Street Plan for the City of Eagan. For construction purposes it can best be
carried out in two projects; one for utilities and the other for street improve-
ments.
DISCUSSION: The proposed Thomas Lake Addition consists of 8 single family
residential lots located north of Cliff Road near Thomas Lake. The proposed
plat is located in Section 28 in Eagan, Minnesota.
The proposed plat will receive sanitary sewer service through a lateral
connecting to a trunk sewer located west of the proposed plat. Future develop-
ment to the east will also be served by this lateral.
Water service will be provided by connecting to the 24" diameter water trunk
in place in Cliff Road. A stub was constructed to the north side of Cliff Road
during the construction of the trunk for the purpose of serving the proposed
Thomas Lake Addition and other development in the area.
Storm sewer drainage for the proposed plat will consist of laterals,drain-
ing to a small siltation pond near Thomas Lake and to Thomas Lake directly.
All of the streets within the proposed Thomas Lake Addition will be con-
structed as normal residential streets with 32' wide bituminous surfaces, con-
crete curb and gutter and 5 ton carrying capabilities.
In order to serve the Thomas Lake Addition with utilities and streets it
is necessary to cross other properties with these services. It is expected
that properties to the west of the addition will share in the cost of these
services.

DISCUSSION: The proposed Vienna Woods Addition consists of 90 single family re-
sidential and 15 double family residential lots located in section 31 in Eagan.
This project also includes service to several existing homes in the area, three of
which are in included in the plat.
Sanitary sewer service to the proposed addition will be provided through a
series of laterals draining to a 12" diameter trunk in place at the east end of
Nancy Circle. Future service to residential property along Cedar Avenue will also
be provided through these laterals.
Improvement project No. 191 as ordered by the City Council provides for the
construction of a 16" diameter water trunk from the intersection of Nancy Circle to
the intersection of Cedar Avenue and Kings Road. It is proposed to construct the 16"
trunk in conjunction with this project and extend it as an 18" trunk over the length

of Kings Road. Laterals connecting to this trunk will serve the proposed Vienna
Woods Addition as well as properties along Cedar Avenue.
Improvement project No. 186 as ordered by the City Council provides for the
construction of a trunk storm sewer from Pond AP;Bthrough the proposed addition and
northerly to Pond AP -9 . Laterals draining to this trunk will drain the western three-
fourths of Vienna Woods. The eastern edge of Vienna Woods will drain to a small
pond located in the eastern portion of the addition.
All of the streets within the proposed addition will be constructed as normal
residential streets, 32' wide with bituminous surfaces, concrete curb and gutter
and 5 ton carrying capabilities.

Water service will be provided by extending the 24" trunk in place in Cliff
Road to Lexington Avenue. A 20" diameter water trunk will then be placed in Lex-
inton Avenue forming a loop to the water main proposed for Wilderness Run Road.
Water laterals connecting to this 20" trunk water main will serve the proposed
plat.
Storm sewer laterals serving Ches Mar East will drain to several small ponds
located near the north and east edges of the proposed addition. Outlets to these
ponds may be provided in the future if needed.'
All of the streets within the proposed Ches Mar East Addition will be construct-
ed to the City standards for normal residential streets. A normal residential street
in the City of Eagan has a 44' wide bituminous driving surface, surmountable con-
crete curb and gutter and a 5 ton carrying capability.

Other Business
A. Final plat - Safari Estates -- Mr. Byron Watschke has
requested time on the agenda to discuss the final plat for
Safari Estates. The final plat was submitted to City Hall for
review by the staff, however, there are no Sh x 11 copies
available for the City Council. The City Attorney has the
various -figures available required for the Development agreement
which -will -be completed in a few days. Even though the final
plat and development agreement have not been completed as of
-today,'i felt it was necessary to address the Safari Estates
issue at the meeting on Tuesday for the following reasons:
1. Mr. Watschke has requested time on the agenda to
discuss a reservoir matter in detail and
2. The City staff would like to have the matter discussed
with the City Council so there is some direction provided
as a result of the meeting on Tuesday.
If you recall, the City Council approved site 1 on the Safari
Estates Addition plat for dedication of a water reservoir high
altitude system as it is required in future years. The Watschkes
has objected to dedicating this site for water reservoir. The
Watschkes are planning and have had plans to construct their
own personal residence on the same site. When the City Council
approved the preliminary plat with the understanding that the
Site 1 would be selected for the water reservoir high altitude
system, the staff was also directed to pursue other alternatives
to locating a.reservoir site. The Consulting City Engineer did
pursue two other sites in Safari Estates as well as a site on
the Sieg property. Those sites were all more expensive than
'Site 1 on Safari Estates. Recently, several meetings have been
held between the City staff including the City Administrator,
City Attorney, Consulting City Engineer, and Director of Public
works with the Watschkes to negotiate various alternatives to
locating the water reservoir site either in Safari Estates or
an area of land more or less adjacent to the Safari Estates
Addition as proposed. The staff has met with Chuck Lowery,
Dakota County Park Director, and it appears that it might be
possible for the City and County to secure a location within the
park to locate a water reservoir which would eliminate the
necessity of locating a water reservoir site in Safari Estates.
According to Consulting Engineer Rosene, at least one site in
the park would be the same cost as Site 1 in Safari Estates. it
.is essential that the City establish a site for a high altitude
water reservoir that would be constructed in future years at
this time. if the final plat of Safari Estates is to be
approved by the City Council at the meeting on Tuesday, or at
a future meeting, it is recommended that action be taken to
approve the reservoir site as site 1 of Safari Estates with the
understanding that the reservoir would be located on an alternative
site if an alternative site could be secured by the City staff
and developers. Mr. Watschke has addressed the whole reservoir
question i a letter of which a copy is enclosed on pages -/7

Dear Mr. Hedges:
I am writing this letter to you as well as the City Councel Members
with respect to the proposed water reservoir location in Safari Estates.
Our final Plat hearing is before the Council at the December 12th.
meeting and we would Like to address the Council on this matter at that
time.
The City Council in approving our Preliminary Plat for Safari Estates
on August 1, 1978 did so "with the (Council's) understanding that Site #1
would be acquired by the City for water reservoir site purposes". We
did not have an opportunity to discuss this issue at that time, the
alternate sites, the environmental and economic effects of site #1 on
Safari Estates and Eagan nor were we aware of Mr Rosene's letter to
the City Council relative to costs of various sites for the Reservoir.
Furthermore, -this matter had not cane up before the Planning Comnission
as part of Preliminary Plat Approval -so we maturally assumed the question
;and -decision would be brought up in the future as its need was some
years away.
After the Council action of August 1, 1978 we wrote Mr. Hedges outlining
our concern and objections to our site #1 location for the Reservoir,
my letter dated 'August 15, 1978. This letter waswrittenafter a
physical inspection of the Safari Estates sites and the Seig site was
made by Mr. Hedges, Mr. Rosen and the applicant on August 9, 1978 and after
we held a meeting in your 'office August 4 where we verbally outlined our
great concern -over this matter.
We. have held'several meetings with you and your staff since August in
an attempt to resolve this matter to both of our satisfaction. Fran these
meetings it appears that a water reservoir site in the Dakota County Park
land on the East may be available at no additional cost to the City over
site #1. Secondly, we have offered to give the Seig site to the City
upon acquiring their property abutting on the West. Thesealternates
should be discussed at the Council meeting on December 12 at which time
I understand refined costs for the various sites will be presented by Mr.
Rosen.
The major reason for our.,great concern over the location of the,water reservoir
in the Safari Estates site is our development plan._ Of the 27 lots in the
wooded, rolling hills towards the South, (3) lots are over 2 acres in size,
17 are over 1 acre and the other 7 are approximately 'h,acre to 1 acre. Our
Covenants for this area and for these lots will be very restrictive

and we expect the cost of homes in this area to be $200,000 and over. This
could make Safari Estates one of the finest Residential Developments in
the whole Metro Area, if not, Eagan for sure. A water tower 80 feet high
no matter how it is built would seriously detract from these develofinent
plans, in particular, the (4) lots on top of the hills, lots #18, 19, 20
and 21 which are all over.2 acres in size except lot 21 (1.1 A). We, as you
arewellaware, have completed plans for our own home on site #1, lot 18,
-having started preparation of the house plans early last year, 1977, before
we even heard of the water problem.
in conclusion, from an economic stand point it would seem more prudent for
the City of Eagan to select either one of the Alternate sites; 1. Dakota
County Park Iafid.- possible 3 sites or;2. The Sieg Site even tho the Sieg
Site may initially cost slightly more. Certainly the cities share of
Real Estate taxes and Assessments on 4 homes of $200,000 + value would
far exceed any additional costs of construction on the Sieg site and the
city would not be removing lot #18 from the tax rolls. We may be willing
to even monetarily assist•in relocating the water reservoir to an alternate
site under the circumstances should this become an important factor of
major consequence.
Another suggestion was for us to offer Site #2 (Lot 19) in place of Site
#1 (Lot 18). We would bemore in favor of Site 2 of course from a personal
stand point but the adverse effect of a water tower would still be there.
We will consider this as a possible solution,providing an alternate site
does not become available,and discuss the suggestion at the hearing if
requested.
Recently we investgated a water reservoir site in Apple Valley, Heritage
Hills, and of 6 lots on the Tower Cul de sac, only one lot has been built
upon:and that home has been for sale every time we have gone by. In Burnsville
a Reservoir off.Parkwood Drive in Butlers Addition sits on top of a hill
surrounded by a large Condominium Codex. Some residents we talked to
complain about noise during.freezing weather carting from the tank and at
times, the shade it creates by blocking the suns 'rays during cooler weather,
not to mention the appearance factor which no one found appealing. Sites
l and 2 are both heavily wooded thus causing Environmental problems as well
as those mentioned.
We look forward to an open discussion of this matter by all concerned
on December 12th. I am'sure we can came up with a reasonable solution
to all concerned.

At 5:00 p.m. on Monday, December 11, 1978 Mr. Mac Hyde would
like to meet with the City Council to discuss the status of
the I -35E bridge permit with the Department of Natural
Resources. Mr. Hyde has asked to meet with the City Council
in an executive session that will more than likely not exceed
one hour in length., I have enclosed for your reference a
copy of the final exceptions as presented by Mr. Hyde to the
Department of Natural Resources. Also enclosed is a copy of
a memorandum from Mr. A.W. Clapp III, who is special Assistant
Attorney General representing the DNR, a copy of a letter to
the Department of Natural Resources from Dunn and Curry Real
Estate Management, Inc., and a copy of a letter from Mr. Hyde
to Joe Alexander, all of which relate to the I -35E Blackhawk
Lake crossing matter.
I met with the Police Association bargaining unit on Wednesday,
December 6, 1978 and it appears that I will have a counter
proposal to the City Council's proposal #2 prior to the meeting
on Tuesday. If the public hearings are not too lengthy, I
would like to meet with the City Council briefly to discuss the
status of the Police negotiations so that I may continue nego-
tiations next week. I have also addressed all non-union and
management salaries for 1979 and have completed a spread sheet
for consideration by the City Council. I will distribute that
after the meeting on Tuesday.

ing examiner has come to the same conclusion. Staff urges

applied for, also grants a permit for the route around the
lake. This route is thoroughly analyzed in the record before
the Commissioner; no further deliberation on its approval
is warranted. A suggested Order is attached. Note that it
is drafted to be issued before you have adopted Findings
of fact. This enables.you immediately to clear the way for
the renewal of design work on the route around the lake, while
providing time for you to make sure you adopt Findings which
accurately reflect the record.

The Report of the Hearing Examiner was received by
this.office November 13, 1978. I have accepted exceptions
received through November 28, 1978. I have reviewed the
hearing examiner's report, the hearing record and the
exceptions. The examiner's conclusion is the outcome of an
obviously careful review of the facts and application of
the statutes and case law to the facts. I agree with his
recommendation.and therefore accept it.
Because of the generally felt need to get on with
the building of I -35-E from Burnsville to Mendota Heights,
I am issuing this Order as promptly as possible. Findings of
Fact will be forthcoming in the near future.
The.application of the Minnesota Department of
Transportation for permission to route Interstate 35-E across
Blackhawk Lake in the City of Eagan, is denied.
A permit is granted for the freeway route which
passes around the east end of the lake as more precisely
described in the hearing record where it is identified as
the A-2 route. It is -a condition of the permit that'MnDOT
must obtain approval from DNR of the final plans and
specifications, which shall show that reasonable effort
has been made to minimize its impact on the lake and the
park.

Report of Hearing Examiner Myron S. Greenberg of
November 9, 1978.
Dear Sir:
We compelled to respond to what we consider substantial
erroneous interpretation of fact by Mr. Greenberg regarding
the subject as follows.
Planning: Testimony - E. Dunn - Pages 93-98 establishes.the
history of an eight year expensive, detailed planning process
which led to our present Planned Unit Development agreement
with the City of Eagan in 1977. This is a formal, mutually
binding contract.
Mr. Greenberg's conclusion: "The Dunn proposal is clearly
flexible" - Page 12 -DNR -78-922 MG is based on study and hearsay
which preceded by two years our final development agreement
with the City of Eagan and the selection of alignment A-1 by
Mn/Dot.
Mr. Greenberg's conclusion: "Mr. Dunn finds either route
acceptable" - Page 19 (T-100). My testimony as contained
on pages 100-101 documents our reasons why we currently feel
A-1 the superior route. Mr. Greenberg ignores my reasoning
and conclusion to the contrary.
Cost of delay: - Page 98 - Mr. Dunn - "Our costs of holding
this.land..... will range on the order of five to six hundred
thousand dollars a year just for interest costs. In addition
we have paid ..... $166,000 in real estate taxes in Dakota County
this year."
Page 9.9 - Mr. Dunn - "We think it urgent a solution be found
to finishing 35 East."
Mr. Greenberg's conclusion:
Page 18 - "Delay is not a problem for Dunn f, Curry because
they do, not intend to begin construction of the project for
more than five years" and
Page 28 - "The only direct quantifiable cost to any party con-
sists of $129,500 for relocation of a trunk sewer line and
waterline in Eagan."
Dunn and Curry did invest freely in discussing and evaluating
alternatives for A'-1 and A-2. When the decision was made by
Mn/Dot and A-1 was selected, we made financial commitments
related to projected completion date of this segment of 35E.
If started now, this appeared to be three to five years away.
A delay of two years impacts all of our property in Eagan -
not just 10%. Accordingly we would project any delay approach-
ing two years to cost us in excess of forty thousand dollars
per month delay.

An inspection of the site and logic both. impeach this "conclu-
sion".
Page 9 - Greenberg quoting - "Fashingbauer agrees that 'If the
whole thing is going to be invaded by the Huns, we are all
wasting our time as to whether A-1 or A -Tis completed."'
We feel the examiner evidences a prejudice by using this arbi-
trary, intemperate statement to help support his findings.
It's baffling that seven families who located here previously
with an intimate knowledge of the probable alignment of 35E
have acquired all of the rights while those who have held
property perhaps longer at greater expense, but have not built
a building have lost their rights.

We have attempted to focus only on those subjects which we
believe misconstrue the intent of our own testimony. However
there are many other conclusions contained in this report we
assume will be questioned by others.
In.conclusion we submit it is our firm conviction that the
legal, orderly process has been followed and that Mn/Dot
application should be granted promptly. Past gross delay
can hardly be a justification for continued delay.

As counsel for the City of Eagan, Minnesota, a party to the
above entitled proceedings and the municipality in which the
A-2 segment of I -35-E is located, I wish to note that several
objections and reservations to the action of the DNR Staff
and implications of the Response and proposed Order.
it would appear that the implication of the DNR Staff Response
and proposed Order is that all regulatory and statutory
proceedings necessary to initiate, consider, approve and
_.review.a new project locating I -35-E in the east end of the
Blackhawk Lake basin on a new and different alignment requiring
new designs, anew right-of-way designation and ultimately
new takings have already occurred. However, the statutory
scheme of federal and state highway development requires
that permits must be initiated by the Department of Transpor-
,tation and must be reviewed consistent with federal and
state environmental requirements and must be subject'to
possible challenge by residents and affected communities
under the federal and state environmental laws. The proceedings
before the Commissioner at this time contained no such
permit application for federal and state environmental
reviews.specifically following the statutory scheme. There
is no•sugges:tion in the bNR Staff'Response or proposed Order
as to any authority in federal or state laws, rules or regu-
lations which would allow the Commissioner' to issue a permit
for A-2 on the.strength of these proceedings. Moreover, the
Staff Response and proposed Order do not provide even the
barest specification of the work in 'public waters or other
action of a state agency, municipality or private party
which constitute the "permitted" activity supposedly to
result from the entry of this order.

As the DNR Staff is aware, the jurisdiction of any single
agency does not encompass all approvals, reviews and considera-
tions which are accorded other agencies, communities and
individuals under applicable laws and regulations. Therefore,
the implication of the Response and proposed Order is erroneous
in suggesting that the entry of such an Order can sweep away
the requisiteadministrative actions and community input. The
proponents of the A-1 corridor have outlined the potential
delays of selecting an A-2 corridor',while the opponents in-
cluding the DNR Staff have contended that such delays may he
eliminated or ignored. We must unfortunately conclude that the
Staff Response and proposed Order are submitted for the purpose
of advancing the Staff's adversary position that administrative
procedures required by law may be eliminated or ignored. In
doing so, we believe that the Staff has exceeded its role as
'a party to this proceeding.
'rime does not permit a detialed explication of the procedures
which are required in initiating, considering, approving and
reviewing amajor project such as the A-2 corridor. These
procedures have been the subject of extensive consideration
in the administrative proceedings and are a matter o.`. recor.d.
In behalf of the City of Eagan, the undersigned formally
lodges an objection to the DNR Staff Response and proposed
0 i:C,-r and states that contrary to the implcation thereof and
contrary to any action which the Commissioner might undertake
in adopting the Staff proposed Order there will necessarily
flow from the rejection'of.the A-1 alternative a significant
and substantial delay in the implementation and completion of
I -35-E of several years.
