03/21/1980 - City Council Special (2)MEMO TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES _ -- _-, .DATE: _...MARCH.21, 1980..__ -- SUBJECT: SPECIAL CITY COUNCIL MEETING The Advisory .Planning Commission is meeting on Tuesday, March 25,'1980, for their regular meeting. Because the meeting is not scheduled to last —long, it was felt -by -the Mayor, Chairman -of the Planning -Commission-and - staff that this would be a good .opportunity for members of the City Council and Planning Commission to meet and discuss the comments that were made in the recent informal meetings regarding the :Comprehensive Land Use Plan. This would allow member's of the APC and City Council to give direction to the Consulting Planner, Mr. John Voss, and City Planner, Mr. Dale Run- kle, regarding changes to the Comprehensive Land Use 'Plan and, further, to establish a date for the final hearing. By. meeting Tuesday evening to discuss these matters, it will be possible to have the final hearing some- time in late April. It will take Mr. Voss approximately twenty to thirty -- ---days, to -make all the final changes, print the documents and have them ready for public inspection prior to the final public hearing. The only comments recorded• by the City Administrator were those recorded in minutes of the March 6, 1980, informal meeting at Pilot Knob Elementary School. Representatives of Miller & Schroeder Lare willing to make a brief presenta- tion and answer question regarding Industrial Revenue Mortgage Financing' on Tuesday evening and therefore this item has been set for 7:00 p.m. in the office of the City Administrator. It seems appropriate to spend about half an hour to an hour on this topic, and assuming there is addi- tional time available, the City Council could informally discuss the outcome of Mak'n Magic vs. the City of Eagan case regarding enforcement of the drug paraphernalia ordinance which was ruled upon by the Eighth District - -------Court of Appeals in St. Louis this week. Nothing has been received regarding the decision on this case by the City Attorney's office or the City Administrator's office. Late this afternoon, I called the law clerk for the Federal District Court and was informed that they will not receive the decision for .thirty (30) days, at which time they will then notify the affected parties. I then decided to contact the Eighth District Circuit Court in St. Louis and. was informed -that. the judge's ruling was nine pages in length. They would not. read the entire decision but, did read the .last paragraph 'which appears to be a summary., It reads as follows: On -the basis .of this record, we have no alternative but to reverse and remand the directionsthat the District Court enter a preliminary injunction until a trial at which the merits of the ordinance can be fully weighed.
