SUBJECT: SPECIAL CITY COUNCIL MEETING
A special City Council meeting is scheduled for 7:00 p.m. Tuesday, October
12, 1982. The purpose of the meeting is to hold a workshop on several
major issues that will require action by the City Council at future City
Council meetings.
Water Treatment Plant
The Director of Public Works will be present along with the City Administra—
tor to discuss the report that was presented as a part of the Administrative
Packet including some considerations and suggestions by the Director of
Public Works as they relate to polyphosphates and a water treatment plant.
Secondly, the City Administrator and Director of Public Works would like
to further discuss and outline for the City Council a timetable for completing
a water treatment plant project. Thirdly, some further discussion regarding
a possible RFP for an engineering consultant should be held. To date,
the City Council has taken formal action to, treat water; however, the method
of treatment and a timetable for treatment has not been acted upon. Action
will be required at the October 19 or a future City Council meeting to accept
the engineer's report and decide on a method of water treatment.
City Hall Update
The City Administrator will provide a brief update on the status of the
City Hall expansion project. Regular meetings have been taking place with
the architect, the management team has visually inspected six (6) city
halls throughout the Twin Cities to investigate how offices and departments
interrelate in a given floor space and, finally, a time schedule will be
outlined by the City Administrator regarding the proposed construction
project.
Final General Government Budget Adjustments
The City Administrator will review some recommended general government
budget adjustments for consideration. These budget adjustments include
both deducts and additions and represent approximately 1% to 2% of the
total general government operating budget.
Subdivision & Nuisance Ordinances
The subdivision and nuisance ordinances were deferred to this workshop
session at the last regular City Council meeting for review and comment.
Please bring copies of those ordinances to the work session. The Director
of Public Works will be available for that discussion.

This letter is simply an update on the action brought by Amcon and others
against the City of Eagan regarding the application for planned development
approval covering the Amcon-O.J. Sporting Goods property at the southwest
intersection of Pilot Knob Road and I-494. The Summons and Complaint was
served about August 18, Interrogatories were served on the City and detailed
Answers were submitted about the 20th of September. Revisions to those Answers
are being prepared and will be served on the Plaintiffs' attorneys shortly.
Depositions were scheduled immediately by the Plaintiff and depositions have
now been taken of the three Councilmembers, namely Mayor Blomquist and Council -
members Smith and Egan. On Wednesday, October 6, a deposition is scheduled
for John Voss.
On Wednesday, October 13, depositions are scheduled for Mr. Nigle Finney of
the MAC and Mr. Richard Keinz of MN/DOT Aeronautics Division. In addition,
Dale Runkle's deposition will be taken on the same date. I would expect that
the City will depose several parties representing the Plaintiff and Mr.
Stalland has indicated now that he is going to make a motion to advance the
action on the calendar of the District Court. The Plaintiffs, of course, are
anxious to get a decision from the District Court as soon as possible and he
is going to ask that the case be heard in District Court by December of this
year. There are many implications to this lawsuit for the City and, of course,
also for the Joint Zoning Board over the long term and I think it's very
important that the City's position be deliberate and very clear as to the
direction that the Council is going to take in this action. The Council should
not overlook the possibility of some type of compromise and if there.are,any
comments from the members concerningthe 11 lawsuit or compromise in any
way, certainly get in touch with me.

I am enclosing a copy of the Order for Preliminary Injunction that was entered
into by Judge John Fitzgerald dated September 27, 1982, relating to the Pioneer
Press action. You will note that the Judge was temporarily enjoined the City
from removing the boxes but he did not give any explanation as to his decision.
You may also remember that this is the second stage in a three-part injunction
action, the first being the temporary restraining order, this being the temporary
injunction stage and the third being an eventual trial on the merits. I can
only assume that he felt that the boxes now are in the locations that the City
deemed to be safe locations and that a question of whether the Pioneer Press
should be charged for the permit would have to be brought out at the time of
the final hearing.

Copies of the "Blue Book" history manuscript draft have been sent to city clerk
those members who had not previously received one. In order to keep to
the schedule discussed by the History Committee and City Council at
their last meeting, it is appropriate that we meet to finalize the
document to be published.
The City Council has a joint meeting with other city councils on
Wednesday, October 27, at 7:30 p.m. and so would like to meet with
the History Committee at 6:30 on that evening.
Hopefully all members will have had time to review and compare their
drafts. The City Council will discuss the Committee's two versions
and reach a decision in order to prepare for publication. The
preparation and dedication of the History Committee to the project
is most commendable; we all look forward to taking the next step
in making this history book a success.

SUBJECT: MISCELLANEOUS
There are several things that need to be accomplished during the month
of November. The public enterprise funds must be reviewed by the City
Council so the final 1983 budget document can be adopted and printed to
be effective January 1, 1983. It is also necessary' to review all salary
proposals for union and non-union personnel. The Director of Public Works
would like a few minutes to discuss the proposal that is anticipated to
be made to residents abutting Diffley Road at the upcoming informational
hearing scheduled for December at Cedar Elementary School. There will
also be a need to review some preliminary drawings of the City Hall facility
so that the architect will be able to proceed ahead with the final design
and eventually an advertisement for bids. It is recommended that we
schedule two (2) workshop sessions during the month of November and plan
to review these items at those meetings. If all this information can be
reviewed at one meeting, it would then be possible to cancel the second
meeting. Choosing a date for the meeting is somewhat difficult due to the
rearrangement of regular City Council meeting dates and the November
election.
The dates that are already committed for the month of November 2 - general
election, November 9 and 16 - regular City Council meetings, November 18
is a tentatively scheduled regular Joint Burnsville/Eagan Cable Commission
meeting, and November 25 is Thanksgiving. November 11 is Veterans' Day
which is a federal holiday and governmental business is not allowed to
be conducted on that day. Through process of elimination, it seemed that
Thursday, November 4, and Tuesday, November 23, would be reasonable
dates to meet to stay consistent with the Tuesday or Thursday meeting dates.
This would spread out the workshop sessions if they are both required.
If those dates are not feasible, it would then mean a Monday or Wednesday
date, consisting of November 8, 10, 15 or 17, which would also be feasible.
These dates do cause consecutive meeting nights for the City Council.
The City Administrator will contact each member of the City Council on
Monday, November 1, and get some response as to when each of you would
like to schedule the workshop sessions. It is important that one session
be scheduled early in the month and one later in the month.

SUBJECT: COMSERV BUILDING COLOR
The City has received a few calls concerning objections to the present blue
color of the Comsery building which is currently under construction.
Because we have received these calls and in case you receive any, please
be informed that the blue color is merely a protective coating which will
be removed after construction. The tentative date for this removal is March.
The actual color of the building is "gun metal silver grey." Comsery has
notified other business in the area, i.e., Blue Cross, etc., and informed
them that the blue color is only temporary. If you do receive any com-
plaints about the unsuitability of the color, the above information should
help you.

and reach a decision in order to prepare for publication. The
preparation and dedication of the History Committee to the project
is most commendable; we all look forward to taking the next step
in making this history book a success.

SUBJECT: MISCELLANEOUS
There are several things that need to be accomplished during the month
of November. The public enterprise funds must be reviewed by the City
Council so the final 1983 budget document can be adopted and printed to
be effective January 1, 1983. It is also necessary' to review all salary
proposals for union and non-union personnel. The Director of Public Works
would like a few minutes to discuss the proposal that is anticipated to
be made to residents abutting Diffley Road at the upcoming informational
hearing scheduled for December at Cedar Elementary School. There will
also be a need to review some preliminary drawings of the City Hall facility
so that the architect will be able to proceed ahead with the final design
and eventually an advertisement for bids. It is recommended that we
schedule two (2) workshop sessions during the month of November and plan
to review these items at those meetings. If all this information can be
reviewed at one meeting, it would then be possible to cancel the second
meeting. Choosing a date for the meeting is somewhat difficult due to the
rearrangement of regular City Council meeting dates and the November
election.
The dates that are already committed for the month of November 2 - general
election, November 9 and 16 - regular City Council meetings, November 18
is a tentatively scheduled regular Joint Burnsville/Eagan Cable Commission
meeting, and November 25 is Thanksgiving. November 11 is Veterans' Day
which is a federal holiday and governmental business is not allowed to
be conducted on that day. Through process of elimination, it seemed that
Thursday, November 4, and Tuesday, November 23, would be reasonable
dates to meet to stay consistent with the Tuesday or Thursday meeting dates.
This would spread out the workshop sessions if they are both required.
If those dates are not feasible, it would then mean a Monday or Wednesday
date, consisting of November 8, 10, 15 or 17, which would also be feasible.
These dates do cause consecutive meeting nights for the City Council.
The City Administrator will contact each member of the City Council on
Monday, November 1, and get some response as to when each of you would
like to schedule the workshop sessions. It is important that one session
be scheduled early in the month and one later in the month.

SUBJECT: COMSERV BUILDING COLOR
The City has received a few calls concerning objections to the present blue
color of the Comsery building which is currently under construction.
Because we have received these calls and in case you receive any, please
be informed that the blue color is merely a protective coating which will
be removed after construction. The tentative date for this removal is March.
The actual color of the building is "gun metal silver grey." Comsery has
notified other business in the area, i.e., Blue Cross, etc., and informed
them that the blue color is only temporary. If you do receive any com-
plaints about the unsuitability of the color, the above information should
help you.
