SUBJECT: SPECIAL CITY COUNCIL MEETING FIRST
The Tax Increment Financing Workshop to discuss Tax Increment
Financing Revenue Bonds is set for 6:30 p.m. Miller & Schroeder
Municipals Inc. have been notified and will be here at 6:30 p.m.
to discuss this proposed financing option. It is the desire of the
City Council once M & S employees have left to. discuss as a City
Council the overall philosophy of Taxing Government Financing
Revenue Bonds.
Attatched is a copy of the Management By Objectives chart that was
discussed by the City Council in a special meeting held in late
February of this year. The City Administrator will provide
additional information at the meeting on Monday, to update the
list with additional objectives and also provide a column stating
the status of each of the objectives listed on the original chart.
Northwestern Mutual Life Insurance Company is proposing a develop-
ment of three-story office buildings in the Eagandale Industrial
Park. There is a restriction in the R & D zoning that provides a
problem to staff in granting building permit for the first phase.
Subdivision 20 states the Lot area has to be 40 acres in size in
an R & D district and the acreage in which Northwestern Mutual
Life Insurance is proposing office buildings would not comply.
Attatched is a copy of a memorandum prepared by the City Planner
for your review. The City Administrator will be asking for an
interpretation by the Council as to whether the City can proceed
with the issuance of a building permit or whether variance preced-
ings must be provided for under interpretation of the Code.
The City Administrator has offered an agenda item entitled Admin-
istrative Update. There are a number of issues the City Admin-
istrator would like to briefly mention and/or discuss with the
City Council. Some of those issues are as follows:

SUBJECT: BUILDING PERMIT REQUEST BY NORTHWESTERN MUTUAL LIFE
INSURANCE
The City has received a request from Northwestern Mutual Life
Insurance regarding the property immediately north of Country Home
Heights. Presently, this parcel is zoned RD (research and develop-
ment) and has stricter limita.tions in this area for development
than in a straight industrial zone which is the majority of zoning
in this general area. The applicants have submitted an overall
plan as to how they would like to develop the R and D District north
of Country Home Heights. Northwestern Mutual Life is proposing
to construct four, three story office buildings and one restaurant
at the intersection of Pilot Knob Road and Corporate Center Drive.
In review of the zoning, the office buildings meet all of the
criteria of the R and D zoning district and the zoning would not
be a problem for use, lot size or any other ordinance requirements.
The restaurant would take a. zoning change to be a permitted use
within this general area. The applicants feel that the restaurant
would serve the general industrial area and would also fit within
their overall planning or location because they would be proposing
a hotel facility just on the north side of Corporate Center Drive.
In reviewing the overall plan and what the first phase will intend,
the applicants have indicated that they would like to start building
number one, the office building located in the SW portion of the
site as soon as possible. Presently, the proposed building meets
all of the setbacks of the R and D zoning and meets the land use
intent of the R and D zoning and will fulfill all of the site
criteria in order that a building permit could be issued on the
platted lot. There is one exception, subdivision 20 states that
a lot area has to be 40 acres in size and the entire R and D dis-
trict is not 40 acres. Therefore, no building would be allowed
to be constructed on this property if the 40 acre provision were
to be upheld. In review of all other required ordinances, the ap-
plicants do meet or exceed the City ordinances with this exception.
As stated earlier, the building is proposed to be located on lots
22, 23, 24 and 25 Eagandale Center Industrial Park. In order to
construct other buildings, the applicants would have to replat.which
they intend to do in the future. However, they would like to
acquire a building permit as soon as possible to begin the first
phase of construction of the office facility.

SUBJECT: SPECIAL CITY COUNCIL MEETING FIRST
The Tax Increment Financing Workshop to discuss Tax Increment
Financing Revenue Bonds is set for 6:30 p.m. Miller & Schroeder
Municipals Inc. have been notified and will be here at 6:30 p.m.
to discuss this proposed financing option. It is the desire of the
City Council once M & S employees have left to discuss as a City
Council the overall philosophy of Taxing Government Financing
Revenue Bonds.
Attatched is a copy of the Management By Objectives chart that was
discussed by the City Council in a special meeting held in late
February of this year. The City Administrator will provide
additional information at the meeting on Monday, to update the
list with additional objectives and also provide a column stating
the status of each of the objectives listed on the original chart.
Northwestern Mutual Life Insurance Company is proposing a develop-
ment of three-story office buildings in the Eagandale Industrial
Park. There is a restriction in the R & D zoning that provides a
problem to staff in granting building permit for the first phase.
Subdivision 20 states the .Lot area has to be 40 acres in size in
an R & D district and the acreage in which Northwestern Mutual
Life Insurance is proposing office buildings would not comply.
Attatched is a copy of a memorandum prepared by the City Planner
for your review. The City Administrator will be asking for an
interpretation by the Council as to whether the City can proceed
with the issuance of a building permit or whether variance preced-
ings must be provided for under interpretation of the Code.
The City Administrator has offered an agenda item entitled Admin-
istrative Update. There are a number of issues the City Admin-
istrator would like to briefly mention and/or discuss with the
City Council. Some of those issues are as follows:

SUBJECT: BUILDING PERMIT REQUEST BY NORTHWESTERN MUTUAL LIFE
INSURANCE
The City has received a request from Northwestern Mutual Life
Insurance regarding the property immediately north of Country Home
Heights. Presently, this parcel is zoned RD (research and develop-
ment) and has stricter limitations in this area for development
than in a straight industrial zone which is the majority of zoning
in this general area. The applicants have submitted an overall
plan as to how they would like to develop the R and D District north
of Country Home Heights. Northwestern Mutual Life is proposing
to construct four, three story office buildings and one restaurant
at the intersection of Pilot Knob Road and Corporate Center Drive.
In review of the zoning, the office buildings meet all of the
criteria of the R and D zoning district and the zoning would not
be a problem for use, lot size or any other ordinance requirements.
The restaurant would take a zoning change to be a permitted use
within this general area. The applicants feel that the restaurant
would serve the general industrial area and would also fit within
their overall planning or location because they would be proposing
a hotel facility just on the north side of Corporate Center Drive.
In reviewing the overall plan and what the first phase will intend,
the applicants have indicated that they would like to start building
number one, the office building located in the SW portion of the
site as soon as possible. Presently, the proposed building meets
all of the setbacks of the R and D zoning and meets the land use
intent of the R and D zoning and will fulfill all of the site
criteria in order that a building permit could be issued on the
platted lot. There is, one exception, subdivision 20 states that
a lot area has to be 40 acres in size and the entire R and D dis-
trict is not 40 acres. Therefore, no building would be allowed
to be constructed on this property if the 40 acre provision were
to be upheld. In review of all other required ordinances, the ap-
plicants do meet or exceed the City ordinances with this exception.
As stated earlier, the building is proposed to be located on lots
22, 23, 24 and 25 Eagandale Center Industrial Park. In order to
construct other buildings, the applicants would have to replat,which
they intend to do in the future. However, they would like to
acquire a building permit as soon as possible to begin the first
phase of construction of the office facility.

SUBJECT: SPECIAL CITY COUNCIL MEETING FIRST
The Tax Increment Financing Workshop to discuss Tax Increment
Financing Revenue Bonds is set for 6:30 p.m. Miller & Schroeder
Municipals Inc. have been notified and will be here at 6:30 p.m.
to discuss this proposed financing option. It is the desire of the
City Council once M & S employees have left to discuss as a City
Council the overall philosophy of Taxing Government Financing
Revenue Bonds.
Attatched is a copy of the Management By Objectives chart that was
discussed by the City Council in a special meeting held in late
February of this year. The City Administrator will provide
additional information at the meeting on Monday, to update the
list with additional objectives and also provide a column stating
the status of each of the objectives listed on the original chart.
Northwestern Mutual Life Insurance Company is proposing a develop-
ment of three-story office buildings in the Eagandale Industrial
Park. There is a restriction in the R & D zoning that provides a
problem to staff in granting building permit for the first phase.
Subdivision 20 states the Lot area has to be 40 acres in size in
an R & D district and the acreage in which Northwestern Mutual
Life Insurance is proposing office buildings would not comply.
Attatched is a copy of a memorandum prepared by the City Planner
for your review. The City Administrator will be asking for an
interpretation by the Council as to whether the City can proceed
with the' issuance of a building permit or whether variance preced-
ings must be provided for under interpretation of the Code.
The City Administrator has offered an agenda item entitled Admin-
istrative Update. There are a number of issues the City Admin-
istrator would like to briefly mention and/or discuss with the

SUBJECT: SPECIAL CITY COUNCIL MEETING FIRST
The Tax Increment Financing Workshop to discuss Tax Increment
Financing Revenue Bonds is set for 6:30 p.m. Miller & Schroeder
Municipals Inc. have been notified and will be here at 6:30 p.m.
to discuss this proposed financing option. It is the desire of the
City Council once M & S employees have left to discuss as a City
Council the overall philosophy of Taxing Government Financing
Revenue Bonds.
Attatched is a copy of the Management By Objectives chart that was
discussed by the City Council in a special meeting held in late
February of this year. The City Administrator will provide
additional information at the meeting on Monday, to update the
list with additional objectives and also provide a column stating
the status of each of the objectives listed on the original chart.
Northwestern Mutual Life Insurance Company is proposing a develop-
ment of three-story office buildings in the Eagandale Industrial
Park. There is a restriction in the R & D zoning that provides a
problem to staff in granting building permit for the first phase.
Subdivision 20 states the .Lot area has to be 40 acres in size in
an R & D district and the acreage in which Northwestern Mutual
Life Insurance is proposing office buildings would not comply.
Attatched is a copy of a memorandum prepared by the City Planner
for your review. The City Administrator will be asking for an
interpretation by the Council as to whether the City can proceed
with the issuance of a building permit or whether variance preced-
ings must be provided for under interpretation of the Code.
The City Administrator has offered an agenda item entitled Admin-
istrative Update. There are a number of issues the City Admin-
istrator would like to briefly mention and/or discuss with the
City Council. Some of those issues are as follows:

SUBJECT: BUILDING PERMIT REQUEST BY NORTHWESTERN MUTUAL LIFE
INSURANCE
The City has received a request from Northwestern Mutual Life
Insurance regarding the property immediately north of Country Home
Heights. Presently, this parcel is zoned RD (research and develop-
ment) and has stricter limitations in this area for development
than in a straight industrial zone which is the majority of zoning
in this general area. The applicants have submitted an overall
plan as to how they would like to develop the R and D District north
of Country Home Heights. Northwestern Mutual Life is proposing
to construct four, three story office buildings and one restaurant
at the intersection of Pilot Knob Road and Corporate Center Drive.
In review of the zoning, the office buildings meet all of the
criteria of the R and D zoning district and the zoning would not
be a problem for use, lot size or any other ordinance requirements.
The restaurant would take a zoning change to be a permitted use
within this general area. The applicants feel that the restaurant
would serve the general industrial area and would also fit within
their overall planning or location because they would be proposing
a hotel facility just on the north side of Corporate Center Drive.
In reviewing the overall plan and what the first phase will intend,
the applicants have indicated that they would like to start building
number one, the office building located in the SW portion of the
site as soon as possible. Presently, the proposed building meets
all of the setbacks of the R and D zoning and meets the land use
intent of the R and D zoning and will fulfill all of the site
criteria in order that a building permit could be issued on the
platted lot. There is, one exception, subdivision 20 states that
a lot area has to be 40 acres in size and the entire R and D dis-
trict is not 40 acres. Therefore, no building would be allowed
to be constructed on this property if the 40 acre provision were
to be upheld. In review of all other required ordinances, the ap-
plicants do meet or exceed the City ordinances with this exception.
As stated earlier, the building is proposed to be located on lots
22, 23, 24 and 25 Eagandale Center Industrial Park. In order to
construct other buildings, the applicants would have to replat,which
they intend to do in the future. However, they would like to
acquire a building permit as soon as possible to begin the first
phase of construction of the office facility.

Council that because of the location of the research and development
district in regard to the Country Homes Heights neighborhood, the

SUBJECT: BUILDING PERMIT REQUEST BY NORTHWESTERN MUTUAL LIFE

The City has received a request from Northwestern Mutual Life
Insurance regarding the property immediately north of Country Home
Heights. Presently, this parcel is zoned RD (research and develop-
ment) and has stricter limitations in this area for development
than in a straight industrial zone which is the majority of zoning
in this general area. The applicants have submitted an overall
plan as to how they would like to develop the R and D District north
of Country Home Heights. Northwestern Mutual Life is proposing
to construct four, three story office buildings and one restaurant
at the intersection of Pilot Knob Road and Corporate Center Drive.
In review of the zoning, the office buildings meet all of the
criteria of the R and D zoning district and the zoning would not
be a problem for use, lot size or any other ordinance requirements.
The restaurant would take a zoning change to be a permitted use
within this general area. The applicants feel that the restaurant
would serve the general industrial area and would also fit within
their overall planning or location because they would be proposing
a hotel facility just on the north side of Corporate Center Drive.
In reviewing the overall plan and what the first phase will intend,
the applicants have indicated that they would like to start building
number one, the office building located in the SW portion of the
site as soon as possible. Presently, the proposed building meets
all of the setbacks of the R and D zoning and meets the land use
intent of the R and D zoning and will fulfill all of the site
criteria in order that a building permit could be issued on the
platted lot. There is one exception, subdivision 20 states that
a lot area has to be 40 acres in size and the entire R and D dis-
trict is not 40 acres. Therefore, no building would be allowed
to be constructed on this property if the 40 acre provision were
to be upheld. In review of all other required ordinances, the ap-
plicants do meet or exceed the City ordinances with this exception.
As stated earlier, the building is proposed to be located on lots
22, 23, 24 and 25 Eagandale Center Industrial Park. In order to
construct other buildings, the applicants would have to replat.which
they intend to do in the future. However, they would like to
acquire a building permit as soon as possible to begin the first
phase of construction of the office facility.

The City Staff would like to bring to the attention of the City
Council that because of the location of the research and development
district in regard to the Country Homes Heights neighborhood, the
City Council should review prior to Staff issuing a building permit.
The building permit would be in order to be issued once the appli-
cants have submitted all information for Staff review. If you have
