Re: Backyard drainage issues
Dear Mr. & Mrs. Del Santos,
The purpose of this letter is to summarize my observations from my site visit to your property
this past Friday. I reviewed the lot survey, which I have included for your reference, when your
home was built in 2006/2007 so I have some familiarity with your property. In reviewing the
grading during this recent visit its clear there have been no adjustments made from the original
approved grading plan; the backyard is basically the same as it was when the home was
originally constructed.
Storm water runoff from your property is intended to run from an east/southeast direction and
flow to the west/northwest direction. From there it exits your property and flows through
platted drainage and utility easements in the rear yards of 628 and 632 McFaddens Tr.,
eventually ending up in the storm water treatment pond in the rear yard of 636 McFaddens Tr.
This is exactly where the water is currently flowing.
You mentioned your neighbor who lives at 628 McFaddens Tr. believes the grass near your rear
lot line as well as grass on her side of the property line is not growing well because of the water
runoff from your yard. I have to respectfully disagree with her assumption for two reasons.
One, the volume of water coming through there is not great enough to cause this issue and
second, and more important, the heavy tree canopy that exists is a much more significant
factor in prohibiting the ability to grow grass in this area.
My recommendation is that you contact a Land Surveyor and have your property corners
located so there is no doubt where the property line is for you and your neighbor. From my
observations, it's possible that the actual property line is anywhere between 6 to 10 feet
outside of your fence.

By placing the retaining wall block along your fence and dumping dirt inside of your fence your
neighbor has technically committed at least several crimes, namely trespassing and illegal
dumping. These items should be removed as soon as conditions allow in order to prevent
damage elsewhere on your property. As far as the suggestion that your neighbor made to you
about re-grading your back yard, not only is this impractical but it won't work as this is the only
location that runoff can exit. Everything other direction would either require it to run uphill,
impact existing trees that have been there long before the subdivision or both.
