SUBJECT: Setback from Wescott Road
Conclusion: The existing building setback of 47 feet from Wescott Road right-of-way is the
established building setback line and will be considered the required setback for the future.
Purpose: The purpose of this memo is to explain and document the setback from Wescott
Road on this lot.
Issue: This house was built at a setback of 47 feet from Wescott Road whereas the
required minimum setback should be 50 feet. This error came to light well after construction
was complete, when the homeowner inquired about building a deck addition to the rear of
the home.
Background: Wescott Road is a B Minor Arterial roadway with a right-of-way width of 100
feet. Therefore, per the additional setback section in the zoning ordinance, the minimum
setback from Wescott Road is 50 feet, and the Willow Ridge staff report indicated it as such.
After subdivision approval, when the surveyor inquired specifically about setbacks for this lot,
staff mistakenly responded that the required structure setback from Wescott Road was 40
feet. The discrepancy was not caught during plan review for and the Building Permit was
issued based on the survey showing a 47-foot setback from Wescott Road. The house
construction is complete, and the established building line is now at a setback of 47 feet.
The Willow Ridge subdivision received final approval in 2016 and is zoned R-1S. Four lots
in the development abut Wescott Road, and this is the only lot in the development with a side
yard abutting Wescott Road.
