The proposed location of the game court would displace trees in the rear yard. These trees were required planting as mitigation for tree removal associated with the subdivision development, and removal of the trees would be in violation of the development contract. For this reason, we are unable to approve the Zoning Permit for the game court. Please find attached the application and with reason for denial noted. We can reconsider a new Zoning Permit application if it is accompanied by a tree replacement or relocation plan identifying how many of these trees are impacted, and how and where they will be either replaced or relocated. I have again attached the denied Zoning Permit for your records. More specific reasons for denial are noted in this e-mail below. Once you have resolved these issues,you may resubmit with acceptable plans for both the court and the tree relocation. Because the Developer of the Summerbrooke subdivision is responsible for the planting and survival of tree mitigation trees,the Developer must sign off on and approve of the tree relocation plan. The Developer in this case is Hunter Homes, LLC, Kurtis Manley,Trustee. Since these trees were recently planted, relocating them a second time is stressful and decreases chances of survival,and it is the Developer's responsibility to replace mitigation trees that don't survive. • Please obtain written permission from the Developer of a tree relocation proposal, revised per the City Forester's comments. Per the City Forester,the proposed tree relocation plan is not acceptable: • Trees should not be installed on or near property lines.This placement will lead to future tree maintenance issues and encroachment of the tree's crown onto others property. • The crowns of the trees to be installed on the east property line will also have crowns that encroach into the utility easement area, restricting access. Plus these trees are proposed too close together leading to eventual tree health issues(twig and needle fungus and tree decline). • Revise the plan to plant acceptable amounts of trees on this lot(allowing for mature crown growth). If that is not possible,cash payment in lieu of on-site tree mitigation planting is an alternative options for satisfying the balance of mitigation. From the Asst.City Engineer: • The sport court must be completely out of the drainage and utility easement that runs across the rear yard. There is a critical drainage swale that runs through that easement,and it must remain free of obstructions. • If you reapply with an acceptable proposal such that the Zoning Permit can be approved,then before installing the sport court, please locate and mark the edge of the easement on the property and stake out the extent of the sport court. Then contact City Engineering Technician Tom Strid (651-675-5636,tstrid@cityofeagan.com )to inspect and confirm the location before any hard surface work is done.
