DRAINAGE AND UTILITY EASEMENT
THIS EASEMENT is made this t-19`•day of Nei at 9 ,, 2019, by Kevin
R. Pyles and Jenne V. Pyles, husband and wife (the "Landowners"), in favor of the City of
Eagan,a Minnesota municipal corporation(the "City").
The Landowners are the fee title holders of property legally described as follows:
Lot 14, Block 1,Brittany 4th Addition, according to the recorded plat thereof,Dakota
County, Minnesota,
(the"Property").
The Landowners, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration,the receipt and sufficiency of which are hereby acknowledged, do hereby
grant and convey unto the City, its successors and assigns, a permanent easement for drainage
and utility purposes over, under and across a portion of the Property legally described as follows:
An easement over, under and across that part of Lot 14, Block 1,BRITTANY 4TH
ADDITION, according to the recorded plat thereof,Dakota County,Minnesota,
described as commencing at the southwest corner said of Lot 14;thence South 87 degrees
56 minutes 49 seconds East,assumed bearing, along the south line of said Lot 14,a
distance of 10.00 feet to a line 10.00 feet east of and parallel with the west line of said
Lot 14;thence North 0 degrees 22 minutes 26 seconds East along said parallel line a
distance of 5.00 feet to the point of beginning of the easement to be described;thence
continuing North 0 degrees 22 minutes 26 seconds East,along said parallel line,3.00 feet
to a line 8.00 feet north of and parallel with said south line of Lot 14; thence South 87
degrees 56 minutes 49 seconds East, along said last described parallel line, 93.77 feet;
thence North 47 degrees 29 minutes 11 seconds East 28.50 feet; thence North 2 degrees
55 minutes 11 seconds East 30.98 feet to a line 5.00 feet south of and parallel with the
north line of said Lot 14;thence South 88 degrees 26 minutes 09 seconds East,along said
last described parallel line,20.01 feet;thence South 2 degrees 55 minutes 11 seconds
West 54.16 feet to a line 5.00 feet north of and parallel with said south line of Lot 14;
thence North 87 degrees 56 minutes 49 seconds West, along said last described parallel
line, 133.64 feet to the point of beginning.

(the"Easement Area").
See Exhibit "A" attached hereto and incorporated herein which depicts the Easement
Area.
The grant of the foregoing easement includes the right of the City, its contractors, agents
and servants to enter upon the Easement Area at all reasonable times to construct, reconstruct,
inspect, repair and maintain pipes, conduits and mains; and the further right to remove trees,
brush, undergrowth and other obstructions. After completion of such construction, maintenance,
repair or removal,the City shall restore the Easement Area to the condition in which it was found
prior to the commencement of such actions, save only for the necessary removal of trees, brush,
undergrowth and other obstructions.
The Landowners covenant with the City that they are the fee owners of the Property and
have good right to grant and convey the easement herein to the City.
This easement and the covenants contained herein shall run with the Property and shall
bind the Landowners and their successors and assigns.
IN WITNESS WHEREOF, the Landowners have execute this instrument as of the day
and year first written above.
