UTILITY EASEMENT
This Utility Easement is made this i i• day of Venter. 2019, by and between
Eternity Homes, LLC, property owner of Lot 29, Block 2 Vienna Woods (hereinafter referred to
as "Landowner"), and the City of Eagan, a municipal corporation, organized under the laws of the
State of Minnesota (hereinafter referred to as "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent utility easement
over, across and under the Southwest Quarter of the Northeast Quarter of Section 31, Township
27 North, Range 23 West, situated within Dakota County, Minnesota, to -wit:
Perpetual easement for utility purposes over, under and across that part of Lot 29,
Block 2, VIENNA WOODS, according to the recorded plat thereof, Dakota
County, Minnesota, described as follows:
An easement for utility purposes over and across that part of Lot 29, Block 2, Vienna
Woods Addition, Dakota County, Minnesota, lying easterly of the West 10.00 feet of
said Lot 29 and westerly of the following described lines:
Commencing at the southwest corner of said Lot 29; thence North 00 degrees 20
minutes 05 seconds West, along the west line of said Lot 29, a distance of 34.00 feet to
the point of beginning of the lines to be described; thence North 9 degrees 40 minutes
21 seconds East, a distance of 138.11 feet to a point 61 feet South and 24.00 feet East
of the Northwest corner of said lot 29; thence North 46 degrees 33 minutes 13 seconds
West, a distance of 33.24 feet to a point on the West line of said Lot 29, which point is
located 38.00 feet South of the Northwest corner of said Lot 29 and there terminating.
AND
An easement for utility purposes over and across that part of Lot 29, Block 2, Vienna
Woods Addition, Dakota County, Minnesota, lying westerly of the East line of the West
30.00 feet of said Lot 29 and easterly of the following described lines:
Commencing at the Northwest corner of said Lot 29; thence North 89 degrees 49
minutes 06 seconds East, along the north line of said Lot 29, a distance of 10.00 feet to
the point of beginning of the lines to be described; thence South 35 degrees 02 minutes
15 seconds East, a distance of 63.22 feet to a point which is 52.00 feet South and 46.00
feet East of the Northwest corner of said Lot 29; thence South 09 degrees 47 minutes 47
seconds West, a distance of 181.88 feet to a point 14.00 feet East of the Southwest
corner and along the South line of said Lot 29 and there terminating.
(hereinafter the "Easement Area")
See also Exhibit "A" attached hereto and incorporated herein.
The grant of the foregoing permanent easement for utility purposes includes the right of
the City, its contractors, agents and servants to enter upon the premises at all reasonable times to
construct, reconstruct, inspect, repair and maintain pipes, lift station pumps, conduits and mains.
After completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of potential moveable obstructions.
And the Landowner, its successors and assigns, does covenant with the City, its
successors and assigns, that it is the Landowner of the premises aforesaid and has good right to
grant and convey the easement herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to be executed
as of the day and year first above written.
