In 2001, Joe Miller Farms, Inc., a Minnesota corporation, agreed to waive any objection to
special assessments on Unisys Pazk 2°d Addition property. That written waiver of objection to
special assessments was filed with the County Recorder. At the end of 2005, the property was
transferred and the special assessments, which had been levied, were paid in full.
First American Title Insurance Company requested a Certificate of Release of Waiver of Special
Assessment. We have prepared the Certificate of Release of Land from Waiver of Objection to
Special Assessments for signature by the Mayor and Deputy City Clerk.

the City of Eagan under permits issued by the City. Your construction activities have
, included grading and/or disturbance of the site.
An inspection of your site was conducted by CiTy staff on April 17, 2006. At that time
the following items were found to be out of compliance with City Code and/or the
National Pollution Discharge Elimination System (NPDES) permit governing your site:
1. Install and/or maintain silt fence per approved grading plan
2. Install and/or maintain temporary cover on all exposed soils
3. Provide proper stock pile protection
The above items must be addressed within 48 hours of receipt of this notice in order to
bring your site into compliance. City staff will conduct a follow-up inspection at the end
of the 48 hour grace period. If the site is found to be out of compliance at that time, the
City reserves the right to withhold future inspections, hire a third party contractor to bring
the site into compliance, using the financial guazantees for the project to pay for the work
and may issue a Stop Work Order for the entire project.

TERMINATION OF WELL FIELD DEVELOPMENT AGREEMEn'T
FOR EAGAN PRESERVE
The City entered into a Well Field Development Agreement with linisys and Harris Trust
and Savings Bank as Directed Trustee for Unisys Master Trust on Febiuary 7, 1989 affecting the
property now platted as The Eagan Preserve. The Well Field Development Agreement was filed
in the office of the County Recorder of Dakota County, Minnesota on February 21, 1989 as
Document No. 878526 ("Well Field Development AgreemenY'). The Well Field Development
Agreement was later amended by a First Amendment, also dated February 7, 1989 and recorded
therewith, and a Second Amendment to the Well Field Development Agreement, dated October
15, 1991 and recorded therewith.
A groiind water hydrologic study conducted by the City in 1996 indicated that those wells
originally designated by the Well Field Development Agreement to be located within the lands
platted as the Eagan Preserve are no longer required by the City.
A regular meeting of the Eagan City Council, Dakota County, Minnesota, was held on
November 7, 2002 at the City Hall, all members being present, where it was resolved that the
Well Development Agreement entered into on February 7, 1989 as amended shall be terminated
as it pertains to the propeny legally described as the plat of The Eagan Preserve.

It has come to our attention that a number of trees located on City property within Berry
Patch Park have been cut down. Berry Patch is a park that has long been managed so as

Ciry Adminisvaror property, it appears that the trees were cut down to provide a view of the lake from your
property.
Please be advised that the unauthorized removal or damage of vegetation on City park

are hopeful that they will regenerate from the original root system thereby negating the

conversation I inspected the site and found, in my opinion, that there is room to improve
the grading and drainage on the MVTA property in the area between your property line
and the bottom of their slope. This could improve the drainage on your property.
On April 3, 2006 I met with a representative from the MVTA and looked at the area in
question. He agreed that there is room for improvement. He DID NOT commit to
making any improvements at this time. However, he did agree to talk to some
contractors, get some prices to do the necessary improvements and will present the
estimates to his boss for final approval.
It is the City's desire for the MVTA to complete this work as soon as conditions allow
and we have conveyed this to them. It should be noted, if the work does take place and is
done correctly, it will be in the City's opinion that the MVTA has done everything
possible to address the situation and we will not be in a position to request any further
work from them in that particulaz azea. If the work is done properly, it is my opinion that
runoff from the MVTA property onto your property will be significantly reduced if not
totally eliminated.
