Mr. Delaney received the denial and was not happy. He said it was ridiculous for us to enforce a setback when this was
the perfect location of the shed. He said he spend thousands of dollars to put it up, cement it in and replace the
fence. He is not moving it or taking it down. I explained he is in violation of City Code and I cannot legally approve a
zoning permit at its current location. I didn't even get into whether or not it matches the house. I provided him the
opportunity for a Variance request but he needs to show why it can't be located in the NE corner. He doesn't want to
spend the money on what is a "ridiculous" rule and that we should just let this pass and that we have better things to be
doing.
There isn't more I can do on this. I will leave it up to Mike and CE on how to proceed.

We are not able to approve the zoning permit as presented. Sheds must be located in the rear yard and meet all setback
requirements including those from public rights -of -way. Since your property borders three streets, we need to first
determine the rear yard for the shed. In this case, we are allowing it to be the side opposite Whitetail Way where the
shed may setback 5' from the property line closest to Wilderness Run Road. It may not be closer to the street than the
house along Fawn Ridge Trl. Please identify a location in the area I marked in red on the attached permit denial and we
can go from there. If you cannot identify an approved location, then the shed needs to be removed.
Also, all sheds over 120 sq ft must have siding, color and roof style/pitch to match the existing home. Please provide
more details regarding the shed exterior.
