Zoning permit. The rear yard storm sewer is really shallow (only about 1.5' of cover over it), so they should not put their fence right on top of it. I'd put a condition that a fence is allowed in the easement, but it can't restrict the flow of stormwater to the rear yard catch basins, access needs to be maintained at all times, and it cannot be directly over of the storm sewer pipe. The pipe is 21" in diameter, so they should be at least 2'-3' from the center of the pipe. Also, any installation in the easement is at their own risk.
