The Standard Plate Count is the total number of organisms capable of growth at 35°C. This test may provide
supporting data of the results of the coliform test levels.
The Coliform group of organisms are found in the intestines of humans and all other warm blooded animals
as well as surface soil. A positive test for coliforms is indicative of contamination by sewage or surface water.
Drinking water supplies, which contain coliform organisms in excess of 1 coliform per 100 ml. of water, are
contaminated and corrective measures should be taken. Thus a result of < 1 is acceptable.
Nitrate-Nitrogen, is considered excessive over 10 Mg/liter. If exeessive the water can be harmful to small infants and
young livestock and should not be consumed by them. Any number less than 10 is considered an acceptable level.
Note: When existing well defiencies have been corrected, disinfection by approved methods may result in improved
bacterial quality. After disinfection the well should be re-sampled following a waiting period of at least one week.

In response to your request for information which was received in our office on March 1,
2007, I would refer you to our conversation in my office several months ago relative to
the property listed for sale at the corner of Lexington Ave. and Lone Oak Rd. in Eagan.
The property is owned and being marketed privately, and the city has not yet received a
development application in its regard. If and when an application is received, a tree
survey will be required at that time. It is also at the point of a development application
that the city reviews the size of the property and the nature of the proposed development
to determine whether or not it meets or exceeds thresholds that justify an Environmental
Assessment. As such, there is no basis on which to make that determination at this time.
As we discussed when you were in the office, while the city may regulate the nature and
intensity of development, it is not permitted to prohibit development of any kind.
If you wish to review information that may be submitted at the time a development

The City has received information that the individual sewage treatment system at 2977 L,exington
Ave. has been classified as a failed system as defined by MN Rules, Chapter 7080.0020, Subp.
16b and City of Eagan Code Section 4.04.
A failed system occurs when:
1. There is msufficient vertical separation from the bottom of the drain field to the high water
table or bedrock
2. A bottomless or leaking septic tank is present
3. There is discharge from a cesspool, drywell, or seepage pit.
Failed systems must be renaired or renlaced within 180 davs of this notice. If at any time the
system backs up or discharges above grade, corrective action should be completed within 30
days.
Your attention to this matter is required to protect the heahh of your family and the community.
Only a properly designed and operating system can treat the effluent to reduce hamiful bacterial
and other contaminants.
The Compliance Inspector in the report of this individual sewage treatment system has
determined a new septic system would require a vaziance to the high water mark of the ponds
from the DepaRment of Natural Resources and variance to lot lines From the City of Eagan. He
states the house should be connected to the sewer line at Lexington Ave.
The City of Eagan agrees with the sewer connection based on the Minnesota State Plumbing
Code. Section 4715.0310 states if a public sewer is accessible in a street or alley to a building or
premises and the connection is feasible, liquid wastes from any plumbing system in that building
must be discharged into the public sewer unless othenvise prohibited by this code or a local
ordinance.

RE: 2977 Lexington Avenue South Septic Report
Pursuant to my phone conversation with Mike Lence, Sr. Inspector, on or about December 19,
2005 I am sending a written response to the City's letter of notification that my septic is a"failed
system".
To date I have not been able to review the septic report submitted by Barry Brown. This
inspection was ordered by my ex-husband, who quite obviously gave the inspector enoneous
inforrnarion. At the time of the inspection there was no enhy into the home, and my sons, who
were home, did not observe the use of any type of equipment.
The last real back-up into the basement was in 1998 when my ex and I were still married, I did
have some issues with my unused toilet in the garage last spring due to a small drip that had gone
un-noticed for possibly several months. There was some ciear water leakage, which I believe
was due to the leak in the toilet, early last spring. However, I had leak fixed and the septic tank
pumped this past May and there has been no problem since.
This property, along with three other contiguous properties, is currently zoned transitionat and is
on the market as a commercial lot. My realtor, Dave Sender, has been working with an interested
developer. Please feel free to contact him at 651- 269-3625 (cell).
Because the septic system is currently in working order, and because this property will,
hopefuily, soon become a commercial development, I am respectfully requesting the City
reconsider the requirement to install city sewer at this time. I am certainly willing to cooperate
with the City in resolving this issue, I am just hoping for the opportunity to relieve myself of tlris
property without spending money that I just don't have.

The Ciry has received mformation that the individual sewagc treatmcnt system at 2977 Lexington
Ave. has been classified as a failed system as defined by MN Rules, Chapter 7080.0020, Subp.
16b and City of Eagan Codc Section 4.04.
A failed system occurs when:
There is insufficient veRical separation from the bottom of the drain field to the high water
table or bedrock.
A bottomless or leaking septic tank is present
There is discharge from a cesspool, drywell, or scepage pit.
Failed svstems must be reqaired or replaced within 180 days of this notice. If at any time the
system backs up or discharges above grade, corrective action should be completed within 30
days.
Your attention to this matter is required to protect the hcalth of your family and the community.
Only a properly designed and operating system can treat the effluent to reduce hamifiil bacterial
and other contaminants.
The Compliance Inspector in the report of this individual sewage treatment system has
determined a new septic system would require a variance to the high water mark of the ponds
from the Department of Natural Resources and variance to lot lines from the City of Eagan. He
states the house should be connected to the sewer hne at Lexing[on Ave.
The City of Eagan agrees with the sewer connection based on the Minnesota State Plumbing
Code. Section 4715.0310 states if a public sewer is accessiblc in a street or alley to a building or
premises and the connection is feasible, liquid wastes from any plumbing system in that building
must be dischazged into the public sewer unless otherwise prohibited by this code or a local
ordinance.

On October 9, 1996, the City of Eagan Protective Inspections Division performed an inspection at
the above mentioned address to alterations made under the MAC sound abatement program. This
inspection revealed that the water heater is vented through a side basement wall which does not meet
the design standazds for this equipment. It is spilling flue gasses and there is no combustion air.
THIS LETTER IS TO ADVISE YOU THAT THIS COULD POTENTIALLY LEAD TO A
CARBON NIONOXIDE HAZARD.
