PROCLAMATION OF TOM HEDGES' DAY IN THE CITY OF EAGAN ACTION TO BE CONSIDERED: To proclaim Tuesday, May 15, 2001 as Tom Hedges' Day in the City of Eagan FACTS: • On Friday, May 11, 2001, Eagan City Administrator Tom Hedges was presented with the first Minnesota City/County Management Association's Dr. Robert A. Barrett Manager of the Year Award. • This year, City Administrator Hedges will celebrate his 25`'' anniversary as the first and only City Administrator of the City of Eagan. • In honor of his many achievements, the Mayor and Council are proclaiming Tuesday, May 15, 2001 as Tom Hedges' Day in the City of Eagan. ATTACHMENT: Attached on page 3 is a copy of the proclamation. CITY OF EAGAN PROCLAMATION TOM HEDGES' DAY IN THE CITY OF EAGAN WHEREAS, on May 11, 2001, Eagan City Administrator Tom Hedges was presented with the 2001 Minnesota City/County Management Association Dr. Robert A. Barrett Manager of the Year Award, an award created to identify a Manager, Administrator or Coordinator who has established himself or herself as a role model, leader and mentor in the local government profession; WHEREAS, this was the inaugural presentation of this award and Tom Hedges was selected by his peers as its first recipient; WHEREAS, Tom Hedges will celebrate his 25th anniversary as the first and only City Administrator of the City of Eagan on July 12, 2001; WHEREAS, in those 25 years, Tom Hedges has overseen the growth of the City from approximately 17,000 people to a current population of over 63,500; WHEREAS, Tom Hedges has dedicated his time to community service including membership and service in numerous professional organization such as the Eagan Rotary Club, the Minnesota Valley Exchange Club, the Chamber of Commerce, Volunteers for Minnesota, the Chief Black Dog District Indianhead Council of the Boy Scouts of America, the Southwest Area YMCA, the Eagan Foundation, the Eagan High School Football Boosters and many more; WHEREAS, Tom Hedges has long been recognized as a premier mentor for aspiring City Administrators and Managers, receiving the International City Management Association's L. P. Cookingham Career Development Award and the Minnesota Association of Urban Management Assistants' first Outstanding Manager Mentor Award; WHEREAS, in September of 2000, the employees of the City of Eagan selected him to receive the "Spirit of Eagan Award" which is given to an employee whose actions and accomplishments have embodied the City's values as expressed in the City's Mission Statement and who may be termed the overall "Employee of the Year," because, in part, he "is fair, compassionate, visionary, extraordinarily ethical, and a respected leader who continually exhibits a tremendous amount of patience and composure under adversity. His door is always open for his staff and his ability to maintain a positive outlook is second to none. He is the epitome of "Grace Under Pressure. SIGN CODE AMENDMENT - CITY OF EAGAN ACTION TO BE CONSIDERED: ➢ To Amend Table A of the Sign Code to reflect recently approved off-premise sign erections and removals throughout the City and direct the City Attorney to prepare an amendment suitable for publication. FACTS: ➢ Table A of the Sign Code establishes the allowed number, size and location of off-premise signs (billboards) within the City. The Table was most recently amended in June of 1993 and does not accurately reflect permissible off-premise signage within the City. Further, the Table is vague in making references to allowed locations for such sign type. ➢ Since Table A was last amended, the following approvals have taken place which affect its content: June 1, 1999 - Eller Media - Conditional Use Permit and Variance The approval resulted in the following: 1. FACTS: • In August, 2000, the City received a petition from several property owners requesting a study to investigate the feasibility of the installation of a public storm sewer outlet pipe for the current landlocked private pond in the middle of Clearview Addition located north of Cliff Road and east of Blackhawk Road. • On November 21, 2000, the petition was presented to the City Council, after the initial July 2000 Super Stonn Drainage Study was completed. Council directed staff to prepare a feasibility report considering a storm sewer outlet from the landlocked pond in the Clearview Addition area. • A draft of this Feasibility Report has been prepared and is being presented to the Council for their consideration of scheduling a public hearing for June 19, 2001 to formally present and discuss the merits of this project. • An informational neighborhood meeting will be held with the adjacent property owners prior to a public hearing to review and discuss the proposed improvements. BACKGROUND/HISTORY The Stoney Point subdivision was approved in the 1980's, with R-1 zoning district guidelines applied to this single-family development. Mr. Narlock has lived in his home since it was built in 1989. EXISTING CONDITIONS The subject site is a 10,193 square foot lot surrounded on all sides by similar single-family residences. The existing house and attached garage totals approximately 1,900 square feet. There is a deck and play area located in the back yard. All setback and code requirements are currently met. The proposed 500 square-foot addition would extend the southeast corner of the home one foot and nine inches into the required 10-foot side yard setback from the neighboring property to the south. Ms. Tresa Jackson, owner of the property to the south, has submitted documentation in support of Mr. Narlock's plans for an addition and request for a variance. Lot coverage is currently at 19%. Construction of the addition would increase lot coverage to 24%. EVALUATION OF REQUEST The applicant is proposing to construct a 500 square foot addition onto the existing 1,900 square foot home. The addition would measure approximately 16'x 32', with a 12' x 20' deck to be added at a later date. Height and materials of the addition would match the existing home. Lot coverage is currently at 19%, and would increase to 24% after construction. Construction of an addition onto the existing home would bring the south side yard setback to eight feet and three inches, thus requiring a variance of one feet and nine inches. SUMMARY/CONCLUSION In summary, the applicant is requesting a Variance to construct an addition onto the existing house. MN/DOT required right-of-way in excess of what is typical for this type of roadway and the City Public Works Director has indicated that the right-of-way is not needed for roadway expansion. • In addition to the amount of right-of-way MN/DOT has required in this location, the site's triple street frontage contributes to the difficulty in meeting the required parking setbacks because of the increased setback requirements along much of the perimeter of the property along Blue Gentian and Blue Water Roads, as well as along Hwy.55. • The applicant proposes to satisfy landscape and screening requirements by landscaping within the MN/DOT right-of-way. For purposes of measuring setbacks, public right-of-way means "the entire area dedicated to public use or contained in an easement or other conveyance or grant to the state, county or city BACKGROUND/HISTORY The Spectrum Business Park subdivision received final plat approval from the City Council on March 20, 2001, however, recording of the final plat has not yet been completed. The property included a portion of MN/DOT right-of-way, which was reconveyed to the property owner. EXISTING CONDITIONS The site has been graded and preparation for construction of the first phase of the building on Lot 2 has begun. Access to the site is provided via Blue Gentian and Blue Water Road. EVALUATION OF REQUEST The applicant is building an office/warehouse building on Lot 2. The building will be constructed in three phases and when completed, will be 296,980 square feet in area. The building contains an enclosed upper level parking deck and is designed with a central truck court, screened from adjoining properties and rights-of-way by the building. Surface parking surrounds the perimeter of the building so there is parking located near each of the building entrances. Setbacks and other performance standards appear to be satisfied with the exception of the parking setback from the Hwy. 55 right-of-way. A six-foot setback is proposed versus a required setback of 20 feet. While the setback from the parking lot to the right-of-way is six feet, the distance from the parking lot to the edge of the Hwy. 55 pavement is 88 feet (six feet on the site and 82 feet of right-of-way). The City Public Works Director worked with the developer and MN/DOT on the reconveyance of MN/DOT right-of-way over the past year or so, and indicated that MN/DOT retained right-of- way in excess of what would typically be required for this type of roadway. The right-of-way is not needed for roadway expansion, but rather was retained by MN/DOT to match existing right- of-way lines adjacent to this site, and to encompass the backslopes of the drainage ditch. In addition to the amount of right-of-way retained by MN/DOT, the site's triple street frontage contributes to the difficulty in meeting the required parking setbacks because of the increased setback requirements along much of the perimeter of the property along Blue Gentian and Blue Water Roads, as well as along Hwy.55. The proposed six-foot parking setback adjacent to Hwy. 55 does not provide sufficient space for landscape screening on site. Documentation also should be provided indicating maintenance responsibility for the landscaped area. APPLICANT'S ESTIMATE OF HARDSHIP The applicant has submitted a statement of hardship, which is attached in the exhibits to this report. The applicant states that MN/DOT has retained nearly 82 feet of right-of-way beyond the roadway pavement, encompassing both the drainage ditch and the slope adjacent to it. It is the applicant's position that this distance between the roadway and their proposed parking area provides a sufficient separation between the parking and roadway. The applicant also has indicated that MN/DOT agreed to allow the placement of landscape materials within the MN/DOT right-of-way to provide screening of the parking area. Documentation of MN/DOT's consent to landscaping within their right-of-way should be provided to the City prior to issuance of a building permit. SUMMARY/CONCLUSION Spectrum Development Group is requesting a 14-foot Variance to the minimum 20-foot front yard pavement setback from a public right-of-way for Lot 2, Block 1, Spectrum Business Park. The area of land in this MNDOT Right of Way parcel totals some 85,529 square feet (1.96 acres). The Developer/Owner has negotiated with MNDOT to landscape a large portion of this Right of Way parcel, and to berm the land so that there is a significant landscaped separation between Highway 55 and the project. The City of Eagan's parking setback requirement from a public street under the Business Park Zone is 20 feet. Regarding the Spectrum Commerce Center the following is the case: Edge of bituminous east to Right of Way Line: 81 feet l flinches. FACTS: • In 1995, Eagan, Inver Grove Heights, Dakota County and MnDOT entered into an agreement to cooperatively complete a corridor study to evaluate the benefits and necessity of an extension of Yankee Doodle Road from TH 149 to TH 3. • On September 12, 2000, the Dakota County Board officially received the Corridor Study with its preferred alignment and directed County staff to proceed with detail design and related environmental studies. • On January 16, 2001, the City Council authorized the preparation of a Feasibility Report to identify the proposed scope, cost estimate, financing and schedule for the potential street and utility improvements on this street segment. • On May 16, 2000, the City Council adopted the Public Works Department's 5-Year Capitol Improvement Program (2001-2005) including the extension of Yankee Doodle Road east of Highway 149 into Inver Grove Heights for 2003. • On April 17, 2001, the feasibility report for Project 776R consisting of an urban street construction with off-street trails and utility improvements was presented to the City Council and a Public Hearing was scheduled for May 15 to formally present and discuss the report. • An informational open house was held on May 7 at the Wescott Library for the adjacent property owners and business representatives to discuss the proposed improvements. 3 persons representing 3 properties attended the informational meeting. • All notices have been published in the legal newspaper and sent to all affected property owners informing them of this public hearing. Feasibility Report for Yankee Doodle Road Extension A-EAGAN0103.00 City of Eagan, Minnesota Page i March 30, 2001 Feasibility Report Yankee Doodle Road Extension - Streets and Utilities Prepared for the City of Eagan, Minnesota 1.0 Introduction Yankee Doodle Road (C.R. 28) is an east-west roadway with termini at TH 13 in Eagan and C.R. 56 in Inver Grove Heights. The roadway is not continuous from western to eastern Dakota County due to the omission of the segment between TH 149 and TH 3. For the past six years. Dakota County, in coordination with the Cities of Eagan and Inver Grove Heights, Mn/DOT, and SEH, has evaluated various geometric alternatives to connect Yankee Doodle Road between TH 149 and TH 3. A preferred alternative has been chosen, and the project is proposed to be divided into three stages. The project location is shown in Figure 1. Stage 1 of the project involves the construction of Yankee Doodle Road between TH 149 and TH 55. Stage 2 of the project involves the construction of Yankee Doodle Road from TH 3 to the west, «,ith a connection to TH 55. Stage 3 of the project involves the construction of an interchange at TH 55 and the elimination of the at-grade intersection of C.R. 28 and TH 55. Stage 1 of the project is located in the Cities of Eagan and Inver Grove Heights, and Stages 2 and 3 of the project are located entirely within the City of Inver Grove Heights. Figure 2 shows the proposed roadway alignment and the staging of the project, and Figures 3A-3D show the proposed alignment and geometrics for Stage 1 of the project within the City of Eagan. Currently there is $2.4 million in federal funding available for Stage 1 of the project, and Stage 1 is proposed to be constructed beginning in 2003. No funding has been determined yet for Stages 2 and 3, and there is no estimated construction date for these stages. A-EAGAN0103.00 Page 1 t 2.0 Scope This project provides for the follo,.N ing improvements: ■ Construction of Yankee Doodle Road from TH 149 cast to the Eagan/In er Grove Heights corporate line. Yankee Doodle Road will have a 4-lane typical section with an 18-foot raised median and 8-foot shoulders. It will be an urban section with 13418 curb and gutter. ■ Construction of bituminous trails on both sides of the roadway. There will be a 10-foot trail on both sides of the road with a 15- foot boulevard between the road and the trail. ■ Removal of the existing segment of roadway east of TH 149. Approximately 900 feet of roadway has been constructed east of TH 149 along the proposed Yankee Doodle Road alignment to provide access to existing businesses. Most of this segment will be removed to match the proposed typical section. ■ Construction of water main Nvithin Yankee Doodle Road. Water main will be provided to the adjacent properties by connecting to the existing stub in Yankee Doodle Road east of TH 149 and looping with a stub that was extended from the Bur Oak Hills development to the north. ■ Construction of sanitary sewer within Yankee Doodle Road. Sanitary sewer will be provided to the adjacent properties by connecting to an existing manhole that Nvas extended from the Bur Oak Hills development to the north. ■ Storm sewer construction and pond expansion. Storm seNver will be constructed to provide adequate drainage on Yankee Doodle Road and existing ponds will be expanded as necessary to accept additional flow. 3.0 Feasibility and Recommendation This project is necessary to provide an additional east-west corridor in northern Dakota County. There is currently an eight-mile gap between the two existing east-west county roadways connecting 1-35E and TH 52, and the existing roadways lack traffic carrying capacity and land access. As the Cities of Eagan and Inver Grove Heights continue to develop, the need for cross county access will grow, and the Yankee Doodle Road extension is necessary to meet the future traffic needs. This project will also improve safety on the surrounding roadways. Presently, local trips are often forced onto the higher speed, east-west roadways within northern Dakota County, contributing to acceleration/deceleration and resulting in lower operating speeds along short segments. More specifically, the traffic on the segment of TH 149 north of Yankee Doodle Road will be relieved, alleviating existing accessibility concerns. This project is cost effective in the fact that it will provide a needed east-west corridor between major roadways, accommodate future development along the corridor, increase safety, and Stage 1 will be funded to a significant extent using federal funds. The project is feasible from an engineering standpoint in that the street and utility improvements will extend an existing road alignment, and with the acquisition of additional right-of-way, construct said improvements through undeveloped areas with minimal environmental impacts. It is recommended that the project be constructed as proposed in this report and that all of the work be completed in conjunction with the construction of Yankee Doodle Road within Inver Grove Heights. .4.0 Proposed Improvements 4.1 Roadway Yankee Doodle Road will be constructed to a 10-ton capacity urban section roadway 86 feet in width with 4 travel lanes. Figure 4 shows this typical section. Dakota County recommends full access intersections every '/a mile and right-in/right-out access every 1/8 mile. Accesses are proposed to be provided as shown in Figures 3A-3D for frontage roads or driveways to businesses. Exclusive right and left turn lanes will be constructed at the full access intersections and right turn lanes will be provided at the limited access intersections. Figure 5 shows the typical turn lane section. Most of the existing 900-foot extension of Yankee Doodle Road east of TH 149 will be removed. The existing section currently does not have curb and gutter or paved shoulders, and the median currently ends approximately 300 feet east of TH 149. 4.2 Bituminous Trail A 10-foot bituminous trail will be constructed along both sides of the roadway for the entire project length. Trails serve both transportation and recreational functions providing continuous routes for commuting or recreational trips. 4.3 Street Lights Street lighting has not been included within this report. Dakota Electric will be responsible for any future desired street light installation. Feasibility Report for Yankee Doodle Road Extension A-EAGAN0103.00 City of Eagan, Minnesota Page 3 t 4.4 Traffic Signal There is an existing signal at the intersection of TH 149 and Yankee Doodle Road. The existing stub east of TH 149 has two through lanes in each direction with a left turn lane and a raised 6-foot concrete median. With the exception of a proposed right turn lane, this section matches the proposed improvements, so no physical revisions to the signal are anticipated. With the increased volume of traffic on Yankee Doodle Road east of TH 149, the signal timing will be reviewed and modified as needed. 4.5 Sanitary Sewer There is an existing 8-inch sanitary sewer main that extends along the proposed Yankee Doodle Road alignment approximately 900 feet. That line will continue to serve the properties that it now serves. New sanitary sewer will be installed under Yankee Doodle Road to serve the remaining unserved adjacent properties in Eagan and provide the opportunity to serve the adjacent properties in Inver Grove Heights within the Joint Powers Agreement (1997) limits. This sanitary sewer will connect to an existing manhole located on the south property line of the Bur Oak Hills development to the north. Eight-inch service stubs will be extended to the right of way line to serve the properties. Figures 6A-6D show the proposed and existing sanitary sewer in the project area. 4.6 Water Main An existing 12-inch water main extends along the proposed Yankee Doodle Road alignment approximately 900 feet. The proposed water main will connect to that stub and will be extended in Yankee Doodle Road to serve the remaining unserved adjacent properties within the City of Eagan and provide the opportunity to serve the adjacent properties in Inver Grove Heights within the Joint Powers Agreement limits. This line will be looped with the existing 8-inch trunk line stub extending south along a lot line of the Bur Oak Hills development to the north. Six-inch service stubs will be extended to the right of way line to serve the properties. Figures 7A-7D show the proposed and existing water main in the project area. 4.7 Storm Water Since the proposed road section is an urban section, storm sewer will be required to accommodate drainage. Storm water flow between TH 149 and approximately 600 feet east of the Eagan City line will be carried to Pond GP-5, located south of Yankee Doodle Road. There is adequate storage capacity in this pond to accommodate the additional flow. Storm water flow from the portion of Yankee Doodle Road continuing to the east will be managed within the City of Inver Grove Heights. Figures 8A-8E show, the proposed storm sewer and ponding location. A preliminary drainage report has also been prepared for the entire corridor to evaluate the roadway drainage. 4.8 Joint Powers Alternate For the base improvements of this project, sanitary sewer and water main are not proposed to extend into Inver Grove Heights. However, as part of the Joint Powers Agreement between the City of Eagan and the City of Inver Grove Heights, Eagan has agreed to serve the area west of Argenta Trail (County Road 63) with its sanitary sewer and water main systems. Inver Grove Heights must assess its future needs for sanitary sewer and water main, and will determine if sanitary sewer and water main are needed within Yankee Doodle Road as part of this project, or if future development can be served from the existing Eagan systems. Therefore, a Joint Powers Alternate has been included that shows the extension of sanitary sewer and water main (Figures 9A-9C) into Inver Grove Heights. 5.0 Easements and Permits 5.1 Right of Way The right of way required to construct Yankee Doodle Road as proposed will need to be acquired from the adjacent property owners. See Figure 10 for impacted parcels. Temporary easements will therefore be required for construction outside of the right of way. Temporary easements will also be required for any work done for pond expansion or grading. A permit will be required by the Department of Health for the water main work. Permits from the MCES and the MPCA will be required for the sanitary sewer work. The Natural Resource Conservation Service and State Historic Preservation Office must also approve the project. Because federal funds will be used, Mn/DOT must also approve the plans. 6.0 Cost Estimate Detailed cost estimates are located in Appendix A. The estimates are based on anticipated 2003 construction costs and include 10 percent contingency plus indirect costs of 30 percent, which include legal, administrative, engineering and bond interest. The extension of sanitary sewer and water main into Inver Grove Heights is shown as an alternate, entitled Joint Powers Alternate. The following ratios indicate cost responsibilities. A preliminary assessment roll is included in Appendix B. It is recommended that appraisals be done on the parcels proposed to be assessed in order to attain an opinion of maximum benefit. The estimated cost for street, trail, and storm sewer construction is $1,780,000. The cost per front foot is calculated as $1,780,000/5,271 feet = $337.70/front foot. Per City of Eagan policy, the Commercial/Industrial parcels are to be assessed for 100Io of a 52-foot wide roadway. The typical section proposed for Yankee Doodle Road is 86-feet wide. The cost per front foot is calculated as 100% x 52 feet / 86 feet x $337.70 = $204.19/front foot. The 2001 Fee Schedule for street improvements for Commercial/Industrial parcels is $137.60 per front foot. It is proposed that the assessments will be limited to the current Fee Schedule rate at the time of construction. Also per City of Eagan policy, the water main for non-residential properties shall be assessed for 100% of the associated utility cost. There is an additional charge for the trunk water main system. The estimated cost for water main construction is $100,300 The total estimated length of water main is 1,865 feet (this includes the length of the line that extends off the road to complete the loop). The cost per centerline foot for water main installation is $100,300 / 1,865 feet = $53.78/centerline foot. The 2001 Fee Schedule for improvements for non-residential parcels is $2,010 per acre for water main oversize (trunk charges apply for 12-inch water main), and $58.10/centerline foot ($29.05/foot for each side of the road). Since the estimated cost per centerline foot is less than the Fee Schedule, it is proposed that the project calculated amount will be assessed to the properties. Lateral sanitary sewer assessments shall be applied to properties not connected to public sanitary sewer at the time of the project construction. Properties shall be assessed 100% of the associated utility costs. The estimated cost for sanitary sewer construction is $122,400. The total estimated length of sanitary sewer is 1,725 feet. The cost per centerline foot for sanitary sewer installation is $122,400 / 1,725 feet = $70.96 / centerline foot. The 2001 Fee Schedule for sanitary sewer lateral improvements is $45.70 / centerline foot ($22.85/foot for each side of the road). It is proposed that the Feasibility Report for Yankee Doodle Road Extension A-EAGAN0103.00 City of Eagan, Minnesota io Page 8 assessments will be limited to the current Fee Schedule rate at the time of construction. 10.0 Assessment Financing Options The property owners will have the option at the time of the assessment hearing to pay the full assessment or include the assessment in with their property tax statement. FACTS: • On January 31, the City received a petition form Mr. Greg Miller, of Interstate Partners LLC, requesting the City to vacate the existing public rights of way for Lawrence Ave. and Linde Lane as dedicated within the Kollofski's Plat. This area is located west of Hwy 149 and north of Hwy 55 near the Blue Water Rd. intersection. This petition was presented to the Council on April 3 with a public hearing scheduled for May 15 to consider the merits of this request. • The applicant wants to replat all the lots in the Kollofski's Plat, including the public rights of way for Lawrence Ave. and Linde Lane, for redevelopment as part. of the overall Grand Oaks Office Park. The developer's application for preliminary subdivision (Grand Oak 3rd Add.) is scheduled for Council's consideration under New Business on this agenda. A condition of that approval is the vacation of these rights of way. • All notices were published in the legal newspaper and sent to all potentially affected utility companies. As of this date, the staff has not received any objections to this request. ISSUES: • Until the final subdivision of the Grand Oaks 3rd Addn. is approved and recorded, the existing lots in the Kollofski's Plat will still exist and be landlocked without these public rights of way. Therefore, the approval should be contingent upon the final approval and recording of the new plat eliminating these lots of record. FACTS: • On May 16, 2000, the City Council adopted the Public Works Department's 5-Year Capitol Improvement Program (2001-2005) including the construction of a storm sewer outlet for Pond HDP-1 in 2001. This schedule anticipated the development of the proposed Kennerick Addition. • On September 15, city staff received a petition signed by Brad Swenson, developer of the Kennerick Addition, and Eileen Kennedy, 1415 Lone Oak Road, requesting the installation of a storm sewer outlet for Pond HDP-1 on the north side of Lone Oak Road (County Road 26), west of Pilot Knob Road (County Road 31). • On October 3, the City Council authorized the preparation of a feasibility report identifying the scope, cost, financing and schedule of the construction of a storm sewer outlet for Pond HDP-1 to serve the proposed Kennerick Addition and additional adjacent properties. • On April 3, 2001, the feasibility report for Project 806 was presented to the City Council and a Public Hearing was scheduled for May 1 to formally present and discuss the report. • At the Public Hearing on May 1, the City Council continued the hearing until May 15 and directed staff to analyze alternatives to the stonn sewer and ponding improvements proposed in the feasibility report presented at the hearing. ATTACHMENTS: • Alternates Report, pages through ALTERNATES KENNERICK ADDITION STORM SEWER IMPROVEMENTS CITY PROJECT NO. 806 Mav 10, 2001 Introduction: The public hearing for the Kennerick Addition Storm Sewer Improvements was held May 1. 2001. The residents in the watershed and those who abut Pond HDP-1 (the pond receivin, storm water from the watershed and the proposed Kennerick Addition) requested additional alternatives be investigated in addition to the improvements presented in the Preliminary Report dated April 2001. The two alternates that have been suggested are discussed below: Alternate I -Pond HP-I I Expansion Pond HP-I l located south of Skyline Road would be expanded not only to accept storm water runoff from the drainage area that is directly tributary to it but also Kennerick Addition and the easterly portion of Treffle Acres. which is tributary to Pond HDP-1. Although this alternative is feasible, it's recommended this alternate not be considered based on the following: • The expansion of Pond HP-1 1 to accommodate stormwater runoff from another watershed is not preferred from an engineering and hydrologic standpoint. • The cost increase to oversize Pond HP- I 1 and the storm sewer pipe from Kennerick Addition is not justified. • The pond oversize to accommodate additional storm water runoff would exceed the existing easement. There;ore, additional easement would be required. • The most efficient time to expand and develop Pond HP-1 1 is when the abutting land and its direct drainage area further develops. Alternate 2 - Kennerick Addition Storm Water Pond Kennerick Addition would provide for and develop its own ponding on the westerly end of the plat. The ponding would not only provide for water quality. but also storage for a I9r rainfall event ( 100-year). The pond requirements are noted below: Water Quality Storage 0.51 Acre-feet 117c Rainfall StoraLye 0.75 Acre feet A6 Summary The Alternate 2 project for Kennerick Addition to provide its own ponding is economically more desirable than the original project based on Dakota County recently including this section of Lone Oak Road in its proposed 5-Year CIP. Dakota County will likely participate financially in a portion of the storm water improvements proposed with the original project for and adjacent to Pond HDP-1. The project costs and revenue sources to cover the original project are noted below and are compared to Alternate 2 (Kennerick Addition Storm Water Pond). WCA requires the following: • Wetland filling requires 2 to 1 replacement • Additional ponding beyond the existing wetland accounts towards 1009 wetland replacement • Plantings/wetland restoration accounts towards 50% wetland replacement The original project satisfied the WCA requirements for Pond HDP-1. The project would also be reviewed with the Army Corps of Engineers and Department of Natural Resources to assure their jurisdictional requirements are being met. /O C2 In addition, the storm sewer pipe outlet for Pond HDP-1 and the ponding in Kennerick Addition would be constructed north to Skyline Road as previously proposed. The proposed storm sewer pipe alignment to Skyline Road (as requested by the property owner) and Kennerick Addition Pond are shown on Figure 1. Due to the fact Kennerick Addition is providing its own ponding. wetland restoration and re-grading (cleaning) for Pond HDP-1 is not included in the alternate. As a result, pond easements for Pond HDP-1 are not proposed to be acquired at this time. Dakota County has recently proposed to include the section of Lone Oak abutting Pond HDP-1 in its 5-Year Capital Improvement Program (CIP). Therefore, it's recommended any improvements to Pond HDP-1, including the eroded area between Lone Oak Road/Pond HDP-1 be constructed in conjunction with future improvements to Lone Oak Road. Future improvements for Pond HDP-1 to be considered with Lone Oak Road are shown on Figure 2. Also noted on Figure 2, Eagan Public Works proposes to slip line and provide watertight manhole covers to the sanitary sewer system abutting Pond HDP-1 to prevent infiltration/inflow from Pond HDP-1 into the sanitary sewer. The estimated project cost for the Kennerick Addition Stormwater Pond is detailed in Appendix A (attached to this Alternate Report) and noted below. Trunk Storm Sewer Pipe $149,000 The total estimated project cost, including 109c contingency, 309c indirect costs, and easement is S149,000. Its assumed the storm water pond for Kennerick Addition and the sanitary sewer/water main relocation will be done as part of Kennerick Addition. The storm sewer pipe outlet for Pond HDP-1 will be provided with this alternate. Therefore, the proposed assessments and assessment area for the original project will remain the same. VARIANCE (OFF-STREET PARKING SUPPLY) CHEROKEE SIRLOIN ROOM ACTION TO BE CONSIDERED: ➢ To approve a 48 stall Variance from the off-street parking supply requirement for a restaurant located at 4625 Nicols Road in the NW '/4 of Section 31. FACTS: ➢ This request was continued from the April 3, 2001 City Council meeting to allow the restaurant's owner to pursue a solution to the restaurant's off-street parking deficiency (i.e. a new cross parking agreement or agreements with properties to the north and/or south). ➢ The existing cross parking agreement allows the use of the office building parking lot (approximately 80 stalls) located south of the restaurant. The agreement does however terminate on October 31, 2001 and is therefore not considered a long term solution to the on site parking shortage. For this reason, the applicant was given additional time to address the parking deficiency. ➢ According to the City Code, a restaurant must provide at least one parking space for each three seats based on capacity design. ➢ In the spring of last year, the Cherokee Sirloin Room constructed a two-story seasonal patio without obtaining a building permit as required. Prior to deck construction, the restaurant failed to satisfy the off-street parking requirements of the code for the number of seats provided (for 384 seats, 128 stalls are required and only 105 stalls are provided). This condition is considered a legal nonconformity and has a right to continue indefinitely under the terms of the restaurant's original approval. ➢ The seasonal patio adds 73 seats to the restaurant's seating capacity increasing the number of required off-street parking stalls from 128 to 153. ➢ While a building permit application has been received, issuance is being withheld (by the Inspections Division) pending positive action on the requested variance. If the variance is not approved, the permit will not be issued and staff will request that the seasonal patio be removed. FACTS: • In January 2001 the City Council adopted their strategic plan which included Objective 9.2: "Establish a repeat call charge program': • The stated purpose of the repeat call charge program is to "Establish fees for addresses that create undue drain on police resources by habitual or chronic neighborhood disturbances". • The proposed ordinance allows the City to impose a service call fee upon the owner or occupant of the property if the City has rendered services or responded to the property on three (3) or more occasions with in a period of 365 days in response to same or similar nuisance activity. • Before imposing a fee, the Police Department would verify that the complained of behavior or activity did occur and provide a written notice to the owner or occupant that the conduct did occur and that future service calls for the same nuisance may subject the owner or occupant to a service fee. • The fee will be established by City Council resolution. The City Council of the City of Eagan does ordain: Section 1. Eagan City Code Chapter 10 is hereby amended by adding Section 10.44 to read as follows: Sec. 10.44. Repeat Nuisance Call Service Fee Subd. 1. Purpose. The purpose of this section is to protect the public safety, health and welfare and to prevent and abate repeat service response calls by the City to the same property or location for nuisance service calls, as defined herein, which prevent police or public safety services to other residents of the City. It is the intent of the City by the adoption of this Section to impose and collect service call fees from the owner or occupant, or both, of property to which City officials must repeatedly respond for any repeat nuisance event or activity that generates extraordinary costs to the City. The repeat nuisance service call fee is intended to cover that cost over and above the cost of providing normal law or code enforcement services and police protection City wide. Subd. 2. Scope and Application. This Section shall apply to all owners and occupants of private property which is the subject or location of the repeat nuisance service call by the City. This Section shall apply to any repeat nuisance service calls as set forth herein made by an Eagan peace officer, part time peace officer, community service officer, animal control officers and code enforcement technicians. Subd. 3. Definition of nuisance call or similar conduct. A. The term nuisance service call shall mean any activity, conduct, or condition occurring upon private property within the City which: (i) unreasonably annoys, injures or endangers the safety, health, morals, comfort or repose of any member of the public; (ii) or will, or will tend to, alarm, anger or disturb others or provoke breach of the peace, to which the City is required to respond, including, but not limited to the following: 1. Any activity, conduct, or condition deemed as a public nuisance under any provision of the City Code; 2. Any activity, conduct, or condition in violation of any provision of Chapter 10 of the City Code; 3. Any conduct, activity or condition constituting a violation of Minnesota state laws prohibiting or regulating prostitution, gambling, controlled substances, use of firearms; and 4. Any conduct, activity, or condition constituting disorderly conduct under Chapter 609 of Minnesota Statutes. Subd. 4. Repeat nuisance service call fee. The City may impose a repeat nuisance service call fee upon the owner or occupant of private property if the City has rendered services or responded to the property on three (3) or more occasions within a period of 365 days in response to or for the abatement of nuisance conduct, activity, or condition of the same or similar kind. The repeat nuisance service call fee under this Section shall be an amount as set forth and duly adopted by City Council resolution. All repeat nuisance service call fees imposed and charged against the owner or occupant under this Section shall be deemed delinquent 30 days after the City's mailing a billing statement therefore. Delinquent payments are subject to a ten percent (10%) late penalty of the amount due. Subd. S. Notice. No repeat nuisance service call fee may be imposed against an owner or occupant of property without first providing the owner or occupant with written notice of the prior nuisance service calls prior to the latest nuisance service call rendered by the City upon which the fee is imposed. The written notice shall: (1) State the nuisance conduct, activity or condition that is or has occurred or is maintained or permitted on the property, the dates of the nuisance conduct, activity or condition; (2) State that the owner or occupant may be subject to a repeat nuisance call service fee if a third nuisance service call is rendered to the property for the same nuisance, in addition to the City's right to seek other legal remedies or actions for abatement of the nuisance or compliance with the law, and (3) Be served personally or by U.S. Mail upon the owner or occupant at the last known address. Subd. 6 Right to appeal repeat nuisance service call fee. Upon the imposition of a repeat nuisance service call fee, the City shall inform the owner or occupant of his/her right to a hearing on the alleged repeat nuisance service calls. The owner or occupant upon whom the fee is imposed may request a hearing by serving upon the City Clerk within five (5) business days of the mailing of the fee invoice, inclusive of the day the invoice is mailed, a written request for hearing. The hearing shall be heard by the hearing office within fourteen (14) days of the date of the owner's or occupant's request for hearing. lls The hearing shall be conducted in an informal manner and the Minnesota Rules of Civil Procedure and Rules of Evidence shall not be strictly applied. The hearing need not be transcribed, but may be transcribed at the sole expense of the party who requests the transcription. After considering all evidence submitted, the hearing officer shall make written findings of fact and conclusions on the issue of whether the City responded to or rendered services for repeat nuisance service calls of the same or similar kind on three (3) or more occasions within a 365 day period. The findings and conclusions shall be served upon the owner or occupant by U.S. Mail within five (5) days of the notice of hearing. An owner or occupant's right to a hearing shall be deemed waived if the owner or occupant fails to serve a written request for hearing as required herein or fails to appear at the scheduled hearing date. Upon waiver of the right to hearing, or upon the hearing officer's written findings of fact and conclusions that the repeat nuisance call service fee is wan anted hereunder, the owner or occupant shall immediately pay the fee imposed. Subd. 7 Legal Remedies Nonexclusive. Nothing in this Section shall be construed to limit the City's other available legal remedies for any violation of the law which may constitute a nuisance service call hereunder, including criminal, civil, injunctive or others. Section 2. Eagan City Code Chapter 1 entitled "General Provisions and Definitions Applicable to the Entire City Code Including Penalty for Violation"' and Section 10.99, entitled "Violation a Misdemeanor" are hereby adopted in their entirety by reference as though repeated verbatim. Greg Miller, President of Interstate Partners, stated opposition to condition number 6 regarding the right-of-way. He discussed the hardship and difficulty of semi-truck mobility into Lot A. There being no public comment, Chair Heyl closed the public hearing and turned discussion back to the Commission. Member Segal questioned the problems with the driveway access. Assistant City Engineer Gorder discussed the problems with the driveway access including improper use as an egress. Member Segal asked if condition 13 is a code requirement. The proposed subdivision overlays 22.0 acres of land located north of TH 55 and east of Blue Water Road in the northeast 1/4 of Section 2. In conjunction with the requested preliminary subdivision, the applicant has also requested a Rezoning of a portion of the property (approximately 3.8 acres) from an R-1, Residential Single Family zoning designation to a BP, Business Park designation. AUTHORITY FOR REVIEW Rezoning: City Code Chapter 11, Section 11.40, Subdivision 5 states, in part that the Council shall not rezone any land or area in any zoning district or make any other proposed amendment to this chapter without first having referred it to the planning commission for it's consideration and recommendation. A~6 Planning Report - Grand Oak Three April 24, 2001 Page 2 Subdivision: City Code Section 13.20 Subd. 6 states that "In the case of platting, the Planning Commission and the Council shall be guided by criteria, including the following, in approving, denying or establishing conditions related thereto: A. That the proposed subdivision does comply with applicable City Code provisions and the Comprehensive Guide Plan. B. That the design or improvement of the proposed subdivision complies with applicable plans of Dakota County, State of Minnesota, or the Metropolitan Council. C. That the physical characteristics of the site including, but not limited to, topography, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, water storage and retention are such that the site is suitable for the type of development or use contemplated. D. That the site physically is suitable for the proposed density of development. E. That the design of the subdivision or the proposed improvement is not likely to cause environmental damage. F. That the design of the subdivision or the type of improvements is not likely to cause health problems. G. That the design of the subdivision or the improvements will not conflict with easements of record or with easements established by judgment of court. H. That completion of the proposed development of the subdivision can be completed in a timely manner so as not to cause an economic burden upon the City for maintenance, repayment of bonds, or similar burden. 1. That the subdivision has been properly planned for possible solar energy system use within the subdivision or as it relates to adjacent property. (Refer to City Handbook on Solar Access). J. That the design of public improvements for the subdivision is compatible and consistent with the platting or approved preliminary plat on adjacent lands. K. That the subdivision is in compliance with those standards set forth in that certain document entitled "City of Eagan Water Quality Management Plan for the Gun Club Lake Watershed Management Organization" which document is properly approved and filed with the office of the City Clerk hereinafter referred to as the "Water Quality Management Plan". Said document and all of the notations, references and other Planning Report - Grand Oak Three April 24, 2001 Page 3 information contained therein shall have the same force and effect as if fully set down herein and is hereby made a part of this Chapter by reference and incorporated herein as fully as if set forth herein at length. It shall be the responsibility of the City Clerk to maintain the Water Quality Management Plan and make the same available to the public." BACKGROUND/HISTORY A portion of the subject property is included in the Highway 55 Tax Increment Financing (TIF) Redevelopment District that was created by the City in 1996 with the primary purpose of removing blighted and inconsistent land uses. To aid in this effort, the City used TIF eligible expenses to acquire several homes in the Kollofski Plat and to pay for the demolition of the Airliner and Spruce Motels. In the summer of last year, the City rezoned its acquired five R-1 (Residential Single Family) zoned parcels in the district to BP, Business Park (Lots 1-3, Block 1 and Lots 3 and 4 Block 2, Kolofski's Plat). The 22.0 acre property in question currently overlays 17 tax parcels of land (including eight remaining R-1 zoned parcels) and soon to be vacated Lawrence Avenue and Linde Lane (public hearing scheduled for May 1, 2001). It is the applicant's intent to consolidate the various parcels of land and former rights-of way into two lots that would accommodate future Business Park uses. EXISTING CONDITIONS The subject property is presently vacant. Mature vegetation is concentrated in the central area of the property proximate to single family homes that occupied the area. The site slopes to the northeast (toward the ponding area) with the most significant slopes existing along the site's western boundary. The property is currently vacant. SURROUNDING USES The following existing uses, zoning, and comprehensive guide plan designations surround the subject property: North - Office/showroom/warehouse; zoned BP, Business Park; guided SA, Special Area /C 1 2. i Planning Report - Grand Oak Three April 24, 2001 Page 4 South - TH 55 and industrial; zoned I-1, Limited Industrial; guided I-1, Limited Industrial East - Industrial; zoned I-1, Limited Industrial; guided SA, Special Area West - Undeveloped; zoned I-1, Limited Industrial; guided SA, Special Area EVALUATION OF REQUEST Rezoning The requested rezoning from R-1, Single Family Residential to BP, Business Park is consistent with the City's redevelopment objectives for the area (by eliminating incompatible R-1 zoning designations) and is consistent with the long-term development objectives Comprehensive Guide Plan. Preliminary Subdivision Compatibility with Surrounding Area - The proposed use appears compatible with existing and anticipated surrounding land uses. The subject site is bounded on all sides by Business Park or Limited Industrial uses. The proposed addition of Business Park type uses is not anticipated to adversely affect surrounding land uses. Lots - Within BP zoning districts, a minimum lot area requirement of 1.5 acres is required. Proposed Lot 1 measures 12.4 acres in size while Lot 2 measures 9.6 acres. Thus, both proposed lots satisfy minimum area requirements of the City Code. Setbacks - All lots show an ability to meet minimum BP district setback requirements including the minimum 50 foot setback from Highway 55. Building Plans - As shown on the submitted site plan, a 100,000 square foot office building has been proposed upon Lot 1 and a 40,000 square foot office/showroom building has been proposed upon Lot 2. While specific building heights have not been identified, single story structures have been proposed. Specific building elevations specifying height, exterior finish materials etc. will be required as part of the building permit application. Green Area - With 41.9 percent of Lot 1 and 64.8 percent of Lot 2 devoted to green space, the minimum 25 percent requirement imposed in industrial zoning districts has been satisfied. Off-street Parking - A total of 533 off street parking stalls are required for the 100,000 square foot office building (Lot 1) and 214 stalls are required of the 40,000 square foot office showroom building. Off street parking requirements have been satisfied via a combination of on-site and "proof of parking" stalls. Of the 533 required stalls for the office building, 115 stalls have been /a9 Planning Report - Grand Oak Three April 24, 2001 Page 5 designated as "proof of parking". Of the 214 stalls required of the office building, 54 have been designated as "proof'. In accordance with State requirements, ample handicap parking has been provided. All off-street parking stalls have been found to comply with minimum dimensional requirements of the City. Landscaping - The landscape plan appears to provide adequate screening of loading and off- street parking areas. Specifically, off-street parking areas are to be screened via a combination of deciduous shade trees, deciduous ornamental trees, evergreens and shrubs. A significant amount of vegetation (a mixture of shade trees and shrubs) is also to be provided along the perimeter of the proposed building. Outside Storage - Outside storage of materials, other than trash/recycling containers, is not allowed in BP zoning districts. Gradin - The preliminary grading plan is acceptable. The site generally slopes from west to east and is open. The proposed building on Lot 2 is approximate 4 - 5 feet above the grade of adjacent Blue Water Road and 0- 6 feet below the grade of Highway 55 to the west. Storm Drainage - The preliminary storm drainage plan is acceptable with modifications. This development will construct a new storm water pond on Lot 2 and utilize an existing pond on Lot 1 to accommodate storm water runoff from the development. Both ponds drain east to Pond FP- 1 (as designated in the City Storm Water Management Plan - 1990). An outlet skimmer in accordance with City engineering standards should be constructed on the outlet pipe from the new pond. Utilities - The preliminary utility plan is acceptable. Sanitary sewer is available for connection within Blue Water Road. Streets/Access/Circulation - Public street access is available from Blue Water Road, near its intersection with Highway 55, to the west of the site. The preliminary site plan shows a right-in only access approximately 220 feet from the intersection of Blue Water and Highway 55. To provide adequate site and vehicle stacking distance, all driveway accesses should be a minimum of 300 feet from the intersection. With the adjacent WisPark (Grand Oak I) development, the City Council approved an Alternative Urban Area wide Review (AUAR) environmental study (City Project No. 736) in October, 1998. This study evaluated the various transportation related impacts and the associated improvements necessary during a twenty-year period due to the development of properties bordered by I-494, Highway 55 and Highway 149. The AUAR identifies estimated costs for the needed mitigative improvements based on the potential land uses in the area. With the Grand Oak development, the City Council approved a condition obligating WisPark to /~3 0 Planning Report - Grand Oak Three April 24, 2001 Page 6 contribute financially to fund these future improvements, based on the projected increase of traffic generated from that development. The proposed development as office/warehouse is generally consistent with the potential uses and potential traffic generation identified in the AUAR. This development should accept the City's determination of responsibility and costs of $3,478.00 (2001 rate) per net developable acre for AUAR Mitigative Traffic Improvements as identified in the Final AUAR document approved by the City Council on October 20, 1998. The financial obligation should be placed in an escrow account with the City to be used solely for financing the AUAR improvements and any unused amount will be returned to the payers upon full development of the AUAR properties. Easements/Permits/Right-of-Way - The developer should obtain all necessary permits from MnDOT for any work within Highway 55 right-of-way. The developer is negotiating with the Minnesota Department of Transportation (MnDOT) for the acquisition of a portion of the existing Highway 55 right-of-way to be used with the development, as shown on the preliminary plat. MnDOT has preliminarily indicated its willingness to convey the property to the developer. As a condition of Final Subdivision approval, the right-of-way in question should be formally vacated and acquired by the applicant. This development incorporates the soon to be vacated right-of-way property of abandoned Lawrence Avenue and Linde Lane. The applicant should dedicate ingress/egress easement to allow access for the proposed shared access between Lots 1 and 2. This easement should be prepared for review and approval by the City Attorney prior to building permit approval. Tree Preservation - The tree inventory indicates that there are sixty-eight (68) significant trees on site. Staff has revised the applicant's tree inventory (non-significant trees were removed from the inventory). This site appears to have such a variety of trees because of its previous use, commercial hotel and residential. Many of the existing trees were probably installed as landscape trees. The development as proposed will result in the removal of fifty-three (53) significant trees (77.9% of the total). According to the City of Eagan Tree Preservation Ordinance, allowable tree removal for this type of development proposal (single-phase, multiple-lot, commercial) is set at 47.5% of the total significant trees. With a proposed removal more than the allowable amount, there will be required tree mitigation for this proposal. Required tree mitigation calculates to thirty-five Category A trees or 70 Category B trees or 140 Category C trees, or an equivalent combination of the three categories. Planning Report - Grand Oak Three April 24, 2001 Page 7 The applicant has submitted a tree mitigation plan that has adequate numbers of replacement trees to fulfill their tree preservation/mitigation requirements, (which will be installed in addition to their landscape requirements). Water Quality - The proposed subdivision is located in the City's F-watershed, which is in the northeast corner of the City. Stormwater runoff from the development eventually would enter City Pond FP-1-a Class V (Nutrient Trap) waterbody-, which is also DNR public water wetland #19-120W. The required volume and area of water quality treatment ponds are based on the impervious proportion of proposed developments (i.e., land covered by buildings, parking lots, driveways, and walks). To meet City water quality requirements, the developer proposes to direct runoff from the site through treatment ponds adjacent to FP-1. Runoff from 10.1 acres of the site containing proposed Building 7 would be directed to an existing treatment pond that was constructed as part of Grand Oak Two. Including an additional offsite drainage area of 2.9 acres, 13 acres of development, with a combined impervious cover of 69 percent, would contribute stormwater to the existing treatment pond. A minimum wet-pond volume of 2.0 acre-feet would be needed in the existing treatment pond; the pond actually contains 2.9 acre-feet of wet-pond volume. Runoff from the 4.5 remaining acres of the site containing proposed Building 8 would be directed to a constructed stormwater treatment pond. The impervious coverage of this part of the site is 62 percent, requiring a stormwater pond with a minimum wet-pond volume of 0.62 acre- feet covering a minimum surface area of 0.27 acres. The pond would need a minimum depth of six feet and a 10:1 aquatic bench beginning at the normal water level. The outlet structure of the pond would need to be consistent with City of Eagan standards. Wetlands - The nearby natural wetland (FP-1) was last delineated in July 1997. Wetland conservation procedures consider wetland delineation reports to be valid for about 5 years. Therefore, no new wetland delineation report is needed. No draining, filling, or excavating of the wetland is proposed. To minimize the potential of nearby impacts, and to the extent practicable given existing infrastructure, the development would need to be set back at least 30 feet from the edge of the delineated boundary of the wetland. During and after development, a minimum 30-foot wide buffer of natural undisturbed vegetation along the wetland would need to be maintained. Erosion - Erosion control practices should be properly installed and effectively maintained throughout the development process to prevent and minimize soil loss and negative impacts to down-gradient resources and water quality. Parks and Trails - This development will be subject to a cash parks and cash trails dedication at the time of building permit. /JWZ Planning Report - Grand Oak Three April 24, 2001 Page 8 Airport Noise Considerations - The City of Eagan considered airport noise as a factor in its Comprehensive Land Use Guide Plan. The Metropolitan Council has adopted an Aviation Chapter of its Metropolitan Development Plan that anticipates the impacts from the continued operation of the airport at its current location. The noise policy contours in Eagan place the subject property within Noise Zone 3. Within this area, industrial uses are considered consistent. SUMMARY/CONCLUSION The proposed land use (rezoning) and two lot subdivision is consistent with the land use directives of the comprehensive plan and is considered compatible with existing and anticipated uses in the area. ACTION TO BE CONSIDERED A. To recommend approval of a Rezoning of approximately 3.8 acres from R-1, Single Family Residential to BP, Business Park located north of TH 55 and east of Blue Water Road in the northeast 1/4 of Section 2. B. To recommend approval of a Preliminary Subdivision (Grand Oak Three) on property located north of TH 55 and east of Blue Water Road in the northeast 1/4 of Section 2. If approved, the following conditions should apply: 1. The developer shall comply with these standards conditions of plat approval as adopted by Council on February 3, 1993: Al, B1, 2, 3, 4, Cl, 2, 4, D1, E1 2. The property shall be platted. 3. Lawrence Avenue and Linde Lane shall be formally vacated. 4. The portion of the existing Highway 55 right-of-way which overlays Lot 2 development shall be formally vacated and acquired by the applicant. 5. An outlet skimmer in accordance with City engineering standards shall be constructed on the outlet pipe from the pond. 6. All driveway accesses shall be a minimum of 300 feet from the intersection of Blue Water Road and Highway 55. Planning Report - Grand Oak Three April 24, 2001 Page 9 7. This development shall accept the City's determination of responsibility and costs of $3,478.00 per net developable acre for AUAR Mitigative Traffic Improvements as identified in the Final AUAR document approved by the City Council on October 20, 1998. The financial obligation shall be placed in an escrow account with the City to be used solely for financing the AUAR improvements and any unused amount will be returned to the payers upon full development of the AUAR properties. 8. This development shall be subject to a cash parks dedication at the time of building permit. 9. This development shall be subject to a cash trail dedication at the time of building permit. 10. The applicant shall dedicate ingress/egress easement to allow access for the proposed shared access between Lots 1 and 2. This easement should be prepared for review and approval by the City Attorney prior to building permit approval. 11. This development shall meet the City's water quality requirements entirely through on- site ponding. 12. A stormwater pond shall be constructed with a minimum wet-pond volume of 0.62 acre- feet and a minimum area of 0.27 acres. The stormwater treatment pond shall be constructed according to NURP standards with a minimum depth of 6 feet, a 10:1 aquatic bench, and an outlet skimmer according to City design standards. 13. To minimize the potential of nearby impacts, and to the extent practicable given existing infrastructure, the development shall to be set back at least 30 feet from the edge of the delineated boundary of the wetland. During and after development, a minimum 30-foot wide buffer of natural undisturbed vegetation along the wetland shall be maintained. 14. Erosion control practices shall be properly installed and effectively maintained throughout the development process to prevent and minimize soil loss and negative impacts to down-gradient. 15. The applicant shall meet mitigation requirements through on-site planting in accordance with the approved plan. 16. Tree Protective measures (i.e. orange colored silt fence or 4 foot polyethylene laminate safety netting) shall be installed at the Drip Line or at the perimeter of the Critical Root Zone, whichever is greater, of significant trees/woodlands to be preserved both on-site and off-site on private property. 13V i Planning Report - Grand Oak Three April 24, 2001 Page 10 17. The applicant shall contact the City Forestry Division and set up a pre-construction site inspection at least five days prior to the issuance of the grading permit to ensure compliance with the approved Tree Preservation Plan and placement of the Tree Protection Fencing. 1%3 i STANDARD CONDITIONS OF PLAT APPROVAL A. Financial Obligations 1. This development shall accept its additional financial obligations as defined in the staff's report in accordance with the final plat dimensions and the rates in effect at the time of final plat approval. B. Easements and Rights-of-Way 1. This development shall dedicate 10-foot drainage and utility easements centered over all lot lines and, in addition, where necessary to accommodate existing or proposed utilities for drainage ways within the plat. The development shall dedicate easements of sufficient width and location as determined necessary by engineering standards. 2. This development shall dedicate, provide, or financially guarantee the acquisition costs of drainage, ponding, and utility easements in addition to public street rights-of-way as required by the alignment, depth, and storage capacity of all required public utilities and streets located beyond the boundaries of this plat as necessary to service or accommodate this development. 3. This development shall dedicate all public right-of-way and temporary slope easements for ultimate development of adjacent roadways as required by the appropriate jurisdictional agency. 4. This development shall dedicate adequate drainage and ponding easements to incorporate the required high water elevation plus three (3) feet as necessitated by storm water storage volume requirements. C. Plans and Specifications 1. All public and private streets, drainage systems and utilities necessary to provide service to this development shall be designed and certified by a registered professional engineer in accordance with City adopted codes, engineering standards, guidelines and policies prior to application for final plat approval. 2. A detailed grading, drainage, erosion, and sediment control plan must be prepared in accordance with current City standards prior to final plat approval. 3. This development shall ensure that all dead-end public streets shall have a cul-de-sac constructed in accordance with City engineering standards. 4. A separate detailed landscape plan shall be submitted overlaid on the proposed grading and utility plan. The financial guarantee for such plan shall be included in the Development Contract and shall not be released until one year after the date of City certified compliance. D. Public Improvements 1. If any improvements are to be installed under a City contract, the appropriate project must be approved by Council action prior to final plat approval. E. Permits 1. This development shall be responsible for the acquisition of all regulatory agency permits required by the affected agency prior to final plat approval. F. Parks and Trails Dedication 1. This development shall fulfill its park and trail dedication requirements as recommended by the Advisory Parks, Recreation and Natural Resource Commission and approved by Council action. G. Water Quality Dedication 1. This development shall be responsible for providing a cash dedication, ponding, or a combination thereof in accordance with the criteria identified in the City's Water Quality Management Plan, as recommended by the Advisory Parks, Recreation and Natural Resource Commission and approved by Council action. H. Other 1. All subdivision, zoning and other ordinances affecting this development shall be adhered to, unless specifically granted a variance by Council action.
