MVTA reduced staff levels, unlike the Region. -MVTA operating around 71% of base schedule (February 2021) MVTA focuses on health and safety of our customers and employees –Adopting recommendations from the CDC on enhanced cleaning, sanitizing, and disinfecting procedures. –Promoting social distancing guidance. MVTA Service Update Route 436V •Pilot service added to Viking Lakes Area in September 2020 •Peak hour service with 4 trips per day targeting key shifts at Omni Hotel •15 minute connection to 46th Street LRT Station MVTA Connect Expansion •MVTA Planning is currently reviewing launching MVTA Connect service in Eagan. •MVTA is submitting applications to procure vans (not buses), possibly electric. •Will be seeking letters of support. Route 442X –New, more direct service to Twin Cities Premium Outlets (effective February 20, 2021) –Hourly service, 7 days/week –Provides connections from Apple Valley Transit Station and Mall of America New Eagan Shelters •Eagan has been a supporter of MVTA, transit service, and transit amenities. •MVTA Facilities staff worked with the Public Works Director on placement of additional bus shelter pads at Lone Oak and Lexington and Lexington and Yankee Doodle. •MVTA intends to procure and install two shelters this year and two in 2022. MVTA Systemwide Study –Comprehensive review of current transit service operated by MVTA & SouthWest Transit –Examine unmet needs and opportunities for additional routes or coordinated service. –Study will address internal & external factors influencing the use of public transit (parking supply, schedules & route design, amenities, marketing, land use, COVID-19, etc.) Red Line Update •MVTA Operates 64% of the service at Cedar Grove Transit Station. •Metro Transit took over Red Line operations and management of Cedar Grove Transit Station on Dec. 5, 2020. 3 Month MVTA review of Red Line and Facility Management •Increased non-transit activity •General upkeep, snow clearance, below previous MVTA standard •Customer Complaints –concerning cleanliness and safety •MVTA passenger amenities vandalized •Service Reliability -Red Line trips missed, MVTA hadn’t missed trip since 2017 •Older vehicles retrofitted for Red Line and no uniformity in service delivery Cedar Grove Transit Station -Eagan 2021 LEGISLATIVE PRIORITIES Maintain Existing Funding Model (MVST and Reserves at current percentages) as economy stabilizes from pandemic. –The 1st Cares Funding was primarily used to maintain Service and Operations to offset the loss in fare revenue, ridership and maintain passenger safety. –CARES 2 Funding hasn’t been distributed to Suburban Providers (allocated by FTA in December to the Metropolitan Council). –Over $410M in Federal Emergency Transit funding and STP’s have only received $12.1 (MVTA $6.1) back in April. 2021 LEGISLATIVE PRIORITIES Provide more flexibility to suburban providers and more equitable oversight –The MPO is also the region’s largest operator creating unhealthy competition; limiting opportunities for equitable funding, planning, collaboration, and overall accountability. –The STA members should become Direct Recipients for federal funding like similar-sized transit providers around the state, and have the ability to set: –Fare Policy -Allow STA members to set appropriate fares based on distance –Fleet Replacement –Ensure STA stake in vehicle ownership and replacement Questions? Agenda Information Memo March 9, 2021 Eagan Special City Council Workshop IV.Northland’s Utility Rate Study Findings Direction for Consideration: Receive a presentation from Northland Securities on its utility rate study findings and provide feedback regarding their long-term financial management plan for water, sanitary sewer, storm drain/water quality and street lighting utilities. Facts: At its January 12, 2021 special workshop, the Council received a utilities infrastructure needs analysis presentation from AE2S, the City’s engineering consultant. The City contracted with Northland Securities to perform a rate study, utilizing the AE2S report for capital needs, and accessing data from our billing system to help create a long- term utilities operating and capital financing plan. Northland’s plan addresses: o Utilization of existing resources, combined with issuance of bonds, to achieve revenue sufficiency for operating and capital needs over the next 20 years; and o Utility user rate calculations. The plan suggests rate changes would be implemented effective January 2022. The complete Northland study is provided via separate email because of its large file size. Tammy Omdal from Northland Securities will present slides at the meeting. She and City staff will be available to answer questions. PRESENTATION OF 2020 COMMUNITY SURVEY RESULTS Action to be Considered: No formal action is needed. Facts:  Every two years, the City of Eagan engages an independent research firm to conduct a scientific survey of residents. The survey is designed to provide the City Council and staff with resident perspectives about community quality and government services.  For the 2020 survey, the City once again partnered with National Research Center (NRC), because of its ability to not only gauge resident perceptions of the city, but also to make both regional and national comparisons with peer cities. NRC fielded a customized version of its National Community Survey™ (NCS™) last year.  The NCS™ was developed in partnership with the International City/County Management Association (ICMA) to provide cities with an affordable, high-quality method to access and interpret resident data. The NRC survey is the only community survey endorsed by ICMA and the National League of Cities, and it is used by 27 Twin Cities metro based communities including Bloomington, Brooklyn Center, Eden Prairie, Edina, Golden Valley, Lakeville, Maple Grove, Roseville, Shakopee, Shoreview, Woodbury, and Dakota County, along with more than 440 jurisdictions in 44 states.  The 2,700 randomly selected households each received either a paper copy of the survey or an invite to fill out the community survey digitally in November 2020. In total, 522 surveys were completed, yielding a margin of error of +/- 4% a confidence interval of 96%.  Communication and Engagement Director Joe Ellickson will give the presentation about the key findings of the survey and answer questions the City Council may have. The phrase “livable community” is used here to evoke a place that is not simply habitable, but that is desirable. It is not only where people do live, but where they want to live. Great communities are partnerships of the government, private sector, community-based organizations and residents, all geographically connected. The NCS captures residents’ opinions considering ten central facets of a community:  • Economy  • Mobility  • Community Design  • Utilities  • Safety  • Natural Environment  • Parks and Recreation  • Health and Wellness • Education, Arts, and Culture  • Inclusivity and Engagement The report provides the opinions of a representative sample of 522 residents of the City of Eagan collected from November 4, 2020 to December 30, 2020. The margin of error around any reported percentage is 4% for all respondents and the response rate for the 2020 survey was 19%. Survey results were weighted so that the demographic profile of respondents was representative of the demographic profile of adults in Eagan... How the results are reported For the most part, the percentages presented in the following tabs represent the “percent positive.” Most commonly, the percent positive is the combination of the top two most positive response options (i.e., “excellent” and “good,” “very safe” and “somewhat safe,” etc.). On many of the questions in the survey respondents may answer “don’t know.” The proportion of respondents giving this reply is shown in the full set of responses included in the tab “Complete data.” However, these responses have been removed from the analyses presented in most of the tabs. In other words, the tables and graphs display the responses from respondents who had an opinion about a specific item. A list of all households within the zip codes serving Eagan was purchased from Go-Dog Direct based on updated listings from the United States Postal Service. Since some of the zip codes that serve the City of Eagan households may also serve addresses that lie outside of the community, the exact geographic location of each housing unit was compared to community boundaries using the most current municipal boundary file. Addresses located outside of the City of Eagan boundaries were removed from the list of potential households to survey. Each address identified as being within city boundaries was further identified as being within one of the three zip codes. From that list, addresses were randomly selected as survey recipients, with multi-family housing units (defined as those with a unit number) sampled at a rate of 53 compared to single family housing units. An individual within each household was selected using the birthday method. The birthday method selects a person within the household by asking the “person whose birthday has most recently passed” to complete the questionnaire. The underlying assumption in this method is that day of birth has no relationship to the way people respond to surveys. This instruction was contained in the introduction of the survey. Conducting the survey The 2,700 randomly selected households received mailings beginning on November 4, 2020 and the survey remained open for seven weeks. For 1,200 households, the first mailing was a postcard inviting the household to participate in the survey. The next mailing contained a cover letter with instructions, the survey questionnaire, and a postage-paid return envelope. The final mailing contained a reminder letter, another survey, and a postage-paid return envelope. For the remaining 1,500 households, the first mailing was a postcard inviting the household to participate, followed one week later by a reminder postcard. All mailings included a web link to give residents the opportunity to respond to the survey online. All follow-up mailings asked those who had not completed the survey to do so and those who had already done so to refrain from completing the survey again. About xx% of the 2,700 mailed invitations or surveys were returned because the household address was vacant or the postal service was unable to deliver the survey as addressed. Of the remaining xx households that received the invitations to participate, 522 completed the survey, providing an overall response rate of 19%. The response rate was calculated using AAPOR’s response rate #2* for mailed surveys of unnamed persons. It is customary to describe the precision of estimates made from surveys by a “level of confidence” and accompanying “confidence interval” (or margin of error). A traditional level of confidence, and the one used here, is 95%. The 95% confidence interval can be any size and quantifies the sampling error or imprecision of the survey results because some residents’ opinions are relied on to estimate all residents’ opinions. The margin of error for the City of Eagan survey is no greater than plus or minus four percentage points around any given percent reported for all respondents (522 completed surveys). In addition to the randomly selected “probability sample” of households, a link to an online open participation survey was publicized by the City of Eagan. The open participation survey was identical to the probability sample survey with two small updates; it included a map at the beginning asking where the respondent lives and a question about where they heard about the survey. The open participation survey was open to all city residents and became available on December 30. The survey remained open for two weeks. The data presented in the following tabs exclude the open participation survey data, but a tab at the end provides the complete frequency of responses to questions by the open participation respondents. Analyzing the data Responses from mailed surveys were entered into an electronic dataset using a “key and verify” method, where all responses are entered twice and compared to each other. Any discrepancies were resolved in comparison to the original survey form. Range checks as well as other forms of quality control were also performed. Responses from surveys completed on Polco were downloaded and merged with the mailed survey responses. The demographics of the survey respondents were compared to those found in the 2010 Census and 2017 American Community Survey estimates for adults in the City of Eagan. The primary objective of weighting survey data is to make the survey respondents reflective of the larger population of the community. The characteristics used for weighting were age, sex, race, ethnicity, housing type, tenure, and area. No adjustments were made for design effects. Weights were calculated using an iterative, multiplicative raking model known as the ANES Weighting Alogrithm.* The results of the weighting scheme for the probability sample are presented in the following table. Polco and /National Research Center aligns demographic labels with those used by the U.S. Census for reporting purposes, when possible. Some categories (e.g., age, race/Hispanic origin, housing type, and length of residency) are combined into smaller subgroups. When there is an insufficient number of respondents within a category for those subgroups to be able to make meaningful comparisons (generally, less than 50), that subgroup has been excluded from the analysis. The survey datasets were analyzed using all or some of a combination of the Statistical Package for the Social Sciences (SPSS), R, Python and Tableau. Virtually all residents gave excellent or good ratings to Eagan as a place to live, the overall quality of life in the city, and Eagan as a place to raise children; 95% of residents or more would recommend living in Eagan to someone who asked and planned to remain in Eagan for the next five years. At least 9 in 10 residents gave positive ratings to the overall image or reputation of Eagan and the overall feeling of safety in the city. Many of these ratings were higher than those given in other communities across the nation, in communities with populations and household incomes similar to Eagan’s, and to other Twin-Cities-area communities. Eagan’s Natural Environment and Parks and Recreation continue to be highly rated community amenities that are important to residents. Nearly all residents favorably rated the overall quality of the natural environment in Eagan, with about 9 in 10 rating this facet as essential or very important. As in past years, ratings for most Natural Environment-related aspects of the community were exceptional: about 9 in 10 survey respondents gave positive marks to the cleanliness of the city, water resources, and air quality, while 8 in 10 were pleased with preservation of natural areas and Eagan open space. These ratings were all higher than the national benchmark comparisons. The Economy is a resident priority and also a community feature. While Eagan residents rated the facet of Economy as relatively higher than the median in importance and lower than the median in quality when compared to ratings for other facets of community livability, thus highlighting this as an area of focus for the City, it is noteworthy that Economy ratings in Eagan tended to be higher than those given in other communities nationwide. About 9 in 10 residents gave excellent or good ratings to the overall economic health of Eagan, the overall quality and variety of business and service establishments, economic development, and shopping opportunities, while 8 in 10 were pleased with Eagan as a place to work and employment opportunities. About three-quarters of respondents gave high scores to Eagan’s vibrant downtown/commercial area and cost of living. Almost all of these Economy-related ratings were higher or much higher than the national, peer community, and Twin Cities benchmark comparisons. Government performance and public trust ratings in Eagan continue to shine. As in past years, survey respondents gave above-average marks to all aspects of local government performance. Virtually all residents gave high marks to the overall customer service provided by Eagan employees (an increase since 2018), and about 9 in 10 gave excellent or good scores to the overall quality of services provided by the City, the overall direction that Eagan is taking, and public information services. Eight in 10 residents were pleased with the value of services for taxes paid, overall confidence in Eagan government, generally acting in the best interest of the community, being honest, being open and transparent to the public, informing residents about issues facing the community, treating all residents fairly, and treating residents with respect. Balancing performance and importance Every jurisdiction must balance limited resources while meeting resident needs and striving to optimize community livability. To this end, it is helpful to know what aspects of the community are most important to residents and which they perceive as being of higher or lower quality. It is especially helpful to know when a facet of livability is considered of high importance but rated as lower quality, as this should be a top priority to address. To help guide City staff and officials with decisions on future resource allocation, resident ratings of the importance of services were compared to their ratings of the quality of these services. To identify the services perceived by residents to have relatively lower quality at the same time as relatively higher importance, all services were ranked from highest perceived quality to lowest perceived quality and from highest perceived importance to lowest perceived importance. Some services were in the top half of both lists (higher quality and higher importance); some were in the top half of one list but the bottom half of the other (higher quality and lower importance or lower quality and higher importance); and some services were in the bottom half of both lists. Services receiving quality ratings of excellent or good by 94% or more of respondents were considered of “higher quality” and those with ratings lower than 94% were considered to be of “lower quality.” Services were classified as “more important” if they were rated as essential or very important by 83% or more of respondents. Services were rated as “less important” if they received a rating of less than 83%. This classification uses the median ratings for quality and importance to divide the services in half. The quadrants in the figure below show which community facets were given higher or lower importance ratings (up-down) and which had higher or lower quality ratings (right-left). To help guide City staff and officials with decisions on future resource allocation, resident ratings of the importance of services were compared to their ratings of the quality of these services. To identify the services perceived by residents to have relatively lower quality at the same time as relatively higher importance, all services were ranked from highest perceived quality to lowest perceived quality and from highest perceived importance to lowest perceived importance. Some services were in the top half of both lists (higher quality and higher importance); some were in the top half of one list but the bottom half of the other (higher quality and lower importance or lower quality and higher importance); and some services were in the bottom half of both lists. Services receiving quality ratings of excellent or good by 94% or more of respondents were considered of “higher quality” and those with ratings lower than 94% were considered to be of “lower quality.” Services were classified as “more important” if they were rated as essential or very important by 83% or more of respondents. Services were rated as “less important” if they received a rating of less than 83%. This classification uses the median ratings for quality and importance to divide the services in half. Survey invitations were mailed to 2,700 randomly selected households and data were collected from November 4, 2020 to December 30, 2020. The results from this main survey effort represent the most robust estimate of your residents’ opinions. After the above data collection period was underway, a link to an online open participation survey was publicized by the City of Eagan. The open participation survey was identical to the probability sample survey with two small updates; it included a question at the beginning asking in which zip code the respondent lives and also a question about where they heard about the survey. The open participation survey was open to all city residents and became available on December 30. The survey remained open for two weeks. The open participation survey data were not collected through a random sample and it is unknown who in the community was aware of the survey; therefore, a level of confidence in the representativeness of the sample cannot be estimated. However, to reduce bias where possible, these data were statistically weighted to match the demographic characteristics of the 2010 Census and 2017 American Community Survey estimates for adults in the City of Eagan. The characteristics used for weighting were age, sex, race, ethnicity, housing type, tenure, and area. No adjustments were made for design effects. Weights were calculated using an iterative, multiplicative raking model known as the ANES Weighting Algorithm.* The results of the weighting scheme for the probability sample are presented in the following table. * Pasek, J. LEASH LAW DRAFT ORDINANCE REVIEW    Direction For Consideration:     To provide direction regarding a draft leash law ordinance amendment.    Facts:      Currently, City Code allows a dog off its owner’s property to be controlled by a leash or  voice command. The City Council received a request from residents to consider changes  to its leash law regulations for dogs, specifically to require a leash when off the owner’s  property.   At the January 12, 2021 City Council work session, the Council directed preparation of  an ordinance amendment to require a leash for dogs off their owner’s property. Council  directed that the draft ordinance amendment be placed on a future Council work  session agenda for further discussion.   The City Attorney’s Office has drafted an ordinance amendment for Council review.    As background for Council, there are two existing enforcement mechanisms for leash  law/animal regulations:  1. Civil – City Code establishes a $250 per occurrence civil fee for the third and each  subsequent violation of an animal control regulation within a year.  2. Criminal – Violation of the leash law is a misdemeanor, which is often  adjudicated to a petty misdemeanor.    Community members who have contacted the City Council regarding the leash law have  been notified of this meeting.    Policy Issues:   At the January work session, Council directed staff to review whether electronic collars  would be an appropriate alternative to leashes. The draft ordinance amendment does  not allow electronic collars in lieu of leashes. Animal Control has found that electronic  collars are often used incorrectly and can increase a dog’s level of anxiety.    The City Attorney opined that the ordinance should not speak directly to the issue of  animals at‐large while on apartment or townhome properties, as they are private  properties for enforcement by the property owner. The attorney noted the ordinance  would be enforceable if and when the at‐large animal went onto public right‐of‐way or a  City sidewalk or trail.      Attachments: (4)    VI‐1 Draft ordinance amendment  VI‐2 January 12, 2021 Meeting Minutes  VI‐3 Correspondence  VI‐4 City Leash Regulations Comparison   ORDINANCE NO. ___ 2ND SERIES AN ORDINANCE OF THE CITY OF EAGAN, MINNESOTA, AMENDING EAGAN CITY CODE CHAPTER TEN ENTITLED “PUBLIC PROTECTION, CRIMES AND OFFENSES” BY AMENDING SECTION 10.11 REGARDING ANIMAL REGULATIONS BY MODIFYING THE DEFINITION OF “AT LARGE” AS IT RELATES TO DOGS, CATS, AND FERRETS; AND BY ADOPTING BY REFERENCE EAGAN CITY CODE CHAPTER 1 AND SECTION 10.99. It is unlawful for the owner of any dog, cat, ferret, horse or miniature pig to permit such animal to run at large. A dog, cat, or ferret shall be kept on a leash or chain at all times when off the premises of the owner and not confined within a motor vehicle or cage. The police officer or animal control officer may seize, impound or restrain any dog, cat, ferret, horse, or miniature pig found running at large. Subdivisions 4 and 5 shall apply to any dog, cat, ferret, horse, or miniature pig impounded under this subdivision. This subdivision shall not apply to a dog running at large within the confines of an off-leash dog area, provided that the owner of the dog, as defined herein, is present within the confines of the off-leash dog area and within close enough proximity to the dog to be able to physically restrain the dog when necessary or if so directed by a police officer or animal control officer. LEASH ORDINANCE REVIEW City Administrator Osberg introduced the item noting the City has been asked to consider modifying City Ordinance, which could require dogs to be on a leash while in public. Currently, the City does allow dogs to be off -leash in public, provided they are under voice control. Police Chief New and City Clerk Scipioni was available for questions. Caller David Ruppert addressed the Council noting his objection to the potential change to the leash ordinance. Mr. Ruppert noted his dog is voice trained and he would hate to have to leash his dog every time when outdoors. The Council and staff discussed the current leash ordinance. It was the consensus of the Council to require leashing dogs when off the owners' property and investigate whether an electric collar should be an option. The Council also discussed the ordinance being complaint -based like many other city ordinances. I am against any change! I am a proud pet owner and was quite frankly unaware there was no leash requirement. I am still against any change for several reasons. I would like to know how with out a requirement does unleashed animal incidents in Eagan compare to other comparable cities with leash requirements? I don’t believe there is a difference, other wise this would have been addressed years ago. So why change what is not broken? Having been a long time pet owner, I can tell you that I have witnessed more dog aggression from leashed dogs than unleashed dogs. I believe this to be a case where; on the leash the dogs are attached to the owner and the feel the need to protect them more, where as had the 2 dogs met off leash there would have been no incident at all. You can see incidences of this nature at the dog parks all the time when people keep their dogs on the leash instead of letting the roam free. A properly trained dog will be just as controllable under voice command as they are on the leash. I have seen where they are even more controllable off-leash than they are on leash. In regards to changing the requirement on private property the above statements still apply. In addition to any leash/fence requirement, many owners have the ‘invisible fence’ which is just as effective as a physical barrier such as a fence or leash. The invisible fence gives many dogs a much larger area to play and exercise in than a traditional yard leash would, thus creating more controllable animals. Since the ‘invisible fence’ is often buried underground it is undetectable to the casual observer and thus I do not believe it would cut down on any calls to the Code Enforcement Department. I do not see how changing the current codes would reduce an incidence, cause for a reduction in calls for the Code Enforcement Department so what change. In fact I believe that any change would increase incidence as well as the number calls to code enforcement, thus being counter productive. I am also a big fan of not ‘fixing’ that which is 'not broken’. The current codes have been on the books for quite some time so why change now? There are rumors on social media and amongst neighbors that this consideration might be due to a certain individual who themselves have a dog, and that said dog has been known to be very vocal and aggressive on the leash. The dog mentioned in the rumors, is said to be of a smaller breed, that doesn’t mean that the nuisance barking or aggressiveness as well as a potential bite is any less severe than any other breed of dog. As such, any change to the current codes would have an effect on all dogs to include the ones in the rumor. If there is any truth to this rumor, this would fall under the guise of 'careful what you wish for', as well as ‘whats good for the goose is good for the gander’ Even if the rumor is to true, any change to the current codes should involve a careful look into any and all potential consequences. I applaud the City Council for listening to the concerns of each and everyone of Eagan’s residence, but just because a squeaky wheel needs some oil, doesn’t mean the rest of the machine does, or that the machine needs to be changed or replaced. The laws as written assume all dogs will mind and listen and all owners are responsible with complete control of their dog. What about the other times or when a child is present or the animal is startled or goes to chase after the squirrel, goes to the bathroom (pooping) unseen by the owner in someone’s yard or driveway, or chases after my dog (that is leashed) or me? If needed I can explain personal examples of issues specific to my area but will let my concern be known with above comments. If further examples are needed please feel free to contact me. I have a few. Please require leashing of all animals, specifically dogs, unless in home or gated yard. We do have a lot of dogs in the Eagan community. Many are large breeds that can do serious harm.
