ADJOURNMENT City of Evan MeMo TO: HONORABLE MAYOR AND CITY COUNCILMEMBERS FROM: CITY ADMINISTRATOR HEDGES DATE: JULY 3, 2008 SUBJECT: SPECIAL CITY COUNCIL MEETING TUESDAY, JULY 8, 2008 A Special City Council meeting is scheduled for Tuesday, July 8, 2008 to consider two (2) items on the agenda: 1.) Interview Applicants for City Council Vacancy, and 2.) Consider Resolution Establishing Procedure for Council Appointment. It was the consensus of the City Council at the July 1 meeting that an open dialogue is preferred as opposed to scripted questions for each of the interviews. There is no legal requirement that the City Council ask the same questions of each candidate. The Special City Council meeting starts at 5:30 p.m. in Conference Rooms 2A & 2B; the first interview is scheduled at 5:45 p.m. allowing fifteen minutes to discuss the logistics and process for the interviews. It was also agreed at the July 1 Council meeting that each interview would be fifteen minutes in length with a five minute cushion allowing the City Council to either continue the interview longer or move up the next candidate for his or her interview. There are also two (2) breaks scheduled for the evening. Please note that the City Attorney has reviewed state statute and the minimum age is 21, which no longer qualifies Will Ische for consideration. Mr. Ische has been notified of the statute and, as a result, will not be included in the interview process. For a copy of the list of candidates interviewing for the evening, refer to page ?, a copy of a letter inviting each candidate is nclosed on pa e 3 and, for a copy of the vacancy notification and application, refer to pages through All the applicants completed a form which is enclosed on pages 3-- through3 in the order they appear on the interview schedule. Also, enclosed on pages_ A through ,/-/I for consideration by the City Council as an additional agenda item, is "A Resolution Establishing Procedure for Council Appointment". It was suggested by the City Attorney that this Resolution be considered and adopted by the Council in advance of the July 15 meeting so a process is determined by official City Council action in advance of the appointment process. With issues like Carriage Hills and the lawsuit against MAC, its clear Council is working hard for the Eagan residents. A RESOLUTION ESTABLISHING PROCEDURE FOR COUNCIL APPOINTMENT WHEREAS, the following alphabetically listed names have been submitted to the City Council of Eagan for consideration for appointment to the vacant position of Councilmember of Eagan: Edward L. Ashby Patrick Geagan Ted Gladhill Michael Holmdahl Shawn Hunter Susan Orandi Johnson Mark L. Olson Brenda Rivera Kristine Thornburgh Jane Vanderpoel WHEREAS, Minnesota Statutes 412.02, Subd. 2(a), provides, in part: A vacancy in an office shall be filled by Council appointment until an election is held as provided in this subdivision. In case of a tie vote in the Council, the Mayor shall make the appointment. WHEREAS, pursuant to law, this appointment is for a term where more than two years remain in the unexpired term; thus a special election will be held at the next regular City election, on November 4, 2008, to elect an individual for the remainder of the term, and WHEREAS, the following procedure is a preliminary process and not a binding Council action, further Council action, by motion, is necessary to nominate and appoint a candidate for the vacancy. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Eagan, Dakota County, Minnesota, that the following procedure will be used to reduce the number of candidates considered by the Council for the appointment: 1. A written roster has been prepared listing the applicants. 2. The Council shall proceed in the following manner to reduce the list of applicants to arrive at a nominee: A. Each Councilmember shall receive a copy of the roster. z1b B. Each Councilmember shall in writing select up to five (5) of the names appearing on the roster by placing an (X) next to the name of an applicant whom the Councilmember wishes to remain on the roster. C. The marked rosters shall be delivered to the Director of Administrative Services for tabulation. D. If an applicant has not been selected by three or more of the Councilmembers, his/her name shall be stricken from the roster by the Director of Administrative Services and shall no longer appear as a name to be considered by the Council; E. The Director shall submit the revised roster to the Council and announce the number of names that remain on the roster. Each Councilmember shall in writing select that certain number of names which is one less than the total number then appearing on the roster in the same manner as identified in Paragraph 5(B). F. The process of selection continues in the manner identified above except that, if after selection by the Council there results a tie between or among all the names appearing on the roster after a selection, the Council, in writing, shall again select until one or more names have been stricken; provided, however, the Council shall not reselect more than three (3) times. If after the third selection there remains a tie, the process shall end. Otherwise, the process shall end when only one name remains. 4. After the process has ended, a motion to appoint a Councilmember shall be in order. The motion shall be in the form of: "I move to appoint to the position of Councilmember of Eagan."
