What’s going on with tree removal? After learning that the walls are replacement, I figured there would be little impact to trees, but the photos show some tree removal. The Tree Pres ordinance doesn’t strictly apply in this case, however, Shoreland Zoning does have some limitations on vegetation removal in the Shore Impact Zone (the first 25 ft. from the OHWL) and on steep slopes. I am fine with releasing the zoning permit for the retaining wall construction/1:1 replacement, since: - the lowest wall is approximately 33-feet beyond the DNR OHWL, horizontally (attached is a jpeg of a map excerpt, showing my gps point for the lowest wall’s distance from the DNR OHWL, and a wide-angle photo of the backyard walls to be replaced), - the contractor described their plan for: - erosion & sediment control in the backyard, using sediment logs butted up against the existing chain-link fence (sediment logs were on-site, but not yet placed), - erosion & sediment control in the frontyard, using sediment logs behind the curbline (which were on-site, but not yet placed), - staging materials in the frontyard (and not on the street), - access from the frontyard to the backyard, using 4x8 mats (which were on-site, but not yet placed) This contractor seemed very aware of how to prevent erosion downslope and preventing sediment tracking onto the street. If you need a written erosion control plan, let the contractor know. Once you have what you need and are comfortable letting him proceed, then I can approve and release the ZP. Please recall we do not charge a fee or get any deposit with a Zoning Permit. The ZP process is intended to facilitate communication and expectations. Since we don’t charge a fee, we don’t generally inspect them, but given the nature of the work here, it’s a good idea for someone to inspect to prevent any problems. I think we’ll need an erosion control plan either way. Aaron needs to sign off on a ZP, but Dave W usually visits the site for erosion control, and he can also can confirm it doesn’t need a building permit (wall height and separation of tiers determines that). For zoning/shoreland compliance, once the OHWL is confirmed, I just need to know how far back from the OHWL the first retaining wall is. There is no required setback, but anything within 25 ft. is more sensitive about vegetation removal and slopes. Also, stairs cannot be more than 4 ft. wide. Thanks and let us know what you find out. At first glance I would say this is a candidate for a Stormwater Management Permit (SMP), as one could say it is within the scope of altering existing contours which result in changes to drainage. Two things I would like to confirm would be: 1. Is this a 1-for-1 replacement of existing retaining walls. If yes, than that would dismiss the need for a SMP and they would follow your typical protocol for a zoning permit application, 2. Confirm the OHWL. I appreciate that the we have an elevation to work with but in my opinion it would be good to go out there with an EoS to confirm. I can reach out to Vaughn from Limitless Landscaping to confirm if it’s a replacement and to setup an on-site to confirm OHWL. Just to confirm if they need a SMP who would like to be looped into the review process? My self for erosion sediment control, someone from Engineering for drainage / grading (Typically Dave for Building permits), and Pam for ensuring adherence to zoning requirements? I think there may already be retaining walls present and these are replacements, but it’s hard to see them in the aerials. This is in Shoreland Zoning, so vegetation removal and site disturbance requirements in Sec. 11.65 apply. Same for erosion control and tree removal. The lot is below with contours and easemements. There are apparently no side yard d/u easements on this lot. The OHWL for O’Leary is 884.1. Shore Impact Zone is 25’ from the OHWL. In other similar cases, we’ve had to confirm the location of the OHWL, and the retaining wall setback from the OHWL, and also asked for an erosion control plan and sent out an Engineering Tech to review the erosion control measures once in place. Is this a candidate for the new Stormwater Permit? If this is not a candidate for a Stormwater Permit, please let me know what you need for the Zoning Permit.
