I. Agenda and Meeting Procedures The following format was adopted by the APC with regard to the meeting agenda: a. Public hearings would be scheduled first b. Miscellaneous business, including old and new business, would be considered next. c. "Visitors to be Heard" would be left off the agenda; a determination would be made by the APC at each meeting whether specific persons would be heard. At a later meeting, it was decide'1 that the City Administrator would acquire the names of persons wishing to make a presen- tation at APC meetings, particularly when a specific issue involves large numbers of persons. Also, the City Administrator would submit to the APC on a periodic basis a follow-up on action completed by the Council and the staff to keep the APC members abreast of activities that have been acted upon by the APC. Thp resolution which was adopted establishing rules and regulations for the conduct of APC meetings is presented on pages 3 and 4 II. Amendments to Ordinance #52 A. Board of Adjustments and Appeals With the amendment to section 52.09, subd. 2, the City Council now serves as the Board of Adjustment and Appeals; The APC Chairman and Secretary are no longer mefibers of this Board. Also, this board no longer considers all requests for variances; instead, it only hears appeals of staff or Council decisions related to the zoning ordinance or building' code. B. Vd'riances The procedure for consideration of variances (Section 52.09, Subd. 3) has also been amended. The APC now hears these requests and makes its recommendation to the Council. Notice is mailed to property owners within 200•feet of the subject parcel, as well as those that the City Clerk determines are affected by the variance. In addition,if they so desire, the City Council may hold a public hearing on the request. Copies of these sections, as amended, are on pages through 7 III. General Variances 5 During 1977, certain developers requested general variances for particular subdivisions so as to allow the construction to fit into the topography and preserve trees in the area. This would be up to a 10 foot variance of the front and side lot setback requirements and up to a 15 foot variance of the rear lot setback requirements. Such variances would be approved by the Building Inspector on a lot by lot basis depending on individual circumstances. The subdivisions for which this general variance applies are Wilderness Park lst and 2nd Additions and the Ches Mar lst through 4th Additions. IV. Metropolitan Land Planning Act Refer to page 8 for a discussion of this act and its application to the City. V. Game Room Device Ordinance Upon request of the APC, the City Council directed the staff to prepare an ordinance regulating "amusement, game, and recreation centers and setting up a licensing system and fee structure for the operation of games of skill, pin -ball machines, and other amusement devices. A rough draft of this ordinance has been prepared by the City Attorney and is currently under review by the City Administrator and Chief of Police. • 2 3 RESOLUTION ADVISORY PLANNING.COMMISSION CITY OF EAGAN WHEREAS, a regular meeting of the Eayon Advisory Pi:.- ning Commission was held on February 22, 1977 at 7 : 00 P.. :. _ all members present; and, WHEREAS, the Advisory Planning Commission reviewed rules and regulations for the conduct of Advisory Plannii:r. Commission meetings; and, WHEREAS, the members of the Advisory Planning Comma_ indicated that a guideline establishing rules and regulFitions would be advantageous to the conduct and order for Advis,.)r,. Additional administrative items will be considered at any meeting upon discretion of the Planning Commission Chairman. 2. Any person or group of persons who wish to appear on the Planning Commission agenda must present all infor:r,at2o:- pertaining to the agenda item to the office of the City Clerk or City Administrator at least two weeks prior to the Planr..a_: Commission meeting so there is adequate time for staff review. 3. Only one item on the agenda will be considered at a time. It is advisable that a spokesman be selected to present an issue to the Advisory Planning Commission. 4 4. No talking or disrupting the meeting will be permitted. If there is -a question to be asked to the Commission, the person should raise their hand and be recognized by the Chairman before interrupting. 5. All persons appearing before the Advisory Planning Commission will be expected to state their name, address and the question they may have upon recognition by the Chair- man. 6. There will be no special meetings of the Advisory Planning Commission unless there is a hardship determined by the Chairman. 7. This fee shall not be refunded. Such application shall also be accompanied by suffi- cient copies of detailed and written and graphic materials necessary for the explanation of the request as prescribed by the City, together with a list of property owners affected or within 200 feet of the outer boundaries of the subject property. The request shall be considered as being officially submitted when all the information requirements arc complied with. 2. The hdvisory Planning Commission shall make a finding of fact and review each request for variance and recommend approval or denial of said request. All owners of property located within two hundred (200) feet of the outer boundaries of the subject property shall be mailed a notice of the request for variance and those that the City Clerk determines are affected by the variance. In formulating its decision, the Planning, Commission shall consider the effect o proposed variance on the Comprehensive Cuide Plan and on the character and development of the neighborhood. The recommendation of the Planning Commission and the City staff's report shall be presented to the City Council at its next regular meeting. 4. In considering all requests for a variance, or any subsequent appeal, the City staff, the edvisory Planning Commission and thn City Council shall make a finding of fact that the.proposed action will not: (a) Impair an adequate supply of light and air to adjacent property. The first step toward implementing this act involved the preparation of a Systems Statement by the Metro Council for each local unit of government. By law, the Systems Statements had to be completed by July 1, 1977. The Systems Statement for each local governmental unit dealt with the following subjects as they specifically related to that particular community: 1. Population, employment and housing need projections. 2. Metropolitan Facilities (transportation, airports, waste management, recreational open space). 3. Elements which could be excluded from the Compre- hensive Plan. Following the receipt of the Systems Statement, a community has up to three years to prepare a Comprehensive Plan. This plan would then be reviewed by the Metropolitan Council to ensure conformance with the Metropolitan Systems Plan prior to its adoption by the local government. To assist communities in the preparation of their comprehensive plans, the legislature had appropriated $1,100,000. This would be divided in the following manner: 1. All communities would receive an "entitlement" grant, in an amount determined by the Land Use Advisory Committee (a citizen's advisory body to the Metro Council). 2. Communities could also request additional funds which would be distributed on a discretionary basis, depending on the degree to which that community is affected by areas or facilities of regional significance. The amount of the entitlement grant for the City of Eagan is $19,204. The City also requested a discretionary grant totaling $23,800 for further study of the effect on the community of the following items: 1. The Minnesota Zoological Gardens 2. The Mpls.-St. Paul International Airport 3. Interstates 35E and I-494. 4. The Ft. Snelling State Park and the Dakota County Park 5. A special study on land use along state and federal highways within Eagan. The total grant request, then, was $43,004, and this would be matched with $14,496 in local funds. Acorn Day -Care Center -- Setback Variance 10' variance from rear lot line setback requirement approved by APC, 4-26-77, approved by Council, 6-7-77. 2. Crown Auto -- 50' variance from the 300' requirement in Ordinance 61, Planning Commission sent variance to the City Council with no recommendation. City Council did not approve the variance. A recommendation was made by Hedtke, seconded Sperling, that the Council review the sign ordinance to provide that all major businesses be eligible for pylon signs in G-B, General Business, zones with the understanding there be recommendation from the City Planner. All members voted in favor. 3. Ches Mar 1st Addition, Lot 9, Block 1, --10' variance from the front yard setback, There were specific guidelines for approval by staff. 4. Lake side Estates, 10' variance from the front yard set- back requirement, The purpose of the variance was for the construction of a septic tank 10' closer to the street in order to stay as far away from the lake as possible for pollution purposes. All members approved the variance. 5. Neil Charpentier -- 18' variance from the front setback requirements . There was extended discussion concerning the construction of an attached garage and questions concerning the actual hardship involved. There was also a concern regarding the site line of the street. Motion was made to build the garage partially in the house and only grant a 12' variance. All Planning Commission members voted in favor. 6. Wilderness Park Addition Variance -- 10' variance from the front setback requirements for Lots 11,12, 13, Block 3, Wilderness Park Addition. Reasons for variances were for the preservation of trees in the area. All members voted in favor. 7. McDonald's -- 16' variance from the front setback re- quirement for an additional storage building. People from the surrounding area were present objecting to the variance. It was approved in the 1974 that garbage would be contained in the building. Presently there is a dumpster sitting out- side where the garbage is stored. Advisory Planning Commission recommened denial because the petitioner did not appear and there is no hardship. • • • 8. Ches Mar 3rd and 4th Addition -- Variance to allow a 10% slope from the required 8% slope for internal streets because of the topography in the area. 9. Ches Mar, Lot 1, Block 1, 20' variance from the front setback requirements. It was noted that the 110' lot would require a variance of 20' under the present plan for the residents as opposed to the 50' setback requirementfrom major streets under the ordinance. It was approved that the hardship existed and Eagan did not acknowledge at the time platting occurred. 10. Wilderness Park 2nd Addition -- General Variance setback for all lots in Wilderness Park 2nd Addition. Reasons for variances are the trees and topography make building difficult on particular lots. It was recommended that a 10' deviation from front setbacks and a 15' deviation from rear setback be allowed on a lot by lot basis, each being approved by the Building Inspector. 11. Lehman and Crosz Variance -.Variance from the requirement of five acres in agriculturally zoned property for single family residents and for the one acre requirement without sewer and water. The variance was denied because, 1) Non- compliance with Ordinance 52.07, Subdivision 8, and 52.06, Subdivision 6C, 2) Non-compliance with PCA recommendation of 1 acre minimum without utilities, 3) Non-conformance with Metropolitan Council's recommendation of 21 acre minimum without utilities, and 4) No hardship is apparent. 12. T. Doherty, Shale Lane, 24' variance from street setback regulations for an attached garage. Hardship stated that the petitioner would not be able to expand his house. APC recommended approval of the 24' variance from the 30' setback requirement. 13. Wiener King Variance -- 3' variance from side setback for commercial building. Recommended approval due to hardship. Also there was a variance requested from the lineal placement for a pylon sign under Ordinance 16. The location of sign would be approximately 140' from Country Kitchen Sign and 160' from the Crown Auto sign. APC recommended denial of variance for the pylon sign and recommended a ground sign of am over 7' in height. 14. Ralph Nelson and Roger Johnson -- .2 acre variance from the five acre requirement in which to operate a dog kennel. The dog kennel had previously been in operation and no development has occurred around the kennel. APC recommended approval of the .2 acre variance. • • • 15. Ches Mar (Lot 1, Block ) -- 10' variance from front setback requirement for the purpose of saving trees on his lot. APC recommended approval and also recommended the blank variance be granted on all of Ches Mar with staff approval. 16. Lots 3, High View Acres (Paul Twomey) -- 10' variance from street setback on the east side of the lot. There was discussion if the proposed street would actually be installed to serve the portion of the Lost Spur Club. The minutes of the meeting described no particular hardship. APC recommended approval. 17. Cedar Ridge 1st Addition -- Variance to delete concrete curb and gutter in Dr. Mason's parking lot. The 1st motion made was to deny the variance, because no hardship existed. The motion failed. A second motion was made that the petitioner install a paved parking area and delete the curb and gutter until any expansion of the building or parking area. 18. Master Tool -- Variance to allow a structure to cover 39% of an industrial lot instead of the maximum 35% coverage for a portion of Lot 5, Block 2. The City Council granted the variance subject to the APC's approval. There was no hardship recorded for this variance, but 3 conditions were recommended with the approval of the variance. These were: 1) Ability to meet the parking requirements, 2) Property landscaping be provided, 3) All regulations be met for the parking area. (Curb & Gutter, paving). Another variance was also approved to allow a loading dock on the front of a building. 19. Public Street Variance (Oak Chase Addition) -- Variance to allow building permits on Lot 1 & 2, Oak Chase 3rd Addition and Lots 5 & 6, Block 7, Oak Chase 1st Addition which do not meet the minimum 60 frontage on a public street. The reasons for the varaince was that the park dedication for Oak Chase would create an access problem for the remaining land not dedicated for park land. 20. R.L. Johnson Investment Co. -- Variance from platting covering property north of Highway 13. The petition should have been for a temporary waiver of plat, however, staff did not recognize the error in the petition until it was too late to advertize for a public hearing for a waiver of plat. This is why it was a variance instead of a waiver. APC approved variance subject to platting and all applicable ordinances prior to occupancy. i 21. Durning's Subdivision - (Mr. Steak)• -- 40' variance from setback requirement along Highway #26. For the reason that it would allow greater depth from the residential housing east of Cedar Avenue. It would also increase the green area abutting Cedar Avenue. 22. Wilderness Park 1st Addition -- Blanket variance to allow the 10' front setback and the 15' rear setback variance. Prior to the incorporation the Eagan Town Board determined that a zoning and platting history of the town should be prepared in order to correctly reflect the current status of zonings and plattings for the benefit of the new village. On March 12th, 1956 when it appeared that the development and urbaniza- tion of Eagan was underway, the Town Board farsightedly appointed a planning committee (designated the Advisory Planning Committee, or APC) to study ways and means of planning and aiding the orderly growth of the town. The committee was composed of seven members all of whom were residents and landowners in Eagan and who served without pay. The contribution made by this first Advisory Planning Committee and the Town Board during these early years, when commercial, industrial and resi- dential development was taking place in an otherwise totally agricultural community, cannot be overstated. With the aid of the town engineer and town attorney, the Committee drafted and recommended to the Board the adoption of the first zoning ordinance. After numerous joint meetings of the Board and Committee, the Town Board formally adopted Zoning Ordinance No. VI on February 23rd, 1960. Equally important as the adoption of this original zoning ordinance was the gradual development within the Committee and Board of a definitive philosophy about planning and zoning for the future growth and development of • • Eagan. The Board and Committee were keenly aware of what they had to work with -- the location of already existing trackage, highways, terrain and existing residential, commercial and industrial development, sparse as it was at that time. They observed the beginnings of the Cedar Grove housing development and appreciated the potential residential growth of that area and the likelihood of commercial development in what is now the Cedarvale shopping area. The growth patterns were natural ones which inevitably the developers, businessmen and homeowners created and followed with the guidance and approval of the Committee and Board. Over objections from various quarters the Committee and Board repeatedly rejected the imposition of any over-all comprehensive zoning plan for the township. The original zoning ordinance and subsequent amendments were calculated to place a minimum of technical regulation upon the developers coming into Eagan subject to reasonable control by the Committee and Board. In short, the philosophy was to permit free enterprise to work in the development of the township subject to reasonable and flexible planning and control by the Commit- tee and Board commensurate with the protection of the general health and welfare of the community at large. This philosophy early encouraged substantial commercial and industrial development without any real detriment to surrounding residential development. This, in turn, created for Eagan a most favorable tax base and enhanced the sound fiscal policies practiced by the Town Board over the years. Time has proven the wisdom of the Board and Committee. In addition to providing for the orderly planning and zoning in Eagan, the Committee and the Board approved and adopted a Subdivision Ordinance on April 6th, 1971. Prior to this time properties were ordinarily surveyed and platted by developers and/or owners for the purpose of selling off parcels -2- • • of land by lot or building houses for resale. In each instance the law required that a plat be prepared by a registered surveyor, approved by the local govern- mental authorities and filed for record with the Dakota County Register of Deeds. Before the adoption of the Platting & Subdivision Ordinance No. 10 plats were simply prepared by the applicant for approval and submitted to the Advisory Planning Committee for recommendation for approval and then approved or rejected by the Town Board. Prior to 1960 plat approval was informal and in a number of cases, because of execution of a final plat outside of a regular Board meeting, the minutes 'cif town board meetings fail to reflect final plat approval, notwithstanding that such plats were approved and signed by the Town Board Chairman and Clerk and subsequently filed with the Register of Deeds. It must be appreciated that until 1960 the minutes of each annual town meeting and all the intervening meetings of the town board were handwritten by the Town Clerk. Even after 1960 when the practice was to have formal minutes prepared by the Town Attorney, many plats that had been given preliminary ap- proval never received final, formal approval at a Board meeting (or vice versa) but rather the hardshell plats were signed by the town officers at times other than a regular meeting and consequently in some instances did not get recorded in the minutes of any town meeting. In preparing the chronological zoning and platting histories, refer- ence, of necessity,has been made not only to the Committee and Board minutes, the official zoning and platting maps, but also to the applications for rezonings and plattings, and in some fewer instances to the applicants, owners and town officials to clarify dubious or difficult questions involved. One of the greatest difficulties has been in determining the correct legal descriptions of the properties rezoned. • • • The reason and necessity for this is to ensure to the owner, developer and subsequent purchasers, not to mention the village, the certainty of the area of land so rezoned or platted. Many of the difficulties as to descriptions have been caused by the owner/developer/applicant who neglected to provide a complete legal description in the original application. Committee procedure in the first instance requires the submission of a complete and correct legal description before final approval by the Board. Unfortunately the applicant did not always follow up on providing this and the minutes frequently simply had to be prepared from the application, or with reference to it, in the hope that, as requested, the applicant would provide the description before final approval by the Board. In addition to checking the town records, reference has also been made to all known approved plats and the official maps now on file and of record with the Dakota County Register of Deeds. Although all of the entries in the histories have been double-checked for accuracy the compilers realize that there well may be errors. These remain to be seen. However, by prepar- ing these histories in loose-leaf fashion, any errors can be readily corrected upon proper proof and new pages inserted at random reflecting such corrections. In some instances the minutes of either or both the Committee and Board reflect that applications for preliminary approval of plats had been acted upon but that subsequently no further action was taken by the applicant. Or in other cases, for example, the application for rezoning was denied. Only those applications for platting or zoning which were finally approved by the Board are included in the histories. It is contemplated that the new Village of Eagan will continue these histories on an annual basis. It is recommended that the application requirements • as to plats and rezonings be more stringent than in the past to insure accurate and promptly submitted legal descriptions. In conclusion, it may be noted that the material has been divided into three separate sections--introduction,platting and zoning. From the first page of the introduction to the last page of the zoning history, the pages have been numbered consecutively. The introduction covers the first 5 pages. The platting history covers the next 30 pages and the zoning history the last 32 pages. You will also note that the pages of both platting and zoning carry the section num- ber in the upper left-hand corner. Eagan has less than 36 sections (the usual number for towns).
