1973 Covington Lane - Letter re: Utility Easement - 2022-03-30.�#. EAGAN ESTABLISHED 1860 March 30, 2022 Patrick and Marcie Tietjan 1973 Covington Lane Eagan, MN 55123 RE: Building Permit Application No. 174905 Dear Mr. and Mrs. Tietjan, City staff has received a building permit application from Innovative Basement Authority identifying the desire to install ten exterior push piers at your residence, 1973 Covington Lane, to address settlement of your home at the rear or west side of the house. Research for the permit application determined that your house may have been placed within a utility easement and that the house footing may be very near a large water pipe. You may have noticed blue spray paint in your yard near the back of your house; this marking indicates the approximate location of the water pipe. Due to the proximity of the water pipe to the proposed construction area, the method of construction is being denied. Push piers will not be acceptable in this situation. The City would like to enable you to resolve settlement issues with your home. Due to the proximity of your foundation to the water pipe, we are concerned about potential damage to the water pipe and your home during construction. Since we understand that work is needed near the back of your home to resolve the settlement issue, we have provided conditions for proceeding with a method of construction to complete such work. The issued building permit shall be subject to the following conditions, and violation of any of the conditions shall constitute grounds for revocation of the permit: 1. An application for a permit to work within a public right-of-way/easement shall be submitted by the party in possession of the building permit that includes all the building permit details. No work may proceed until the approval of the right- of-way/easement permit. 2. An encroachment agreement shall be executed between the City of Eagan and the property owner (1973 Covington Lane) allowing the placement of a portion of the existing house and the proposed building permit improvements within the existing public utility easement. An escrow in the amount of $1,000 shall be submitted to the City of Eagan. No work may proceed until the execution of said agreement. 3. The building permit shall only allowhouse settlement improvements designed and inspected by a structural civil engineer currently registered in the State of Minnesota as a professional engineer. 4. The building permit improvements shall only be initiated upon review and approval of the City of Eagan City Engineer. 5. The building permit improvements shall only be initiated after permittee excavates observation hole(s) to expose the existing 18" water main to the satisfaction of the City Engineer to ensure that the water main is not damaged. 6. The permittee shall take all necessary actions to prevent the water main or other city equipment and facilities from being damaged or impacted by the improvements. 7. The permittee shall furnish aWarranty/Maintenance Bond or financial guarantee in the amount to be determined by the City Engineer that is required to ensure protection of the water main from the completion of the improvements. This Warranty/Maintenance Bond or financial guarantee shall remain in effect for 2 years after completion of the improvements to protect the City from damages or impacts due to consequences of the improvements. S. The permittee shall file with the City a liability insurance policy or certificate of such insurance issued by an insurance company authorized to do business in the Minneapolis -St. Paul Metro Area. The policy shall insure the person performing said improvements and the City, listed as an additional insured, in the sum of at least $1,000,000 for injury to one person, and $1,000,000 for one accident, and at least $1,000,000 property damage. The policy shall be kept in effect until the building permit is finalized. 9. Except for the negligent acts of the City, its agents and its employees, the permittee shall assume all liability for, and save the City, its agents and its employees, harmless and defend same atits sole cost and expense from any and all claims for damages, actions or causes of action arising out of the building permit improvements and the continuing uses by the permittee, including but not limited to the placing, constructing,, and reconstructing, maintaining, protecting and use ofsaid structure under this application and building permit. |n addition to all the listed coverage, the permittee shall procure and maintain an Umbrella Excess Liability Policy in a minimum amount of $1,000,000-00. 10.
