SIDEWALK EASEMENT

This Sidewalk Easement is made this JZ day of March, 2022, between VCI-ECC LLC, a
Minnesota limited liability company, (hereinafter referred to as "Landowner"), and the City of Eagan, a
Minnesota municipal corporation, organized under the laws of the State of Minnesota (hereinafter
referred to as "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby
grant and convey the following easements to the City, its successors and assigns a permanent
easement (the "Sidewalk Easement") for trail and sidewalk purposes (and for no other purposes) over,
under, and across Lot 1, Block 1, Eagan Convenience Center, Dakota County, Minnesota described as
follows:

r Commencing at the northeast corner of said Lot 1; thence southwesterly along a curve, being
the southerly right-of-way of Duckwood Drive, concave to the southeast 30.85 feet, having a
radius of 740.00 feet, a central angle of 02 degrees 23 minutes 20 seconds, and a chord which
bears South 72 degrees 00 minutes 05 seconds West a distance of 30.85 feet to the point of
beginning; thence South 57 degrees 34 minutes 36 seconds West, not tangent to last described
curve 30.47 feet; thence South 89 degrees 48 minutes 25 seconds West 17.06 feet to said
southerly right-of-way; thence northeasterly along a curve concave to the southeast, not
�Q tangent to last described line, 45.82 feet, having a radius of 740.00 feet, a central angle of 03
C� degrees 32 minutes 51 seconds, and a chord which bears North 69 degrees 01 minutes 59
seconds East a distance of 45.81 feet to the point of beginning.
The Sidewalk Easement is depicted on Exhibit "A" attached hereto and incorporated herein.
The City, its contractors, agents and servants will construct, reconstruct, inspect, repair and
maintain a sidewalk and/or trail in the Sidewalk Easement Area and erect and maintain signs in
conjunction with the public's use of said sidewalk and/or trail and any signs erected in conjunction with
the use of the sidewalk and/or trail in the Sidewalk Easement Area. The City shall be repair, at it's sole
cost, any damage to irrigation, landscaping or otherwise on Landowner's property resulting from
construction or maintenance of the sidewalk and/or trail.
IN TESTIMONY WHEREOF, the Landowner and the City have caused this easement to be
executed as of the day and year first above written.
