NOTICE OF WAIVER OF NOISE MITIGATION
THIS NOTICE OF WAIVER OF NOISE MITIGATION ("Notice") is provided by
Melissa Jean Manley and Ethan Kurtis Manley, wife and husband (hereinafter "Landowners").
WHEREAS, Landowners are the fee owners of property located at 641 Remington Court
and legally as Lot 3, Block 1, Manley Gun Club (the "Property"); and
WHEREAS, the Property is located near the West End Trap Club; and
WHEREAS, as a condition for the home to be constructed on the Property, the Developer
proposed certain noise mitigation standards for each property located with the development; and
WHEREAS, the noise mitigation for the Property would include the installation of a fence
above the exterior deck on the Property; and
WHEREAS, the Landowners believe that the installation of a fence on top of the exterior
deck on the Property would be both costly and aesthetically displeasing; and
WHEREAS, the Landowners have declined potential alternatives, including a ground level
patio, which would be buffered with the existing fence located along the north property line.
NOW, THEREFORE, Landowners, for themselves, their heirs and assigns, knowingly
waive any requirement for noise mitigation for the fence above the exterior deck on the Property
and hereby provide notice to all future owners of the Property:
That the Property has opted out of obtaining any noise attenuation that
would require the installation of a fence above the exterior deck on the
PropertLy. and
1 That this notice shall run with the Property and be binding on all future
property owners,.
