I’ll make that note that it is their responsibility to confirm location of property lines.

Please review the attached Zoning Permit and let me know if this is acceptable. She said she had a contractor
install the steps and patio last year, and they said the work didn’t need a permit.
Darrin, Does this meet the standards for recreational fire?
And Aaron, I assume the 2’ patio encroachment should just be noted “the patio is partially located within a
drainage and utility easement and is subject to the terms of the easement”?

Aaron/Darrin,
In reviewing a zoning permit to install a fence on this property, I noticed there is a new staircase and
patio/firepit in the rear yard on this lot for which we have no zoning permit on file. It appears that the stairs
and patio/firepit were installed in 2020, see 2020 and 2021 aerial images below.
There is a 10 foot d/u easement along the rear lot line, so the patio/firepit are within the easement. And the
firepit also does not appear to meet the recreational fire setback of 10 feet from the rear lot line .
The only zoning issue is not having obtained a ZP, but there may also be an easement violation or violation of
Sec. 10.40. I can contact the property owner and ask them to submit a ZP application, but if you are unable to
approve it, then it is an enforcement issue. Please advise how you’d like to proceed.
