I am writing this follow up letter pertaining to my letter of request to have a fine that has
been levied against my property at 855 Cliff Road removed. My letter of request was
dated June 12, 2012.
I have just this day come across the letter sent by the City of Eagan dated April 6, 2012
advising me that the City had decided to levy this fine when in fact I had the inspection
completed on April 2, 2012.
I am enclosing a copy of the inspection report and the letter I received advising me of this
fine.
I feel that when you consider the evidence and the explanation that I have presented you
will agree that this fine should be removed from my water bill.

NOTICE of SURCHARGE to UTILITY BILL
As you were informed in previous notices, the City of Eagan is conducting a city -wide
internal residential and commercial property inspection program aimed at reducing
the amount of stormwater and groundwater entering into the metropolitan sanitary
sewer system. The problem is called Inflow and Infiltration (I &I).
On January 9th and February 6, 2012 you have been sent formal notices regarding this
mandatory inspection and /or required corrective work order to avoid incurring
substantial surcharges to your Utility Bill. Our records indicate that you have either
not yet responded to these notices or complied with their related repair
requirements.
The inspections and subsequent corrective repairs are necessary to find and eliminate
the sources of these excessive flows as mandated to Eagan by the Metropolitan
Council Environmental Services (MCES).
Inspections and Repairs Are Mandatory
FAILURE TO COMPLY results in substantial fees being added to your Utility Bill
until the property is brought into compliance with City Codes:
$150 /month for Single Family, Duplex, Townhome properties, or
$500 /month for all other properties.
You are receiving this letter to inform you that the surcharge has now been added to
your Utility Billing account and will continue for each succeeding month until the
property is determined to be in compliance with the I &I program requirements.

I am requesting to have a fine that was levied against my property removed. The first
notice of this fine came with my latest water bill.
I have been in communication with Jim Hauth of the sanitary sewer department and he
has advised me to address this letter to you.
I am a senior citizen of Eagan and I and my wife spend Jan,Feb, and March in the warm
climate of Arizona. We have our mail forwarded by the post office however that
procedure is less than perfect. The first letter that I received regarding the in home
inspections for clean water infiltrating the sanitary sewer, arrived at my Arizona
residence on about March 20, 2012. I will admit that I decided to wait to contact your
Department until I arrived home on March 31. At that time I did contact the city and
scheduled an inspection for April 2, 2012. That inspection was performed and we
received a clean bill of water infiltration by Mr Hauth. In mid may I received a
certificate stating that all was inspected and approved.
Imagine my surprise upon receiving my June water bill and seeing a surcharge of $150
for something I took care of as soon as physically possible.
Being a retired person of 68 years young and living on a fixed income I am requesting
that this ridiculous penalty be erased from my water bill.
An aside it was just 3 years ago that my property was assessed $10,000 for what in most
of the neighbors and myself feel was a totally unjust storm sewer installation out here
where all of us have acreage lots.
